This paper deals with the reasons why the United States have been seeking for the strengthening of the intellectual property rights (IPRs) at recent bilateral and multilateral negotiations, specially during the GATT's Uruguay Round. The hypothesis of this paper suggests that the IPRs' strengthening is part of an attempt made by the United States to revert the present process of weakening of their competitive advantages in the International trade. The decline of North America's preeminence along the 70s and 80s caused private entrepreneurship to urge the US government towards engagement in an aggressive foreign policy for intellectual-property-rights protection. The conflict between Brazil and the United States on pharmaceutical patenting stems from such a policy. Changes in Brazilian legislation are under way, and new American pressures will but delay the process, raising nationalistic reactions. (Polit Externa/DÜI)

A exemplo das relações econômicas internacionais, a saúde segue o ritmo da mundialização. Fala-se, ao mesmo tempo, de uma economia da saúde globalizada e da internacionalização dos riscos sanitários. No entanto, os países desenvolvidos e aqueles em desenvolvimento não estão no mesmo nível em relação ao combate às doenças. Observa-se uma "fratura sanitária" simbolizada, por anos a fio, pela epidemia da AIDS nos países pobres. Enquanto o progresso científico oferece respostas a numerosas doenças, a maioria dos habitantes dos países do "Sul" não tem acesso regular a medicamentos. No centro das políticas de saúde pública, o medicamento vem se tornando mercadoria, em uma economia mundial focada na exploração do conhecimento, no caso a inovação farmacêutica. A falta de acesso a tratamentos pode ser analisada como resultado da exclusão dos países em desenvolvimento frente ao mercado de produtos farmacêuticos, causada tanto pela situação socioeconômica, quanto pela estrutura do mercado e pelas regras da OMC relativas à propriedade intelectual. ; As international economic relations, health field follows the steps of the globalization. People talks, at the same time, about a global health economy and the internationalization of health risks. However, the developed countries and those who are in development are not in the same level to fight against diseases. There is a "health break" for many years symbolized by AIDS epidemic in poor countries. While scientific progress provides answers to several diseases, most of the inhabitants of the "South " has no regular access to medicines. At the heart of public health policies, the drug is becoming a commodity in a global economy focused on the exploration of knowledge, particularly the pharmaceutical innovation. The lack of access to treatment can be analyzed as a result of the exclusion of developing countries facing the pharmaceutical market, caused by socioeconomic status, by the structure of the market and by WTO's intellectual property rules. ; À l'instar des relations économiques internationales, la santé vit au rythme de la mondialisation. Aussi parle-t-on d'une économie de la santé globalisée comme d'une internationalisation des risques sanitaires. Pourtant les pays développés et les pays en développement ne sont pas sur un pied d'égalité face au poids de la maladie. Le constat est celui d'une "fracture sanitaire", symbolisée depuis plusieurs décennies par le fléau du sida au sein des pays à faible revenu. Alors que les progrès scientifiques permettent de répondre à de nombreuses maladies, la majorité des habitants des pays du "Sud" n'a pas accès régulièrement aux médicaments. Au cœur des politiques de santé publique, le médicament est parallèlement devenu un objet de marché dans une économie mondiale centrée sur l'exploitation commerciale du savoir, en l'occurrence l'innovation pharmaceutique. Le manque d'accès aux traitements peut alors s'analyser comme le résultat d'une exclusion des pays en développement vis-à-vis du marché des produits pharmaceutiques, causée tant par leur situation socio-économique que par la structure du marché et les règles de l'OMC relatives à la propriété intellectuelle.

Micro, small, and medium-sized enterprises (MSMEs) constitute the majority of businesses and a significant part of developed and developing countries' Gross Domestic Product (GDP). This article presents a series of prospective scenarios that investigate the effects of public policies on entrepreneurship in Canada, Ireland, and Italy. Public policies for this sector can be classified as regulatory policies (e.g., laws for the entrance and exit of businesses, labor and social laws, property laws, tax laws, intellectual property laws, bankruptcy laws, and laws that affect the liquidity and availability of capital) and stimulus policies (e.g., promotion of cultural and educational programs to foster entrepreneurship and internationalization). Regulatory policies influence the business environment for MSMEs, and are generally designed to provide entrepreneurs with high growth potential (known as "gazelles"). Four scenarios involving the critical uncertainties surrounding political and economic integration and technological development are developed for each country. Each scenario is constructed based on public policies specific to each country. This article concludes that public policies are not a panacea capable of generating economic development, given that their effectiveness depends on other economic decisions and exogenous economic conditions. However, the absence of state intervention does not produce positive effects, even in the case of positive scenarios under exogenous conditions.

This article will try to outline the implications of counterfeiting as an economic threat in its implications to society and ultimately to political power, by establishing a relationship between these implications and the main purposes of the State in ensuring security and prosperity. The analysis will focus on the European Union, since this type of transnational crime affects the main EU strategy for sustainable growth based on fostering innovation and knowledge. The objective is to present and confront the effectiveness of the cooperation mechanisms as preventive and anti-counterfeiting measures, as well as their impact on the evolution of this transnational crime within Europe. This article makes a critical description of the statute of the licenses for the exploitation of works out-of-commerce envisaged in the Proposal for a Directive of the European Parliament and the Council on copyright in the Digital Single Market of September 14, 2016. In addition to the analysis of the precepts of the aforementioned Proposal, its main backgrounds are analysed, e.g., the Memorandum of Understanding on Key Principles on the Digitisation and Making Available of Out-of-Commerce Works, the French normative experience and the Soulier and Doke case (Judgment of the Court of Justice of the European Union of November 16, 2016). ; Este texto procede a uma leitura crítica da regulamentação de licenças para a exploração de obras que deixaram de ser comercializadas, prevista na Proposta de Diretiva do Parlamento Europeu e do Conselho relativa aos direitos de autor no Mercado Único Digital, de 14 de setembro de 2016. ABSTRACT OBJECTIVE To analyze Government strategies for reducing prices of antiretroviral medicines for HIV in Brazil. METHODS Analysis of Ministry of Health purchases of antiretroviral medicines, from 2005 to 2013. Expenditures and costs of the treatment per year were analyzed and compared to international prices of atazanavir. Price reductions were estimated based on the terms of a voluntary license of patent rights and technology transfer in the Partnership for Productive Development Agreement for atazanavir. RESULTS Atazanavir, a patented medicine, represented a significant share of the expenditures on antiretrovirals purchased from the private sector. Prices in Brazil were higher than international references, and no evidence was found of a relationship between purchase volume and price paid by the Ministry of Health. Concerning the latest strategy to reduce prices, involving local production of the 200 mg capsule, the price reduction was greater than the estimated reduction. As for the 300 mg capsule, the amounts paid in the first two years after the Partnership for Productive Development Agreement were close to the estimated values. Prices in nominal values for both dosage forms remained virtually constant between 2011 (the signature of the Partnership for Productive Development Agreement), 2012 and 2013 (after the establishment of the Partnership). CONCLUSIONS Price reduction of medicines is complex in limited-competition environments. The use of a Partnership for Productive Development Agreement as a strategy to increase the capacity of local production and to reduce prices raises issues regarding its effectiveness in reducing prices and to overcome patent barriers. Investments in research and development that can stimulate technological accumulation should be considered by the Government to strengthen its bargaining power to negotiate medicines prices under a monopoly situation. ; RESUMO OBJETIVO Analisar as estratégias governamentais para redução de preço de medicamentos antirretrovirais para aids no Brasil. MÉTODOS Realizada análise das compras de medicamentos antirretrovirais pelo Ministério da Saúde, de 2005 a 2013. Foram analisados o gasto e o custo do tratamento por ano e comparados com os preços internacionais para o atazanavir. Foram estimadas as reduções com base no contrato da Parceria para Desenvolvimento Produtivo para obtenção de licença voluntária de patente e transferência de tecnologia do atazanavir. RESULTADOS O atazanavir teve peso expressivo nos gastos com antirretrovirais adquiridos no setor privado. Os preços praticados no Brasil foram mais altos que aqueles de referência internacional e não houve evidências da relação entre volume de compra e preço pago pelo Ministério da Saúde, por ser medicamento patenteado. Em relação à estratégia mais recente para reduzir preços, envolvendo produção local da cápsula de 200 mg, as reduções foram menores do que as estimadas. Quanto à cápsula de 300 mg, os valores pagos nos dois primeiros anos após a Parceria para Desenvolvimento Produtivo foram próximos aos estimados. Os preços em valores nominais mantiveram-se praticamente constantes entre 2011 (assinatura da Parceria para Desenvolvimento Produtivo), 2012 e 2013 (após estabelecida a Parceria). CONCLUSÕES A redução do preço de medicamentos é complexa em ambiente de concorrência limitada. O uso da Parceria para Desenvolvimento Produtivo como método para aumentar a capacidade de produção local e reduzir preços levanta questões em relação à redução efetiva dos preços e ao enfrentamento da barreira patentária. Investimentos em pesquisa e desenvolvimento que possam estimular a acumulação tecnológica devem ser considerados pelo governo para fortalecer seu poder de barganha ao negociar preços de medicamentos em situação de monopólio.

ABSTRACT Objective: to provide a reflection on the concepts, trends and possibilities of patent registration. Method: Reflective analysis. This is a descriptive study, based on theoretical frameworks about patent legislation, trends and possibilities. Results: a patent is a title of temporary ownership over an invention or utility model, granted by the State to inventors. The patent registration process in the country is considered very bureaucratic. The Intellectual Property Law (IPL) - number 9.279/1996 - establishes some criteria that must be considered in the registration of a patent. For a product to be patentable, the requirements of novelty, inventiveness and practical applicability must be met. The country's culture with regard to the production of scientific knowledge that generates patents is still insignificant. Final remarks: there is a need for improvement of the patenting process in Brazil. The possibility of a greater boost in research activities on industrial products in the area of healthcare is expected in the near future. Descriptors: Family Health; Biomedical Technology; Nursing. Brazil grew 2.4 percent per year on average in the last 25 years-somewhat less than Latin America, a good deal less than the world, far less than the emerging countries of Asia in the same period, and indeed far less than Brazil itself in previous decades. If anything stands out favorably in recent Brazilian experience, it is not growth but stabilization and the successful opening of the economy. The purpose of this paper is more modest. It is limited to setting out the authors' particular view of recent efforts to consolidate democracy in Brazil while controlling inflation and resuming economic growth. At the same time the paper presents, as objectively as possible, some thoughts on the limits but also the relevance of action by political leaders to set a course and circumvent obstacles to that process. Here and there, the paper refers to the experiences of other Latin American countries, especially Argentina, Chile, and Mexico, not to offer a full fledged comparative analysis but merely to note contrasts and similarities that may shed light on the peculiarities of the Brazilian case and suggest themes for a more wide-ranging exchange of views.
