Meine Diplomarbeit "die deutschsprachige Minderheit in Tschechien" ist durch ihre Aktualität noch immer problembehaftet. Dies liegt an der oft einseitigen historischen Aufarbeitung und noch immer nicht abgeschlossenen juristischen Disputen. So möchte ich mich in meiner Arbeit im Speziellen der Erstellung eines Kartenatlanten widmen, welche die Census 1910, 1930 und 2011 (Anteil der deutschsprachigen Minderheit, absolute Anzahl, Gesamtbevölkerung, Bevölkerungsdichte, politische Gliederung) auf den Gemeindegrenzen von 2011 darstellt und analysiert. Zusätzlich wird das Völkerrecht, in wesentlichen Teilen mit Bezug zur deutschsprachigen Minderheit, skizziert. Abschließend möchte ich einen Überblick über die Geschichte Böhmens und das Zusammenleben der Völker geben. Sowohl im juristischen als auch im historischen Teil verwendete ich ausschließlich die "qualitative Inhaltsanalyse", also reine Literaturrecherche. Im Kartenatlas wurde ein quantitativer Ansatz verwendet. Bei der Gleichsetzung der Gemeinden wurde das aktuelle, 2011, Gemeindeverzeichnis der Tschechischen Republik als Ausgangspunkt gewählt. Hierbei nutzte ich die Suche nach Gemeindeteilen bzw. Abgleich mit historischem Kartenmaterial zur Klärung der exakten Gemeindegrenzen. ; Due to its topicality my thesis "The German-speaking minority in the Czech Republic" can be considered problematic. This results from a potentially biased historical reappraisal and ongoing legal disputes. Focus of my work is the creation of an atlas of maps illustrating and analysing the census data 1910, 1930 and 2011 on the 2011 municipal borders (share and total number of German-speaking minority, overall population, population density and political structure). In addition, I will outline international law relating to the German-speaking minority and conclude with an overview about bohemian history and cohabitation of peoples.In both the legal and historical parts I will use qualitative content analysis only, namely literature research. For the creation of the atlas part quantitative methods were used. Baseline for municipal borders is the 2011 list of municipalities issued by the Czech Republic. Gegenstand der Untersuchung ist eine rechtsvergleichende Betrachtung von menschenrechtlichen Vorgaben betreffend die Untersuchungshaft und deren Umsetzung an internationalen Strafgerichten. Die Gewährleistungen für Untersuchungshäftlinge in der EMRK und im IPbpR bilden als »internationale Werteordnung« den Maßstab der Arbeit. Ausgehend hiervon wird untersucht, ob die Regelungen, die der Jugoslawien- und Ruandastrafgerichtshof als Tribunale der Vereinten Nationen und der Internationale Strafgerichtshof für Untersuchungshaft vorsehen, diese Mindeststandards gewährleisten. Dabei besteht gerade angesichts der Schwere und des Ausmaßes von Völkerrechtsverbrechen einerseits sowie der in diesem Zusammenhang sensiblen Fragestellung der Rechte des inhaftierten Beschuldigten andererseits erhebliches Konfliktpotenzial. Die Arbeit enthält eine umfassende Aufarbeitung der rechtlichen Grundlagen und der praktischen Umsetzung und bewertet diese anhand der menschenrechtlichen Vorgaben. Gegenstand der Arbeit ist eine rechtsvergleichende Betrachtung des Instituts der Untersuchungshaft. Ausgehend von den Garantien in der EMRK und im IPbpR wird untersucht, ob die Regelungen, die der Jugoslawien- und Ruandastrafgerichtshof und der Internationale Strafgerichtshof für Untersuchungshaft vorsehen, diese Mindeststandards, auch in der praktischen Umsetzung, gewährleisten. Die Arbeit enthält eine umfassende Aufarbeitung der rechtlichen Grundlagen unter Berücksichtigung des Spannungsfeldes zwischen Schwere und Ausmaß von Völkerrechtsverbrechen und den Rechten des Beschuldigten. Alena Hartwig-Asteroth studierte nach ihrem Abitur, das sie in Buenos Aires/Argentinien absolvierte, Rechtswissenschaften an der Philipps-Universität Marburg. Von 2008 bis 2011 arbeitete sie dort als wissenschaftliche Mitarbeiterin am Lehrstuhl von Prof. Dr. Christoph Safferling, LL.M. (LSE), und am Forschungs- und Dokumentationszentrum Kriegsverbrecherprozesse (ICWC). Seit März 2011 ist sie Rechtsreferendarin in Marburg.
Abstract With a primary focus on civil law, the article provides a general overview of the most important legislation, court decisions and other state practice in explaining how international law on state immunity applies in Denmark today. Although Danish court practice has been quite sparse, there have been a number of important decisions effectively implementing international state immunity law into Danish law. The article also reflects on the application and development of customary international law in Danish law outside Danish courts with a particular focus on the 2004 UN Convention on Jurisdictional Immunity of States and Their Property, which Denmark has signed, but not ratified. Other examples of Danish practice are briefly highligthed, underscoring the conclusion that Denmark has broadly embraced the restrictive approach to international law on state immunity.
The United States is at a crossroads--albeit one it has visited several times before. Although the Supreme Court has ruled upon the constitutionality of the Patient Protection and Affordable Care Act, the polarizing controversy surrounding national healthcare that began several generations ago is likely to continue into the foreseeable future. In this latest round of national debates, the issue of healthcare has been framed exclusively as a domestic issue. But history shows that the question of national healthcare in the United States has also been an extremely important issue for international law and international politics. To shed light on the overlooked nexus between the Act, U.S. constitutional law, and international human rights law, this Article examines the debates surrounding healthcare and human rights that occupied the nation's attention over six decades ago. In the late 1940s, the controversy over President Harry Truman's national healthcare plan became known as the nation's "Great Debate." But because Truman's plan never actually became law, this episode of U.S. history has largely escaped the attention of legal scholars. This mid-century debate over healthcare reform has had a profound impact on contemporary domestic and international legal institutions. This Article reveals how, beginning in 1948, the debate over healthcare set in motion a series of political precedents, social practices, and legal interpretations that have influenced every subsequent battle over U.S. healthcare. But in particular, this early debate over healthcare was an important factor in the historic decision in 1952 to divide the Covenant on Human Rights into the two treaties we have today--the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights.
