Modern devletin vazgeçilmez unsurlarından biri olan egemenlik anlayışı önemli bir dönüşüme uğramıştır. Bugün Jean Bodin'in kurumsallaştırdığı; mutlak, bölünemez ve sürekli olarak nitelendirilen klasik egemenlik anlayışından bahsetmemiz mümkün değildir. Klasik egemenlik anlayışının geçirdiği dönüşümün çeşitli sebepleri bulunmaktadır. Bu sebepleri hukuk devleti, insan hakları, kuvvetler ayrılığı prensibi ve uluslararası kuruluşlar olarak ifade etmemiz mümkündür. Özellikle Birinci ve İkinci Dünya Savaşı sonrasında ortaya çıkan uluslararası kuruluşlar devletlerin egemenliğine müdahale konusunda oldukça dikkat çekicidir. Egemenlik anlayışının geçirdiği bu dönüşüm sırasında dünya birçok katliama ve savaşlara tanıklık etmiştir. Bu doğrultuda da önce ad hoc mahkemeler kurulmuş ardından da Uluslararası Ceza Mahkemesi'nin kuruluşuna giden süreç başlamıştır. 17 Temmuz 1998 tarihinde kabul edilip, 1 Temmuz 2002'de yürürlüğe giren Roma Statüsü ile de Uluslararası Ceza Mahkemesi kurulmuştur. Devlet egemenliğine önemli bir müdahale anlamına gelen Uluslararası Ceza Mahkemesi'nin yargılama yetkisi konusunda tamamlayıcılık ilkesinin kabul edilmesiyle, devlet egemenliğine yapılan müdahalenin daha aza indirgenmesi amaçlanmıştır. Aynı zamanda da Statü'ye taraf olacak devlet sayısını arttırmak amaçlanmıştır. ; Our understanding of sovereignty, which is one of the essential factors of modern state, has undergone a significant transformation in time. Today, it is impossible to mention a classical understanding of sovereignty which was institutionalized by Jean Bodin as; absolute, indivisible and perdurable. There are various reasons that caused the transformation of classical sovereignty; it can be said that these reasons are constitutional state, human rights, principle of separation of powers and international organizations. The international organizations, especially established after the First and Second World Wars, are quite significant instruments in the process of intervening to the sovereignty of states. During the transformation of understanding of sovereignty, the world had witnessed numerous massacres and wars. In this respect, firstly ad hoc tribunals had been established, after that the process towards the establishment of International Criminal Court started. International Criminal Court was established with Rome Statute which was acknowledged on July, 17, 1988 and inured on July, 1, 2002. Through the acceptance of complementarity principle in terms of International Criminal Court's jurisdiction, it is intended to minimize the intervention to the sovereignty of states. Also, it is aimed to increase the number of states parties to the Statute.
Gelişen dünyada uluslararası ilişkiler ve etkileşimler artmıştır. Bunun bir sonucu da yabancılık unsuru içeren uyuşmazlıkların ortaya çıkması olmuştur. Kural olarak yerel bir uyuşmazlık, uyuşmazlığın çıktığı ülkenin yargı organlarınca çözüme kavuşturulur. Ancak yabancılık unsuru içeren bir uyuşmazlık ulusal bir yargı organınca çözülse bile yargılama sonucu tesis edilen hükmün uyuşmazlığın tarafı olan kişilerin ülkelerinde de etki doğurması artık zorunlu bir hal almıştır. Yabancı yargı organlarınca tesis edilen kararların başka bir ülkede hukuki sonuç doğurması ise ancak o ülke makamlarınca tanıma ve tenfiz prosedürü işletildikten sonra mümkün olmaktadır. Bu tanıma ve tenfiz prosedürünün şartlarını ise kararın etki doğuracağı ülkelerin kendileri belirlemektedir ; In the developing world, international relationships and interactions have increased. As a consequence, disputes including foreign element arise between nations. As a rule, a domestic dispute has to be resolved by national courts. Despite, it is solved nationally, the solution also needs to result in parties countries. A foreign judgment can be effect as a "judgment" in another country, only after a process of recognition and enforcement and conditions of the recognition and enforcement of a foreign judgment can only be determined by the law of this country
Terörizm, on yıllardır çeşitli tanımları yapılmasına rağmen devlet politikaları ve çıkar çevrelerince aynı durumun farklı zamanlarda farklı şekillerde tasvir edilmesinden dolayı net kabul görmüş bir tanıma sahip olamamıştır. Bütün devletler için tarih boyunca tehdit oluşturmuş bir kavram iken, tehdidin büyüklüğü ve önemi dünya coğrafyasınca ancak 11 Eylül saldırıları sonrasında anlaşılmıştır. Türkiye, teröre karşı mücadele eden ve bu konuda en çok acı çeken ülkelerin başında gelmektedir. Dünyada çok az ülke Türkiye kadar terör sorunu ile karşı karşıya kalmıştır. Göz ardı edilmemelidir ki, Türkiye'de terörizme karşı kazanılacak zafer, tüm dünyaya örnek olacak ve barış için en büyük bir adım teşkil edecektir. Bu çalışma, genelde dünya coğrafyasının büyük bir kısmının farklı sebep ve şekillerde de olsa maruz kaldığı terör ve terörizm kavramlarının tanımlanması ve terörizmin nedenleri, amaçları, özellikleri, çeşitleri ve terörün uluslararasılaşan boyutunu ele almış; özelde ise Türkiye'nin de yıllardır maruz kaldığı PKK Terör Örgütü'nün örgüt yapısı, ideolojisi, amaç-stratejisi, geçirdiği evreler incelenmiştir. Devletler kendi aralarındaki antlaşmalara ahde vefa ilkesi gereği genellikle uyma eğilimi göstermektedirler. Ancak devletlerin kendi aralarında imzaladıkları antlaşmalara zaman zaman uymadıkları da görülmektedir. Anarşik bir uluslararası sistemde devletler arasında uyuşmazlıklar çok sık görülmektedir. Devletler çıkarlarına ters düştükleri durumlarda ister istemez farklı devletler ile uyuşmazlığa taraf olabilmektedirler. Uyuşmazlıkların çözümü için uluslararası hukukta barışçıl çözüm ve yargısal çözüm olmak üzere iki çözüm yolu bulunmaktadır. Yargısal çözüm devletlerin ancak yargı yetkisini kabul ettikleri bir mahkeme veya tahkim ile mümkün olabilmektedir. Barışçıl çözüm yolları Birleşmiş Milletler Antlaşmasının 33. Maddesinde belirtilmiştir. Bu çözüm yollar görüşme, soruşturma, arabuluculuk, uzlaşma, hakemlik ve yargısal çözümdür. Bunun yanında bazı uluslararası antlaşmalar kendi yargısal çözüm mekanizmalarını da oluşturmuştur. 1982 Birleşmiş Milletler Deniz Hukuku Sözleşmesi, Avrupa Birliği'nin yargı organları bu alanda verilebilecek başlıca örneklerdir. Bu çalışmada barışçıl ve yargısal yoldan anlaşmazlıkların çözümü ile uluslararası hukukta uygunluğun sağlanması mekanizmaları karşılaştırılacaktır. ; One of the main sources of international law is international treaties signed between states. States generally tend to comply with the treaties among themselves, as required by the pacta-sunt-servanda principle. However, it is also seen that states sometimes do not comply with the treaties they have signed among themselves. In an anarchic international system, conflicts between states are very common. States may inevitably be a party to disputes with different states when they conflict with their interests. There are two solutions in international law for the settlement of disputes, namely, peaceful and judicial solutions. Judicial settlement can only be possible with a court or arbitration where the states accept their jurisdiction. Peaceful solutions are specified in Article 33 of the United Nations Charter. These solutions are negotiation, investigation, mediation, reconciliation, arbitration and judicial solution. Besides, some international agreements have also created their own judicial solution mechanisms. 1982 United Nations Convention on the Law of the Sea, the judicial bodies of the European Union are the main examples that can be given in this field. In this study, the mechanisms of peaceful and judicial dispute resolution and ensuring compliance with international law will be compared.
A.B.D'nin 1945 yılında Japonya'nın iki kentine atom bombası atması sonucunda, Sovyetler Birliği, bir silâh yarışını ateşleyerek, atom silâhlarını geliştiren ve nükleer bölünmede küresel bir menfaati olan ikinci devlet olmuştur. Geleneksel nükleer silâhlar, tek tehdit değildir. 11 Eylül olayları da, teröristlerin, dünyanın nükleer güç istasyonları ve araçlarını hedef alabileceğine dair endişeleri arttırmıştır .İkinci Dünya Savaşı sonrasında nükleer silâhların giderek yayılma eğiliminin görülmesi üzerine, bu silâhların kontrolüne ve sınırlandırılmasına dair yapılan müzakereler, sayı olarak azalmalarına yol açmıştır. Nükleer caydırıcılık hususunun, oldukça uzun bir süredir barışın sürdürülmesine katkıda bulunduğuna dair yaygın bir kanı vardır. Ayrıca, nükleer silâh kullanımı, en azından bazı nükleer güçlerce sadece son çare olarak değil, aynı zamanda dünyanın herhangi bir noktasında kimyasal, biyolojik veya hatta konvansiyonel silâhlarla yapılan bir saldırıya karşılık vermenin bir yolu olarak da dikkate alınmıştır. Nükleer silâh kullanımının, herhangi bir çekince ileri sürülmeden yasaklanmaması durumunda, dünyanın nükleer tehlikelerden tam anlamıyla arındırılması mümkün olamayacaktır. Bu yazıyla, silâh kullanımına dair mevcut sınırlama ve uygulanabilecek hukuk gözönüne alınarak, söz konusu nihai amaca ulaşmak için gelecekte neler yapılabileceğinin değerlendirilmesi amaçlanmıştır. ; As a result of United States' bombing of two Japanese cities in 1945, the Soviet Union, by setting fire of a weapon competition, became the second State which has developed nuclear weapons and has global interest in the nuclear division. The general nuclear weapons are not the only risk. The September 11th incident has been increased concerns about the world's nuclear power stations and means that could be target of the terrorists. After the Second World War, an increasing trend of proliferation of nuclear weapons have led to negotiations on the control and restrictions that would be concluded with reduction of these weapons as number. There is a fairly widespread belief that nuclear deterrence helped to maintain peace over several decades. Moreover, the employment of nuclear weapons is now envisaged - at least by some nuclear powers - not only as a last resort, but also as a way to react to any attacks committed with chemical or biological or even conventional weapons. As long as the use of nuclear weapons has not been unreservedly prohibited, the efforts to create a nuclear-weapon-free world will remain useless. This article, considering existing restrictions and applicable law on the use of weapons, intends to determine what the future works are, in order to reach this aim eventually.
Yüksek denetim kavramı, Sayıştaylar tarafından yürütülmekte olan dış denetim faaliyetini diğer dış denetim organları tarafından yapılan denetimlerden ayırt etmek için kullanılmaktadır. Ülkemizde "yüksek denetim (supreme audit)" literatürde fazla yer almayan bir kavram olmakla birlikte, uluslararası literatürde yaygın bir kullanıma sahip olduğu bilinmektedir. Türkiye'de; kaynağını Anayasadan alan, meslek mensuplarının yasal güvencelere sahip olduğu, kurumsal bağımsızlığı olan, millet meclisi adına mali denetim faaliyetini yürüten yüksek denetim organı Sayıştay'dır. Bu çalışmanın amacı, Osmanlı devletinde ve Türkiye Cumhuriyetinde yüksek denetim uygulamalarının ve kurumlarının (Sayıştay) gelişim sürecinin ortaya konulmasıdır. Çalışmada bibliyografya (kaynak taraması) yöntemi kullanılmıştır. Çalışmada kullanılan kaynaklar, Başbakanlık Osmanlı Arşivlerindeki belgelerden, yurt içi ve yurt dışı ilgili kitap, makale, bildiri ve araştırmalardan oluşmaktadır. Elde edilen bulgular tarihsel sırayla kaleme alınmıştır. ; The concept as supreme audit is used for separating the external audit which is performed by courts of accounts from the ones performed by independent external audit organs. Although the term as "supreme audit" is not a concept which is frequently met, it is widely used in international literature. Sayıştay is the court of accounts in Turkey, of which members of profession took their authority from the constitutional law in Turkey having legal assurance in an institutional independence, and it performs the activity as financial audit being a supreme audit organ, on behalf of the National Parliament. The aim of this study is to determine the development process of supreme audit procedures in Ottoman Empire and Republic of Turkey, showing the same for the institutions (Sayıştay: the court of accounts in Turkey.). ÖZETBasın özgürlüğü, toplumun doğru şekilde bilgilendirilmesi ile birlikte bilinçli bir kamuoyunun oluşmasında önemli bir rol üstlenir. Özellikle liberal demokrasilerin vazgeçilmez parçası olan bireylerin kendi kendisini idaresi ve fikirlerin farklılığına saygı çerçevesinde görevini yerine getirir. Bu yüzden basın özgürlüğü, demokratik bir toplumun en temel ve vazgeçilmez unsurudur.Basın özgürlüğü, ifade özgürlüğünün bir diğer şekli olarak karşımıza çıkar. İfade özgürlüğü bir insan hakkı olarak, BM İnsan Hakları Evrensel Bildirgesi, BM Medeni ve Siyasi Haklar Sözleşmesi, Avrupa İnsan Hakları Sözleşmesi gibi en temel insan hakları belgelerinde yer almıştır. Avrupa İnsan Hakları Sözleşmesi m. 10'da ifade özgürlüğü güvence altına alınmıştır. Anılan maddede ilk olarak ifade özgürlüğünün çerçevesi çizilmiş, bu özgürlüğün kanaat özgürlüğü ile kamu otoritelerinin müdahalesi ve ülke sınırları söz konusu olmaksızın haber veya fikir alma ve verme özgürlüğünü de içerdiği belirtilmiştir. 10. maddenin ikinci fıkrasında ifade özgürlüğünün kabul edilebilir sınırları belirlenmiştir. Buna göre, ifade özgürlüğü üzerine konan bir sınırlamanın kabul edilebilmesi için, sınırlama ilkin kanunen belirlenmiş olmalı, ikinci olarak bu sınırlama demokratik bir toplumda gerekli olmalıdır. üçüncü olarak ise bu sınırlama 10. maddenin ikinci fıkrasında sayılan meşru amaçlardan birini gerçekleştirmeye yönelik olmalıdır.Maalesef ülkemizde, AİHS m. 10 korumasına rağmen özellikle siyasi baskılardan ve medya sahiplik yapısından kaynaklanan nedenlerle basına müdahaleler olmakta ve Avrupa İnsan Hakları Mahkemesi tarafından ihlal kararları verilmektedir. Çalışmamızda mahkeme kararları ışığında ihlal nedenleri incelenecek ve basın özgürlüğünün meşru sınırlandırılması halleri anlatılacaktır. Ayrıca mahkeme kararları, Avrupa Birliği İlerleme Raporları ve basın meslek kuruluşlarının bildirileri ışığında Türkiye'nin basın özgürlüğü konusundaki geçmişine, şu andaki durumuna ayrıntılı şekilde yer verilecektir. This freedom fulfills mission in the context of an inherent part of liberal democraties, a form of government based on self governance, respect for a plurality of view. Freedom of expression is necessity and an essential liberty of democratic society. Freedom of press appears as a form of freedom of expression. The right to freedom of expression is protected by all major international human rights instruments such as the U.N. Universal Declaration of Human Rights, the International Covenant an Civil and Political Rights, and The European Convention on Human Rights and Fundamental Freedoms. Article 10 of the European Convention on Human Rights protects freedom of expression. First it states the scope of the right. It entitles everyone to the freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. Article 10 defines the circumstances in which limitations on free expression are permitted. Such limitations are permissible only if they satisfy three tests. Firstly, the restriction must be prescribed by law. Second, a restriction is permissible only if it is "necessary in a democratic society". And third, a restriction is valid only if it is designed to specified objectives in the article 10/2.Despite of the protection in Article 10 of European Convention of Human Rights, unfortunately in Turkey, there is illegal interference in freedom of press especially arising from political pressures and ownership structure of the media. So European Court of Human Rights finds violation of the right to freedom of press.In our thesis, causes of right violation will be analyzed in the light of the court decisions. At the same time the limitations of freedoom of press will be explained. Furthermore background, today and the plans about the freedoom of press in Turkey will be covered in detail in the light of court decisions, European Union Turkey Progress Reports and international press associations. Aynı şekilde gerek bu kurumları oluşturan antlaşmalar hukuku, gerekse yaptığı hukuk, üye devletlerde aynı etkiye sahip olup, üye devletler tarafından tek taraflı olarak değiştirilemez ve ortadan kaldırılamaz nitelikte olması da Avrupa Birliği hukukunun uluslar üstü (supranational) olduğu yaklaşımını geliştirmiştir.AB tam anlamıyla devletin ana öğelerini bünyesinde bire bir barındırmamakla beraber, devlete, özellikle federal devlet biçimine çok benzer yetkiler kullanmakta, AB Anayasal Antlaşması ile bir anayasal yurttaşlık oluşturmaya çabalamaktadır. Kuvvetler ayrılığı ilkesi çerçevesinde yasama, yürütme ve yargı yetkilerini birbirinden ayrıştırmış ve her biri için ayrı organlar yaratmış ve bunların işleyişini de kurucu antlaşmalara ve nihayetinde anayasa ile hukuk ilkelerine bağlamıştır. . Bireylerine AB Temel Haklar Şartı ile temel hak ve özgürlüklerin kullanımı ve hak arama özgürlüğünü tanımaktadır. Üyesi bulunan devletler ile yetki paylaşımı yaparak bunu anayasa metnine dâhil etmiştir. ; The State is an entire of the institutions. The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.
Avrupa Birliği, kuruluşundan itibaren göç alan ve politikalarını insan hakları çerçevesinde düzenleyen bir ulusüstü örgüttür. Avrupa Birliği tarafından düzensiz göçün azami seviyede tutulması amaçlanmıştır. Bu sebeple de Birlik bütünlüğünü sağlamak amacıyla sözleşmeler ile belirlenen politikalar doğrultusunda iç ve dış göçü kontrol altına alacak bir takım düzenlemeler yapmıştır. Dolayısıyla bu çalışma; insanların dini, iktisadi, siyasi, sosyal ve diğer durumlar sebebiyle yer değiştirme hareketlerinin Avrupa Birliği politikalarını nasıl etkilediğiyle ilişkilidir. Çalışma kapsamında söz konusu bu politikalar incelenerek, bugüne kadar katedilen mesafe ifade edilmeye çalışılacaktır. Çalışmada Avrupa Birliği göç politikaları; tarihsel verilere, yapılan antlaşmalara, kararlara ve uygulamalara göre değerlendirilerek; uluslararası hukuk, Avrupa Birliği komisyon kararları, Frontex verileri, Birleşmiş Milletler raporları, göç politikası çerçevesinde yapılan antlaşmalar, insan hakları tarihsel gelişimi ve Avrupa İnsan Hakları Mahkemesi ve Avrupa İnsan Hakları Komisyonu'na ilişkin kararlar çerçevesinde ele alınacaktır. v Çalışma dört bölümden oluşmaktadır. Birinci bölümde; araştırmanın konusuna, amacına, önemine, çalışma ile hangi sorulara yanıt arandığına ve konuya ilişkin tanımlara yer verilecektir. İkinci bölümde; göç kavramı, göç türleri ve Avrupa Birliği'nde göç konusu ve göç politikalarının tarihsel gelişimi ele alınacaktır. Üçüncü bölümde; insan hakları açısından sığınma hakkı ve mültecilik, insan haklarının tarihsel gelişimi, sığınma hakkının ortaya çıkışı, Birleşmiş Milletler Mülteciler Yüksek Komiserliği'nin kurulması, 1951 Cenevre Sözleşmesi ve mültecilerle ilgili diğer çalışmalar incelenecektir. Dördüncü bölümde ise göç politikaları, Avrupa Birliği öncesi Avrupa ülkelerinin göç politikaları, Avrupa Birliği'nin ortak göç politikaları, ortak sığınma politikası üretme çabaları kapsamında yapılan antlaşmalar ve Avrupa Birliği'nde göçmenlere ve sığınmacılara yönelik bazı kurumlar incelenecektir. ; The European Union is a supranational organization that has received immigrants since its establishment and regulates its policies within the framework of human rights. The European Union aims to keep irregular migration at the minimum level. For this reason, in order to ensure the integrity of the Union, it has made a number of arrangements to control the internal and external migration in accordance with the policies determined by the agreements. Therefore, this study is related to how the policies of the European Union is affected according to people's movements due to religion, economics, politics, social issues, and other situations. Within the scope of the study, these policies will be examined and the distance covered up to the present will be expressed. In this study, European Union migration policies will be handled while being evaluated according to the historical data, the agreements, decisions, and practices; in the framework of international law, the European Union commission decisions, Frontex data, the United Nations reports, treaties on migration policy, historical development of human rights and decisions of the European Court of Human Rights and the European Commission of Human Rights. vii The study consists of four parts. In the first chapter; the subject, the purpose, the importance of the study, which questions are aimed to be answered with this study, and the definitions about the subject will be included. In the second part; the concept of migration, the types of migration, and the historical development of the subject of migration and migration policies in the European Union will be discussed. In the third chapter; the right to asylum and migration in terms of human rights, the historical development of human rights, the emergence of the right to asylum, the establishment of the United Nations High Commissioner for Refugees, the 1951 Geneva Convention and more studies on refugees will be examined. In the fourth chapter, migration policies, migration policies of European countries before the European Union, common migration policies of the European Union, treaties made within the scope of efforts to produce common asylum policy, and some institutions about migrants and asylum seekers in the European Union will be examined.
