This book looks at the past, present and possible future relationship between the EU and the UK in the fields of law enforcement and judicial cooperation in criminal matters. It examines successively the EU-UK relationship prior to 1 February 2020; the relationship during the transition period; the relationship after the end of the transition period. The book analyses the relevant provisions of the Withdrawal Agreement, the Political Declaration, of the EU and UK negotiating mandates and draft legal texts, and the state of play of the negotiations. It looks at the possible forms that the future cooperation can take and the likely areas, which might be covered, such as cooperation with Europol and Eurojust; criminal records; DNA, dactyloscopic and vehicle registration data; passenger name records; surrender procedures, and mutual legal assistance. It also analyses the overarching issues of protection of personal data and the future role of the Court of Justice of the EU. Finally, this book puts forward some ideas on the possible impact of Brexit on security cooperation within wider Europe and on the possible emergence in future of a European Security Union within wider Europe. Die Autorin erläutert den examensrelevanten Stoff anhand von Fällen, die grundlegenden Entscheidungen des Bundesgerichtshofs nachgebildet sind. Gleichzeitig dienen die Fälle der Erarbeitung, Wiederholung und Vertiefung des materiellen Rechts. Anne Röthel, geboren 1968 in Bochum, studierte Rechtswissenschaften an den Universitäten Köln und Clermont-Ferrand. Nach einer verfassungsrechtlichen Promotion habilitierte sie sich an der Universität Erlangen-Nürnberg über 'Normkonkretisierung im Privatrecht'. Für ihre weiteren Forschungen erhielt sie ein Heisenberg-Stipendium, bevor sie im Jahr 2004 einen Ruf an die Bucerius Law School auf einen Lehrstuhl für Bürgerliches Recht, Europäisches und Internationales Privatrecht annahm. Im europäischen Kartellrechtsverständnis vollzog sich in den vergangenen Jahren der Wandel von einem ordoliberal geprägten, marktstrukturellen Kartellrechtsverständnis zu einem zunehmend auswirkungsorientierten, auf ökonomisierten Grundlagen basierenden Ansatz (sog. "More economic approach"). It remains to be seen whether the past few months will mark a genuine turning point in the conflict in eastern Democratic Republic of Congo (DRC), as the rebel faction March 23 Movement (M23) announced the end of its 20-month insurgency against the government on 5 November 2013. News of the rebel group's surrender following its political and military defeat signals an important moment of hope and renewed prospects of peace and stability in a region prone to protracted armed conflict. However, long-term stability in the country and in the region will require a multi-faceted process consisting of comprehensive accountability for human rights violations that have been committed by all parties to the conflict. In this article, I will first lay out the historical context of the fighting and the root causes of conflict present long before M23's entrance onto the scene as a splintered rebel faction so as to understand M23's place within the country's history of protracted violence. Next, I will explain the violations of international humanitarian and human rights law committed by all possible parties, including rebel and government groups, as well as individual criminal responsibility and corporate liability. Lastly, I will chart the pathways of criminal and social accountability at various levels of international and domestic justice systems to see how the DRC may continue to build long-term local stability in the eastern parts of the country by addressing the question of accountability for international crimes. This brief analysis aims to provide a broader understanding of a complex conflict beyond the defeat and disarmament of M23, albeit a key group in a region of contentious cross-border conflict.

This article proposes an analytical framework for exploring policy responses to common challenges of environmental governance. Observing that governance involves multiple processes, I begin by identifying a conceptual platform for studying unilateral learning and adaptation as well as international cooperation as integral and interacting components of a complex governance system. I propose the concept of co-evolution as the cornerstone of this platform and distinguish between two modes of co-evolution: diffusion and cooperation. The article draws findings and propositions from recent literature to identify the mechanisms at work and the conditions under which they foster mutually beneficial solutions. Indicating how important governance challenges differ with respect to these conditions, I build the case for a diagnostic and differential approach that matches capacity-building and policy strategies with the challenge in focus. Although international human rights law establishes the individual right to receive reparations, collective reparations have been considered a common response from judicial and non-judicial bodies to reparations for victims of gross violations of human rights. As such, collective reparations have been awarded within the field of international human rights law, international criminal law and transitional justice. Yet the concept, content and scope of collective reparations are rather unspecified. To date, neither the judicial nor the non-judicial bodies that have granted this kind of reparations have ever defined them.00This book presents the first study on collective reparations. It aims to shed light on the legal framework, content and scope of collective reparations, and to the relationship between collective reparations and the individual right to reparations. In order to do so, the book analyses specific case law from the Inter-American Court of Human Rights, the International Criminal Court and the Extraordinary Chambers in the Courts of Cambodia. Additionally, the practices of non-judicial mechanisms were examined, specifically those of the Peruvian and Moroccan Truth Commissions and of two mass claims compensation commissions (the United Nations Compensation Commission and the Eritrea-Ethiopia Claims Commission).
