A maioria dos países integrantes do Fórum das Ilhas do Pacífico(1) foi colônia ou protetorado britânico. Essa condição resultou na transposição de leis britânicas relativas à saúde pública que necessitam de revisão e reforma. Estes países também contam com uma rica tradição de direito consuetudinário e métodos de organização social anteriores à experiência colonial(2). Acrescente-se a esse ambiente legal pluralista, o fato de que todos os países do Pacífico ratificaram tratados de direitos humanos internacionais ou tratados que criam obrigações no direito internacional em relação à saúde. ; Most Pacific Island countries which are members of the Pacific Islands Forum have a history as British colonies or protectorates. This delivers a legacy of transplanted British style public health laws from the first half of the twentieth century, which are out of date and in need of review and reform. Pacific Island countries also have a rich tradition of customary laws and methods of social organisation predating their colonial experience. Added to this pluralist legal environment, all Pacific countries have ratified some international human rights treaties or treaties creating obligations at international law in relation to health.

The specificity of the Strasbourg judgments is versatile and concerns many different areas of social life that it is not possible to effectively adapt legal norms and apply their interpretation by one entity of public authority. It can be said with full conviction that the execution of judgments is a continuous process and will last as long as the European Court of Human Rights is functioning; surely it will not end with the completion of the most difficult cases. It is important for the national system for the protection of human rights to be very efficient in the context of the protection of human rights. If, however, there is a violation of the norms of international agreements, Poland must be effective in meeting obligations such as the judgments of the European Court of Human Rights. There are two aspects involved in fulfilling obligations under international law arising from the European Convention for the Protection of Human Rights and Fundamental Freedoms. The first one is the introduction of appropriate standards of respect for the rights and freedoms enshrined in the treaty, and the second one is the obligation to enforce judgments of the European Court of Human Rights in the case of a stated infringement of the Convention. Both obligations must be carried out simultaneously by the state – which, as a party to the Convention, respects its provisions and fulfills the required international legal obligations. The subject of this paper is to present the powers and legitimacy of the body of the executive in Poland in connection with the execution of the judgments of the European Court of Human Rights. ; A especificidade dos acórdãos de Strasburg é versátil e diz respeito a muitas áreas diferentes da vida social, e não é possível adaptar eficazmente as normas jurídicas e aplicar suas interpretações por uma única entidade de autoridade pública. Pode-se dizer que a execução das sentenças é um processo contínuo e durará enquanto o Tribunal Europeu dos Direitos do Homem estiver em atividade; seguramente não terminará com a conclusão dos casos mais difíceis. É importante que o sistema nacional de proteção dos direitos humanos seja eficiente no contexto da proteção dos direitos humanos. Se, no entanto, houver violação das normas dos acordos internacionais, a Polônia deve ser eficaz no cumprimento de tais obrigações, como as sentenças da Corte Europeia de Direitos Humanos. Existem dois aspectos envolvidos no cumprimento das obrigações decorrentes do direito internacional da Convenção Europeia para a Proteção dos Direitos Humanos e das Liberdades Fundamentais. A primeira é a introdução de padrões apropriados de respeito aos direitos e liberdades consagrados no tratado, e a segunda é a obrigação de executar sentenças da Corte Europeia de Direitos Humanos no caso de uma violação declarada da Convenção. Ambas as obrigações devem ser cumpridas simultaneamente pelo Estado que, como parte da Convenção, respeita suas disposições e cumpre as obrigações legais internacionais exigidas. Introduction: nutritional care was recognized as a human right in the Cartagena Declaration of May 3, 2019. This article defines this right and discusses the implications of the human right-based approach in clinical nutrition and the fight against disease related malnutrition. Methodology: an analysis was carried out with the human rights-based approach. This approach is a fundamental strategy to determine the role and obligations of different stakeholders (governments and policy makers, health institutions, patients, health professionals and caregivers). Results: it is possible to define nutritional care as an emerging human right. Its normative mandate is found in the principle 13 of the Cartagena Declaration. Like other human rights, it is based on the principle of respect for human dignity but its content and scope are limited to the field of clinical nutrition. Although this mandate has no binding force, it does imply an important moral commitment to ensure that the patient benefits from the nutritional care process. Conclusion: the recognition of nutritional care as a human right is the result of the effort of international scientific societies in the field of clinical nutrition that seek to fight for a minimum guarantee so that people, anywhere in the world can access nutritional care. The international movement for health promotion began in the 1980s. The I International Conference on Health Promotion, November 1986, in Ottawa, Canada, signals the historical milestone for the paradigm shift. Discussions based on the Alma-Ata Declaration on Primary Health Care in the WHO document on Health for All, as well as on the debate at the World Health Assembly, originated the "The Ottawa Charter for Health Promotion"(1). According to the document: "Health promotion is the process of enabling people to increase control over, and to improve, their health."1 Promoting health is now an obligation in the various health systems, articulated to actions that aim to respond to the diversity of social needs not dissociated from human potentialities. In the new paradigm of intervention of the health sector the approach goes beyond national considerations, appealing to the participation of actors and partnerships and the articulation between research and clinical practice. In this pact, everyone will have a role to play in disseminating reference practices - citizens, health professionals, educators, workers in the various sectors, municipalities and the Government(2). Changes in the coming years will pose challenges for all sectors of society (from education, the environment, the economy, the quality of services and skills of professionals), where policies will play an important role for their demands on health promotion(3). The research that has been done in this context highlights that the specific regional needs identified during the policy-building process reinforce the wealth of developing, in an innovative, democratic and participatory way, actions that can give meaning to health promotion. The commercialization of products of animal origin in Brazil, by virtue of specific legislation, is preceded by previous industrial and sanitary inspection. Such inspection is performed by the Federal Inspection Service in establishments that carry out interstate or international commerce; by the State Inspection Services in those that carry out inter-municipal trade; and by the Municipal Inspection Services in those that carry out local trade. Independently of this obligation, it is the exclusive responsibility of the establishments to assure the quality and appropriateness for consumption of the products elaborated by them, leaving to the public authority the prerogative to authorize the regular ones and prevent irregularities from reaching consumers' table, punishing the offenders when it is the case. The operation started by the federal police called "weak meat", had as scope the information that abattoirs would be marketing deteriorated or otherwise unsuitable for consuming beef, constituting a criminal process and with the participation of public agents responsible for Inspection in these establishments. The objective of this debate was to evaluate the possible circumstances that motivated the fact in the interpretation of the author, as a result of his technical knowledge as Veterinarian PhD in Veterinary Hygiene and Technological Processing of Animal Products, without considering official information for which it did not have access. ; A comercialização de produtos de origem animal no Brasil, por força de legislação específica, deve ser precedida de prévias inspeções industrial e sanitária, exercidas pelo Serviço de Inspeção Federal, nos estabelecimentos produtores que realizam comércio interestadual ou internacional, pelos Serviços de Inspeção Estaduais, naqueles que realizam comércio intermunicipal, ou pelos Serviços de Inspeção Municipais, nos que realizam comércio local. Independentemente desta obrigatoriedade, cabe exclusivamente aos estabelecimentos produtores a responsabilidade pela qualidade e propriedade para consumo dos produtos por elas elaborados, ficando o poder público com a prerrogativa de chancelar os regulares e impedir que os irregulares possam chegar a mesa dos consumidores, punindo os infratores quando for o caso. A operação deflagrada pela Polícia Federal denominada de "carne fraca" teve como escopo a informação de que frigoríficos estariam comercializando carne bovina deteriorada ou de outra forma imprópria para o consumo, o que se constitui um processo criminoso com a participação dos agentes públicos responsáveis pela inspeção nestes estabelecimentos. O objetivo deste debate foi o de avaliar, ante as notícias veiculadas pelos meios de comunicação, as possíveis circunstâncias que motivaram o fato na interpretação do autor, fruto de seu conhecimento técnico como Médico Veterinário Doutor em Higiene Veterinária e Processamento Tecnológico de Produtos de Origem Animal, sem considerar informações oficiais às quais não teve acesso.
This article aims to understand the characteristics of migration policies targeted at refugees, especially concerning the right to work, from the end of World War II to 2019. Migration policy can be defined as the rights and obligations of migrants, including the guarantees and regulations immigrants have when residing in a foreign country. Labor shortages, national security, international treaties, and humanitarian issues are often recurring concerns in migration policy management. This study relied on scientific, journalistic and institutional (legislative) sources available in digital media. Documentary data analysis focusing on themes regarding migration policy, refugees, and refugee employment were used. As a result, it has been concluded that Brazil had inherited conservative, nationalist, and racist policies in the scope of migration. Furthermore, regardless of the progress made during the democratic period, there is still room for improvement in refugee assistance following its legalization in the country. The right to work and the documentation required to work legally are safeguarded to immigrants recognized as refugees. It also includes groups who have acquired the right to validate their qualifications. Nonetheless, the policy has failed to ensure access to employment and protect these groups from performing illegal work without labor rights, which, in turn, highlights the need for public policies that may intervene in this regard. In conclusion, we show the relevance of migration policies to the legal recognition of refugees' rights, especially concerning their right to work. ; Las políticas de migración pueden definirse como los derechos y deberes de los inmigrantes, incluidas las garantías y regulaciones relacionadas con la residencia y el ingreso a un país extranjero. La escasez de mano de obra, seguridad nacional, tratados internacionales y cuestiones humanitarias son algunos de los temas que influyen en la gestión de las políticas de migración.
