Uluslararası toplumda ortaya çıkan uyuşmazlıkların tarafları dikkate alınarak incelendiğinde, uluslararası hukuk kişileri arasındaki uyuşmazlıklar ve uluslararası hukuk kişileri ile özel hukuk kişileri arasındaki uyuşmazlıklar biçiminde bir tasnif yapılmaktadır. Diplomatik uyuşmazlık çözümü, uluslararası hukuk kişileri arasındaki uyuşmazlık çözümünü konu edinmekte özel olarak ise uyuşmazlık taraflarından en azından birinin devlet olduğu uyuşmazlık çözüm yollarını ifade etmektedir. Uyuşmazlıkların diplomatik yollarla çözümü gerek tarihsel açıdan bakıldığında gerekse çağdaş uluslararası toplum düzeni incelendiğinde en çok tercih edilen ve tüm uyuşmazlıkların konu itibarıyla sınırlandırılmadan çözülebileceği yolları bünyesinde barındırmaktadır. Bu çalışmada uyuşmazlıkların tanımlanmasından başlanarak uyuşmazlıkların diplomatik yollarla çözülmesinin incelemesi yapılacaktır. Öncelikle bir uluslararası uyuşmazlığın yargı içtihatları çerçevesinde belirlenmesi ve tasnifi için öngörülen kıstasların değerlendirilmesi yapılacaktır. Ardından uyuşmazlıkların barışçı çözümü yükümlülüğünün içeriği kişi, konu ve nitelik itibarıyla işlenecektir. Diplomatik müzakereler, dostça girişim, arabuluculuk, soruşturma ve uzlaştırmadan oluşan yerleşik diplomatik uyuşmazlık çözüm yolları, hukukî dayanakları çerçevesinde temel vasıfları açıklanmak suretiyle değerlendirilecektir. Bu yolların tercih nedenleri ve hangi durumlarda işletildikleri incelenirken somut örneklere yer verilerek anlatım zenginleştirilecektir. Devam eden kısımda ise uluslararası ilişkilerde meydana gelen değişimlerin bu yolları nasıl etkilediği ve ne tip yönelimlerin diplomatik uyuşmazlık çözümünü etkilediği ele alınacaktır. Bu değişimlerden yola çıkarak diplomatik uyuşmazlık çözümünün geliştirilmesi adına dikkate alınabilecek tavsiyeler dile getirilecektir. ; The disputes that rise in the international community can be classified as the ones between intenational law persons and the ones between international law persons and private law persons when they are studied by the charecter of parties. The subject of diplomatic dispute settlement is the disputes that are between intenational law persons and specifically the disputes which at least one of the parties is a state. Diplomatic dispute settlement contains the most preferred and comprehensive means that can settle all disputes without any limitations on subject matter both historically and in contemporary international community. In this study, dispute settlement with diplomatic means will be reviewed by describing disputes at the beginning. Firstly international disputes and criterions used in classfication of disputes will be determined within the scope of case law. After that, the obligation of peaceful dispute settlement will be handled by characteristics of obligation including ratione personae and ratione materiae. The established means of diplomatic dispute settlement which are diplomatic negotiations, good offices, mediation, inquiry and conciliation will be studied within the frame of legal basis of these means by stating their fundemental characteristics. When preferability and most suited conditions of these means examined the subject will also be enriched by concrete examples. In following part, the effects of changes in international relations to diplomatic means and what kind of tendencies can be observed will be discussed. Based on this discussion recommendations on enhancing the diplomatic dispute settlement will be stated.
Günümüzde uluslararası ekonomik birleşme hareketleri önem kazanmaya başlamıştır. Uluslararası ekonomik birleşmeler üye ülkeler arasındaki tüm ticaret engellerinin kaldırılması ve belirli alanlardaki işbirliğinin kurulması ile ilgilenir. Başlıca ekonomik entegrasyon türlerini şöyle sıralayabiliriz: Serbest ticaret bölgeleri, gümrük birlikleri, ortak pazar, parasal birlik, ekonomik birlik, ve tam entegrasyondur.Cumhuriyetin ilanından sonra tüm alanlarda yönünü batıya çeviren Türkiye, özellikle ekonomik alanda AB ülkelerinin önemli partneri olmuş ve bu ülkelerin oluşturdukları organizasyonlar içinde yer almak istemiştir. Türkiye'nin 1963 yılında başlayan birlik macerası 1996 yılında GB'nin kabul edilmesiyle yeni bir boyut kazanmıştır.Tam üyelik esasına göre kurulmuş olan AB sisteminde, ülkeler önce tam üye statüsüne sahip olurlar ve daha sonra siyasal, ticari, mali ortak yükümlülükler altına girerler. 6 Mart 1995'de Türkiye-AB Ortaklık Konseyi Kararı olarak kabul edilen ve 1 Ocak 1996'da yürürlüğe giren Gümrük Birliği ile Türkiye'nin AB'ne tam üye olmadan, tam üye ülkelerin altına girdiği yükümlülükleri üstlenmiştir.Gümrük Birliği ile birlikte Türkiye , AB mallarının sıfır gümrükle ithaline ve AB'nin belirlediği üçüncü ülkelere karşı uygulanacak Ortak Gümrük Tarifesine uyma yükümlülüğüne girerek; AB lehine Türkiye aleyhine ticaretin gelişmesine olanak tanımış ve aynı zamanda sıfırlanan gümrük vergileri ile birlikte, kamu gelirleri içerisinde önemli yeri olan gümrük vergi gelirleri kaybına uğramıştır.Türkiye, dış ticareti yönünden önemli partneri olan AB ile oluşturduğu GB sürecini tekrar gözden geçirecek mekanizmalar geliştirilmelidir. In 6 March 1995, Turkey - EU assouote council accepted and in 1996, 1sh january Turkey accepted the all obligation without membership to EU called custom associations.One of the obligation of custom association for Turkey was zero custom to all EU proper ties and to fit shared custom price list that applicated to third countries. These obligations have benefits for EU. However, they affected Turkey economically. Commercial developed against to Turkey. At the same time custom tax which was get zero, and public in come decreased slowly.Turkey should control foreing commercial, which shared with EU. and developed mechanism to check custom union process. Bilindiği üzere Avrupa Birliği (AB), Avrupa'daki demokratik ulusları birleştiren en eski uluslararası örgütlerden biridir. Avrupa Birliği'ne üye olmanın şartlarını belirten Kopenhag Kriterleri 1993 yılında kabul edilmiştir. Avrupa entegrasyon süreci, katılan ülkeler üzerinde çok çeşitli etkiler yapmaktadır. Reform sürecinde AB, Türkiye'nin üyelik yükümlülüklerini üstlenebilme yeteneğini incelemektedir ki, bu yükümlülükler, antlaşmalar, ikincil yasalar ve AB politikalarında ifadesini bulan AB müktesebatından oluşmaktadır. Bu makalenin temel amacı Avrupa Birliği'ne üyelik sürecinin Türkiye'de ulusal hukuk sistemini ne ölçüde etkilediğine ışık tutmaktır. ; As it is known, the European Union(EU) is the one of the oldest international organization which has been unifying the democratic nations in Europe. In the reform process, EU examines Turkey's ability to assume the obligations of membership – that is, the acquis as expressed in the Treaties, the secondary legislation, and the policies of the Union. Bu makalede self determinasyon hakkının yirminci yüzyılda Milletler Cemiyeti ve Birleşmiş Milletler dönemleri uluslararası hukukunda geçirdiği aşamalar; hakkın, tarihsel, siyasal ve felsefi kökleri ile birlikte özellikle 1980'li yıllardan sonra self determinasyon hakkı konusunda akademik yazında geliştirilen bazı teoriler incelenecektir. Bu bağlamda, self determinasyonun uluslararası hukukta gözetilmesi istenen siyasal bir ilkeden 1960'lı yıllarda Birleşmiş Milletler bünyesinde yapılan çalışmalarla birlikte yükümlülük doğuran bir hakka doğru evrildiği gösterilecektir. Self determinasyonun bir hak olarak değerlendirilmeye başlanması ile birlikte iç ve dış self determinasyon ayrımları da yapılmaya başlanmıştır. Ancak meselenin, uluslararası hukukun diğer ilkeleri, güç ilişkileri, milliyetçilik, demokratik yönetim, kültürel haklar ve insan hakları ile olan ilişkisinden kaynaklanan çok boyutlu bir yapısı vardır. Özellikle hakkın kompleks yapısı ve dış self determinasyonun bir formu olan ayrılma hakkı ile mevcut uluslararası hukuk arasındaki uyumsuzluk nedeni ile akademik yazında self determinasyon hakkı üzerine bazı (liberal) teoriler geliştirilmiştir. Bu teoriler, bu hakkı gerekçelendirmeye, kapsamını belirlemeye ve pratik uygulamasına ilişkin kısıtlamaların neler olabileceği gibi konulara odaklanmıştır. AB'NİN TARAF OLDUĞU SERBEST TİCARET ANLAŞMALARININ TÜRK DIŞ TİCARETİNE ETKİLERİKüreselleşmenin en önemli ürünü olarak ortaya çıkmış olan Avrupa Birliği. With these agreements, the EU aims to increase its economic strength and to maintain its stronger presence against the strengthening US in Asia.The fundamental relationship with the EU based on the Customs Union with Turkey is obliged to comply with the EU's common commercial policy. Because of this obligation, it was directly affected by the EU's common foreign trade policy. non-effective in the decision-making process of international trade policy is not a member country, Turkey is enacting free trade agreements signed by the Union. As a natural result of these agreements, they face unfair competition in both domestic and international markets. Free trade agreement with the EU, some countries implemented trade agreements concessions member countries for lack of agreement excludes Turkey. Gelişimin unsuru olan enerjinin kullanımında, küresel eğilimler kamuoyu oluşturmakta ve çevresel etkileri nedeniyle fosil yakıtların tüketimi ve verimsiz kullanıma baskı artmaktadır.Bizim konumuz olan enerji verimliliği ulusal rekabet gücümüze katkı sağlamanın ve çevresel baskılar sonucu ileride oluşacak uluslararası yaptırımlara hazırlıklı olmanın temelini oluşturmaktadır.Hükümetler tarafından yapılan kanuni düzenlemeler ile tüm hukuksal altyapı uluslararası hukuğa ve ulusal ihtiyaca uygun hale getirilmiştir.Tüm bu unsurlar bir araya getirildiğinde ülkemizde yer alan tüm işletmelerin enerjiyi daha verimli kullanmaları, kanuni yükümlüklerini yerine getirmelerine, maliyet avantajı aracılığıyla rekabet güçlerini artırmalarına ve geleceğin en önemli pazarlama unsuru olan çevreci şirket imajlarına katkı sağlamaktadır. The global trends form the public opinion while the usage of energy which is an element of development and the enforcements over the consumption of fossil fuels and against ineffectual usage is increasing. Energy productivity which is our issue here, form the basic for the contribution in our national competitive power and being ready for the international enforcements that will arise in the future as the result of environmental pressure. The legal regulations prepared by the government and all legal infrastructure were made proper into international laws and national requirements. When all these elements are put into together, more productive energy usage of all enterprises exist in or country contributes to performing their legal obligations, increasing their competitive power through cost advantages and their environmentalist company image which is the most important marketing element of the future. The purpose of this study is to make the definition of energy concept and defining the energy productivity in accordance with the environmental and economic dimensions and performing the comparison of international applications with national situation. These comparisons and analysis were performed specially at service sector, whose share in national economy is great and at which energy usage is intensive. This study is formed of three chapters. In the first chapter includes the definition of energy, energy resources, energy usage and application areas, international applications and their results and the cost accounting concepts for the companies. In the second chapter, the study is focused on accommodation facilities which are ones among the most important sub groups that form the service sector. A survey study performed with the 5 star hotels located in Antalya region and analysis of this survey also take place in the second chapter. And in the last chapter, the results achieved at the end of the application are explained. This study both explain the energy, resources, energy consumption, environmental results, financial affects conceptually and also shows the results by means of the field study.

Çünkü savunma harcamaları kamu harcamalarından savunma hizmetleri adına ayrılan kısımdır. Bununla birlikte savunmaya ayrılan pay ülkenin içinde bulunduğu tehdit arttıkça artmaktadır. Bu çalışmaların sürekli tazelenmesinin nedenleri arasında tarih boyunca devletlerce savunmaya pay ayrılmış olması ve bu paydan hiçbir devletin vazgeçememiş olması yatmaktadır. Genel bir çerçevede bakıldığında gelişmiş ülkelerin daha faza savunma harcaması yaptığı görülmektedir. Bu çalışma, Augment Dickey Fuller testi, ADF Birim Kök testi, Johansen Eş bütünleşme Testi, Varyans ayrıştırma analizi, Housman testi, Panel veri analizi kullanılarak; seçili ülkelerde askeri harcamalar, cari denge ve silah ithracatının ekonomik büyüme üzerindeki etkisini incelemiştir. Çalışmada öncelikle 1965-2015 yılları arasındaki dönemde Türkiye incelenmiştir. Türkiyenin ekonomik büyümesindeki uzun dönemli faktörler tespit edilmeye çalışılmıştır. Daha sonra Fransa, İngiltere, Almanya, İtalya ve Kanada gibi ülkeler de ilave edilerek araştırma genişletilmiştir. Tüm bu ülkeler arasında ampirik bir araştırma yapılmıştır. This search and need for security brought with it the obligation of states to defend themselves. World wars, cold war, polarization between countries, power struggles, desire to get rich, understanding of sovereignty, etc. have become affecting the world. It would be a very optimistic approach if we think economic stability could be stable.As long as international relations of interest persist, uncertainty will increase, the complexity that this uncertainty increases will trigger the desire of countries to protect themselves and hold their sovereignty. These situations naturally reflected on economic units, because it is possible to consider defense expenditures as the price of sovereignty. As the chaos in the country increases, the need for defense naturally increases, and this necessity necessitates the transfer of more resources to the defense field because defense expenditures are the part allocated from public expenditures for defense services. However, the share allocated to defense increases as the threat to the country increases. Since Benoit, studies have been carried out on how the resource allocated to industry affects the economy. One of the reasons for the constant renewal of these studies is that throughout history, states have allocated a share of defense and that no state has given up this share. The important thing is to keep this defense margin at an optimum level, because allocating too much resources to defense expenditures shows that there is no correct defense plan. A correct plan and planning of the required level of defense expenditures will affect the economic growth at the best level. There are multiple factors that affect countries when they make their defense spending. From a general perspective, it is seen that developed countries spend more on defense. This study investigated the effects of military spending, current account balance and arms exports on economic growth in selected countries using Augment Dickey Fuller test, ADF Unit Root test, Johansen Cointegration test, Variance decomposition analysis, Housman test, Panel data analysis. The study primarily examined Turkey's 1965-2015 year. Turkey's economic growth in the long-term factors have been determined. Later, the research was extended by adding some countries such as France, Britain, Germany, Italy, Canada. An empirical research has been conducted across all these countries. The date range to be selected in the research was selected according to the availability of data.
Avrupa Birliği (AB) 2004 yılından bu yana Orta ve Doğu Avrupa ülkelerinin büyük çoğunluğunu resmi olarak birliğe kabul etti ve Batı Balkanlarda geriye kalan üye olmayan ülkeler AB'nin yeni hedefi haline geldi. Ancak, Birlik AB politik üyelik koşulları yoluyla kurallarını Orta ve Doğu Avrupa ülkelerine kıyasla Batı Balkanlardaki diğer üye olmayan ülkelere aktarırken birtakım zorluklarla karşılaşmıştır. Burada akla iki soru gelmektedir: Birinci soru, "Hangi şartlar altında bu koşullar etkili olabilir?" iken; ikinci soru, "AB üyelik koşulları neden Batı Balkanlarda bulunan ülkelerin iç politikasında kısmen sınırlı bir rol oynar?" şeklindedir. Bu meseleyi açığa kavuşturmak için Schimmelfennig ve Sedelmeier (2004) tarafından "dış teşvik modeli" benimsenmiştir. Bu çalışma "dış teşvik modelinin" bu soruları tam anlamıyla cevaplandıramadığını ve ulusal kimliğin Batı Balkan devletleri olan Hırvatistan ve Sırbistan'da AB üyelik koşullarının etkililiğini belirleme noktasında önemli bir role sahip olduğunu ileri sürmektedir. Çalışmanın Hırvatistan ve Sırbistan'ı durum çalışmaları olarak ele almasının sebepleri; bu iki ülkenin eski Yugoslav Sosyalist Federal Cumhuriyeti olmaları ve 1990'lı yıllarda ortak bir savaş tarihi paylaşmalarıdır. Belirtilen bu ortak özelliklere rağmen bu iki ülkenin Birliğe olan üyelik sürecine ilişkin tutumlarının birbirinden farklılık arz ettiği dikkat çekmiştir (Massari, 2010). Hırvatistan AB üyeliğini hâlihazırda 2013 yılında elde etmiş olmasına rağmen, Sırbistan'ın bu üyeliği gerçekleştirme noktasında kat etmesi gereken daha çok yol vardır ; The European Union (EU) has formally initiated the vast majority of the Central and Eastern European Countries (CEECS) into the Union and Western Balkans' remaining non-EU countries have became the new target of EU enlargement since 2004. The Union, however, has faced some difficulties in transferring its rules to non-member countries in Western Balkans by means of the EU political accession conditionality in comparison to Central and Eastern European Countries. Here are two questions to mind: 'Under what circumstances could the conditionality be effective?' and 'why does the EU conditionality play relatively limited role in the domestic politics of the Western Balkan states?' An "external incentive model" is adopted by Schimmelfennig and Sedelmeier (2004) to articulate the issue. This study addresses this contestation, arguing that the "external incentive model" is incapable of fully answering these questions and that national identity has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. The reasons why the paper has chosen Croatia and Serbia as case studies are that they are republics of former Yugoslavia and that they have shared war history in the 1990s, however act differently on the way to the European Union (Massari, 2010). Although Croatia has become a member of the Union, Serbia still has got a long way to go The European Union has utilised political conditionality as one of the most significant strategies to export its governance and to encourage non-member countries to obey the rules of the EU (Schimmelfennig and Sedelmeier, 2004). Political conditions, which are necessitated by the Union from the very beginning, can be described as a competitive party system, and free and fair elections. As for the essential political conditions of EU accession that the EU confirmed in 1993, which are also defined as the Copenhagen Criteria, they are the stability of democratic institutions, rule of law, liberal market economy, human rights and lastly the protection of minority rights (Bieber, 2013:2). The required political conditions are flexible. By which it means that some specific requirements could be added to the conditions. For instance, the UE required cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) in the context of Western Balkans (Frerburh and Richter, 2010:269-71). Predominant studies select "external incentive model" to articulate the logic of EU conditionality and political conditions. This model is based on a rationalist cost-benefit calculation that assumes that states are regarded as rational actors, seeking to boost their interests (Schimmelfennig and Sedelmeier, 2004). The tool of conditionality is perhaps the most significant instrument that the EU external governance applies to force would-be member states to obey the rules of the EU. That is, the Union decides its instructions as conditions and would-be member states are expected or required to accept these conditions to receive rewards. Consequently, the target government would face three various pressures namely from the Union, domestic and international politics in return for EU external incentives (Trauner, 2011:8). It is therefore the credibility of the EU conditionality plays a key role in evaluating the pros and cons of EU rewards as opposed to domestic compliance (Schimmelfennig and Sedelmeier, 2004:663-7). This model is, however, unsuccessful in fully articulating why the EU political conditionality could perform better in states like Croatia than in states like Serbia in the context of Western Balkan despite the fact that the Union has provided these countries with rewards. At this point, national identity, as a constructivist variable, has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. National identity is the main theme that determines whether conditionality can be effective or not. Constructivists argue that wouldbe member states would acknowledge the influence of the Union by means of socialisation and persuasion processes. It is these processes internalizing identities with the help of domestic actors (Trauner, 2011). Considering the rules of the EU appropriate and compatible with political conditionality helps domestic actors to stick to given EU rules (Schimmelfennig et al., 2006:27-52). In this sense, national identity, as a filter actor, influences EU conditionality. It is, therefore, crucial to note that states, as social actors, often shape and reshape national identity when they face or interact with different social structures. The EU political conditionality has raised doubts about its effectiveness in the countries in question. This is because they had ethnic conflicts in 1990s that shaped their national identities. It is this historic background affecting the effectiveness of EU political conditionality in Croatia and Serbia in different lights. The way in which the transformation of the EU rules, however, quite varied from one another. Croatian elites saw the cooperation with ICTY as indispensable part of EU accession and in line with Croatian respect of European organizations. Croatia met EU requirements. This is simply because the country was one of the European countries in which the rule of law is respected and obeyed. As far as Serbia is concerned, the cooperation with the ICTY was ensured by Serbian elites who felt forced and oppressed to do so. But they rejected the Hague tribunal. Even though they rejected it, a sense of obligation arising from the fear of being punished by the international community through the cancellation or postpone of EU talks took place regarding detaining suspects. This problematic issue resulted in different images of the EU in the eyes of these two countries. Serbia regards the European Union as a punisher and a superior force that inclined to in Serbia. This could be one of the reasons why there is distance between Belgrade and Brussels. As for Croatia, the image of Europe in the eyes of Croatian people is related to high democratic standards, liberty and civilization (Subotic, 2011:326-7). This could be one of the reasons why there is close cooperation between Croatia and the European Union. The rational incentive model is important for explaining the choice of would-be member states. It is crucial to clarify that this model is valid once the rules of the European Union are compatible with national identity of the would-be member states. Once the national identity of the target state is incompatible with the rules of the EU, it is fair to say that any material condition does not serve a very useful purpose. Türkiye ekonomisinde 1960'lı yıllardan sonra planlı döneme geçilmiştir. 1960-1970 yılları arasında tarımsal girdi kullanımının teşviki ve sulama alanlarına yönelik yapılan yatırımlarla sağlanan verim artışı sonucunda destekleme alımları yapılmış ve desteklenen ürünlerin sayısı arttırılmıştır. Bu dönemde yaşanan sosyal ve siyasal istikrarsızlık, Kıbrıs Savaşı, petrol krizi ve döviz darboğazından dolayı ekonomide durgunluk yaşanmıştır. Bu gelişmeler sonucunda Hükümet önlemler almaya başlamış, 1978 yılında "istikrar programı "nı açıklamıştır. İstikrar programı içerisinde yer alan ve uygulanan önlemler; KİT açılarlını kapatmak amacıyla KİT ürünlerine zam yapılmış, ithalat zorlaştırılmış ve devalüasyon yapılmıştır. 1979 yılında uygulana yeni bir program ile KİT ürünlerine yönelik zam uygulamasına devam edilmiş, faiz oranları yükseltilmiş ve Türk Lirası yeniden devalüe edilmiştir. Enflasyona engel olunamamasından ve durgunluğun devam etmesinden dolayı 24 Ocak1980 Kararları alınmıştır. 1980 sonrası dönemde 24 Ocak 1980 Kararlarıyla; devletin tarım sektörüne sağladığı destek azalmıştır. Fiyat yoluyla desteklenen ürün sayısı, 1980 yılında 24 iken, 1981 yılında 20'ye, 1985 yılında 18'e,1990 yılında ise 10'a düşmüştür. Nisan 1994'de yaşanan ekonomik kriz nedeniyle desteklenen ürün sayısı azaltılmış Bu süreç 2001 yılı sonuna kadar devam etmiştir. 2000'li yıllara gelindiğinde etkinliğini yitiren tarım politikalarının yerini, rekabete dayalı, adil, çiftçinin gelir düzeyini yükseltmeyi amaçlayan çevreci olan daha etkin tarım politikaları almıştır. Yeni tarım politikalarının hedeflerine ulaşmak için kullanılan araç, Doğrudan Gelir Desteği Uygulaması'dır. Bu uygulama AB'nde uygulanan Tek Çiftlik Ödeme Yöntemi için temel oluşturma niteliğindedir.1980'li yıllarda AB üyelik sürecine yönelik atılan önemli adım Gümrük Birliği Anlaşması olmuştur. Gümrük Birliği sayesinde Türkiye ekonomisi AB pazarında rekabet edebilme gücünü deneme fırsatı bulmuştur.
