This comment will analyze the relative success of the various approaches taken to implement Indian treaty rights in the international fishery. It will discuss the domestic litigation resulting from these approaches and will identify the key legal issues involved. Finally, it will suggest possible means of resolving the dilemma in which the United States currently finds itself. By providing an appreciation of both the scientific complexities of managing this valuable resource and the limitations on unilateral judicial efforts in the United States, it will become apparent that the solution to this sensitive problem rests not in unilateral, but in cooperative United States-Canadian efforts. Only through diplomatic negotiations can we be assured that these recently resurrected Indian treaty rights will be accommodated in harmony with the conservation and enhancement of the salmon resource. It is hoped that the two national governments will come to realize the role of cooperation and act to avoid imposing upon the resource and its beneficiaries the futility of future summers in court.

Während im Falle von Frankreich einerseits einige Förderungsmaßnahmen in der Berufsbildung wie der "credit-formation individualisé" (CFT) und die Vorbereitung eines neuen Berufsbildungsgesetzes sowie Maßnahmen zur Bewältigung der Probleme der Hochschulkapazität (Erhöhung des Bildungshaushaltes, Regionalisierung der Hochschulen durch den Plan "Universités 2000") angesprochen werden, geht es im Falle von Großbritannien vor allem um die Reformvorschläge bezüglich der so genannten "Higher Education" und im Falle von Spanien um den Religionsunterricht an Schulen und die Durchführung eines neuen Hochschulzulassungstests. "Die potentiellen Leistungen der vergleichenden sozialwissenschaftlichen Forschung sind häufig Gegenstand theoretischer und methodologischer Erörterungen gewesen. Deutlich klafft jedoch eine Lücke zwischen solchen grundlegenden Zuschreibungen und den tatsächlichen Arbeitsbedingungen vergleichender Forschung. Der Beitrag resümiert Erfahrungen des Berichterstatters aus mehreren mehrjährigen empirischen Forschungsarbeiten des Wissenschaftlichen Zentrums für Berufs- und Hochschulforschung der Universität Gesamthochschule Kassel: (1) drei Analysen der Mobilität Studierender und jüngerer Wissenschaftler(inne)n in Europa, darunter die Begleitstudien des ERASMUS-Programms, (2) eine international vergleichende Analyse des Hochschullehrerberufs in fünfzehn Industrie- bzw. Schwellenländern, (3) ein Vergleich der Beziehungen von Bildungs- und Beschäftigungssystem in Japan und Deutschland. Dabei zeigt sich eine größere Anfälligkeit international vergleichender Studien gegenüber finanziellen und organisatorischen Umständen. Kooperative vergleichende Forschung mag in ihrem Abstimmungszwang pragmatische Kompromisse nahelegen, hat jedoch auch die Chance, eine Integration von Konzepten zu fördern, die den Gefahren einer Überstülpung von Fragestellungen aus einem spezifischen nationalen Kontext entgegenwirkt. Die vergleichende Betrachtung des Hochschulwesens ist besonders fruchtbar, wenn geprüft wird, inwieweit die Entwicklung einzelner Hochschulsysteme idiosynkratisch, funktional oder politisch-optimal bestimmt ist. Für Studien der internationalen Mobilität und Kooperation sind vergleichende Perspektiven von besonderer Bedeutung, weil es nicht nur in der Konzeption der Studie, sondern auch beim Gegenstand der Analyse zugleich um Vergleich und kreative Konfrontation nationaler Hochschulsysteme geht." The UN Charter and the Vienna Convention on the Law of Treaties require interpreting treaties and settling international disputes "in conformity with the principles of justice and international law." This contribution discusses procedural and substantive principles of justice which the international judge may take into account in interpreting international economic agreements. The "sovereign equality of states" underlying the "international law of coexistence" as well as the "international law of intergovernmental cooperation" must be interpreted in conformity with the universal recognition of human dignity as a source of inalienable human rights. The universal recognition of economic and social human rights further requires taking into account solidarity principles, as proposed also by the sociological approach to international law. The constitutional structures and citizen-oriented functions of the law of international economic organizations liberalizing and regulating mutually beneficial market transactions among citizens require judges to engage in a careful balancing of state-centered and citizen-oriented principles of international law, including respect for the emerging human right to democratic decision-making. This modern "international integration law" and the increasing number of "international constitutional rules" promote the reconciliation of the various state-centered approaches, human rights approaches, sociological approaches and policy-approaches to international law as a system not only of international rules and "legal pluralism" but also of constitutionally limited decision-making processes and struggles for human rights.
