El Derecho internacional no es concluyente en cuanto a la determinación del régimen jurídico del derecho de libre determinación de los pueblos no coloniales, puesto que la previsión contenida al respecto en la Resolución 2625 (XXV) de 1970 de la Asamblea General de las Naciones Unidas es muy sucinta, ha tenido una práctica posterior desigual y muy politizada en el ámbito de esta organización, y en los sistemas regionales se ha sustituido por la no discriminación y la protección de los derechos humanos de estas minorías nacionales. Sin embargo, sigue vigente esa denominada cláusula de salvaguardia, ha sido aplicada en casos recientes de la práctica internacional y cuenta con el apoyo de un sector de la doctrina que considera la autodeterminación externa, incluyendo la secesión, como el último remedio en los supuestos de discriminación de la minoría nacional y de violación grave, masiva y sistemática de sus derechos humanos por el Estado en el cual están integrados. En las pretensiones secesionistas auspiciadas por el Gobierno de Cataluña se han planteado dos fundamentos jurídicos diferentes. Primero, el derecho de libre determinación de los pueblos expresado en el Derecho internacional, concretamente en el sistema de las Naciones Unidas, y, ante las dificultades que plantea su aplicación para este caso concreto, por no haber ni discriminación ni opresión, se han fundamentado, en segundo lugar, en el principio democrático, considerado aisladamente como simple voluntad de los integrantes del pueblo, sin la consideración de los demás requisitos y circunstancias que integran la noción de democracia, como el respeto a la legalidad y a las resoluciones judiciales. Los problemas planteados en la práctica no se circunscriben al acto realizado el 9 de noviembre de 2014, que no ha cumplido las mínimas exigencias de los referéndums realizados o supervisados por las organizaciones internacionales, sino que puede incluir una eventual declaración unilateral de independencia. ; International Law is not conclusive regarding the mapping of the legal right of non-colonial people to self-determination, since the related estimate included in Resolution 2625 (XXV) of 1970 of the UN General Assembly is highly scarce, it has had an inconsistently highly politicized subsequent use within the frame of this organization and has been replaced in regional systems by non-discrimination and protection of such national minorities human right. However, the so-called safeguard term continues to apply and has been used in recent cases in international practice and counts on the support of one side of doctrine that believes in self-determination from an external point of view, including secession as the last measure in case of discrimination of national minorities and of serious massive systematic infringement of its human rights by the state they belong to. Two different legal requirements apply in the secessionism predicted by the Government of Catalonia. First of all, the right to self- determination of people as stated in International Law, particularly in the UN General Assembly, and, facing the problems its put into practice for this particular purpose arises, since there is neither discrimination nor oppression here. Secondly, the principle of democracy, separately considered as the mere will of its people's members, not taking into consideration the rest of the requirements and circumstances that make part of the idea of democracy, such as respect to the law and to legal resolutions. In practice problems do not relate to the act passed on 9 November 2014, which has not met the requirements of the referendums called or supervised by international organizations and could eventually lead to a unilateral declaration of Independence. ; Das Internationale Recht ist hinsichtlich der Bestimmung der Rechtsstellung des Rechts auf freie Selbstbestimmung der nicht kolonialisierten Völker nicht schlüssig, da die entsprechende Gesetzespassage, die von der Vollversammlung der Vereinten Nationen im Beschluss 2625 (XXV) 1970 verabschiedet wurde, sehr kurz gefasst ist. Zudem wurde sie danach auch ungleich angewendet und innerhalb der UN stark politisiert ausgelegt. In den regionalen Rechtssystemen wurde sie durch den Gesetzesinhalt zur Nicht-Diskriminierung und den Schutz der Menschenrechte dieser nationalen Minderheiten ersetzt. Jedoch ist die sogenannte cláusula de salvaguardia (Vorbehaltsklausel) weiterhin gültig und wurde erst kürzlich in der internationalen Praxis, unter Berufung auf den Bereich der Lehrmeinung, der die externe Selbstbestimmung, - einschliesslich der Sezession - als letzter Maßnahme rechtfertigt, dann angewendet, wenn die nationale Minderheit mutmaßlich diskriminiert wird, und zwar unter schwerwiegender, massiver und systematischer Verletzung der Menschenrechte durch den Staat, in den sie eingegliedert ist. Bei den Sezessionsbemühungen, die von der Regierung Kataloniens unterstützt wurden, wurden zwei verschiedene Rechtsgrundlagen zu Grunde gelegt. Erstens: Das Recht auf freie Selbstbestimmung der Völker wie es im Internationalen Recht, konkret im System der Vereinten Nationen, ausformuliert wurde. Zweitens: Wissend um die Schwierigkeit, die die Anwendung des Rechts auf den konkreten katalanischen Fall mit sich bringt, da keine Diskriminierung und Unterdrückung vorliegt, haben sie sich auf das demokratische Prinzip berufen - es losgelöst ausgelegt - als den schlichten Wille des Volkes. Hierbei wurden jedoch die anderen demokratischen Voraussetzungen und Umstände, die den Begriff Demokratie ausmachen, außer Acht gelassen. zum Beispiel die Achtung vor der Rechtsstaatlichkeit und den gesetzlichen Regelungen. Die aufgezeigten Probleme beziehen sich nicht nur auf den am 9. November 2014 ausgeführten politischen Akt, der nicht einmal die grundsätzlichen gesetzlichen Voraussetzungen einer Volksabstimmung erfüllt hat, wie sie üblicherweise von den internationalen Organisationen ausgeführt oder überwacht werden, sondern er kann auch als eine einseitige Unabhängigkeitserklärung betrachtet werden.

They often avail different types of membership within the receiving state which does not necessarily require the acquisition of the citizenship.
