Zsfassung in engl. Sprache u.d.T.: Analytical thinking in jurisprudence and legal practice

The first part of the paper is devoted to the regulations concerning rural construction in the Valley of Kamienna River from the beginning of the 19th century till the end of the First World War. In this period, the regulations that were probably of the greatest importance were issued by the Governmental Commission of Revenue and Treasury of the Sandomierskie Province, which were binding for the villages of government estate. Research into the forms and technical solutions in the constructions from the second half of the nineteenth century, supported by archival documents prove that some aspects of these provisions were closely observed, while implementing others faced considerable difficulties. Unambiguous determination of the extent to which these regulations affected the development of the rural construction of the region is not possible due to the small number of preserved objects from the period preceding their introduction. Certainly, the existence of objects meeting the requirements of these regulations can be confirmed from the moment they became binding. ; Pierwsza część artykułu poświęcona jest przepisom dotyczącym budownictwa wiejskiego, które obowiązywały w regionie doliny rzeki Kamiennej od początku XIX wieku do końca pierwszej wojny światowej. W okresie tym bodajże, największe znaczenie miały przepisy wydane przez Komisję Rządową Przychodów i Skarbu Województwa Sandomierskiego obowiązujące we wsiach dóbr rządowych. Badania form oraz rozwiązań technicznych budynków z drugiej połowy XIX wieku, wsparte dokumentami archiwalnymi dowodzą, iż niektórych aspektów tych przepisów przestrzegano starannie, podczas gdy przeforsowanie innych, napotykało na duże trudności. Jednoznaczne określenie, do jakiego stopnia przepisy te wpłynęły na rozwój budownictwa wiejskiego regionu, nie jest możliwe ze względu na niewielką ilość zachowanych obiektów z okresu poprzedzającego ich wprowadzenie. Z pewnością jednak potwierdzić można występowanie obiektów odpowiadających wymogom tychże przepisów, począwszy od momentu ich obowiązywania.

Reserved contracts are a legal instrument that allows the promotion of those economic operators who, as part of their business, pursue also social goals. Pursuant to Article 22 (2) of the Act of 29 January 2004 – Public Procurement Law (Journal of Laws 2018, item 1986 as amended), they may only be applied for by sheltered workshops and other economic operators whose activities include the social and professional integration of members of socially marginalised groups. Unfortunately, the use of reserved contracts is in practice marginal, which is also caused by difficulties in interpretation of national laws. The article discusses the institution of reserved contracts and the terms of application thereof, in the context of the EU legislation. ; Zamówienia zastrzeżone są prawnym instrumentem pozwalającym promować tych wykonawców, którzy w ramach prowadzonej działalności realizują także cele społeczne. O ich udzielenie, na gruncie art. 22 ust. 2 ustawy z dnia 29 stycznia 2004 r. – Prawo zamówień publicznych (Dz.U. 2018, poz. 1986 z późn. zm.), mogą ubiegać się wyłącznie zakłady pracy chronionej oraz inni wykonawcy, których działalność obejmuje społeczną i zawodową integrację osób będących członkami grup społecznie marginalizowanych. Niestety, zastosowanie zamówień zastrzeżonych w praktyce jest marginalne, czemu sprzyjają także trudności interpretacyjne przepisów krajowych. W artykule została omówiona instytucja zamówień zastrzeżonych oraz warunki jej zastosowania w kontekście regulacji prawa unijnego.

Publikacja recenzowana / Peer-reviewed publication ; Pojęcie obywatelskiego nieposłuszeństwa wiąże się tradycyjnie z postacią Henry`ego Davida Thorea, którego słynny esej z 1848 roku pt. Resitance to Civil Government, stał się inspiracją dla rozwoju współczesnej refleksji nad obywatelskim nieposłuszeństwem, a także źródłem nieustannych poszukiwań jego istoty. Rozważania nad nieposłuszeństwem obywatelskim prowadzili też Hannah Arendt, a także John Rawls, Joseph Ratz oraz Ronald Dworkin. Stworzone przez tych autorów definicje obywatelskiego nieposłuszeństwa zawierają pewien katalog cech składających się na to pojęcie. Najważniejszymi spośród nich są zakaz stosowania przemocy oraz gotowość poddania się karze. Na gruncie polskim problematyka ta omawiana była przez Andrzeja Rzeplińskiego, Ewę Łętowską, a ostatnio przez Artura Szutę i Michała Rocha Kaczmarczyka. W historii Polski symbolem obywatelskiego nieposłuszeństwa jest Tadeusz Rejtan. Ostatnio działania wykazujące cechy obywatelskiego nieposłuszeństwa podejmują Obywatele RP. Obywatelskie nieposłuszeństwo może być mylone z takimi pojęciami jak prawo do oporu, sprzeciw sumienia lub nieposłuszeństwo rewolucyjne. Niezależnie od wielu kontrowersji związanych z samym pojęciem, nie ma wątpliwości, że instytucja ta ma do spełnienia szereg bardzo pozytywnych ról. Pozwala na zainicjowanie niezależnej, niekontrolowanej przez władzę dyskusji. Zapewnia partycypację polityczną oraz stwarza warunki sprzyjające możliwości oddziaływania na władzę. Odgrywa też niebagatelną funkcję informacyjną. Ale przede wszystkim przyczynia się do rozwoju społeczeństwa obywatelskiego. ; Over the past few decades, civil disobedience has become one of the most widely studied subjects in jurisprudence. The name which is widely recognized and associated with the term is that of Henry David Thorea for it was his essay, published in 1849 under the title "Resistance to Civil Government" and later renamed "Essay on Civil Disobedience" that first brought this idea to the public attention. After his landmark lectures were published in 1866, the term began to appear in numerous sermons and lectures relating to civil or social oppression in its many forms. In 1866, four years after his death, the term had achieved fairly widespread usage. Among Thorea's numerous followers were Hannah Arendt, John Rawls, Joseph Ratz and Ronald Dworkin who all, in their own way and method, contributed to the catalog of features associated with the term as we know it today: the active, professed refusal to obey certain laws, demands or commands of a government, or of an occupying international power. Civil disobedience is relatively often defined as essentially and profoundly nonviolent. Actions or undertakings which strive to be labelled as such will, therefore, have to be equated with nonviolent resistance and prepared to suffer the penalties set out in the law. In Poland civil disobedience has been discussed in the works of Andrzej Rzepliński, Ewa Łętowska and, most recently, by Artur Szuta and Michał Roch Kaczmarczyk. The most symbolic depiction of the issue held dear in the sentiments of Polish patriots will be the 18th century Polish parliamentarian Tadeusz Rejtan. Today, Polish civil disobedients have chosen a variety of different methods to manifest their discontent. Civil disobedience is often mistaken for the right of resistance, conscientious objection, revolutionary disobedience. But, regardless the confusion those terms might cause, their social standing and significance remain undisputed. It gives rise to independent and spontaneous public debate, free of authoritarian intrusion or imposition. It acts as a free and independent public platform. And, last but not least, it helps to build civil society in its own right.

This article analyzes the most important political, social, ethical problems of modern society – lies in the media, "fake news" as an indicator of the degradation of the media, civil society institutions, and the authorities. The article analyzes the information processes of modern society, states the influence of fake news on political processes. The article reveals the importance of the political culture of society and the negative perception of fake news. This phenomenon is considered in the context of the informational picture of the world, the need of the authorities to abuse the institution of journalism as an agent of influence and manipulation of public opinion. The study notes the role of the linguistic factor in the implementation of the functions of manipulating society, reducing the level of citizens' trust in the state. The article attempts to reveal the role of social networks in promoting fake news. On the example of the secondary interpretation of the results of a sociological survey in the United States, the negative perception of fake news by society is revealed. The survey results indicate the growth of inequality and prejudice in society. The article concludes about the social turbulence of the processes of modern society.

Ocena obecności ludzi starych w społeczeństwie zależy od tempa rozwoju technologicznego i gospodarczego. Szybkie zmiany sprzyjają dyskryminacji ze względu na wiek oraz przyczyniają się do niedostrzegania jednostkowych i zbiorowych korzyści płynących ze wzrostu długości życia ludzkiego. Artykuł zwraca uwagę na niezbędność poszukiwania pomysłów aktywnego uczestnictwa seniorów w życiu społecznym, jak też przybliża koncepcję kreowania przestrzeni miejskich sprzyjających rozwojowi i integracji wszystkich grup wiekowych. Praca podkreśla znaczenie starszego pokolenia w procesie utrzymania ciągłości kulturowej w społeczeństwach informacyjnych i społeczeństwach wiedzy poprzez przeciwstawienie tych idei projektowi społeczeństwa mądrości.

Jednym z fundamentalnych przedmiotów badań nauki o polityce pozostaje niezmiennie język polityki (w swoich licznych odmianach i formach). Analiza naukowa tego przedmiotu badań przysparza jednak politologii nadal szereg problemów, wynikających z nieprzystawalności metod językoznawstwa do funkcji i zadań współczesnej nauki o polityce. Pojawia się więc potrzeba wypracowania politologicznej metody analizy tekstu, która to metoda pozwoliłaby – za pomocą języka – odkryć i wyeksponować założenia kształtujące orientacje i postawy podmiotów politycznych, czyli treści tworzące ogólną przestrzeń polityczną. Propozycją odpowiedzi na to zapotrzebowanie jest prezentowana w artykule metoda, wyróżniająca trzy podstawowe poziomy analizy: konwencjonalną warstwę tekstu, opisową oraz presupozycjalną. Na przykładzie analizy inauguracyjnych orędzi polskich prezydentów, ukazano specyfikę poszczególnych wymiarów: determinant sytuacyjny (na pierwszym poziomie), kreację treści korzystnych wizerunkowo (na poziomie deskryptywnym), wreszcie – najistotniejszy dla politologa – mechanizm odkrywania założeń ukrytych na poziomie presupozycjalnym. ; The language of politics (in its numerous variations and forms) continues to be one of the fundamental objects of political science research. The academic analysis of this object of research, however, continues to generate considerable difficulties for political science as a result of the incompatibility of language studies methodology with the function and tasks of modern political science. Therefore, there emerges a need to develop a method of text analysis for political science that will allow us to use language to discover and present the assumptions that shape the attitudes and ideologies of political entities, or in other words – the content of general political environment. This paper responds to this need by presenting a method that distinguishes three basic levels of analysis: a conventional layer of text, a descriptive one and a presuppositional one. Analyzing the inaugural addresses given by Polish presidents the specificity of their individual dimensions is presented: the situational determinant (level one), the creation of content to boost image (on a descriptive level), and – most importantly to the political scientist – a mechanism revealing the assumptions concealed at the presuppositional level.
