Considers the term "justice" & related theoretical problems emerging in current philosophical discussions. Focus is on the work of John Rawls & his critics, eg, the liberal-communitarian debate & difficulties of discussing social justice in a political liberalism framework. At issue is the idea that the literature to emerge from these debates, while devoted to important ruminations, seems to have put off a detailed argumentation about justice. Whether this postponement is linked to changing political circumstances is addressed, & the tensions between justice & particular interest are elaborated. "Verfahren schaffen die rechtlichen Rahmenbedingungen, gesellschaftliche Konflikte beizulegen. Sie finden nicht nur im engeren juristischen Bereich Anwendung, sondern breiten sich zunehmend auch auf anderen Feldern zur Konfliktlösung aus. Die Erörterungstermine, die im Rahmen der Verwaltungsverfahren zur Genehmigung von Freisetzungen gentechnisch manipulierter Pflanzen stattgefunden haben, stellen den Hintergrund für den empirischen Teil der vorliegenden Arbeit dar. Sie sind ein Beispiel für die Übertragung des 'Verfahrenskonzepts' auf das Feld der Technikfolgenabschätzung und der Umsetzung seiner Ergebnisse. Die Verfasserin führt an diesem Beispiel vor, wieweit die Annahmen und Ergebnisse der sozialpsychologischen 'Procedural-Justice'-Forschung tragen, welche die Einschätzung von 'Verfahrensgerechtigkeit' zur wichtigsten Quelle der Legitimation erklärt. There are a lot of moral values in the practice of communities and the moral philosophies make different hierarchies among them on the one side, and there are different generalizations of morality (rules, maxims, virtues, principles etc.) which mean the fixed norms of morality on the other side. There is the well-known line of critics of MacIntyre, Michael Sandel, Michael Walzer and Charles Taylor which attacks the moral theory of John Rawls as the reduction of the morality to the justice and which tendency appeared in the most clear form in the theory of Jürgen Habermas. The study tries to show that beyond the American line of thought the critique of this reduction can be based in the genuine German line of thought which appeared in the ethics of Rudolph von Jhering and Nicolai Hartmann. In order to show the consequences of this reduction the study compares the theory of Rawls and Habermas with the ethics of Rudolph von Jhering and Nicolai Hartmann who outline in their theories a lot of moral values and as one of these values the justice is placed among them.

Reparations are often held up in transitional justice as a 'victim-centred' means of dealing with the past. Yet transitional justice has often been criticised for side-lining victims in peace negotiations or for other actors appropriating their voices for their own political ends. As a result, reparations in transitional societies can often be 'transactional', an exchange for concessions made to perpetrators, such as amnesties, or as 'blood money' for victims to forego pursuing accountability. This article explores how the political construction of reparations in transitional justice can come into conflict with more international law understandings of reparations as justice. As such this article argues that reparations in transitional justice have to be better conceptualised as in balancing competing political and legal claims, as well as engage with emerging debates on transformative justice
