Devletlerin iç hukuklarında, seçme hakkının da içerisinde bulunduğu belirli temel hak ve hürriyetler, anayasa ve ilgili kanunlar tarafından düzenlenme altına alınmış, sınırları tanımlanmış ve bireylere de etkili bir şekilde kullanım imkânı tanınmıştır. Seçme hakkının varlığı, demokratik bir seçim müessesinin bulunmasına bağlıdır. Demokratik bir seçimle iktidara gelmeyen yönetim, diktatör rejimin başlıca kaynağıdır. Seçme hakkı Türkiye'de sadece Türk vatandaşlarına tanınmıştır. Ancak seçme hakkı ile ilgili çağdaş düzenlemelerde yerleşik yabancılara yerel seçimlerde seçme hakkı tanınmasına yönelik bir eğilim söz konusudur. Seçme hakkı, Anayasalarda, bir temel hak ve özgürlük olarak düzenlenmiş ve kabul edilmiş haklardandır. Ancak seçme hakkı da toplumun bu haklar ile ilgili beklentisinin en adil yollardan sağlanması için diğer haklar gibi sınırlandırılabilmektedir. Demokrasi ile yönetilen ülkelerin olmazsa olmazı seçme hakkını kullanılmasının, kişilere külfet ve zahmet olacak şekilde yansıtılmaması ve seçme hakkının kullanılmasını teşvik eden yöntemler bulunması gerekir. Bu nedenle, ülkenin her toprağında, seçimlerin güvenli bir şekilde gerçekleşmesi sağlanmalı, seçmenler üzerlerinde etki ve baskı olmadan seçim sandıklarına gitmeleri ve tercihlerini özgür bir şekilde sandığa yansıtabilmeleri gerekmektedir. ; In the domestic law of the states, certain fundamental rights and freedoms, including the right to vote, have been regulated by the constitution and related laws, their borders have been defined and individuals have been given the opportunity to use them effectively. The existence of a right to vote depends on the existence of a democratic election institution. The government, which has not come to power with a democratic election, is the main source of the dictator regime. The right to choose is only granted to Turkish citizens in Turkey. However, there is a tendency towards the right to vote in the local elections for foreigners who are resident in the contemporary arrangements concerning the right to vote. The right to vote is one of the rights that are regulated and accepted as a fundamental right and freedom in the Constitution. However, the right to choose can be limited as other rights to ensure the society's expectation about these rights in the most fair way. The use of the right of choice for the countries which are governed by democracy should not be reflected in the way they are burdened and inconvenient, and there should be methods that encourage the use of the right to elect. Therefore, in every country of the country, elections should be ensured safely, voters should go to the ballot boxes without any influence and pressure and they should be able to freely reflect their preferences to the ballot box.

Bu çalışmada, demokrasinin işleyişinde yargının rolü ve meşruiyeti tartışılmaktadır. Demokrasinin tarihi her ne kadar iki bin beş yüz yıl öncesine dayanıyorsa da, demokrasinin neyi ifade ettiği hususu bugün dahi tartışmalıdır. Bu durum, demokrasi üzerine yapılacak çalışmaların her dönemde güncel bir ihtiyaca cevap vereceği anlamına gelmektedir. İşte günümüzdeki demokrasi tartışmalarına güncellik katan en önemli unsur, demokrasi ve yargı ilişkisi olmaktadır. Özellikle İkinci Dünya Savaşı'ndan sonra, yargının demokrasilerdeki rolü değişime uğramıştır. Bu dönemle birlikte, siyasi iktidarları sınırlama ihtiyacına cevap verebilecek en uygun çözümün, yargı yoluyla denetim olduğu fikri kabul görmeye başlamıştır. Böylece Anayasa Mahkemeleri aracılığıyla, yargıya siyasi rolün biçildiği bir döneme girilmiş olmaktadır. Demokrasi-yargı ilişkisini incelemeye değer kılan tek unsur elbette Anayasa Mahkemelerinin varlığı değildir. Yargıda yaşanan bütün sorunların bir şekilde demokratik sisteme zarar verdiği söylenebilir. Aynı şekilde, sağlıklı işleyen bir yargı düzeninin varlığı da, demokrasinin sağlıklı biçimde işlemesi için zorunlu olmaktadır. Bu durum, yargıya ilişkin kurumsal düzenlemelerin ve uygulamadan kaynaklanan sorunların incelenmesi gerekliliğini ortaya koymaktadır. Bu incelemeler ışığında, demokrasilerde yaşanan yargı kaynaklı sorunların önüne geçilmesi mümkün olabilir. Öte yandan, yargı kaynaklı sorunların gerçekten yargı kaynaklı olup-olmadığının anlaşılması için de yargının geniş biçimde incelenmesi gerekmektedir. Çünkü yargı kaynaklı olduğu düşünülen bazı sorunların aslında, siyasi iktidarlardan veya ilgili ülkedeki siyasi kültürden kaynaklanması söz konusu olmaktadır. ; This study discusses the role and legitimism of jurisdiction in democracy. Although the history of democracy dates back to as early as two thousand five hundred years ago, it is not understood fully even today. This means that studies on democracy are to respond to a current need. Thereby the most significant component that makes democracy discussions up-to-date is the relation between democracy and jurisdiction. Especially after the World War II, the role of jurisdiction in democracies has changed. With the beginning of this period, the contemplation that the most appropriate way to meet the need to limit political powers is to use jurisdiction has become popular. Therefore, an era in which jurisdiction is casted a political role via Constitutional Courts has began. The existence of Constitutional Courts is not the only factor that makes the relation between democracy-jurisdiction worthy of studying. It can be argued that all problems in jurisdiction somehow give harm to proper operation of democracy. Similarly, a robust jurisdiction entails a sound democracy. This case entails the examination of the problems resulting from institutional regulations and applications in jurisdiction. In the light of these examinations, it can be possible to prevent jurisdiction related problems in democracy. On the other hand, jurisdiction is to be examined comprehensively so as to decide whether problems are really jurisdiction related or not because it is possible that some problems which are considered to be jurisdiction related can stem from political power or the political culture in the country.

Yürürlüğe girdiği andan itibaren tartışmaların odağında yer alan 1982 Anayasasının her dönemde değiştirilmeye çalışılan otoriter yönü, 2017 Anayasa değişikliğiyle daha da derinleştirilmiştir. Türkiye'de uzun yıllar gündemden düşmeyen başkanlık rejimine geçiş tartışmalarıysa, köklü bir yönetim biçimi değişikliğini öngören 2017 Anayasa değişikliğiyle farklı bir boyuta evirilmiştir. Akademisyenler ve siyasetçilerin yönetim biçimi değişikliği konusundaki tartışmalarına bakıldığında genel hatlarıyla sorunun; federal-üniter devlet yapısı, erklerin anayasal düzlemdeki dizaynı çerçevesinde parlamenter ve başkanlık rejimlerinin avantajları ve dezavantajları yönünden araştırıldığı görülmektedir. Ancak ülkelerin kendilerine özgü siyasi parti yapısı ve parti sistemi, siyasal rejimin işleyişinde önemli bir rol oynadığı için konunun bu yönüyle de ele alınması gerekmektedir. Çalışmanın odak noktası ise, anayasal düzlemde geniş yetkiler verilen cumhurbaşkanının partisi ile ilişiğinin kesilmemesi nedeniyle anayasal pratikte bu yetkisini daha da arttırabilme ihtimalidir. Yeni anayasal sistemin 09.07.2018 tarihinde tamamıyla yürürlüğe girmesiyle de bu konu hakkında somut ipuçları elde edilebilmemiz mümkün olmuştur. Bu bağlamda hukuki ve siyasi boyutta inceleyeceğimiz, cumhurbaşkanının siyasi partisiyle ilişiği çerçevesinde yeni anayasal sistem, mukayeseli hukuktan da faydalanılarak nitelendirilmeye çalışılmıştır. ; The authoritarian aspect of the 1982 Constitution which has been tried to be changed in every period, has been at the center of the discussions since its entry into force, was further deepened with the 2017 Constitutional amendment. Transition to the presidential regime debates that is in the agenda for many years in Turkey, has evolved into a different dimension with the 2017 Constitutional amendment, which foresees a radical change in management style. Considering the discussions of academics and politicians on the change of management style, in general lines the issue seems to be investigated in terms of; federal-unitary state structure, advantages and disadvantages of parliamentary and presidential regimes within the framework of the constitutional design of powers. Nevertheless, since the specific political party structure and party system of countries play an important role in the functioning of the political regime, the issue should also be addressed from this aspect. The focus of study is, the possibility that the president, who is given broad powers at the constitutional level, can further increase this power in constitutional practice for not being cut off his relationship with his party. It has been possible to obtain concrete clues on this issue with the new constitutional system fully coming into force on 09.07.2018. In this context, within the framework of the president's relationship with his political party, the new constitutional system which we will examine in legal and political dimensions, will be tried to be qualified by also making use of comparative law.

Ancak ülkelerin kendilerine özgü siyasi parti yapısı ve parti sistemi, siyasal rejimin işleyişinde önemli bir rol oynadığı için konunun bu yönüyle de ele alınması gerekmektedir. Çalışmanın odak noktası ise, anayasal düzlemde geniş yetkiler verilen cumhurbaşkanının partisi ile ilişiğinin kesilmemesi nedeniyle anayasal pratikte bu yetkisini daha da arttırabilme ihtimalidir. Demokratik sistemlerin vazgeçilmez ve hayati unsuru olan siyasi partiler, temsili demokrasinin yerine getirilmesinin yanı sıra, çağdaş demokrasinin temel niteliği olan "çoğulculuk" ilkesinin hayata geçirilmesinde de önemli rol üstlenmiştir. Türkiye'de Anayasa ve kanunlarda birtakım yasaklarla sınırlandırılan siyasi partiler, söz konusu sınırların ihlali nedeniyle kapatma davaları ile karşı karşıya kalmış ve bu davaların sonucunda ilgili partilere pek çok kez kapatma yaptırımı uygulanmıştır. Hukukumuzda siyasi parti kapatma nedenlerine Anayasamızda açıkça yer verilmiştir. Bunlardan "Devletin ülkesi ve milletiyle bölünmez bütünlüğü" ilkesi nedeniyle verilen siyasi parti kapatma kararlarında Anayasa Mahkemesinin anılan ilkeyi çok katı uyguladığına ilişkin çeşitli eleştireler bulunmaktadır. Avrupa İnsan Hakları Mahkemesi de Anayasa Mahkemesi tarafından verilen kapatma kararlarıyla ilgili olarak çeşitli ihlal kararları vermiştir. Anayasa Mahkemesi kararlarında bir taraftan bölümez bütünlük ilkesinin korunmasına özen gösterirken, diğer taraftan da demokratik ilkelerin hayata geçirilmesini de gözetmelidir. Bu kapsamda ifade hürriyeti ve örgütlenme özgürlüğü hem 1982 Anayasası hem de Avrupa İnsan Hakları Sözleşmesi kapsamında korunan en önemli temel haklardın ikisidir. ; Political parties, which are indispensable and vital elements of democratic systems, have played an important role in the implementation of the principle of "pluralism", which is the basic feature of contemporary democracy, as well as the fulfillment of representative democracy. The limited number of political parties prohibited in the Constitution and law in Turkey, said that faced with due to the border closure cases of violations and closure many times the parties concerned as a result of this case was applied. The reasons for closing political parties in our law are clearly stated in our Constitution. There are various criticisms that the Constitutional Court applied the principle very strictly in the political party closure decisions made due to the principle of "indivisible integrity of the state with its country and nation". The European Court of Human Rights has also issued several violation orders in relation to closure decisions by the Constitutional Court. In the Constitutional Court decisions, while paying attention to the protection of the principle of indivisible integrity, on the other hand, it should also consider the realization of democratic principles. In this context, freedom of expression and freedom of association are two of the most important fundamental rights protected under both the 1982 Constitution and the European Convention on Human Rights.
