Conclusions: "human security" vs. security as a limit to rights.Abstract.The concept of security entails a series of questions that relate, first and foremost, to the scope of its meaning. Some of these dilemmas derive from a mere observation: the current social, political, economic and cultural reality shows that few notions, such as security, are so present in all the fields in which human beings develop. In a certain sense, security surrounds everything and everything can be lead back to that basic and primordial human need. This was understood by thinkers of the importance of Macchiavelli, Hobbes or Locke who, among others, placed security at the origin of the modern State. All of these reasons and circumstances allow us to understand why security is today a legally relevant good, recognized from different perspectives in our constitutional texts and international treaties of particular significance, such as the European Convention on Human Rights (ECHR).Thus, on the one hand, the Spanish Constitutional Court (TC) and, on the other, the European Court of Human Rights (ECtHR) have been responsible to delimit the legal meaning of this notion, each within their respective spheres of competence. In this sense, the TC has interpreted the notion of security contained in the Spanish Constitution of 1978 (EC), giving it a triple meaning: basic principle of the legal system ("legal security"), fundamental right (Art. 17.1 EC), and "citizen security" (Arts. 104 and 149.1.29 EC). Furthermore, the ECtHR recognises that security, within the framework of the ECHR, stands out for its threefold nature: once again, fundamental right (Art. 5 ECHR); security as a clearly established boundary as regards to the exercise of certain rights enshrined in the Convention (Arts. 6, 8-11, Art. 2.3 Prot. Ad. nº 4 y Art. 1.2 Prot. Ad. nº 7 ECHR); and security as an implicit limit to the effectiveness of a certain procedural guarantee: the right to legal assistance (Art. 6.3.c ECHR). In relation to the latter case, the ECtHR (STEDH of 13 September 2016, Ibrahim and others v. the United Kingdom) has been concerned to point out that the existence of "compelling reasons" related to the need to protect national security, would justify the temporary suspension of the right to legal assistance, notwithstanding the letter of Art. 6 ECHR does not protect this interpretation.The study focuses on these aspects and concludes with some considerations on the inability (or unwillingness) of the TC and the ECtHR to adopt the notion of "human security" as an interpretative paradigm in the practice of defending human rights, and on the dangers involved in rewarding utilitarian logics in the development of that same practice. ; El concepto de seguridad entraña una serie de interrogantes que guardan relación, en primer lugar, con el alcance de su propio significado. Algunos de esos dilemas derivan de una mera constatación: la realidad social, política, económica y cultural actual demuestra que pocas nociones, como la de seguridad, resultan ser tan presentes en todos los ámbitos en los que se desarrolla el ser humano. En un cierto sentido, la seguridad lo abarca todo y todo puede ser reconducido a esa necesidad humana, básica y primordial. Así lo entendieron pensadores de la importancia de Macchiavelli, Hobbes o Locke que, entre otros, colocaron la seguridad al origen del Estado moderno. Todas esas razones y circunstancias nos permiten entender por qué la seguridad constituye hoy un bien jurídicamente relevante, reconocido, desde perspectivas distintas, en nuestros textos constitucionales y en tratados internacionales de particular trascendencia, como el Convenio Europeo de Derechos Humanos (CEDH).Así, por una parte el Tribunal Constitucional español (TC) y por otra el Tribunal Europeo de Derechos Humanos (TEDH) se han preocupado de delimitar el significado jurídico de esa noción, cada uno desde sus respectivos ámbitos de competencia. En este sentido, el TC ha interpretado la noción de seguridad contenida en la Constitución española de 1978 (CE), otorgándole un triple significado: el de principio básico del ordenamiento jurídico ("seguridad jurídica"), el de derecho fundamental (Art. 17.1 CE), y el de "seguridad ciudadana" (Arts. 104 y 149.1.29 CE). Asimismo, el TEDH reconoce que la seguridad, en el marco del CEDH, destaca por su naturaleza triple: nuevamente la de derecho fundamental (Art. 5 CEDH); la de límite claramente establecido en lo que atañe al ejercicio de determinados derechos consagrados en el Convenio (Arts. 6, 8-11, Art. 2.3 Prot. Ad. nº 4 y Art. 1.2 Prot. Ad. nº 7 CEDH) y la de límite implícito a la eficacia de una determinada garantía de naturaleza procesal: el derecho a la asistencia letrada (Art. 6.3.c CEDH). En relación a este último caso, el TEDH (STEDH de 13 de septiembre de 2016, asunto Ibrahim and others vs. the United Kingdom) se ha preocupado de señalar que la existencia de "causas imperativas" ("compelling reasons" en el texto de la sentencia) relacionadas con la necesidad de proteger la seguridad nacional, justificarían la suspensión temporal del derecho a la asistencia letrada, no obstante la letra del Art. 6 CEDH no ampare dicha interpretación.El estudio se articula en torno a estos aspectos y concluye con algunas reflexiones sobre la incapacidad (o la falta de voluntad) del TC y del TEDH de adoptar la noción de "seguridad humana" como criterio interpretativo en la labor de defensa de los derechos humanos, y sobre los peligros que entraña premiar lógicas utilitaristas en el desarrollo de esa misma labor.

This paper tries to highlight how, in spite of the importance of the principles of law, due to the functions they satisfy, they seem to have lost prominence for the legislature and for the judiciary, as well as for universities. Is detrimental to justice, a value that should serve as a guide and to which the law must aspire. Beside the exposure and analysis of the problem, possible solutions are proposed. ; El presente trabajo trata de poner de relieve cómo pese a la importancia que poseen los principios generales del Derecho, por las funciones que cumplen, parecen haber perdido protagonismo tanto para el poder legislativo como para el poder judicial, así como para las Universidades, lo que redunda en perjuicio de la justicia, valor que debe servir de guía y al que ha de aspirar el Derecho. Junto a la exposición y análisis del problema, se proponen posibles soluciones.

El presente trabajo plantea la necesidad de abordar la recepción del pensamiento clásico grecolatino por parte de Thomas Jefferson desde un punto de vista iusfilosófico, con la intención de determinar en qué medida corrientes como el estoicismo o la filosofía helenística ejercieron una influencia sobre el pensador virginiano en el desarrollo de principios que acabarían por plasmarse en la experiencia constitucional estadounidense y si verdaderamente tal influjo trascendió un mero rol formativo o, incluso, estilístico y formal, como habitualmente se ha defendido en la literatura científica. ; This article formulates the need to approach the reception of Greek and Roman thought by Thomas Jefferson from the perspective of legal philosophy, in order to determine the extent of the influence exercised by schools of thought like Stoicism or Epicureanism, in concepts like Jefferson's understanding of Natural law. Therefore, it is necessary to clarify if Classical political thought actually transcended a mere formative role or, even, the use as a purely stylistic and formal element, as it has been sometimes defended in the scientific literature.

The circulation of Jacques Derrida's thinking is part of the institutionalisation of literary theory in the context of democratic recovery in Argentina. Josefina Ludmer's seminar "Some problems of literary theory" works on post-structuralism and particularly with Derrida's texts. From the starting point of Class 1985, we will analyse the little exploration of passages between philosopher theory and the book The genus gauchesco. A treaty on the homeland. In that volume, the passages relating to deconstruction and its perspective on literature are profused because they establish a series of continuities with Classes, which makes it possible to confirm the continuity of the reading of Jacques Derrida's work, from which it reproduces its views on literature in its connection with the law and with the limit, the problem of reference and the question of the indecisiveness of the meaning. La terminología minoría ha sido objeto de controversias a lo largo de varias décadas y su significado es algo que trasciende la jerarquía jurídica. Así, la construcción conceptual de minorías ha de considerar un enfoque filosófico, jurídico, social y político. Se pretende aclarar que, según la época y el lugar, entre otros criterios, el significado de minoría puede contemplar o excluir grupos de individuos. Para ello, se utilizó investigación de naturaleza cualitativa, del tipo documental y bibliográfico interdisciplinario en las doctrinas brasileña e internacional. Se demostró que la minoría es concepto dinámico, ya que las minorías se redefinen con el paso del tiempo. De esta manera, el concepto de minorías debería ampliarse para evitar la exclusión de grupos. ; The term minority has been the subject of controversy for several decades and its meaning is something that transcends the law. Thus, the conceptual construction of minorities must consider a philosophical, legal, social and political approach. It is intended to clarify that, according to time and place, among other criteria, the meaning of minority may contemplate or exclude groups of individuals. The study discusses the role of the philosophy of law in the process of unifying legal systems through the prism of the principles of the Draft Common Framework of Reference in Europe. The application of the philosophy of law in unification processes is also a necessary condition for the implementation of these processes about human rights and the sovereign interests of the State, which implements the unification of the legal order. Hence, the issue of European integration determines the strategic direction of the state, and this leads to the unification of law. The study aims to identify the role of the philosophy of law in the processes of unifying the legal systems of the European Union and its importance in the use of principles in these processes, justifying the need to use the philosophy of law in any process of transformation. It is concluded that the philosophy of law is a bridge harmonized with the legal sphere of operation of both individual states and supranational associations.

The multiplicity of legislative powers established by the end of the last century (with international and european law) reached its highest level of complexity with the massifica­tion of the internet and the emergence of a new and neces­sary self-regulatory framework, probably something similar to a new «legislator» or «legislative power» consisting of the giants of the network. Does this mean that the existence of this new branch of law is, above all, the disappearance of physical space, colliding directly with the traditional principle of territoriality that characterized law as we have known it. Regarding the infinity of questions and issues, some legal and others which are very interesting indeed, have caused the arise of considerable concern. The main point is, first of all, to be aware of this new situation of «extraterritoriality», and thereafter meet the new legal or law effects of these new relationships. The debate on the need for international cyberlaw, or the immediate response to the new situations or amere confidence in this «self-regulated» system to some extent. It is an issue that can simply be raised and left open, although there is clearly a more judicious answer which can only a result of a clever combination of all solutions. In fact this area is not going to be covered in just one project, so we have focused on the relationships of private law –extra­contractual and contractual–, and the impact of the problems related to intellectual property and criminal law. We try to prove that «ICT Law» is not a new area of law, but rather a new scenario where relations and legal effects are produced. ; La multiplicidad de poderes legislativos consolidada a finales del siglo pasado (con el derecho internacional y el europeo) alcanza su mayor grado de complejidad con la masificación de internet y el surgimiento de un probablemente necesario nuevo marco de autorregulación, algo similar a un nuevo «legislador» o poder legislativo, constituido por los gigantes de la red. La existencia de esta nueva rama del derecho (¿lo es?), pero por encima de todo la desaparición del espacio físico, choca directamente con el clásico principio de territorialidad que caracterizaba al derecho tal y como lo hemos conocido. Al respecto surgen infinidad de preguntas y cuestiones, algunas jurídicamente muy interesantes y otras que ciertamente nos causan bastante preocupación. Lo principal es, ante todo, ser conscientes de esta nueva situación de «extraterritorialidad», y, a partir de ahí, resolver las nuevas relaciones jurídicas o con efectos de derecho que se produzcan. El debate sobre la necesidad de una international ciberlaw, o de la respuesta inmediata de cada Estado ante cada situación, o la mera confianza en este sistema hasta cierto punto «autorregulado», es una cuestión que podemos simplemente plantear y dejar abierta, si bien parece claro que la respuesta más atinada solo puede venir por una inteligente combinación de todas las soluciones. En realidad esta materia es inabordable en un solo estudio, por lo que en el presente nos hemos centrado en las relaciones de derecho privado –contractuales y extracontractuales– y el impacto de la problemática en relación con la propiedad intelectual y en el derecho penal. Trataremos de demostrar que el «derecho TIC» no es una nueva rama del derecho, sino más bien un nuevo escenario donde se producen relaciones y efectos jurídicos.

This paper analyses the definition that the Act on Suppression of Unfair Competition adopted by Legislative Decree 1044 makes of its own objective scope. The positive concept of "act of competition", that is the centerpiece of such a definition, is examined first, to then focus on the concepts excluded from it, either explicitly or implicitly, in line with both national and comparative legislation and case law. Particular attention is given to the exclusions from the concept of "act of competition" grouped in the literature under the name of "forbidden competition". ; El trabajo analiza la delimitación que hace la Ley de Represión de la Competencia Desleal aprobada por Decreto Legislativo 1044 de su propio ámbito de aplicación objetivo.Se examina, en primer lugar, el concepto positivo de "acto de concurrencia" que constituye el eje de dicha delimitación, para, a continuación, centrar la atención en los conceptos excluidos de ella, tanto explícita como implícitamente, al hilo tanto de los textos legales como de la jurisprudencia nacionales y comparados. Se presta particular atención al conjunto de exclusiones de la noción de "acto de concurrencia" agrupados por la doctrina bajo el nombre de "competencia prohibida".
