Sustainable development requires reconciling the requirements of agricultural land protection with increased investment needs in industry and housing, but also with respect for environmental protection requirements. These objectives should also be pursued in relation to agricultural land within the administrative boundaries of cities. However, with regard to agricultural land in cities, there is a clear conflict between the needs of investors and the resulting pressure to invest and the protection of agricultural land. The analysis of such determined research topic required a territorial approach to the protection of agricultural land, which is reflected in spatial planning. The purpose of this study is to analyze the Polish legislation from the point of view of the admissibility of change to agricultural land use in urban areas. ; Zrównoważony rozwój wymaga pogodzenia wymogów ochrony gruntu rolnego ze zwiększonymi potrzebami inwestycyjnymi w przemyśle i budownictwie mieszkaniowym, a także z poszanowaniem wymogów ochrony środowiska. Cele te powinny być realizowane również w odniesieniu do gruntów rolnych położonych w granicach administracyjnych miast. W odniesieniu do gruntów rolnych w miastach dochodzi jednak do jaskrawego konfliktu pomiędzy potrzebami inwestorów i wynikającą z tego presją na realizację inwestycji oraz ochroną gruntów rolnych. Analiza tak zakreślonego tematu badawczego wymagała podejścia terytorialnego do ochrony użytkowej gruntów rolnych, co znajduje swój wyraz w planowaniu przestrzennym. Celem niniejszego opracowania jest analiza polskiego ustawodawstwa pod kątem dopuszczalności zmiany przeznaczenia gruntów rolnych na obszarach miast.

Regulations of the Act on Protection of Agricultural and Forest Land are treated as a limitation of the right of ownership of the real estate. Unlike civil law regulations, in this Act the legislator defines agricultural land as the subject of obligations specified in the Act, treating them in separation from the issue of ownership relationships. Unlike in civil law regulations, apart from the owner, a number of obligations associated with the protection of agricultural land is also imposed on other entities, which make economic use of the real estate property. According to the Act, the owner of real estate property has a number of obligations, such as prohibition to use land for non-agricultural purposes without having obtained a decision to designate the land for non-agricultural purposes and consent for exclusion of land from production. The owner also has other positive duties, such as the duty to prevent land degradation and devastation. These obligations, however, do not shape the subjective right of ownership, but are external to it, although they should be treated as a limitation to this right. ; Uregulowania ustawy o ochronie gruntów rolnych i leśnych są traktowane jako ograniczenia prawa własności nieruchomości. Odmiennie niż w regulacji cywilnoprawnej prawodawca przedmiotem obowiązków określonych w tej ustawie czyni grunty rolne, których ujęcie abstrahuje od problematyki stosunków własnościowych. W przeciwieństwie do przepisów prawa cywilnego, oprócz właściciela, szereg obowiązków związanych z ochroną gruntów rolnych został nałożony także na inne podmioty, które wykorzystują nieruchomości w sposób ekonomiczny. Właściciel nieruchomości ma zgodnie z regulacją ustawy szereg obowiązków, takich jak zakaz jej nierolniczego wykorzystania bez uprzedniego przeznaczenia terenu na cele nierolnicze oraz bez uzyskania zgody na wyłączenie gruntów z produkcji. Obciążają go również czynne obowiązki, m.in. obowiązek przeciwdziałania degradacji gruntów. Powinności te nie kształtują podmiotowego prawa własności, ale pozostają wobec niego zewnętrzne, jakkolwiek powinny być traktowane jako jego ograniczenia.

The article analyzes the impact of plant production on the protection of biosphere resources. Agriculture significantly affects the quality of resources and natural environment assets and shapes their character. The quality of environmental resources determines the size and directions of agricultural production, and agriculture changes ecosystems, shapes the landscape, affects the quality and quantity of natural resources. European integration has influenced the relationship between agriculture and the environment in many directions. EU legislation and the formulation of development strategies and economic programs contribute to the greening of agricultural land use and the protection of biosphere resources. The assessment of these activities is definitely positive due to the creation of conditions for conflict-free coexistence of the protective function and the agricultural function. ; Artykuł zawiera analizę wpływu produkcji roślinnej na ochronę zasobów biosfery. Rolnictwo w istotny sposób wpływa na jakość zasobów i walorów środowiska przyrodniczego oraz kształtuje ich charakter. Jakość zasobów środowiskowych determinuje wielkość i kierunki produkcji rolniczej, a gospodarka rolna zmienia ekosystemy, kształtuje krajobraz, wpływa na jakość i ilość zasobów naturalnych. Integracja europejska wielokierunkowo wpłynęła na relację rolnictwo – środowisko. Legislacja unijna oraz konstruowanie strategii rozwojowych i programów gospodarczych przyczyniają się do ekologizacji użytkowania gruntów rolnych i ochrony zasobów biosfery. Ocena tych działań jest zdecydowanie pozytywna ze względu na tworzenie warunków do bezkonfliktowego współistnienia funkcji ochronnej i funkcji rolniczej.

Local development policy consists of many sub-policies that allow for proper management of a commune. Tools that support the process of management and decision-making in local government units are land information systems. Their use is also possible in the development of a participatory model of a commune.The chapter presents the essence of local development policy and identifies the tools used in the process of its operation. Particular emphasis is put on the use of land information systems, which due to their use in communes may be an essential element of support for the implementation of territorial unit tasks. They are also a tool supporting the accomplishment of the concept of good governance in the activities of local authorities. The chapter presents good practices in the scope of use of land information systems in collecting data and supporting decision-making processes with the use of these tools. An important element of the participatory decision-making is the SoftGIS method identified as one of the best functioning methods in Scandinavian conditions, which is also used in Poland. In the chapter, data from the research carried out in the scope of good governance, showing the level of civic engagement in co-government, has been used.

The subject of considerations are the legal aspects of the influence of the EU climate and energy framework and trade policy on implementation of permanently sustainable forestry. Even though forestry belongs to the competences of Member States and there is no formal establishment of common forest policy in the TFEU, the new LULUCF Regulation and provisions of regulations regarding prevention of illegal timber trade prove that there is an ongoing process of subjecting forestry to the competencies of the European Union to a growing extent as well as reducing the area left to Member States. It must be stated that the platform for expansion of EU regulations on Member States' forestry in terms of land use and timber trade – acts adopted within the trade policy and climate and energy framework – is the principle of sustainable development that derives from international legislation and is also included in the Constitution of the Republic of Poland. This principle is also the foundation for development of the beginnings of common forest policy that emerges at the verge of EU policies. ; Przedmiotem rozważań są prawne aspekty wpływu unijnej polityki klimatyczno-energetycznej oraz handlowej na realizację trwale zrównoważonej gospodarki leśnej. Mimo zaliczenia gospodarki leśnej do kompetencji krajów członkowskich i braku formalnego ustanowienia wspólnej polityki leśnej w TFUE nowe rozporządzenie LULUCF oraz przepisy rozporządzeń dotyczących przeciwdziałania nielegalnemu obrotowi drewnem świadczą o postępującym procesie coraz większego podporządkowania gospodarki leśnej kompetencjom Unii Europejskiej i redukowania obszaru zostawionego krajom członkowskim. Realizując cel rozważań, stwierdzić należy, że płaszczyzną ekspansji unijnej regulacji obejmującej gospodarkę leśną krajów członkowskich w sferze zarządzania gruntami, a także obrotu drewnem, a więc aktów przyjętych w ramach polityki handlowej i klimatyczno-energetycznej, jest zasada zrównoważonego rozwoju wywodząca się z prawa międzynarodowego, uregulowana także w Konstytucji Rzeczypospolitej Polskiej. Zasada ta stanowi również podstawę do kształtowania się zalążków wspólnej polityki leśnej, wyłaniającej się na styku innych unijnych polityk.

Współczesne spojrzenie na procesy rozwoju terytorialnego coraz silniej eksponuje sprawność otoczenia instytucjonalnego dla prowadzenia działalności gospodarczej oraz organizowania życia społeczności miejskich i regionalnych. W perspektywie tej upatruje się podstaw procesów ekonomicznych zarówno w instytucjach formalnych (np. przejrzystość i efektywność prawa, sprawność działania przedsiębiorstw i organizacji sektora publicznego), jak i pozaformalnych (takich jak czynniki kulturowe, poziom zaufania społecznego, sposób zorganizowania społeczności i społeczeństw). Pozwala to dostrzec, że w warunkach rosnącej mobilności kapitału, ludności, towarów i informacji pewne czynniki odpowiedzialne za rozwój gospodarczy wciąż pozostają "zlokalizowane", choć ich charakter bywa trudno uchwytny. Zjawisko terytorialnego zróżnicowania instytucjonalnych czynników rozwoju społeczno-gospodarczego skłania do sięgnięcia po dorobek intelektualny ekonomii instytucjonalnej, w której podejmowane są liczne próby wyjaśniania przyczyn tych rozbieżności. Celem publikacji jest wskazanie możliwości zastosowań ekonomii instytucjonalnej – jako dynamicznie rozwijającej się gałęzi nauk ekonomicznych – w analizowaniu procesów rozwoju terytorialnego, przede wszystkim w kontekście relacji między instytucjami, bliskością i obecnym rozumieniem pojęcia "przestrzeń". ; Contemporary analyses of territorial development processes expose more and more often the impact of institutional environment on the economies, as well as on local and regional communities. This perspective takes into consideration both formal and informal institutions. It claims that such factors, as: transparency and efficiency of laws and regulations, efficient functioning of enterprises and public sector organizations, but also culture and the level of trust in the society, affect essentially the level of development, not only in national but also local and regional economies. What is more, in the conditions of growing mobility of capital, people, goods and information, certain institutional factors responsible for economic development are still localized, although their nature is sometimes elusive. This book aims at identification of the possible applications of institutional economics, in the analysis of territorial development processes, especially in the context of the relations between institutions, proximity, and the contemporary current understanding of the concept of "space". The review and classification of various strands of institutional economics in terms of their helpfulness for the study of territorial development processes, highlights the role of institutions as more and more important factor of economic development. The reasoning of this monograph allowed to conclude high usefulness of various fields of institutional economics in the study of local and regional development processes, as well as the possibility of treating them as complementary research approaches. However, one of the important conditions for use of the achievements of institutional economics in the study of the processes of territorial development is a combination of data, theoretical base, as well as research methods and researchers. As far as the local and regional development policy is concerned, this work makes it possible to form a thesis that the effectiveness of this policy depends on the awareness of the complexity of the process of institutional transformation. Furthermore, the modern territorial development is the result of the hybridization of formal and informal institutions, resulting from the search for their optimal combination of different institutional layers in various spaces. Aspirations dor independence of Catalonia are increasingly draw the attention of researchers and observers of the European political scene. Possibly division of Spain could have consequences for all of Europe and the European Union. However, visions of a possible future Catalan state, comes down generally the idea to the area of the current Autonomous Community of Catalonia. Meanwhile, both the historical and cultural roots of Catalonia and the Catalan nationalist aspirations date back much deeper. Catalan national doctrine, which is based on the cultural concept of so-called Catalan Countries, presupposes the unification of all the catalan-speaking lands. Although we should not expect to comply with this requirement in the coming decades, it is worth to consider how these doctrinal foundations influence the current policy of the regional authorities and social attitudes. What is more, Catalonia remains an interesting example of the use of the opportunities offered by cross-border cooperation in a united Europe and a contribution to the reflection on how the European Union regional policy has already led to changes in the role of different actors on the European political scene. In this article, the author will present the source of the concept of the Catalan Countries and its contemporary connotations, as well as analyze the current relationship between the regions belonging to the Països Catalans with particular emphasis on the Autonomous Community of Catalonia and the department of Pyrénées Orientales. ; Dążenia niepodległościowe Katalonii coraz silniej zwracają uwagę badaczy i obserwatorów europejskiej sceny politycznej. Ewentualny podział Hiszpanii może mieć konsekwencje dla całej Europy i Unii Europejskiej. Jednakże mówiąc o ewentualnym przyszłym państwie katalońskim, sprowadza się na ogół jego wyobrażenie do obszaru obecnej Wspólnoty Autonomicznej Katalonii. Tymczasem zarówno korzenie historyczno-kulturowe Katalonii, jak i aspiracje katalońskich nacjonalistów sięgają o wiele dalej. Katalońska doktryna narodowa, opierająca się na kulturowej koncepcji tzw. Krajów Katalońskich zakłada bowiem zjednoczenie wszystkich ziem katalońskojęzycznych. Choć nie należy spodziewać się realizacji tego postulatu w ciągu najbliższych dziesięcioleci, warto przeanalizować, w jaki sposób te podstawy doktrynalne wpływają na obecną politykę władz regionu oraz postawy społeczne. Tym bardziej, iż Katalonia pozostaje interesującym przykładem wykorzystania możliwości, jakie daje współpraca transgraniczna w zjednoczonej Europie oraz przyczynkiem do refleksji na temat tego, w jaki sposób polityka regionalna Unii Europejskiej już doprowadziła do zmiany ról poszczególnych aktorów na europejskiej scenie politycznej. W niniejszym artykule autorka przedstawi źródła koncepcji Krajów Katalońskich oraz jej współczesne konotacje, a także przeanalizuje obecne powiązania pomiędzy regionami, wchodzącymi w skład Països Catalans ze szczególnym uwzględnieniem Wspólnoty Autonomicznej Katalonii oraz departamentu Pyrénées Orientales.

: The subject of Borderlands situated further away and close by is presented not by accident. In the Polish historical narrative, we usually remember only about the Eastern Borderlands. Created by Henryk Sienkiewicz's "Trilog", known from the pages of Polish history, being a place of birth to Polish poets, they are inevitably memorable and integral part of Poland's national tradition. This notion is so strong that the word 'Borderlands' is associated only with the formed eastern territories of Poland. We do not use this terminology for other areas. We think only of the eastern borderlands which were gradually lost between the 17th and 20th century. This article also mentions this fact. Nevertheless, the article presents a slightly different perspective, i.e. it tries to present the Borderlands that were distant because they were unknown or known very little, the Borderlands which did not manage to enter the Polish narratives and Polish historical memory for good. They entered Poland for a very short time and disappeared for it very quickly. Nowadays they are abroad and they are practically unknown. The distant, unknown former Polish western Borderlands was Trans-Olza (Zaolzie). The Silesian residents living there in the 19th century shaped mostly Polish national identity, i.e. at the time when the then modern European nations were establishing. Undoubtedly, this was influenced by a strong economic development of the territory of Cieszyn Silesia. On the one hand, it was a blessing, but on the other hand, it turned out to be its curse, causing the rivalry over this land between the Poles and Czechs. The conflict over this territory, where the ethnic issues played no significant role for the powers considering this matter. Moreover, it inscribed into different types of territorial conflicts that Europe experienced after the First World War. For the borders established by the victorious allied forces as part of the Versailles treaty were not entirely fair in any place, which, in turn, is an obvious matter because it is never possible to set borders that would fully satisfy all the parties of the conflict. This was also the case of the Polish-Czech conflict over Cieszyn Silesia. The rivalry did not cease with the borders being established by the allied forces in July 1920, and both countries were still interested in the population living there. The population faced assimilative activities as the so-called 'Polonized Moravians' by the Czechoslovakian Republic. On the other hand, this population became a causation for Poland when reclaiming this area in autumn 1938.
In the second part of the article presents the realities of life in Trans-Olza in the second half of the 1930s, which were witnessed by Paweł Hulka-Laskowski. He collected material for his monumental work on Trans-Olza Silesia. This work is practically unknown today, but it is an equivalent of the results of Melchior Wańkowicz's travels around East Prussia in the book Na tropach Smętka. Who has ever heard in Poland of the work by Paweł Hulka-Laskowski Śląsk za Olzą Similarly, who has the knowledge of the long-forgotten Western Borderlands? This article introduces readers to this subject matter.

Spór o granicę austriacko-węgierską przy Morskim Oko był po rozbiorowym rabunku (1772 r.) kontynuacją ciągnącego się od XVI w. konfliktu granicznego między Królestwem Polskim a Węgrami. Próby ugodowego ustalenia granicy nie przyniosły przez niemal cały XIX w. efektu. W 1879 r. majątek graniczny po stronie węgierskiej (Jaworzyna) kupił pruski książę Chrystian Hohenlohe i podjął działania w celu zajęcia spornego terytorium. Jednak gdy hrabia Władysław Zamoyski w 1889 r. kupił w Galicji dobra (Zakopane) położone z drugiej strony spornego obszaru, zdecydowanie przeciwstawił się roszczeniom pruskiego magnata. Konflikt o własność prywatną (konflikt prawa cywilnego) eskalował w postaci sąsiedzkich gwałtów i trafiał przed sądy, jednak ich orzeczenia, bez ustalenia przynależności politycznej (państwowej) spornego terytorium, nie mogły wiązać zwaśnionych stron. Wobec zagrożenia bezpieczeństwa i spokoju na granicy austriacko-węgierskiej (doszło nawet do grożenia przez żandarmów węgierskich urzędnikom sądowym Galicji bronią palną) rządy w Wiedniu i Budapeszcie doszły do porozumienia, ustalając poufnie linię podziału. Ponieważ uznano, że publiczne ujawnienie rządowego kompromisu, wiążące się z przyznaniem do wzajemnych ustępstw obu stron, zostanie wykorzystane w walce politycznej zarówno w Austrii, jak i na Węgrzech, postanowiono zrzucić odpowiedzialność za kompromis na międzynarodowy sąd polubowny. W artykule autor przedstawia rozwiązania oraz instrumenty polityczne i prawne, do których sięgnęły władze obu państw, by zapewnić taki wyrok sądu rozjemczego, który realizowałby wcześniej przyjęte międzyrządowe porozumienie, a równocześnie przenosiłby na trybunał odium za dokonane ustępstwa. ; The dispute over the Austro-Hungarian border at Morskie Oko was, after the predatory partition of Poland in 1772, a continuation of a border conflict between the Kingdom of Poland and Hungary which started in the 16th century. The attempts to amicably delineate the border did not yield any results for the majority of the 19th century. In 1879, Christian Hohenlohe, a Prussian Prince, bought a border estate situated on the Hungarian side (a village called Jaworzyna) and he subsequently took steps with a view to seize the disputed territory. However, Count Władysław Zamoyski purchased lands in Galicia (Zakopane), located on the other side of the border, in 1889 and then he firmly resisted the claims of the Prussian magnate. The conflict concerning private property (a civil law conflict) continued to escalate and resulted in violence in the area and ended up in courts afterwards. However, without determining the political (state) affiliation of the disputed territory, no decisions made by the courts could be binding for the feuding parties. In the face of danger to safety and peace at the Austro-Hungarian border (there were even threats aimed at Galician court clerks with the use of firearms by Hungarian gendarmes), the governments in Vienna and Budapest came to a covert agreement and delineated a demarcation line. It was deemed that public disclosure of the compromise as well as of the concessions made by both parties would be used in political conflicts in both countries. As a consequence, it was decided that the blame should be put on the international arbitral tribunal. The paper presents solutions as well as the legal and political instruments used by both governments in order to secure such a court decision which would implement the international agreement they had previously reached and, at the same time, it would allow to lay the blame for the concessions on the tribunal.

25 lat działalności samorządu terytorialnego w Polsce to okres w historii Polski szczególny – czas dynamicznych zmian politycznych, społecznych i gospodarczych, których samorządy w znaczącym stopniu były kreatorami. I trzeba przyznać, że to właśnie te pierwsze, najtrudniejsze przecież lata nie miały sobie równych, bo tak ogromnego entuzjazmu i zaangażowania społecznego nie udało się osiągnąć już nigdy później. Miałem szczęście uczestniczyć w budowaniu samorządu terytorialnego w Polsce niemal od początku, na wszystkich jego szczeblach.Na obejmujących swe funkcje samorządowcach spoczęła ogromna odpowiedzialność, bo kredyt zaufania, jakim ich obdarzono, związany był z ogromnymi oczekiwaniami społecznymi: 25 lat temu nie chodziło przecież tylko o możliwość przeprowadzenia wyborów samorządowych, ale o fundamentalne zmiany we wszystkich dziedzinach życia. Decentralizacja i demokratyzacja polskiego państwa nie byłyby możliwe bez samorządów. To one włączały w przemiany całe społeczeństwo, uczyły odpowiedzialności i transparentności działania.Budowa samorządu terytorialnego w Polsce była też ogromną operacją logistyczną, na niespotykana dotąd skalę ‒ 25 lat temu ponad 100 tysięcy osób z urzędników państwowych zmieniło się w samorządowych, zdobywając nowe umiejętności i kompetencje, m.in. korzystając z wcześniejszych doświadczeń innych krajów. W wyniku komunalizacji mienia gminy przejęły wtedy kilka milionów nieruchomości i ponad 1500 przedsiębiorstw.Doświadczenia legislacyjne i organizacyjne pierwszego etapu reformy pozwoliły już jednak w 1991 r. rozpocząć prace nad jej drugim etapem – tworzeniem samorządów powiatowych i wojewódzkich, co nastąpiło po ośmiu latach. Samorząd regionalny powstawał już w momencie, gdy Polska przygotowywała się na przyjęcie unijnych środków przedakcesyjnych, w których podziale samorządy regionalne miały odgrywać znaczącą rolę. To na samorządach regionalnych spoczęła odpowiedzialność za tworzenie warunków do rozwoju województwa i wzrostu jego konkurencyjności.A przed nami kolejne ogromne wyzwanie – optymalne wykorzystanie środków unijnych z okresu budżetowego 2014-2020. Nie mam żadnych wątpliwości, że zrobimy to dobrze. ; The 25 years of activity of self-government in Poland occupy a special place in Polish history. It has been a period of dynamic political, social and economic changes and self-government units have been to a large extent creators of that change. Undoubtedly, the first years, which were also the most difficult ones, played a crucial role, and never again has it been possible to achieve the same level of enthusiasm and social involvement in the process. I was lucky to participate in the building of self-governing structures in Poland from the very beginning and at all levels.There was huge responsibility placed on the shoulders of those who were appointed to the function of a local self-government officer. The credit of trust given to them was charged with enormous social expectations. The stake 25 years ago was not only the possibility of free elections; it was the fundamental changes in all aspect of life. Decentralisation and democtratisation of the Polish state would not have been possible without active engagement of self-government, which involved the entire society in the process of change, they taught responsibility and transparency.The building of self-government in Poland was a huge logistic project, on a scale not previously encountered. Over 100 thousand state clerks transformed into independent officials, learning new skills and competences, also drawing on experiences of other countries. In result of the processof passing state property to local governments, communes and municipalities (gmina) received several millions of plots of land and over acquired over 1,500 enterprises. The experiences gained in the legislative and organisational work of the first stage of the self-governance reform, enabled Poland to enter the second stage of the reform in 1989 and to commence work of the building of district (powiat) and regional (voivodship) self-government structures. That process was completed 8 years later. Self-governance at the regional level was being developed when Poland was about to receive pre-accession funds from the European Union, a lucky moment since it was self-government that was to play a vital role in their distribution. Regional self-government is also responsible for facilitating suitable and supporting conditions for regional development and competitiveness of regions.Today, we are facing another challenge which is an optimal use of the EU funds allocated to Poland from the 2014-2020 budget. I have no doubts that we shall do it well.
