The article presents a comparative analysis of the structure of the land fund of European countries. The analysis of agricultural, forestry, housing and other types (types) of land use and land ownership of European countries in comparison with Ukraine. The condition and saturation of the infrastructural objects of the investigated territories are analyzed. The researches of the specific land use in EU countries significantly increased after Ukraine had elected the European Integration vector. Equally important is the issue of the research of effective land use for different economic purposes by European land users as the main basis of their economic activity. The analysis of the land-use condition and the experience of EU countries can be used as a vector of effective and rational land-use and it can be a guide in organization of effective land policy with further integration into European space. The works of domestic and foreign scientist were devoted to actual questions of study of the modern condition and prospective use of urbanized, natural and agricultural areas – they are D.S.Dobriak, C.N.Volkova, Y.F.Dehtiarenko, SH.I.Ibatullin, O.P.Kanash, M.G.Lyhoghrud, A.G.Martyn, Y.M.Paleha, A.M.Tretiak, V.M.Drughak, A.Y.Stupen', A.Smith, J.Keynes, V.Kristaller, P.Krugman, R.Lucas and others. At the same time the prospective of intensified land-use as the main spatial of production basis was not researched enough. Comparative characteristic of land-use structures is still actual, that gives an opportunity to assess the effectiveness оцінити ефективність and prospects for further use of land potential. Setting targets consists in identification of features and comparative assessment of the land state, natural landscape systems and areas with different levels of urbanization within countries of the European Union and Ukraine . At the end of XX century the land was state owned and land plots were provided for use free of charge. However, the legislation did not abolish taxes and fees to cover the costs on the maintenance and improvement of land. The principle of free land usage, attached to a latent form of payment through the taxation system, prevented the formation of the efficient economic mechanism of the land relations regulation and was a contributing factor to inefficient land usage.The existing economic mechanism has been formed in such a way that in relation to land resources it mostly functions with negative ecological results, because of containing such economic regulators that not always limit the destruction of land.Fiscal payments, which contribute to the accumulation of financial resources, are the example of such regulators. Herewith, for the subjects of land tenure it is more profitable to pay these payments than to spend money on land protection or the implementation of ecologically safe methods of land usage. As a result, government expenditures on land protection and rational land use are insufficient, while the income from land usage increases and becomes a considerable part of national economy income.
The research paper highlights how the problem of finding instruments of financial and economic support for enterprises in the agricultural sector of economy is addressed and, above all, for business entities in crop production. Given the imperfection of the legal and regulatory framework for agri-environmental safety and economic crisis in Ukraine, there is a need for further instruments, ensuring a balanced development of agricultural land-use management. The most appropriate solution to the above problems is an approach that can provide not only financial support to producers of agricultural products, but also reduce the likelihood of adverse effects or environmental situations with negative economic consequences. The increasing degradation processes in the agricultural sector are the source of environmental threats in the crop production subsector, which require the development of an appropriate strategy for agricultural production based on the needs of all subsystems in the agricultural sector. In order to find solutions to environmental and economic contradictions, it is important to develop a business strategy which includes introducing a set of instruments for enhancing the effective functioning of ecological and economic tools and achieving a balanced level of land-use management. In this regard, risk insurance of agricultural land-use management is an important instrument. Its purpose, along with reducing the economic burden on enterprises, is to reduce the level of threats and mitigate the negative effects of land use.The Directive 2004/35/CE of the European Parliament and of the Council "On environmental liability with regard to the prevention and remedying of environmental damage" serves as an international legal basis for performing the above-mentioned tasks in Ukraine on its way to Europe. Its guiding principle is to take efforts in order to implement measures aimed at preventing negative impact from worsening of environmental safety. However, introducing insurance instrument into practice requires further research of theoretical and methodological aspects of such activities.The key component of such activities is developing a systematic list of risks accompanying economic activities in agricultural land use.
In a constantly growing population, the global problem of food security is extremely relevant and needs to be effectively regulated in the framework of international political and economic cooperation. FAO is a world leader in addressing the global food crisis, working to achieve the 2030 Sustainable Development Goals (SDGs) and addressing specific challenges. before the countries. At the same time, regional regulatory measures are becoming increasingly important, because their development implements real problems of satisfaction in a particular geographical region in terms of conditional production and consumption of food. The population of the planet has been growing steadily for the last five centuries, reaching 427 million by 1500 and 1 billion in 1820: 2 billion in 1927. The modern population explosion began in the 1950's and 1960's. In 1959, the world's population was 3 billion; in 1974 – 4 billion; in 1987 – 5 billion people, according to the Food and Agriculture Organization (FAO) by 2050 the number will increase to 9.7 billion people, the issue of food security in the world is acute, which will create a food shortage of 1 billion tons of grain and 200 million tons of livestock products. According to the FAO, food security forecasts in the world are disappointing for almost 690 million people. in the world (8.9%) are starving. It is expected that in 2030 their number will increase to 841 million people, which is almost 20% more than in 2019. More than 2 billion people in the world live in medium and complete food danger., 1.03 billion live in Asia, 675 million in Africa, 205 million in Latin America and the Caribbean, 88 million in North America and Europe and 5.9 million in Oceania. The problem of food security, especially acute, arises in developing countries, because the lack of production technologies and manual labor have low production efficiency and do not contribute to enrichment and cause low purchasing power.

Introduction. The need to provide the newly created united territorial communities with quality and timely documentation in the context of balancing the interests of the state, region and united territorial communities, it is important to assess the impact of existing regime on spatial planning of the united territorial community. In turn, this will minimize existing land conflicts and help attract investment projects, achieve strategic goals and improve the quality of life.The purpose is to generalize theoretical approaches and develop recommendations for ways to improve the efficiency of land use of united territorial communities, taking into account the established zones of restrictions in order to clearly and transparently delineate powers in the assigned territory.Research methods. The following research methods are used in the article: method of system-structural analysis (in the study of the essence and systematization of restrictions on land use around regime-forming objects); statistical and factor analysis (in the study of land fees to local budgets of Ukraine); comparative analysis (in the study of the actual state of land use of the united territorial communities in the Kherson region).Results. The current legislative support of legal forms of planning the functional use and protection of lands of united territorial communities is studied, taking into account the existing restrictions and burdens. The regime-forming objects in the use of lands of the united territorial communities are analyzed on the example of the Kherson region in order to identify opportunities to strengthen the economic potential on the ground. The expediency of modernization of the legislation regulating the activity of local self-government bodies and local state administrations, including in the field of land legislation, has been proved.Perspectives. Further research is needed to formulate specific proposals on the procedure and conditions for inclusion in the territories of united territorial communities of reserves.

From the institutional aspects of land use optimization, the priorities should be: providing the process of transformation of land ownership of economic and social orientation; determination of economic valuation of land as natural capital; improvement of the land payment system, based on its comprehensive assessment as a resource of nature, etc. From the scientific point of view, the improvement of the current system of state land management, in the context of institutional changes, should focus on the development of various forms of cooperation and partnership agreements between government, landowners and land users, introduction of regulatory mechanisms for environmentally adapted land use. Society should remain the main consolidated «owner» of territorial land resources, delegating to specific landowners their administrative and other functions within a fairly narrow, open to change, the boundaries of land law. Controversial issues were considered from the point of view of determining the purpose of the land and functional use (designation) of the territory; the notion of "territorial zone", the definition of restrictions on the land use. A comparative analysis of the concept of "territorial zone" in accordance with the land and spatial planning legislation was conducted. The list of restrictions determined by the normative-legal acts, contract or court decision is given; restrictions imposed on the use of land plots that are subject to state registration in the State Land Cadastre and planning restrictions. At the same time, an important feature of the transformation is withering away of the previous system of economic relations. To determine, if effective occured transformation of agricultural land use, is necessary to conduct environmental and economic evaluation of the transformation of agricultural land use, where ecological and economic evaluation – evaluation of changes of qualitative and quantitative characteristics of agricultural land use as a result of type of social and economic relations and forms of land ownership. In the study suggested structural and logical scheme of transformation of agricultural land use based on formed concepts and statements. Determines the prerequisites of transformation of agricultural land use, based on private ownership of land, so to the main belongs changing of the type of social and economic relations, forms of ownership of land and means of production, the poor state of the environment. As a result of transformation of agricultural land use at market conditions, occured transition from land use of state and collective farms to agricultural formations of market type, зbased on different forms of ownership In the study highlighted the stages of transformation and classification of types of transformation of agricultural land use.Based on the concept of "transformation of agricultural land use" recommended to carry out classification of it's types: by the result - effective, moderately effective and ineffective; by duration - short, medium and long-term; by the way impact of external and internal factors - evolution, revolutionary; within the meaning of preconditions – economic, social, environmental, political, military and others.Described stages of transformation of agricultural land use, namely: first - imbalance second - unstable and uncertain state; coexistence between forms; third - the establishment of stability and dominance of the new system; fourth - arising of equilibrium state; fifth - post-transformational. The result of of transformation of agricultural land use is the emergence of agricultural formations of market type based on various forms of ownership.In the article analyzes experience of transformation forms of ownership of land in countries such as: Poland, Romania, Slovakia, Czech Republic, where land privatization was carried out by restitution and immediately had the opportunity to freely dispose of land. This had a positive impact on the rapid recovery of agricultural production after the establishment of a market economy. But in Ukraine the land was equally distributed among rural population, much of which has never conducted an independent business that has affected the efficiency of agricultural production.After transformation of land relations in our state occurred redistribution of lands between the categories of landowners and land users. The main land users were newly established agricultural enterprises, farms, private farms and citizens for agricultural commodity production. The specific of transformation was the concentration of agricultural land in large agricultural enterprises, which are the main producers of agricultural products and services and in fact - legal successors of collective farms and state farms with employees.Study development of agricultural land use in Ukraine shows that, rent of lands was one of the main ways to implement the landowners of their rights to land. According to Article 77 of the "Land of Defense" of the Land Code of Ukraine, land of defense is the land granted for the deployment and ongoing activity of military units, institutions, military educational establishments, enterprises and organizations of the Armed Forces of Ukraine, other military formations established in accordance with the legislation of Ukraine [ 1]. Land of defense can only be in state ownership. Around the military and other defensive objects, if necessary, protective, security and other zones with special conditions of use are created. According to Article 2 "Legal regime of land of defense" of the Law of Ukraine "On use of land of defense" the parcels are provide to military units for accomplishment of the functions and tasks assigned to them in permanent use according requirements of the Land Code of Ukraine [2]. Features of provision the parcels of land to military units for military and other defensive objects are determined by the Cabinet of Ministers of Ukraine. This conditioned the need to carry out research on the essence of land use in Ukraine and formulate its concept.Installed that the regulation of the legal regime of most types of land of defense is absent today, and the Law of Ukraine "On use of lands of defense" doesn't respond to its name. In the subcategories of the land of the Ministry of Defense, for functional use, agricultural, forestry, nature conservation and urban land use are allocated. Unfortunately, land use is not allocated to the defense function, but part 5 of Article 20 of the Land Code of Ukraine refers precisely to the said law in terms of determining the peculiarities of the legal regime of land defense.The peculiarity of the legal regime of the land of defense is that they can be only state or communally owned (under the objects of socio-cultural, industrial and residential purposes) property (Article 2, part 2, paragraph "c", paragraph 4 of Article 84 of the Land Code of Ukraine ) [2]. The Law of Ukraine "On use of land of defense" [1] provides that land use by the relevant subjects in the title of permanent use (Article 2 (1), but also provides (Article 4) the possibility of granting such land plots for secondary use for agricultural purposes : "military units, in coordination with local executive bodies or authorities and according to they procedure determined by the Cabinet of Ministers of Ukraine, can permit natural persons and legal persons to grow crops, graze livestock and (harvested) hay on land provided to them for permanent use.Analysis of scientific works shows that the concept of land use should be considered in the natural, legal, economic, environmental, defense and security and other aspects.In sense defense and security terms, land-use of defense is a land mass, which consists of one, or several land plots separated on the ground, which are systematically used by military units and have a special regime to ensure the functioning of their properties, the storage of weaponry and military equipment.Consequently, land-use defense is a land mass, which consists of one, or several land plots isolated on the ground, which systematically use military formations and have a special regime for ensuring the functioning of their property objects, the preservation of weapons, military equipment and other military property. The essence of land use of defense is reflected in its characteristics as a physical object, economic, legal, social and environmental defense-security land-property relations in a market economy.Keywords. Land use of defense, land of defense, land and property relations. ; Досліджено сутність землекористування оборони в Україні та сформульовано його поняття. Встановлено, що регулювання правового режиму більшості різновидів земель оборони на сьогодні відсутнє, а Закон України «Про використання земель оборони» не відповідає своїй назві. У складі підкатегорій земель міністерства оборони за функціональним використанням виділяється сільськогосподарське, лісогосподарське, природоохоронне та містобудівне землекористування. На жаль, землекористування за функцією оборони не виділяється. Даний факт оцінюється особливо негативно, зважаючи на те, що частина 5 статті 20 земельного кодексу України відсилає саме до вказаного закону в частині визначення особливостей правового режиму земель оборони. Для земель оборони характерний різний режим їх використання та охорони. Констатовано, що поняття «землекористування» доцільно розглядати у спорідненості з поняттям «земельна ділянка». У Земельному кодексі України (частина 1 статті 79) під земельною ділянкою розуміється частина земної поверхні з установленими межами, певним місцем розташування, з визначеними правами щодо неї. При цьому, «право власності на земельну ділянку розповсюджується на простір, що знаходиться над та під поверхнею ділянки на висоту і на глибину, необхідні для зведення житлових, виробничих та інших будівель і споруд». Відповідно, в оборонно-безпековому відношенні землекористування оборони являє собою земельний масив, який складається з однієї або кількох земельних ділянок, відмежованих на місцевості, які систематично використовують військові формування і мають особливий режим для забезпечення функціонування їх майнових об'єктів, збереження озброєння, військової техніки та іншого військового майна. Також обґрунтовано, що особливості сутності землекористування оборони відображаються в його характеристиках як фізичного об'єкта, економічних, правових, соціальних, екологічних та оборонно-безпекових земельно-майнових відносин в умовах ринкової економіки.
