The article aims to consider the relevant aspects of such a multifaceted phenomenon as efficiency in state activities and legal systems. In modern Russia, not only the effectiveness of laws, but also the effectiveness of state activities in implementing the rule of law, gains importance. To solve the tasks posed, they used the following methods: logical (description, classification), structural-system, formal-dogmatic and comparative. As a result of the study, it has been revealed that the effectiveness of legislation and the effectiveness of activities to implement the rule of law are inextricably linked to the social component, that is, to meet public needs and interests. It is concluded that the effectiveness of Russian legislation is related not only to the achievement of the objectives set by the legislator, the fulfillment of the legislative objectives and the results obtained, but also to the fulfillment of the laws with the needs of social development and public interests. Effective implementation of the rule of law also has a prominent social component. The abstract principles of the rule of law must be full of real social content.

Questionable questions are studied on the annulment of the measure of procedural coercion applied in the form of seizure of property in the event of termination of a criminal proceeding (criminal prosecution) with voluntary compensation for damages caused by a crime. The authors propose to specify the cases in which it is possible to cancel the seizure of property, that is, in case of expiration of the period of detention imposed on the property established by the court, or refusal of extension, as well as in cases of termination of the criminal case (criminal proceedings) and the refusal of the plaintiff of the declared civil claim. Attention is also given to the issues of seizure of property to compensate for moral damage caused by a crime. Based on the results of the consideration of this issue, it is concluded that the use of a measure of procedural coercion in the form of a seizure of property is possible not only for the purpose of compensating for property damage but also to create legal guarantees. Guarantee compensation for moral damage caused by a crime, as specific additions to the current criminal procedure law in Russia are justified.

ABSTRACT This paper aims to analyze the urgency of using Big Data in the formation of laws and regulations associated with the principle of forming good legislation. The results indicated that the use of Big Data to capture the aspirations of the people in the process of forming laws and regulations is a real solution to create laws. Its application can be done at the planning, drafting, and discussion stages of each statutory regulation made. Each input will be analyzed by Big Data and then processed into a new output that is concise and easily understood by the legislators.

La comprensión de la dimensión fenomenológica contradictoria de la práctica abortiva debería persuadirnos de que, aunque esté faltando un reconocimiento pleno de un sistema moral auténtico, la propia existencia de opiniones diferentes en el cuerpo social debería empujar al legislador a evitar el máximo daño probable y, por lo tanto, a no permitir el aborto (aunque luego pudiera haber óptimas razones para no castigarlo). La ontología de las normas puede contener contradicciones verdaderas, como afirman los teóricos "voluntaristas", de los talmudistas de teyku a la escuela franciscana, hasta la concepción iusnaturalista de Peña. Por eso es fundamental distinguir si en el caso del aborto se trata de una contradicción verdadera (como resulta si nos quedamos en el nivel de la experiencia fenomenológica del agente moral medio, y, a fuer de tal, no completamente advertido) o de una contradicción falsa (y por ende de un acto que hay que evitar). Me parece útil ofrecer un argumento para sostener que. en la situación actual de las sociedades occidentales, la imposición del derecho al aborto es inicua no sólo para quien acepta una ontología en la cual el feto es una persona, sino también para quien no comparta tal tesis y acepte al menos ciertas reglas del razonamiento normativo sin opción ideológica caracterizada (un anti-cristiano es ideológicamente abortista). Para hacerlo tendré que exponer las razones para rechazar el legalismo ético, que me parece la característica dominante de la demanda (de los ciudadanos) y de la producción legislativa (parlamentaria) en la Europa actual, independientemente de que sea una doctrina normativa sostenida por algunos autores.
