Um der gestiegenen wirtschaftlichen Bedeutung des Landes gerecht zu werden, beschloss der Nationale Volkskongress der Volksrepublik China, bis 2020 ein marktwirtschaftlich orientiertes Zivilgesetzbuch zu schaffen. Erster Schritt war der Erlass der General Rules of Civil Law im März 2017, eines neuen Allgemeinen Teils für das Zivilrecht. Im Rahmen einer Tagung der Forschungsstelle für chinesisches Recht an der Universität Augsburg diskutierten chinesische und deutsche Rechtswissenschaftler im Juli 2017 Gemeinsamkeiten und Unterschiede der Rechtsordnungen sowie deren gesellschaftliche und politischen Hintergründe. Ein besonderes Augenmerk wurde auf die Teilbereiche Allgemeine Rechtsprinzipien, natürliche und juristische Personen, Recht der Willenserklärungen und das Haftungsrecht gelegt. Die Ergebnisse präsentiert der nun vorliegende Tagungsband. Er konzentriert sich auf verschiedene Teilbereiche der Reform und stellt diese aus chinesischer und bisweilen auch aus deutscher Perspektive dar. Kampagnen sind in der Volksrepublik China ein etabliertes Mittel zur Durchsetzung von politischen und rechtlichen Zielen. Seit dem Beginn der Reform- und Öffnungspolitik hat sich das Land wirtschaftlich rapide entwickelt, was ein Grund ist sowohl für die stetige Weiterentwicklung des lokalen Rechtssystems als auch für die Attraktivität Chinas für ausländische Arbeitskräfte. Dieses Buch untersucht die Rolle von Kampagnen im Kontext des chinesischen Einwanderungsrechts, das im Jahr 2012 grundlegend reformiert worden ist. Es geht dabei der Frage nach, warum die Revision des Gesetzes zur Verwaltung der Ein- und Ausreise mit der verstärkten Durchführung von Kampagnen gegen illegale Einwanderung und illegale Beschäftigung von Ausländern einherging. Zu diesem Zweck untersucht dieses Buch sowohl den inneren Aufbau der Kampagnen als auch die Einbettung des aktuellen Einwanderungsrechts in den Kontext des chinesischen Verwaltungsrechts.

Despite three decades of legal development, China has not truly made professionalism central to its reform agenda. Among many others, one noteworthy but understudied aspect is the widespread use of non-lawyers in the legal services system. ; This dissertation aims to examine the role of the state in the making of professional and non-professional mechanisms in China. In addition to a holistic evaluation of non-professional legal services, the dissertation includes empirical studies and comparative analyses of the two most important groups of non-lawyers the government-sponsored basic-level legal workers and the non-lawyer staff of non-governmental organizations. ; These perspectives reveal a number of important facts. First, the development of non-professional legal institutions mainly serves the purpose of state control. Second, non-professional groups are able to survive only by satisfying the bureaucratic interests of specific state agencies. Third, the staff of non-governmental organizations observed in this study appeared to perform more effectively than basic-level legal workers. There is a continuing struggle between the demand of a market economy for judicial efficiency, impartiality, and professional conduct on the one hand, and the resistance of the traditional ideology to judicial reform, on the other. The current discipline campaign, as a temporary movement, will undoubtedly reduce the incidence of corruption scandals and result in the punishment of violators over a short period. The tougher job, nevertheless, is to reform the current system by introducing a supervisory scheme thai will deter and deal with abuses effectively in the long run. This will improve the quality of the entire judiciary and further develop true judicial independence in China. In terms of the big picture, the upgrading of judicial performance will not be achieved in isolation, but to a large degree, depend on the progress of the rule of law in China. ; published_or_final_version

Chinese tax law affects corporations engaged in cross-border transactions with China. It may also impact the development of the international tax regime as China is increasingly engaged in international tax reform efforts, such as the G20/OECD BEPS Project. 學者研究中國上古時期政治思想,往往以漢武帝以後的儒家思想作為國家權力正當性的基礎,但是此理論的缺憾是,如果只以儒家思想作為國家意識形態的標誌,就難以解釋西漢武帝以前的國家權力正當性是如何運作的。其實早在作為中國最早期實行帝制的秦王朝,已憑著統一的法律標準與有利於專制王權實行管治的官僚機構,確立國家專制權力的基本模式。 ; 本文試圖從儒法之爭的框架跳出來,從法律思想的角度,考察先秦至秦代的法律觀念、法律與國家官僚機構的關係及法律原則與「國家意識形態」的關係等議題。為了更貼近自秦至秦知識分子的「生活世界」,本文採用回到文本本身的研究方法,找出反映儒、道、法各家思想特徵的文本及其中的思想如何互相對話與融合,並從中探討戰國中後期至秦的知識分子與國家官僚對法律與政治觀念的表達,及其中的政治關懷。 ; 本文將從法律思想與國家意識形態的角度,更緊密地考察法律觀念背後反映的政治權力意識,從先秦至秦「刑」、「法」的觀念與實踐的起源、秦國家法律標準、秦法律原則與官僚政治道德的關係三方面探討秦代國家專制權力的正當性基礎。 ; Conventional studies on Ancient Chinese political thoughts consider Confusianism as the basis for legitimising the ruling of the state. However, this theory fails at explaining the period before Han Wudi(漢武帝) officially proclaimed the supreme status of Confusianism. As early as Qin Dynasty(秦朝), the state has established a centralised authoritarian government through its standardised legal practice and complex bureaucratic system. ; Therefore, this study avoids the orthodoxy in explaining political thoughts with the struggle between Confucianism and Legalism and investigates the relationship of laws and the bureaucratic system as well as that of legal principals and state ideology in pre-Qin and Qin period. By scrutinising the contemporary thoughts through careful textual analysis, this study expounds the encountering of Confusianism, Daoism, and Legalism and also their synthesis. Public discourse on cultural identity was not possible on the island of Taiwan until martial law was lifted there in 1987. While until then culture had mainly been an arena for the suppressed political discourse, the demise of the one-party reign of the Guomindang (KMT) at the end of the 20th century signified not only the transformation from an autocratic to a democratic system but also the end of the cultural hegemony of the mainlanders on the island. The transformation process paved the way for further cultural innovation, the keywords here being education reform, language debate, establishment of new academic disciplines, historiographic reconstruction etc. It has also led to a widespread discussion of a specifically Taiwanese cultural identity which is reflected in literature, language, art, theatre and film. The international workshop "Transformation! - Innovation? Taiwan in her Cultural Dimensions", held at Ruhr University in Bochum from March 7th-9th 2001, set out to shed new light on these issues and generated an intensive discussion of potential new interdisciplinary approaches to cultural and literary research in the field of Taiwan studies

Abortion has become a common practice in modern China since the implementation of birth limitation policy in the 1950s. In recent decades, the growing prevalence of abortion among young unmarried migrant workers has aroused public concern. Socially, abortion among this group of young women is often seen as a reproductive health problem or anomalous phenomenon that needs to be managed and handled; at the individual level, abortion is singled out as a behavioural misconduct of young women, which signifies their moral failure. However, these indiscreet and injudicious perceptions fail to acknowledge the complexity and structural dynamics behind their choices.While past studies have examined abortion through perspectives including law, morality, policy and reproductive health, or analyzed its impact on macro politics and institutions at a societal level, few of them have looked into the authentic experiences of these women and examined the whole issue from the perspective of interpersonal and gender dynamics. To fill the gap of knowledge, the present study aims at comprehending this distinctive life event of women and reflecting women's agency. Through conducting intensive ethnographic observation and in-depth interviews with 20 unmarried female migrant workers aged from 17 to 28 years old with diverse background, the underlining forces behind the occurrence of abortion are revealed, such as the influence of state family planning policy, the complex changes of lifestyle under market reform,and the heavy influence of partners and families on the decisions concerning marriage and childbirth. This study also traces the process within which abortion decisions are made, from sexual contacts, contraceptive uses, abortion decision-making,to the negotiation between partners, depicting women's responses to structural constraints and how their choices are made under the influence of migration. ...
