On their return under French sovereignty in 1918, Alsace and Lorraine were governed mainly by German law. In view of the inadequacy of French legislation in the modern world and the various interests involved, it was decided not to proceed with legislative unification. The law then applicable in the new French territories is temporarily maintained in order to inspire the reform of the corresponding French law and to prepare legislative unification on the basis of this renovated right. Despite the penetration of local law into our national legislation, the legislative unity is slow to materialize. ; A leur retour sous la souveraineté française en 1918, l'Alsace et la Lorraine sont principalement régies par le droit allemand. Compte tenu de l'inadaptation de la législation française au monde moderne, et des intérêts divers en présence, il est décidé de ne pas procéder à l'unification législative. Le droit alors applicable dans les nouveaux territoires français est maintenu temporairement afin d'inspirer la réforme du droit français correspondant, et préparer l'unification législative sur la base de ce droit rénové. Malgré la pénétration du droit local dans notre législation nationale, l'unité législative tarde à se réaliser.

Décembre 2009. ; The French Tort Law derives from a codification partially obsolete and from an abundant case law. It is consequently inadapted to the the current requirements and hardly available. Due to its importance from both economic and social points of view, it may be justified to make it evolve, in order to propose to both litigant and practitioner some clear, modern and efficient rules. To this end, various reforms projects have been proposed by the legal doctrine. In this prospective context, the confrontation between the French Law and a foreign Law one may provide new pieces of reflexion. The Swiss Tort Law, recently codified, and resulting from an original reflexion on French and German legals doctrines, has experienced a Reform Project during the last two decades. Then, its analysis could be use as a basis for the proposal of a coherent Reform Project for the French Law. The preliminary purpose of the works described in this thesis is to describe and analyse the Swiss Reform Project, based on the comparative study of French and Swiss Laws. From this analysis, a reflexion is then carried out, in order to assess the relevance of using (partially or completely) or inspiring from the Swiss proposals, in a French Reform framework. Based on this study, a concrete proposal is made for a Reform Project, devoted to improve, or even modify, certain legislative norms of the French Tort Law. ; Le droit français de la responsabilité civile résulte d'une codification partiellement obsolète et d'une jurisprudence foisonnante, le rendant inadapté aux besoins actuels, et difficilement accessible. The real security interests law/secured transactions has gone through crucial changes following a series of several reforms which has affected it. If the subject matter has undoubtedly been modernized, it is obvious that the real security interests law/secured transactions is still lacking of general consistency which is linked simultaneously to the large numbers of proposal on security interests and to the insufficiency of federative rules which come to govern the whole. Actually, the problem poses the question to know if it is possible and conceivable to put forward a base of more sophisticated general rules, or even a general law, and according to what methods? The interrogation underlines the efficacy of ohada real securities law in regard to the inadequacy between the objectives of the African legislator and the means used by him to achieve them. In other words, it is admitted to question on the way of a reinforcement of the actual real securities law in sight of a greatest efficacy. In regard to the international experiences, the answer of these questioning is found, in our opinion, in a reform more ambitious of the ohada real securities law which is going to lead to the adoption of a functional approach as it was observed in States with the same juridical culture of ours. In concrete terms, it is important to give back, through this functional conception of securities interest, coherence, and simplicity, in sum, efficacy to ohada real securities law likewise to bring it closer to the population and to the socio-economic realities of ohada member States while revealing the international economic stakes. ; Le droit des sûretés réelles a fait l'objet de profondes mutations à la suite de plusieurs réformes successives qui viennent de l'affecter. At a time when constitutional reform is on the agenda, is the Constitutional Council the only institution that could not be reformed? This institution should find a new equilibrium in the appointment of its members, a greater openness in its functioning and procedure which could come from a clarification of its relationships with administrative and judiciary magistrates. Examines developments that began with the aim of the government to reform regional elections in order to allow for a more effective regional management. This was a law "relative to the election of regional council members & European Parliament representatives as much as to the public assistance of political parties." Regional ballots of 2004 were to take place under such conditions until the administration, acting under Raffarin, decided to institute a new system by making controversial use of article 49.3 of the constitution in order to have this law passed. The Constitutional Council (Conseil Constituionnel) sanctioned not the applicability of the article, but rather the procedure by which the State Council (Conseil d'Etat) was consulted. The Prime Minister then responded by presenting new, adjusted measures fit to the reply of the Council. The integrity and consequences of justifying passage of reforms based on controversial use of law are thus taken into critical consideration. 50 References. Adapted from the source document.
