Law transforms our lives in the most important way: it changes how we act and because of this it gives rise to fundamental questions. One such question concerns legal authority and individual autonomy and asks; if we are autonomous agents how do legislators, judges and officials have legitimate authority to change our actions and indirectly change how we conduct our lives? The strategy of this article is to focus on the agent, i.e. the addressee of the legal command or directive who performs the action requested by the legal official. This strategy is bottom-up, from the level of agency and practical reason to the justificatory framework of authority.Key words: Individual Autonomy; Legal authority; Compliance Phenomenon. Resumo: O Direito transforma nossas vidas do modo mais importante: ele altera como nós agimos e, por causa disso, exsurgem uma série de questões fundamentais. Uma dessas questões se relaciona à autoridade do Direito e à liberdade individual, fazendo surgir a pergunta: se nós somos dotados de autonomia como indivíduos, como os legisladores, juízes e agentes públicos possuem autoridade legítima para mudar nossas ações e indiretamente alterar o modo como conduzimos nossas vidas? O objetivos deste artigo é focar no indivíduo, isto é, no destinatário do comando legal que pratica a ação requisitada pelo agente da lei. A estratégia, dessa forma, partir de baixo para cima, do nível do agente e da razão prática até o quadro justificador de autoridade. This research describes the frames associated with the mobilization process around the debate about the reform of Brazilian Courts of Accounts (TCs) from 2000 to 2017. Through legitimacy accounts of legal and non-legal actors, three frames were identified: legal, associated with regulation, reframing, and legal compliance of TCs; normative, associated with the transition from political management to the technical competence of TCs and; responsive, associated with the social visibility of TCs. The data consisted of parliamentary speeches, public hearings, debates, news broadcasts, and interviews with representatives of specific segments such as professional corporations, media, academia, and organized civil society. The findings shed light on the procedural dimension of legitimacy in Justice organizations and highlight the emergence of professional corporations as mobilizing entities in the three spheres of segmentation; the emergence of a ceremonial tonic in aspects that promote inter-organizational behavior, and; the progressive increase in responsiveness linked to the field as a result of the entry of specific segments of society in the debate. The results deepen the political-discursive nature of institutional change. ; Esta investigación describe los marcos (frames) asociados al proceso de movilización en torno al debate sobre la reforma de los tribunales de cuentas (TC) brasileños en el período de 2000 a 2017. A través de los relatos de legitimidad de los actores legales y no legales, se identificaron tres marcos: legal, asociado a la regulación, resignificación y cumplimiento legal de los TC; normativo, asociado a la transición de la gestión política a la competencia técnica de los TC; y responsivo, asociado a la visibilidad social de los TC. Para el análisis de los datos se consideraron los discursos parlamentarios, audiencias públicas, debates, noticias y entrevistas con representantes de segmentos específicos, como corporaciones profesionales, medios de comunicación, academia y sociedad civil organizada. Las conclusiones arrojan luz sobre la dimensión procesal de la legitimidad en los tribunales y ponen de relieve: el surgimiento de las corporaciones profesionales como movilizadoras de las tres esferas de la segmentación; la aparición de un tono ceremonial en aspectos que fomentan el comportamiento interoganizacional y el aumento progresivo de la capacidad de respuesta vinculada al campo como resultado de la entrada de segmentos específicos de la sociedad en el debate. Los resultados profundizan el carácter político-discursivo del cambio institucional. ; Esta pesquisa teve como objetivo descrever os frames (enquadramentos) associados ao processo de mobilização em torno do debate sobre a reforma dos Tribunais de Contas brasileiros (TCs) no período de 2000 a 2017. Por meio de legitimacy accounts (assertivas de legitimidade) de atores legais e não legais foram identificados três frames: legal, associado à regulação, ressignificação e conformidade legal dos TCs; normativo, relacionado à transição da gestão política à competência técnica dos TCs e; responsivo, ligado à visibilidade social dos TCs. Os dados analisados consideraram discursos parlamentares, audiências públicas, debates, notícias e entrevistas com representantes de segmentos específicos como corporações profissionais, mídia, academia e sociedade civil organizada. Os achados lançam luz sobre a natureza processual da legitimidade em organizações institucionalizadas, como é o caso dos TCs, e destacam: a emergência das corporações profissionais enquanto entes mobilizadores das três esferas de segmentação; o surgimento de tônica cerimonialista em aspectos fomentadores do comportamento interoganizacional e; o aumento progressivo da responsividade ligada ao campo como decorrência do ingresso de segmentos específicos da sociedade no debate. Os resultados aprofundam a natureza político-discursiva da mudança institucional.
In the scope of urban space production, Brazilian urban policy, despite pointing out in its guidelines the struggle for the right to the city, seems indifferent to the impacts of real estate speculation on ecosystems. Given the context of the climate emergency, there is an urgent need to align urban and environmental policy for planning cities adapted to climate change. This work presents, based on spatial data from the recent deforestation of the city of João Pessoa, the legal and socioenvironmental characteristics of the urban expansion of the city and how the municipal urban and environmental policy has catalyzed processes of socioenvironmental injustice. It appears that planning and management are limited to following the trends signaled by the real estate market and that pressure ecosystems, especially in the southern portion of the municipality, and also that democratic arrangements are forged to make society's role in defending ecosystems unfeasible. ; No âmbito da produção do espaço urbano, a política urbana brasileira apesar de assinalar em suas diretrizes a luta pelo direito à cidade, parece indiferente aos impactos da especulação imobiliária sobre os ecossistemas. Dado o contexto da emergência climática, é urgente alinhar a política urbana e ambiental para o planejamento de cidades adaptadas às mudanças do clima. Este trabalho apresenta, a partir de dados espaciais do desflorestamento recente da cidade de João Pessoa, as características jurídicas e socioambientais da expansão urbana da cidade e como a política urbana e ambiental municipal têm catalisado processos de injustiça socioambiental. Constata-se que o planejamento e a gestão se limitam a acompanhar as tendências sinalizadas pelo mercado imobiliário e que pressionam os ecossistemas, principalmente na porção sul do município, e também que os arranjos democráticos são forjados para inviabilizar a atuação da sociedade na defesa dos ecossistemas.

Method: descriptive, historical and social study, from laws pertaining to nursing, allied and literatures that approached the objective proposed. The study to be prepared was subjected to the researchers of the research laboratory in the history of nursing (Laphe) nursing school Alfredo Pinto-UNIRIO, as laboratory strategy of argumentation, a Republican in the country, profession of 122 years (1890-2012). Results: several were the legal aspects that regulated the Brazilian nursing since the beginning of their professionalization in 1980 until the publication of the legislation in force. Conclusion: a change in nursing legislation is necessary in order to reduce the subjectivities and define what we do in our professional practice, because otherwise other segments in society will find gaps and each new symbolic fights will be fought. The aim of this article is to present, in chronological form, the changes in the formative requirements for the performance of teachers in the early years of elementary education, comprised in the legislation after the enactment of Law no. 9,394/1996. It becomes evident that the demand for higher education to work at this level of education is eased and relativized over time, maintaining the admissibility of the formation in the Normal School/ Teacher-training colleges. Thus, the current guidelines for teacher-formation in the early years of elementary school are similar to those present in the LDB, promulgated more than two decades ago. ; El propósito del artículo es presentar, en forma cronológica, los cambios en los requisitos de capacitación para la actuación de los profesores en los primeros años de educación básica, comprendidos en la legislación después de la promulgación de la Ley n° 9.394/1996. Se ha evidenciado que la exigencia de formación profesional superior para trabajar en este nivel de educación es ablandada y se relativizada con el tiempo, por medio del mantenimiento de la admisibilidad de la capacitación en la Escuela Normal/Magisterio. Así, las directrices actuales para la capacitación de los profesores para los primeros años de la escuela básica son similares a aquellas presentes en la LDB, promulgada hace más de dos décadas. ; O objetivo do artigo é apresentar, de forma cronológica, as alterações nas exigências formativas para a atuação nos anos iniciais do ensino fundamental contidas na legislação após a promulgação da Lei nº 9.394/1996. Evidencia-se que a exigência da formação superior para atuar nesse nível de ensino é abrandada e relativizada ao longo do tempo, com a manutenção da admissibilidade da formação no Curso Normal Médio/Magistério. Assim, as diretrizes atuais para a formação de professores para os anos iniciais do ensino fundamental são semelhantes àquelas presentes na LDB promulgada há mais de duas décadas.
Este estudo analisou se os regulamentos do manejo florestal comunitário (MFC) madeireiro em unidades de conservação (UC) federais na Amazônia brasileira interferem na autonomia das populações tradicionais em executarem suas atividades produtivas. Constatou-se que os regulamentos do MFC madeireiro em UC são constituídos por regras de dimensões territoriais, procedimentais e técnicas, que interferem na autonomia comunitária na gestão do recurso florestal, no processo de obtenção da licença do MFC e nas técnicas de execução da atividade. O não cumprimento da determinação legal de elaboração de planos de manejo florestal sustentável diferenciados para comunidades tem condicionado as populações tradicionais a exigências de licenciamento e técnicas padronizadas em detrimento do reconhecimento constitucional e legal atribuído a um grupo culturalmente diferenciado. Além disso, o licenciamento do MFC está também condicionado ao cumprimento de obrigações prévias do próprio órgão ambiental. Concluiu-se que a autonomia das populações tradicionais no MFC madeireiro em UC é condicionada desde o início, pois a forma comunitária de uso e gestão dos recursos naturais não é o elemento orientador das estruturas legais do MFC madeireiro em UC. A simplificação e a adequação à legislação de alguns instrumentos normativos poderiam aumentar o grau de autonomia comunitária no MFC madeireiro, facilitando sua multiplicação na Amazônia. Algumas mudanças prioritárias nos regulamentos foram propostas neste estudo. ; This study analyzed whether the legal framework of the timber community forest management (CFM) in federal protected areas (PA) of the Brazilian Amazon interferes in the autonomy of the traditional populations in carrying out their productive activities. It was verified that the legal framework of the CFM in PA, constituted by rules of territorial, procedural and technical dimensions, interfere in the community's autonomy in the management of the forest resource, in the process of obtaining the CFM license and in the logging techniques used. The failure to comply with the legal determination to elaborate differentiated sustainable forest management plans for communities has conditioned traditional populations to standardized requirements to the detriment of the constitutional and legal recognition attributed to a culturally distinct social group. In addition, the licensing of CFM is also conditional on the fulfillment of previous obligations of the environmental agency itself. It was concluded that the autonomy of the traditional populations in the CFM is conditioned from its beginning, since the way of use and manage the natural resources by communities is not the guiding of the legal framework of CFM. The simplification and adaptation to the legislation of some normative instruments could increase the degree of community autonomy in CFM, enhancing its multiplication in the Amazon. Some priority changes in the regulations were proposed in this study.
The article seeks to demonstrate how the modernity project sustains the process of exploiting natural resources in Brazil, contextualizing and critically analyzing the case of changes in legal framework for wood export made by IBAMA in 2020. Based on decolonial perspectives, the modernization project, that marks its beginning in the century. XV and involves multiple processes that, among other elements, are based on colonialism, is thought. Modernity and coloniality are legitimized by blatantly unconstitutional legal elements, which by political will privilege the private sector whose interests are profit through the exploitation of natural resources existing in the Legal Amazon. The research uses an inductive method and the procedure is the documentary investigation of the environmental legal framework pertinent to the case. As an extra-normative critical theoretical contribution, a bibliographic review from a decolonial perspective offers elements for the analysis of the epistemological substrates that support the government's orientations and positions. ; El artículo busca demostrar cómo el proyecto de modernidad sustenta el proceso de explotación de los recursos naturales en Brasil, contextualizando y analizando críticamente el caso de cambios en el marco normativo para las exportaciones de madera realizadas por el IBAMA en 2020. Con base en perspectivas descoloniales, se piensa en el proyecto de modernización que marca su inicio en el siglo. XV e involucra múltiplesprocesos que, entre otros elementos, se basan en el colonialismo. Many public policies seek to promote, maintain, modify or improve collective actions. The development of a country requires actions that are complex and wide in scope. This and following texts sort out: i) two general classes of problem-situations that lack collective action; and ii) kinds of mechanisms that are useful as possible solutions to such problem-situations; i.e., mechanisms for acting upon institutions (organizations; formal or legal norms; formal practices) or upon cultural elements (social customs; customary morality; customary values and beliefs) of a society. In these texts, a leitmotif is the strategic dimension, one of the dimensions of building or changing institutions and cultural elements. To this end, one takes advantage of basic games of strategy as simple models for assigning those problems into classes. This first text deals with the problem-situation of cooperation vs. defection, modeled as prisoner's dilemma games. It covers situations of disputes for exits during disasters; of party leaders that become candidates for losing elections; of groupthink in committees; of lack of interest in training employees; of bottlenecks in urban traffic; of creating new city or state governments; of bank runs to financial safety; of tragedies of commons, be they environmental or otherwise.

The article analyzes the influence of the United States of America on legal production for children in the late nineteenth and early twentieth century. The clash between socialism and capitalism, the Monroe Doctrine, Stanley Hall's developmental psychology, the dangerous child and adolescence, the child's salvation proposal, the Congresses and international events were some of the determinations that contributed to the implementation of the tutelary model based on the doctrine of the irregular situation in Latin America. To show how different factors converged to change the legal and social order, we analyzed this course in five countries: Argentina, Brazil, Chile, Mexico and Uruguay. ; El artículo realiza un análisis sobre la influencia de los Estados Unidos en la producción jurídica para el área de la infancia a finales del siglo XIX, a principios del siglo XX. This study analyzes the most relevant political and economic factors that conditioned the institutionalization trajectory of the brazilian Public Employment, Labor and Income System (SPETR). For this, the analytical focus was the financing mechanisms of the Fund of Support to the Worker. Based on a broad analysis of legal instruments and accounting for FAT's annual exercises since its implementation, it has been noted that, as current expenditures have increased in relation to revenues, especially in view of the mandatory constitutional programs (unemployment insurance and salary bonuses), such financing arrangement began to show signs of fragility, since the space to cover discretionary current expenses that make up the other operational dimensions of SPETR has been reduced. However, the main vector of depletion of FAT's financial capacity comes from economic policy decisions within the federal government that have transcended even the decision-making sphere created for this purpose, the Codefat. Decisions with the greatest impact on the system came unilaterally and without any compensation from the economic policy summit of the different governments since the mid-1990s, mainly affecting their revenue stream, particularly revenue earmarking and tax relief.
Objetivos: Analisar a Lei nº 14.034/2020, que dispõe sobre medidas emergenciais para a aviação civil brasileira em razão da pandemia da Covid-19, que foi interpretada equivocadamente e atingiu atos jurídicos perfeitos, determinando a intervenção judicial para deixar absolutamente claro que a inovação legislativa não pode alcançá-los.Metodologia: A metodologia do artigo adota a linha jurídico-dogmática que considera o direito com autossuficiência epistemológica e trabalha com os elementos internos ao ordenamento jurídico. Essa abordagem examina as noções de eficiência e eficácia das normas jurídicas e exige a extrapolação da análise do discurso normativo para além dos limites do ordenamento.Resultados: Reiterar que a Constituição Federal de 1988 reconheceu expressamente, em seu art. 5º, inciso XXXVI, a segurança jurídica como uma das garantias do cidadão. O referido dispositivo faz menção ao direito adquirido, ao ato jurídico perfeito e à coisa julgada, como cláusulas que restringem a atividade legislativa que venha a inovar o ordenamento jurídico infraconstitucional.Contribuições: O artigo ratifica a garantia do ato jurídico perfeito, considerando que a aquisição de bilhetes aéreos se faz, quase que integralmente, pelos meios digitais disponíveis. Demonstra que a pretensão dos fornecedores desses serviços, que tentaram alcançar os cancelamentos já concluídos antes mesmo da Medida Provisória 925, provoca inaceitável insegurança jurídica aos consumidores.Palavras-Chave: Sociedade da Informação; Covid 19; Lei 14.038/2020; Irretroatividade de Lei; Ato Jurídico Perfeito. ABSTRACTObjectives: To analyse Law No. 14,034/2020, which provides for emergency measures for Brazilian civil aviation due to the Covid-19 pandemic, and which was misinterpreted and affected complete legal acts, requiring judicial intervention to make it absolutely clear that the legislative innovation cannot reach such acts.Methodology: The methodology of the paper adopts a legal-dogmatic approach that contemplates the law with epistemological self-sufficiency and works with elements that are internal to the legal system. This approach examines the notions of efficiency and efficacy of legal norms and requires extrapolation of the analysis of the normative discourse beyond the limits of the legal system.Results: To reiterate that the Federal Constitution of 1988 expressly recognized, in Article 5, paragraph XXXVI, legal certainty as one of the guarantees of the citizen. That provision refers to the acquired right, the complete legal act and the res judicata, as clauses that restrict the legislative activity that may introduce changes to the infra-constitutional legal system.Contributions: The paper validates the guarantee of the complete legal act, considering that the purchase of airline tickets is made, almost entirely, by the digital means available. It demonstrates that the intention of the suppliers of these services, who tried to fulfil the cancellations that had been concluded even before Provisional Measure 925, causes unacceptable legal uncertainty for consumers.Keywords: Information Society; Covid-19; Law 14.038/2020; Non-retroactivity of the Law; Complete Legal Act.
This paper discusses two recent speeches by President Obama and the two different types of changes they introduce, identifying the decision processes they reflect. The first speech implies a move away from the continuity of the security policy adopted by the previous administration, embodied by the Authorization to Use Military Force, announcing changes of the global strategy in the fight against terrorism, a greater judicial and political control on the use of drones and asking Congress to review the legal obstacles it created to the closure of Guantanamo. The second speech appears to invert the promises of the non-interventionist stance adopted by this administration, announcing the intention to use military force to punish the government of Syria for its repeated use of chemical weapons, without a United Nations mandate. Bankruptcy law is an important economic institution because of its effects on credit and, consequently, on financial and economic development. This fact has led several countries to revise their law. This article presents an overview on the topic focusing in Brazil. Its main points are: credit in Brazil is not compatible with the country level of development; there is evidence that Brazil is among the countries where legal protection to creditors is worst; the international experience shows that changes in the bankruptcy law affects the market for credit; and the Brazilian law is extremely outdated.
