; The paper attempts to explain the objective difference between a state union and a union of states as the respective forms of federative and confederative systems of government. It tries to distinguish between the expressions status of a country and state status and to point out the necessity of distinguishing between constitutional continuity that exists when a country does not change its status and constitutional discontinuity when the state status of a country is changed. The historical and contemporary examples of unions show that no union could have aspired or can aspire to absorb the basic features of its member state(s). The key issues, dealt with from the aspect of contemporary constitutionalism and theoretical idea of a union, are the issues of constitutional discontinuity that occurs when member state(s) decide to leave the unio n, form independent state(s) and demand international recognition
A decade ago, Serbia has carried out the reform of judicial control of public administration - by establishing the new Administrative Court. The expected results, however, have not been achieved and the problems that caused the reform have not been resolved. Therefore, a decade later, a new reform is in sight. The planned changes include establishing more administrative courts and introducing a two-instance administrative dispute. The aim of this paper is to discuss these changes, but in a slightly different way. Instead of their uncritical acceptance and justification by European legal standards, they are analysed having in mind the legal nature of the administrative dispute. Successful administrative dispute reform cannot be achieved if European legal standards are blindly accepted and copied literally from classical court proceedings. Only the legal nature of the administrative dispute and the features that make it special and different from the usual court disputes can lead us to a successful implementation of the changes.
Häberle claims constitutional law is a comparative experiential science closely linked with political science with which it shares the research subject. The constitutional state has been going through a permanent process of changes; the central question is who is the prime mover of constitutional changes: constitutional/legal institutions, constitutional/lega science and political science or public opinion and political culture of citizens? By analysing the recent history of the changes of the German constitutions he suggests that all these factors contribute to constitutional changes. Nevertheless, as an expert for law and political science, who considers himself as belonging to the wider European scientific community, Häberle thinks that the decisive influences in constitutional changes stem from legal and political sciences and concludes: Sine qua (scientia) mortalium vita non regitur liberaliter. (Without science, mortals do not command their life freely). (SOI : PM: S. 186)
The author analyses the relationship among legal nationhood, social nationhood, and democracy in democratic constitutional states. After identifing the definitions of democratic constitutional state, he concludes that it is an efficient structures within which one can mvestigate the relationship among democracy, legal and social nationhood. He suggests that these three principles have their normative roots in human freedom i.e. in the freedom of participating in p0litical negotiation, in the freedom from coercion and unjust rule, in the freedom from exigency, and in the free participation in the "we" of the modern industrial, technological and information society. And finally, the author analyses the tension between the legal and social nationhood which may be fruitful only if democracy contributes to the accomplishment of major social changes that maximise human freedom. (SOI : PM: S. 91)
A democratic state's constitution ought to guarantee basic personal, political, economic, social, cultural and ecological rights and freedoms of individuals and citizens and shape an efficient system of legal and juridical protection of all the guaranteed human rights. The Republic of Croatia, since its Constitution of 22 December 1990, has undoubtedly been a democratic constitutional state. The Croatian Constitution is an example of the adoption of the constitutional option in the establishment of the constitutional regime. After seven years of its application, it is clear that there is something controversial in its content regarding the fundamental rights and freedoms of individuals and citizens as well as in their legal protection at the constitutional/legal level. Also contentious are the constitutional provisions regarding the structure of the government and local self-rule and administration. There have been many misunderstandings and dangerous constitutional/legal and constitutionallpolitical illusions regarding this matter, particularly concerning the Croatian semi-presidential system and parliamentarism. This analysis shows that semipresidential system, as a specific variant of parliamentary government, is extremely adaptable to all possible changes in both the party and the broader political setting. ; Public administration organisation and the performance of public tasks have significantly altered over the past 30 years through global political, legal and economic change. An important aspect of the administrative reforms is the widespread use of public agencies as a model of administrative organisation to perform an increasing number of specific tasks requiring high levels of expertise. This PhD thesis analyses the agencification of public administration and the specificities of the process in the field of environmental protection at the European level and in Serbia. The main focus of the research is on the legal aspects of the phenomenon, namely the regulatory functions of agencies at the European level: their interaction with other relevant bodies and actors in the regulatory process; their performance of different administrative tasks (including inspections); and their decision-making roles. The thesis examines specific aspects of the agencification process, the transformation of Serbian public administration in the context of European integration, and the influence this transformation has had on environmental governance. The goal of the research is to examine the evolution and current position of environmental agencies in the European Union's and Serbia's legal orders, to analyse the agencies' interaction with complex administrative arrangements developed at the supranational level, and to argue for enhancing their independence and (regulatory) competencies. The further goal is to contribute to legal scholarship on agencification at national and supranational levels, and especially in the field of environmental protection. The thesis consists of the introduction, three parts and the conclusion. The introduction frames and contextualises the research topic, goals and scientific relevance, and it provides a methodological framework. Part one examines the agencification process primarily at the European level but also nationally. The thesis draws attention to EU-level agency position, typology and administrative decision-making, which are highlighted as challenging issues for legal analysis.
Official development assistance (ODA) implies the movement of capital with a minimum of one quarter of grant. It was established in the second half of the previous century, with the aim of getting developed countries to set aside a part of their gross domestic product (GDP) as an aid intended for developing countries. In the European Union, development assistance implies a policy which was established at the very beginning of the integration process, but it was not until the Treaty on the European Union was signed that it obtained its legal basis. Today, the European Union is a key partner of developing countries, and together with member states it ensures more than a half of the ODA assets. The countries of the Western Balkans are categorized among the developing countries and receive aid via loans and grants from developed countries and international institutions. The European Union's support is divided into the aid intended for the countries that are in the process of accession and the aid which is meant for other, less-developed countries. The distinction between these two forms of assistance is very difficult, because the character of the support changes in the course of accession process. The scientific problem that this paper deals with pertains to identification of the intensity of the European Union Official Development Assistance and the level of development of the Western Bal-kans. The assets of the European Union's assistance to the region of the WesternBalkans are necessary, yet not sufficient for achieving a higher level of developmentand the European standards in all directions.
In this paper, the author points to the outdated textbook classification of states into three groups, according to whether they have carried out the codification of administrative procedure or not. The first group includes the states that have administrative procedures fully codified. The second group comprises the states with the so-called mixed systems, which have uncodified procedural regulations related to the administration, while the third group contains a few states that do not have administrative procedural regulations at all. The author analyzes recent changes in this highly dynamic field in order to specify general patterns, common characteristics and peculiarities of regulations of general administrative procedure in contemporary states. The paper especially points to the general acceptance of the concept of administrative act but also underscores the differences in its content in various legal systems. The author has identified and analyzed some smaller standalone trends, such as: the increasing complexity of administrative procedures along the lines of judicial procedures, and the most recent deviations from this trend; the increasing presence of administrative contracting and other forms of alternative dispute resolutions of administrative matters; and the growing insistence on the principle of citizens' participation in administrative proceedings. The goal of the analysis is to determine the degree of influence of the Global and European administrative law on the national regulations, to explore the activities of certain expert organizations bringing together a number of experts in the field of comparative administrative law, and to discuss the course of the latest regulations in this area.
Mixed government, which is commonly regarded as a distinctly medieval form of government, is relevant also to contemporary constitutional states. It is the best form of government, since the aristocratic element is a continuous source of virtue, especially of justice, and a check not only on the executive, as the monarchical element which is the seat of political power, and the legislature, as the democratic element which expresses the will of the majority, but also groups and institutions that have the might and will to impose themselves as oligarchies. Mixed government is also the form of government that is practised by most developed contemporary constitutional states: USA, UK, France, Switzerland, Germany etc. European nobility is the original aristocratic institution, by virtue of the fact that it was a system for the transfer of both virtue and general conditions of life. Three institutions that emerged in the late Middle Ages assumed structures and functions of the nobility. + The first is the clergy. When, as a result of the differentiation of feudal society ethical and intellectual virtues of the nobility could no longer maintain general conditions of life, the clergy, by virtue of their abstract knowledge that ranged from philosophy and theology to law and medicine, became a class of new experts in generalities and thereby a new aristocracy. The second modern aristocratic institution is the judiciary, which has a structure and function similar to earlier aristocracies. The task of judges is to establish the highest virtue o constitutionalism. It is justice by law, which regulates general conditions of life in the state and society. What qualifies judges for the task is expertise in the new generality. The expertise includes not only education and experience in law but also impeccable private life and demonstrated professional ethics. + The third modern aristocratic institution is the profession, whose most important instance is the legal profession. It shares its structure and function partly with the judiciary and partly with other professions. It seems that modern professions are degenerating. In the key area of data processing, due to rapid changes of technology, professions as systems of the transfer of virtue do not even seem to be possible. Professional aristocracies are replaced increasingly by oligarchies of capitalists and technocrats. (SOI : PM: S. 111)
After the economic crisis of 2008, the degree of economic and environmental impact has increased. Challenges encountered by enterprises ranges from fulfilling the legal obligations of integral prevention and pollution control to the adaptation of the environmental management system in order to successfully apply the ISO 14001 standard. Companies face problems arising from soil pollution, climate change and legislation. Companies must take into account the successful management of sustainable development and social responsibility. To date, the basic responsibility of the company is to create profits for the owners of the company. However, including "social aspects", it emphasizes the participation of other stakeholders. The subject of research in this paper focuses on realizing the situation in terms of company's readiness to fulfill legal obligations for integrated pollution prevention and the application of appropriate environmental management standards. The main objective of this paper is to indicate the opportunities that companies have in favor of effective environmental management through cost reduction and cost savings achieved through efficient waste and energy recycling initiatives. Considering the fact that waste management is inappropriate, it can cause numerous consequences for the population and the environment, work for the welfare of the public, management and employees in enterprises, academic researchers and the general public is expected. The contribution of this paper is to expand the literature in this field and to the need to implement an appropriate management concept for integrated environmental management and prevention in order to successfully manage sustainable development.
Each day we make decisions, draw conclusions or resolve problems. The environment in which we make decisions is complex and dynamic and yet it influences the whole process as much as one's knowledge, experience, etc. In these situations, the decision making analysis stands out which provides a logic base for defining possible alternatives and the choice of an optimal option from the possible solutions. The decision making analysis helps the decision maker to choose the optimal option in line with his knowledge, reasoning, beliefs and preferences. When there are several criteria the decision making is ambiguous and one needs to find the optimal or the most efficient solution. The multi-criteria decision making can be multi-purposeful. In case the alternatives are explicitly defined and quantified we are dealing with the multi-attribute decision making. The criteria values for the analyzed alternatives can be qualitative and quantitative; therefore, the qualitative ones have to be quantified. Deciding on the location is one of the key elements of logistics and of the importance of the decision making process used by the companies in order to determine where to locate the facility is a decision of crucial importance to all logistic elements and the entire business development of the company. Further on, the contemporary economic, competitive and technological conditions and the business environment comprise a dynamic category, so the currently optimal location may not be optimal in the future. Companies use qualitative and quantitative criteria while deciding on the location of the factory. When deciding on the location of the factory one conducts a detailed analysis due to the dynamic business environment. Constant changes in the environment influence business adjustments. On the contrary, the logistic facilities and their locations are static and are not subject to alteration in a short period of time and in such a way respond to the business environment changes. While making such a decision one needs to use new methodologies and contemporary tools as a decision making support in order to adequately respond to the business environment changes and secure the high quality decision making by taking into account quantitative and qualitative criteria which are important for making a decision on a choice of a location. From the very beginning, local self-governments, worldwide as well as in Serbia, had different roles in the economic development. Local self-governments usually dealt with administrative procedures with no active part in the economic development. By establishing legal grounds local self-governments started improving the business environment and providing support to the business community, but also actively attracting foreign direct investments which have proven to be the key activity of the local economic development. Identification and understanding of the industrial location decision making process within the companies has been identified as a crutial activity which the local self-governments can use in improving the business environment and recruitment of direct investments. On the basis on the prioritization of the quantitative and qualitative decision making criteria in the process of selection a location, local self-governments can improve their business environment if resources are being used optimally and in such a way they support the local economic development by assisting the business community and attracting direct investments. In this paper we established a model which, using the method for decision making in the case of optimization of the industrial location decision making, enables efficient use of the resources of local economic development. The model will enable the identification of criteria / determinant of locations that should be invested in order to promote local economic development, on the basis of a comparison of local governments and types of potential investors. Use of standard methods of multiattribute analysis gives the possibility of a subjective approach to the researcher who must determine in advance the criteria weights, while the application of the model presented in this paper avoids the subjectivity and objectifies the process of preference, a combination of criteria DEA (Data Envelopment Analysis,) and multiattribute analysis methods (AHP, ELECTRE, PROMETHEE, TOPSIS). Within the dissertation, survey conducted, analysed local governments (alternatives) in terms of fulfilling the criteria (location determinants), within which each local government alone determines the criteria weight based on survey of types of potential investors. A comparative analysis of the results of these studies, where other various methods for decision making can be also used, identified the best method, among selected that are the best known and most used, and the result of the dissertation will determine the importance of the location determinants, which will enable to policymakers in field of local economic development, investment promotion and improving business environment at all levels, through the use of the proposed model of efficient planning, the opportunity to efficiently and cost-effectively use the resources at their disposal.
; The doctoral thesis aims to explain the results of multiparty parliamentary elections in Serbia from 1990 until the first peaceful change in power in 2000 from the standpoint of information about election options available to voters. The thesis confirms a general hypothesis that the information TV programs about elections for the Parliament of Serbia during the 1990-ies prevented a free and fair competition of election rivals. Instead of offering adequate information to voters as a basis for a rational choice, TV programs systematically favored one election participant over others. The thesis identifies the main media strategies of influencing the opinion of voters on the basis of empirical analysis of television presentation of elections in the period 1990-2000. The quantitative-qualitative content analysis is applied to regular news programs and specialized electoral broadcasts produced during campaigns for elections for the Parliament of Serbia in 1990, 1992, 1993, 1997 and 2000. The analysis is focused on identifying the central strategy of the media presentation in each election cycle, the picture of social and political reality as a context for the information on activities of election participants, the main issue of the election campaign and TV images of the main election rivals. The analysis of the media picture of the elections is preceded by a review of political, legal and media context in which the elections took place. The analysis confirmed the working hypothesis that the election coverage of the state television RTS (RTB) from 1990 until 2000 mobilized the voters' support for the ruling party – Socialist Party of Serbia (SPS) or its coalition – by a systematic discrimination of its election rivals; that the specialized programs of the state television favored the interests of the ruling party SPS or its coalition in comparison to interests of other election contestants as well as the interests of election participants over the interests of voters; and that the regular Serbian television news reporting about non-election events made the messages of one election participant more easily acceptable by voters than the messages of other contestants. The way the coverage of election events was placed into a specific picture of non-election events is identified as the key long-term strategy for influencing the voters' decision, together with the media definition of the meaning of the election which was in accord with the interests of one election participant – the preferred election winner. The thesis confirmed a theoretical hypothesis that cultural studies offer a convenient theoretical and analytical basis for studying the role of the media in election communication in Serbia during the 1990's.
; The Cold War was a war without precedent in the history. No war before this prolonged cold conflict between the United States and the Soviet Union was waged that much in the realm of soft power as the Cold War. In the absence of an immediate armed conflict between the United States and the Soviet Union, the Cold War was conducted as a competition in the areas of economy, technology and science, nuclear and conventional weapons, as well as the space race. Besides the competition in the realm of hard power, the United States and the Soviet Union pursued an intensive battle in the realm of soft power. This was a conflict between the American ideology of a liberal democracy and the Soviet Marxist ideology. Each of the two attempted to persuade the citizens of the other country that its social and economic practice was an ideal one, better and more just than the other one. The source of the collapse of the Soviet Union and communism in Eastern Europe will never be fully determined. The circumstances that brought about the break-up of the Soviet Union, the fall of the Berlin Wall in 1989, and the fall down of communism in Europe cannot be summarized as an aggregation of military, political, economic and social factors that independently from each other led to the colossal changes in the world order. All of these factors, entangled together in a complex net, caused the implosion of the Soviet Union which left the United States as the winner in the Cold War. Yet, the United States was not only a military and economic victor, it resurfaced as a moral and ideological champion, as well. The Cold Was has been a theme of numerous papers but only a handful of these papers tackled the American-Soviet conflict in the realm of soft power. Thus, the objective of this research and dissertation is to shed the light, explain and construe the instruments of soft power that the United States institutionalized, put into motion and deployed in the ideological battle against Soviet Union in the Cold War. However, since its birth in the 18th century until the Cold War, the United States had not wielded its soft power strategically. Up to the Cold War, the soft power instruments were used exclusively during the times when the United States was involved in an armed conflict. Only in the Cold War, the need for intentional and thoughtful use of soft power instruments emerged. Soon after the end of the Second World War, the Soviet Union got set off to exert its influence by diffusing its Marxist ideology and communist values. In addition to spreading its ideology, the Soviet Union led a well-planned campaign against the United States and the American way of life. From 1946 to 1950, in response to the Soviet policy towards the United States, the American administration coined the policy of containment of the Soviet Union and the Soviet influence in the world. The policy of containment included both the use of the instruments of hard power and of soft power. At that time, there was a consensus in the American society on the use of political, military and economic means in fighting the Soviet Union, while the use of soft power instruments was a subject of a prolonged public discourse. Government information programs, perceived as propaganda in the United States, have always been a very important soft power instrument, and propaganda has been considered by Americans to be a dishonest activity of autocratic governments. In the period right after the Second World War, the United States implemented legislative, institutional and structural changes that allowed for permanent establishment of the soft power instruments. These foreign policy instruments made it possible for the United States government to diffuse American values, ideas and culture and to wage an ideological war against the Soviet Union and its Marxist principles. The acts adopted at that time are in place nowadays, and provide a legal framework for numerous programs and activities in the realm of soft power.
; There is a consensus in security studies that terrorism is a politically motivated violence and, therefore, it represents one of the forms of violent political struggle. What distinguishes terrorism from other forms of political violence is its primary focus on creating, maintaining and exploiting fear in order to intimidate opponents and strengthen support among allies. Fundamental deviations from theoretical and legal criteria in determination of terrorism are identified in the pratice of the Security Council. The general assessment of the Security Council's actions related to terrorism is that the Council has been following the prevailing political discourse in which, initially, states in their entirety were responsible for terrorism, and later the blame was put on "weak", "irresponsible" and "repressive" states for enabling international terrorist organizations to operate on their territories. The Security Council passed resolutions in which it classified terrorist acts according to the nature of the act but also to the nature of the perpetrator, which resulted in treating all acts of a previously designated terrorist organization as terrorist acts. The research also determined that during the adoption of certain resolutions, political expediency influenced the fact that similar behaviors do not always qualify as terrorist acts. Based on the previously derived conclusions, it could be said that the complexity of fight against terrorism is a consequence of the primacy of the political criterion in designation of an act of violence as a terrorist act, and not because of the difficulties in defining the notion of terrorism. Changes in the concept of terrorism in the Security Council Resolutions and their harmonization with the prevailing public discourse coincides with the efforts of the United States and other Western countries to reshape the international community and establish a new world order. In such circumstances, terrorism becomes an offensive political tool of hybrid warfare, with the negative connotation of terrorism being exploited in two ways. First, terrorism has become a political assessment of one's actions, regardless of the nature of the such activities. Second, terrorism has become a violent political tool which, depending on the interests of those in the position to evaluate certain behaviors, will not be labeled as terrorism in each situation, but rather as a legitimate form of political action at times. Offensive character of the decision leads to the neglect of scientific criteria in favor of political expediency in the process of terrorist act designation. Dominance of the political criterion in designation of a terrorist act influences the instrumentalisation of terrorism and its transformation into an effective means of hybrid warfare. Content of hybrid warfare is not a consequence of an unlimited variety of weapons used, nor their sophistication, but the ability of security management to apply such combinations of different, yet mutually compatible types of warfare in order to achieve a previously determined aim. These are reasons why terrorism, as a form of complex political violence, is exploited in hybrid warfare. Based on the results of the research, three models of exploitation of terrorism for the purposes of hybrid warfare are described. The First Model of exploitation is derived from the political practice of the United States to put countries on the U.S list of state sponsors of terrorism. In accordance with the political and any other influence that the United States has, this practice and its consequences are formally or informally accepted around the world. The main consequences of being placed on the List are sanctions, discredit on the international level and legitimization of measures against such states, while at the same time putting pressure on countries that are not on the List to harmonize their policies with the interests of great powers. The Second Model of exploitation of terrorism for the purpose of hybrid warfare consists of organizing, financing, equipping, training and directing surrogate forces against the governments of countries with whom compatibility of interests has not been achieved, where surrogate forces are presented in the public discourse as freedom fighters. The subject of exploitation in the Second Model is violence that meets the theoretical criteria to be designated as terrorism. However, due to its political expediency it is qualified as a fight for freedom, resistance against oppression etc. The exploitation of violence used in the second model is done with the intention of shifting political power in order to create autonomous regions or states that would be cooperative with the policy of the state that applies the Second Model or as a part of a broader strategy for managing security processes. The Third Model of exploitation of terrorism for the purposes of hybrid warfare implies organization and managing of surrogate forces that are qualified as terrorist organizations or infiltrating individuals into original and independent popular uprisings in order to take leadership positions and manage their actions in accordance with the interests of the state which apply the Third Model. The subject of exploitation in the Third Model is violence that is qualified as terrorism, with multiple goals: 1. Violence and fear that arises as a result of terrorist acts allows crisis management in the country targeted by aggression or in the region in need of political and territorial control, with or without the physical presence of the armed forces of the State applying the Third Model; 2. Creating fear of potential terrorist attacks in order to exert latent political pressure on states to be cooperative, and 3. Creating reasons for a military intervention which results in physical presence and political control of a certain state or region. Based on the previously presented research results, it may be concluded that the first step to prevent terrorist exploitation against our country should be to eliminate or reduce the potential for social conflicts driven by social contradictions. For this reason, an analysis of the normative - political and institutional framework in the relevant areas of social life was conducted. The research has determined that in the Republic of Serbia there is a good basis for engaging and integrating all resources of national power in terms of achieving national security. In addition, there is a need to harmonize the current political and institutional framework for national security with such possibilities. As a result of the research, three groups of measures have been proposed: elimination or reduction of the potential for social conflicts; establishment of an effective and integrated institutional framework for countering political violence that may arise from the aforementioned contradictions, and elimination and reduction of harmful consequences of such political violence.
