For the last 20 years, fostering greater transparency in the historically opaque extractive industries has been a governance priority in the sector. It is now time to build on the progress made and unlock greater gains from it. Achieving this requires getting serious about politics. The extractive industries (EI) are at a critical juncture, confronted with major contextual upheaval. A period of significant commodity price volatility is intersecting with the global energy transition and, more recently, the major social, political, and economic repercussions of the COVID-19 pandemic–a combination of forces creating both uncertainty and potentially major shifts in how EI are developed and governed. As EI governance practitioners grapple with these shifts, and the challenges and opportunities they bring, transparency will be an essential tool. However, practitioners need to think–and work– more politically as they develop and deploy this tool moving forward to make the most of its potential. Work on EI transparency has achieved important successes over the last two decades. For example, significant commitments to disclosure have been secured, the volume of publicly available information about critical activities has increased considerably, and norms around certain information being in the public domain have been established. There is also a growing library of use cases for this information. However, technical and political factors have–and continue to–limit the full range of benefits that can flow from data disclosures. Unlocking the potential of this critical work will require identifying and reckoning with these factors head-on. This brief is part of the Columbia Center on Sustainable Investment's PLUS Politics series, a multi-part series of briefs from CCSI that aims to encourage practitioners to apply a more systematic political lens to their work on governance in the extractive industries.

Meaningful progress on improving the governance of extractive industries requires actors who have a strong interest in bringing this progress about, "reformers", and who have the power to do so. However, reformers in government often face an uphill battle that can involve major personal, professional and political risks coming from powerful actors who have an interest in maintaining the status quo. To address these risks and help improve the prospects of reformers driving real change on the ground, CCSI has been exploring opportunities for global actors working on EI governance to play a more active role in Empowering and Incentivizing Reformers. In a new think piece, Unlocking the Power of Reformers to Achieve Better Progress on Extractives Governance, we share some key findings on the political challenges facing reformers and ideas for more actively supporting them in addressing these. This piece draws on the input of dozens of experts, including numerous past and present government officials, working on EI governance as well as on insights derived from CCSI's broader activities focused on the Politics of Extractive Industries.

The extractive industries (EI) are at a critical juncture. As EI governance practitioners grapple with these shifts, and the challenges and opportunities they bring, transparency will be an essential tool. However, practitioners need to think—and work—more politically as they develop and deploy this tool moving forward to make the most of its potential. This discussion piece is one aggregation of perspectives, ideas, and questions coming out of several years of expert consultations, meetings, and interviews undertaken as part of the Executive Session on the Politics of Extractive Industries convened by the Columbia Center on Sustainable Investment. The piece focuses on the ways in which political realities can shape the efficacy and impact of efforts to advance various goals through transparency of extractive industries (EI transparency). The authors suggest that more systematic integration of political considerations into the design and implementation of these efforts may minimize risks of "zombie transparency," and reinforce ultimate positive impacts. It should help those seeking to use EI data for specific purposes, such as to reduce corruption and enhance benefit sharing; unpack monolithic terms; account for incentives along the transparency lifecycle; and realize yet more of the potential of information disclosures. This is an introductory piece intended to catalyze and provoke critical thinking, debate, further investigation, and, ultimately, practical experimentation. It will be accompanied by a series of blog posts authored by different members of the Executive Session and other EI experts to explore some of the themes touched on below in greater detail, e.g. through country- or sector-specific lenses.

At the request of the Colombian Government and with the support of Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ), CCSI prepared a policy brief focused on linkages from the mining sector in Colombia. The brief gives an overview of existing regulatory requirements, government policies and company programs to foster economic and infrastructure linkages. Based on the findings, the brief provides suggestions for next steps if the government is to develop a more comprehensive linkage creation program.

Although a considerable Corporate Social Responsibility (CSR) knowledge base exists in Zimbabwe, there have been no comprehensive studies on CSR determinants and community CSR in Zimbabwe since 2000. This article explores the dominant narratives in CSR literature that have contributed to continuous debates in related academia, businesses, and society. Zimbabwe is resource rich, but the majority of the population is still living in abject poverty. Some have questioned whether this is indicative of a Zimbabwean resource curse. Many Zimbabweans believe that the companies benefitting from these resources should finance social programs in the country (NewsDay, 2012). This belief is a result of fiscal challenges that the government of Zimbabwe is grappling with. The article concludes by recommending pathways for sustainable CSR implantation.

When a local asset (or a right relating to such asset) is sold, a country will generally have jurisdiction to levy a capital gains tax on the sale, both under domestic law and international treaty. This is called taxation of a "direct" transfer of a local asset. However, taxation becomes increasingly complicated when a company located offshore owns the local asset. Further difficulties arise when the local asset is held by a chain of corporations located in tax havens. An "indirect" transfer occurs when the shares of the domestic subsidiary, the shares of the foreign company with a branch in the country, or the shares of the holding company are sold, instead of the asset. This guidance paper focuses on issues that developing countries' governments may wish to consider if they adopt a policy to taxation of indirect transfers on extractive industries' assets. It examines and provides the language of the legislative and regulatory provisions employed by countries that have adopted such a policy to tax, and comments on the pros and cons of these provisions. It also considers the impact of bilateral tax treaties on this issue.

This paper introduces a Special Section on the extractive industries, mineral sector reform and post-conflict reconstruction in developing countries. The collection of papers presented reflects on a wide range of post-conflict natural resource management scenarios across a variety of geographical settings in sub-Saharan Africa, Latin America and Melanesia. The contributions suggest that although natural resource wealth provides the potential for post-conflict countries to stimulate reconstruction, generate employment and achieve unprecedented economic growth, it also has the ability to de-rail post-conflict peacebuilding and development. Strategies to harness the benefits of extractive industry investment for post-conflict societies will therefore not only require attention to 'better' resource management, but also a deeper understanding of local contextual political struggles and how they are embedded within broader causal factors.

Strategic development planning has long been used by private and public sectors to guide actions that will lead to a determined goal in the medium- to long-term. The SDG framework has helped to create a common language of what development means, what the global objectives are by 2030, and how progress can be measured. With the world entering an era in which data is generated and used at an unprecedented scale, data and ICT systems should be used to better inform policy decision making and help evaluate progress to hold stakeholders accountable to their promises and performances. This report outlines how two mining projects in Chile are using planning and monitoring tools to advance development objectives beyond the mining-impacted areas. Several additional examples are showcased in the annex on how governments, companies, and civil society are using improved data accessibility and technological advances to help achieve and monitor their objectives.

Abstrak Mineral dan tambang merupakan bentuk dari bahan galian tambang yang memiliki peran penting dalam memenuhi hajad hidup orang banyak. Namun, selama ini sumber daya mineral Indonesia dieksploitasi secara besar-besaran tanpa memberikan nilai tambah bagi perekonomian. Oleh karena itu, penelitian ini bertujuan untuk mengkaji dan menganalisis pengaturan hak dan kewajiban eksportir beserta perbedaannya pada industri mineral khususnya logam. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan undang-undang, pendekatan historis dan pendekatan konseptual. Berdasarkan hasil penelitian, dapat disimpulkan bahwa perlu adanya peta persebaran mengenai kebutuhan dan potensi ketersedian mineral untuk industri hilir di Indonesia. Perlu adanya kerja sama antara Departemen Energi dan Sumber Daya Mineral dengan Departemen Perindustrian untuk menjembatani menyediakan dan permintaan pada industri hulu dan hilir pertambangan. Serta pembagian hak dan kewajiban eksportir pertambangan di dasarkan kepada pembagian yang telah ditetapkan dalam UU Minerba. Penggolongan industri bidang pertambangan berdasarkan proses produksi digunakan untuk mempermudah pengidentifikasian kegiatan apa saja yang dapat dilakukan setelah diketahui adanya cadangan mineral logam sampai pada pasar.
