Siyasal sistemler ve rejimler tartışması, Platon'dan Rawls'a kadar sürmüştür. Bu süreçte ideal devlet düzeni arayışlarında, meşruiyetini halk iradesine dayandıran demokrasi modeli tek geçerli sistem olarak modernitenin bir göstergesi şeklinde kabul edilmiştir. Siyasal iktidarın kuvvetler arasındaki dağılımı veya sınırlandırılması anayasalarda düzenlenmiştir. Demokratik ülkelerde Parlamenter Sistem, Başkanlık Sistemi ve Yarı Başkanlık Sistemi olmak üzere üç temel hükümet sistemi bulunmaktadır. Parlamentonun varlığı demokrasi için bir garanti olmadığı için demokrasi, parlamenter sistem olmaksızın da var olabileceği gibi; parlamenter sistem de demokrasi olmaksızın var olabilir. Dolayısıyla hükümet biçimi ile demokrasi veya hukuk devleti arasında doğrudan bir ilişki veya orantı bulunmamaktadır. Bu çalışmada iyimser bir perspektiften bu iddia savunulmaya çalışılmıştır. Bu çalışmanın amacı, Türkiye'de sürekli tartışılan başkanlık sisteminin gerekliliği ve uygulanabilirliğini sorgulamak ve sisteme yöneltilen bazı eleştirilerin ve çekincelerin daha iyi anlaşılmasını sağlamaktır. Bu bağlamda literatür taraması yapılarak başkanlık sisteminin avantajları ekseninde, gerek parlamenter sistemin dezavantajları gerekse başkanlık sisteminin olumlu yönleri karşılaştırmalı olarak ele alınmıştır. Çalışmada ayrıca çeşitli yazarların görüşlerine yer verilmiş ve hükümet sistemlerinin kavramsal boyutta analizi yapılarak tarihsel süreç içerisinde ülke örnekleri ile kıyaslama yapılmıştır. Çalışma üç bölümden oluşmaktadır. İlk bölümde öncelikle başkanlık sisteminin gerekliliği üzerinde durulmuştur. İkinci bölümde başkanlık sisteminin ülkemizde uygulanabilirliği detaylı olarak ele alınmıştır. Üçüncü bölümde ise sisteme karşı yöneltilen eleştiri ve çekincelere yer verilmiştir. ; Political systems and regimes discussion lasted from Plato to Rawls. In this discussion process, the democracy model which is universally the only valid regime of all systems basing its legitimacy upon the people's will has been recognized as an indication of modernity in search of the ideal state order. The distribution or limiting of the power of government among the political powers is regulated by the constitutions of the countries. In democratic countries, there are three basic systems of government including parliamentary system, presidential system and semi-presidential system. Democracy can exist without parliamentary system and parliamentary system, in contrast, can exist without democracy just because the existence of Parliament does not guarantee democracy. Therefore, there is no direct relationship or proportion between the system of government and democracy or the state of law. This paper aims to defend these claims from an optimistic perspective. The main purpose of this study is to question the necessity and applicability of the presidential system which has been continually discussed in Turkey and provide a better understanding of the criticisms of the presidential system and some reservations about it. In this context, in the framework of the advantages of the presidential system, both the disadvantages of the parliamentary system and the positive aspects of the presidential system have been examined by making a literature review as well as making a comparison with the other countries historically and systems of government. Moreover, this paper also contains about the views of the various authors by making an analysis in the conceptual dimension. This work consists of three parts: the first section primarily focuses on the necessity of the presidential system. In the second part, the applicability of the presidential system in our country is considered in detail. The criticisms of the presidential system and some reservations against it are given in the third part.
Yüksek Lisans Tezi ; Kuvvet kullanılmasını içeren orantılı karşı tedbirlere ülke dışında da başvurulabileceğine ilişkin iddiaları BM Antlaşması md. 51 temelinde meşrulaştırmaya çalışan iddialar, teoride olmasa bile uygulamada artan şekilde uluslararası toplum tarafından kabul görmektedir. Doktrinel bakış açısından, böyle bir yaklaşım, elbette BM Antlaşması md. 2/4 tarafından güvence altına alınan "bir devletin ülkesel bütünlük hakkı" ile diğer devletin md. 51'de korunan Meşru müdafaa hakkı arasında bir çatışmayı da beraberinde getirmektedir. BM Antlaşması md. 51'de düzenlenen meşru müdafaa hakkı, kuvvvet kullanma yasağının tek istisnası olarak, bir silahlı saldırıya karşı düzenlenmiştir. Md. 51'de meşru müdafaa hakkından doğal bir hak olarak söz edilmesi, BM Antlaşması'ndan hemen önce örf ve adet hukukundaki meşru müdafaa hakkının saklı tutulduğu anlamına gelmez. Bush Doktrini'nin önleyici meşru müdafaa hakkının hukuka uygunluğunu iddia ederken geleneksel "gereklilik"kriterini esnetmesidir. Bir başka ifade ile uluslararası hukukun öteden beri "vukuu muhakkak"bir silahlı saldırı tehdidine karşı önleyici meşru müdafaa hakkını tanıdığını iddia eden ve yapılması gerekenin "vukuu muhakkak tehdit" kavramını terör eylemlerine, kitle imha silahlarına güvenen haydut devletler ve teröristler gözönünde bulundurularak yeniden yorumlamak olduğunu belirten Bush Doktrini açısından sadece bir saldırı varsayımı, potansiyel bir tehdit, bir risk, "silahlı saldırı" teşkil etmektedir. BM Genel Kurulu'nun İsrail temsilcileri, Güvenlik Konseyi'nde, devamlı olarak ülkesinin yakın bir saldırı tehlikesine maruz kaldığını ve İsrail'in de önleyici meşru müdafaa hakkı'nı kullandığını iddia etmiştir. Anahtar Kelimeler: kuvvet kullanma yasağı, meşru müdafaa, saldırı suçu, İsrail, Lübnan. ; The claims trying to legitimate the claims, which are related to the fact that commensurate counter measures including using force can also be applied abroad on the basis of article 51 of United Nations Treaty, find acceptance by the society not in theory but increasingly in application. From the doctrinaire point of view, such an approach definitely brings about a conflict between the right of territorial unity of a nation which is secured by the article 2/4 of the United Nations Treaty and the right of self defense of another nation preserved in the article 51. The right of self defense arranged in the article of the United Nations Treaty has been arranged considering an armed attack as the only exception of prohibition of using force. The fact that the right of self defense is mentioned as a natural right in the article 51 does not mean that the right of self defense in the Common Law is preserved just before United Nations Treaty. It means that Bush Doctrine stretches traditional necessity criterion while it claims that the right of preventive self defense is lawful. In other words, just an assumption of an attack is seen as a potential threat, a risk, and an armed attack in terms of Bush Doctrine which claims that International Law has approved the preventive self defense against a certain armed attack threat for a long time, and emphasizes that the necessary thing to do is reinterpreting certain threat decision considering rogue states, and terrorists relying on Weapons of Mass Destruction. In the Security Council, Israel representatives of the United Nations General Assembly claim that their country is continuously exposed to a close attack and Israel has the right of preventive self defense. In the first part of this study; the right of self defense, prohibition of using force, definition and history of attack crime, prohibition of using force and the right of self defense in the documents of the United Nations ; In the second part of the study; findings about the origin of the disagreement between in 2006 Israel and Lebanon, definition, history, and the role of terror in the prohibition of using force and in the right of self defense, and evaluation of the disagreement between Israel and Lebanon in accordance with the right of self defense; In the third part of the study; the relations between Turkey and Israel, the relations of Turkey and Lebanon in the period of (AKP) Justice and Development Party, and also the attitude of Turkey towards the disagreement between Israel and Lebanon have been examined. Tacir olmanın hüküm ve sonuçlarından olan ticari işlerde faiz konusu, ticari hayatın bir gereği olarak adi işlerden farklı düzenlemeler gerektirmektedir. Bunun bir sonucu olarak 6102 sayılı Türk Ticaret Kanunu'nda ticari işlerde faiz serbestisi ilkesi benimsenmiştir. Çalışmamızda bu hususlarda gözetilerek öncelikle faizin tarihi gelişimi, faiz kavramı faiz oranları ve türleri incelenmiştir. Ardından ticari iş kavramı ele alınmış, ticari işlerde faiz serbestisi ilkesinin 6098 sayılı Türk Borçlar Kanununun faiz oranlarını sınırlayan hükümleri karşısındaki durumu, öğretideki görüşler ile uygulamaya ilişkin örnek yargı kararları ele alınıp değerlendirmelerde bulunulmuştur. Son olarak, Avrupa Birliğinin Ticari işlemlerde geç ödemelere ilişkin 2000/35 sayılı Yönerge ve bu Yönergeyi değiştiren aynı isimli 2011/7 sayılı Yönerge esas alınarak Türk Ticaret Kanununa eklenen Ticari İşletmeler Arasında Mal Ve Hizmet Tedariki Sözleşmelerinde Borçlunun Temerrüdü, Temerrüdün Şartları Ve Uygulanacak Temerrüt Faizine İlişkin 1530. maddenin 2 ila 8. maddeleri ayrıca incelenmiştir. ; The provision and the result of being a Merchant; The subject of interest in commercial jobs requires different arrangements than normal affairs as a necessity of commercial life. As a result; in 6102 numbered Turkish Commercial Code principle has been accepted. With regards to these matters, interest has been studied as the historical development of interest, concept and types of interest and the interest rates. After that, the concept of commercial affairs ,the situation of freedom of interest in commercial affairs against 6098 numbered Turkish Code of Obligations which restrict the interest rates, opinions in that discipline and examples of applications for judicial decisions are studied and evaluated. Finally, 2nd and 8th parts of the 1530th item about the deptor's default, default conditions and default interest in goods and service supply contract between corporations which were added to Turkish Commerce Law based on the European Union's 2011/7 numbered instruction which replaced 2000/35 numbered instruction about late payment in commerial affairs with the same name have been investigated separately.
Ülkemizde modern anlamda nüfus sayımının ilki 1927 yılında, sonuncusu ise 2000 yılında olmak üzere on dört genel nüfus sayımı gerçekleştirilmiştir. Sayımlar, bu konuda gerekli deneyim, fiziki alt yapı ve yetişmiş elemana sahip olan ülkemizin en köklü ve uzmanlaşmış kuramlarından birisi olan D.İ.E.(Devlet İstatistik Enstitüsü)- Türkiye İstatistik Kurumu (TÜİK) tarafından, Birleşmiş Milletler Örgütü'nün standartlarına uygun olarak gerçekleştirilmektedir. Türkiye nüfusunun ekonomik, sosyal, kültürel ve demografik konulardaki niteliklerini, ülkemizin idari bölünüşüne göre tam ve doğru olarak belirlemek amacıyla gerçekleştirilen bu sayımlar, gerek bilimsel çevreler gerekse kamuoyu tarafından çeşitli eleştiri ve tartışmalara konu olmaktadır. Bu durumu, 1997 Genel Nüfus Tespiti ve 2000 Genel Nüfus Sayımı da içermektedir. Eleştirilere konu olan daha çok ilçe merkezleri ve belediye örgütlü yerleşmelerin nüfus miktarlarının doğruluk derecesidir. Yapılan bu çalışmada, D.İ.E. (TÜİK) tarafından üretilen nüfus istatistiklerinin doğruluk derecesi, nüfus istatistiği konusunda sağlıklı ikinci kaynak olan E.T.F. (Ev Tespit Fişleri) tarafından test edilmektedir. Bu tür bir çalışmanın ülke geneline uygulanması zor olduğu için Afyonkarahisar örneği ile sınırlandırılmıştır. Elde edilen verilere göre, özellikle Belediye Örgütlü Yerleşmelerin nüfus miktarlarında anormal farklılıklar olduğu ve gerçeği yansıtmadığı tespit edilmiştir. Bunun en önemli nedeni nüfus sayımlarının spekülatif hareketlere maruz kalması başta olmak üzere, güncelliğini yitirmesi, ihtiyaçlara cevap verememesi gibi pek çok sorunu beraberinde getiren 1580 sayılı Belediye Kanunuydu. Bütün bunlardan dolayı Belediye Kanunu yeniden düzenlenerek 5393 Sayılı Belediye Kanunu yürürlüğe konmuştur. Fakat yeni belediye kurulmasındaki nüfus miktarı ve merkezi bütçeden toplam nüfus miktarına göre verilen payı düzenleyen maddeler değiştirilmelidir. Bunun yanında; sayımda görevli personelin sayım sonucunu etkilemeyecek şekilde kurallara uygun hareket etmesi ve ülke halkının nüfus sayımının amacının gerekliliği konusunda bilinçlendirilmesi sorunun çözümünü kolaylaştıracaktır. ; In our country fourteen general population censuses had been conducted as the first modern one in 1927 and the last one in 2000. Censuses have been conducted by the State Institute of Statistics of Turkey (SIS), which is one of the most fundamental and specialized institutes of our country and has necessary experience about this subject and physical infrastructure and experienced staff appropriate to the standards of United Nations. The censuses, which aim to identify the qualifications of the economic, social, cultural and demographic subjects of turkey population according to the administrative division exactly and properly, cause various criticisms and disputes by both scientific circles and public opinion. The situation includes 1997 population count and General Population Census 2000. The reason for the criticisms are mostly because of the accuracy of population amount in municipality organized settlements and administrative districts. In this study, the acccuracy of the population statistics which were produced by the (SIS) The State Instituteof Statistics have been tested by the second reliable source (House Determining Records). This sort of study is difficult to be carried out througout the country so that it had been limited with the case of Afyonkarahisar. According to data we got it had been understood that there are abnormal differences and they do not indicate the reality particularly in the population amount of municipality organized settlements. The most significant reason for this is the number 1580 Municipality Law, which brought about firstly the isssue of being exposed to speculative acts in population censuses and many issues such as losing its currency and being unable to answer to necessities. On account of these, Municipality Law had been arranged again and the number 5393 Municipality Law had been implemented. However, the articles, which prepare the share given by the central budget according to total population amount and the population amount in order to set up new municipality, should be altered. Besides, if the staff in charge of census behave properly for the rules so as not to influence the census' data results and making the nation conscious of the necessity of the census will facilitate the solution to the problem.
ÖZBu tezde Türkiye'nin gerçekleştirdiği Şah Fırat Operasyonu, Beşika Müdahalesi, Fırat Kalkanı Harekâtı ve Zeytin Dalı Harekâtı'nın uluslararası hukuka göre meşruiyeti konusu ele alınmaktadır. Türkiye, söz konusu müdahaleleri resmî olarak Birleşmiş Milletler Antlaşmasının 51. maddesinde ifadesini bulan meşru müdafaa hakkına dayanarak gerçekleştirdiğini açıklamıştır. 51. maddeye göre devletler, meşru müdafaa hakkına ancak kendilerine yönelik silahlı bir saldırı vukû bulduğunda başvurabilecektir. Tezde de terör örgütlerinin Türkiye'de gerçekleştirdiği saldırıların, 51. maddede öngörülen silahlı saldırı şartını karşılayıp karşılamadığı tartışmaya açılmaktadır. Ayrıca terör saldırıları üzerine gerçekleştirildiği belirtilen Türk müdahalelerinin ne derece sınırlı, amacına uygun ve terör örgütlerinin oluşturduğu tehdide yönelik olduğundan söz edilecektir. Bununla birlikte, BM Güvenlik Konseyi'nin uluslararası barış ve güvenliği tehdit eden bu kriz karşısında gerekli ve makul önlemleri alamadığı görülmektedir. Bu durum karşısında BM Güvenlik Konseyi gerekli önlemleri alana kadar Türkiye'nin mevcut olanaklarla yaşanan tehdide karşı ne tür önlemler alabileceği de tezde incelenmektedir. Türk müdahaleleri meşru müdafaa hakkı temelinde açıklanırken, devlet dışı aktörlere karşı başvurulacak olan meşru müdafaa hakkı konusunda Birleşmiş Milletler Antlaşması'nın cevap veremediği sorunlara yanıt vermesi için ortaya konan "Acizlik veya İsteksizlik Doktrini", "Zaruriyet Doktrini" ve "Koruma Sorumluluğu Doktrini" çerçevesinde de Türk müdahaleleri açıklanmaktadır. Meşru müdafaa hakkındaki muğlaklıklar ve BM Güvenlik Konseyi sisteminin sorgulanır yapısı da dikkate alınarak tez çalışmasının örgüsü "Küresel Yönetişim Teorisi" üzerinden kurgulanmaktadır. Son olarak çalışmada uluslararası insancıl hukukunun Suriye iç savaşındaki yeri ve önemi değerlendirilmekte ve Türk müdahalelerinin meşruiyetine olan etkisi ele alınmaktadır. --- This thesis examines the legitimacy of Operation Shah Euphrates, the Intervention of Bashiqa, the Operation Euphrates Shield, and the Operation Olive Branch in accordance with international law. Turkey has officially stated that it carried out these interventions in accordance with the right of self-defense based on Article 51 of the UN Charter. According to the Article 51, the right of self-defense for a state can be applied only if an armed attack occurs against it. This thesis will be discussed whether or not the attacks that took place in Turkey by terrorist organizations, is sufficient magnitude to satisfy the criteria of the 'armed attacks' as set forth in Article of 51. Furthermore, Turkish interventions that are claimed to have taken place on the basis of terror attacks will be evaluated on the extent of their limits, appropriateness and aim towards the threats posed by the terrorist organizations. In hindsight, the UN Security Council has failed to take the necessary and reasonable measures against the crisis that is threatening international peace and security. Under these circumstances, what kind of measures can be taken by Turkey against these threats by available means, until the UN Security Council takes the necessary measures, will also be examined. As the Turkish interventions are explained on the basis of the right of self-defense, they will also be evaluated within the framework of the "Doctrine of Unable and Unwilling" and the "Doctrine of Necessity," as well as the "Doctrine of Responsibility to Protect," in order to respond to the problems that the UN Charter is unresponsive to. Considering the ambiguities of the right of self-defense and the questionable nature of the working system of the UN Security Council, the structure of the thesis is constructed on the "Global Governance Theory". Lastly, this study assesses the role and importance of international humanitarian law in the Syrian civil war and its impact on the legitimacy of the Turkish interventions.
Temel hak ve hürriyetlere önem veren, iktidarın aşağıdan verilmesi, yönetime katılma, eşitlik, hürriyet, adalet, şeffaflık, farklılıklara saygı gibi önemli ilkelere dayanan demokrasi, halkın yönetimi düşüncesinde yükselen en önemli değerler arasındadır. Halk seçimlerde önlerine programlarını sunan partiler yanında, halkı temsil edecek kişilere oy vermektedir. Bununla birlikte, seçimlerde halka isimleri ve sıraları belli listeler sunulmaktadır. Sonuçta halk, siyasi partilerin belirlediği listeler arasında tercihte bulunmaktadır. Yönetenlerin belirlenmesi önemli ölçüde bu aşamada gerçekleşmektedir. Adayların seçmenlerce tespiti usulü dünya üzerinde sınırlı olarak uygulanmakta, genel olarak aday tespiti, parti içi işlem olarak değerlendirilmektedir. Partilerin aday tespitine ilişkin düzenleme ve uygulamalarının demokratik ilkelere göre yapılmasının gerekli olduğu kabul edilmekte ise de; siyasi partilerin oligarşik yapıları nedeniyle adayların parti üst yönetimince belirlendiği görülmektedir. Aday tespiti sürecinde en demokratik usulün; ilgili seçim çevresinde tüm partili üyelerin seçmen olarak katılmasını ifade eden, yargı denetim ve gözetiminde gerçekleştirilen ?önseçim? olacağı kanaatine varılmaktadır. Türkiye'de ise partiler önseçime başvurmamakta, adaylar daha çok parti üst yönetimince belirlenmektedir. Sonuçta, demokratik aday tespit usulünün yasa ile zorunlu hale getirilmesi gerektiği anlaşılmaktadır. ; Democracy giving importance to fundamental rights and liberties and depending on significant principles such as ruling power derived from the bottom layer, participation in administration, equity, freedom, justice, transparency and respect for dissimilarities is among the most important rising values in consideration of public administration. People in elections vote for the individuals that shall represent them as well as the parties that present their programs for them. In addition, in elections lists with final names and orders are presented to public as well. Consequently, people makes references among the lists specified by political parties. Determination of leading people is realized significantly in this phase. The procedure of determining candidates by voters is applied in a limited way all over the world and in general, candidate determination is evaluated as an operation within the party. Although it is admitted that regulations and applications of parties with relating to candidate determination are required to be performed in compliance with democratic principles, due to olygarchic natures of political parties, it is seen that candidates are determined by top management of the party. In the process of candidate determination one has the conviction that the most democratic procedure will be ?a primary? in the meaning of all party members? participation in related electoral constitutiency as voters and it is realized through judicial review and supervision. In Turkey parties do not apply for primaries and candidates are designated by mostly top management of the party. Finally, It is understood that the procedure of democratic candidate determination should be rendered as a necessity through law.
ÖZETYüzyılın sonu itibariyle, merkezi devletin küçülmesi ve yerel güçlerin ön plana çıkması çabaları ağırlık kazanmıştır. Ulus devlet, yetki ve görevlerinden vazgeçmeye, yerel kamu hizmeti gören örgütler üzerinde denetim yetkisini azaltmaya eğilim göstermiştir. Bu nedenle, günümüz çoğulcu ve demokratik devlet sisteminin bir gereği de, bütün yetkileri üzerinde toplayan bir devlet yerine, güçlü, hizmette halka yakın ve özerk olan bir yerel idarenin olmasıdır. Demokratik ülke olmayı bir vasfı olarak kabul eden Türkiye'nin yerel yönetim örgütlerinin, sahip olması gereken özelliklerden başlıcası özerklik ilkesidir. Bu tez çalışması, yerel yönetimlerde yerel özerklik kavramının Avrupa Birliği bağlamında irdelenmesine yönelik bir çalışmadır.Birinci bölümde, yerel özerklik kavramı tüm yönleriyle incelenmiştir. Bu bölümde öncelikle yerel yönetim, yerinden yönetim ve yerel özerklik kavramlarının tanımı ve kapsamı ile yerel özerkliğin önemi ve gereklilik nedenleri işlenmiştir. Yerel özerklik hedef ve ilkeleri de incelememizde yer almıştır. Bu ilkeler ise özetle, şeffaflık, objektif davranış, sosyal adalet, halk katılımı gibi ilkelerdir. Ayrıca yerel özerklik-idari vesayet ilişkisi, yerel özerklik-egemenlik, bağımsızlık, yetki genişliği kavramları arasındaki ilişkilerin yanısıra Türk Anayasalarında yerel özerklik yaklaşımı irdelenmeye çalışılmıştır.İkinci bölümde ise, Avrupa Birliği konusu değişik yönleriyle incelenmiştir. Avrupa Birliği'nin kuruluşu, organları ve hukuku ile bu hukukun yerel yönetimler üzerindeki etkilerini incelemek, Avrupa Birliği'nin yerel özerklik yaklaşımını anlamada ışık tutacaktır. Avrupa Birliği'ne üye ülkelerde özerklik uygulamalarının neler olduğu da, örnekleme metoduyla ele alınmıştır.Üçüncü bölümde Avrupa Birliği'nin yerel özerklik konusundaki mevzuat çalışmaları, konferans ve antlaşmaları araştırma konusudur. Yerel özerklik konusunda önemli bir metin olan Avrupa Yerel Yönetimler Özerklik Şartı başlıca inceleme konusudur. Dördüncü bölümde, Türkiye'nin Avrupa Birliğine uyum sorunu incelenmiştir. İnceleme, kronolojik ve kurumsal olarak iki açıdan yapılmıştır. ABSTRACTIt is seen that, there have been effective efforts both to minimize the size of central state mechanisms and to make the local powers stronger towards the end of the century. The nation-state tended to give some of its authorities and tasks to the local administrative structures and minimize the tutelage over them. Therefore, as a necessity of today's pluralist and democratic state system, there must be autonomous local authorities which are powerfull and closer to the local people in regard to the services instead of a centralist state which has all the powers related to service supply. In the local govenmental structure of Turkey which tries to be a democratic state, "autonomy" is the most important characteristics that local authorities should have. This thesis work tries to examine the the concept of "local autonomy" in context of European Union.In the first part of the work, the concept of local autonomy is studied comprehensively. In this chapter, after the concepts of local authority, decentralisation and local autonomy were defined, the importance of and the reasons for local autonomy have been discussed. The relations among the concepts of local autonomy, administrative tutelage, sovereignity, independence and deconcentration are also studied. In the second part, the European Union is studied in several dimensions. Its emergence, basic organs and structure of law are also studied to understand the matter better. The autonomy practices in the member states are gathered by means of sampling method.The structure of current law related with local autonomy in European Union and the related treaties are studied in the third chapter. The European Chart of Local Autonomy which is one of the most important texts on local autonomy is the main subject of the study.The integration and adjustment problem of Turkey to the European Union are examined in the fourth chapter. The examination were made both chronologically and institutionally. The points which are suitable or contradictory to The European Local Autonomy Approach in the process of integration are also examined. In the final chapter, the basic results reached in this work are explained and some suggestions are made.
Terör, bir ülkede yasalara ve toplumsal düzene aykırı hareket etmek üzere bir araya gelmiş ve amaçları o ülkenin toplumsal ve siyasî bütünlüğüne zarar vererek düzenin değişmesi olan zarar verici eylemlerdir. Günümüz toplumlarında hemen hemen her ülkede farklı şekillerde görülmekte olup birçok yönetim erki yoğun mücadele içerisindedir. Terör eylemlerinde can kayıpları yaşanmakta ve toplumsal anlamda huzursuzluk yaşandığında yönetim erki terör ile mücadele için maddî ve manevî anlamda her alanda harcamalar yapmaktadır. Yapılan bu harcamalar ise ülke ekonomisine bir yük olmaktadır. Terör ile mücadele her ülkenin yoğun bir çaba ve harcama içerisinde olmasının nedenlerinden belki de en büyüğü, terörün her ülke için geçerli bir tanımının olmamasından kaynaklanmaktadır. Tek bir tanım etrafında birleşilememesi nedeni ile her ülke terörü farklı yorumlamakta ve ona göre mücadele etmektedir ki çoğu zaman özellikle maddi anlamdaki harcamaların boşa gitmesine neden olmaktadır. Terör eylemleri, ülke içerisinde gerçekleşirken diğer devletlerin desteği de söz konusu olmaktadır. Özellikle o ülkeye zarar vermek isteyen diğer devletler personel ve silah desteği sağlayarak terörü beslemektedir. Bu nedenle terör ile mücadelede zorluklar yaşanabilmektedir. Türkiye'de de son çeyrek asırdır özellikle doğu ve güney bölgelerinde PKK terör örgütü eylem yapmakta ve birçok can kaybı yaşanmaktadır. Yaşanan bu can kayıpları birçok politik ve ekonomik adımların atılması gerekliliğini ortaya koysa da bazı adımlar için geç kalındığı söylenebilir. Özellikle son 20 yıllık zaman diliminde gerçekleşen adımların çok daha önce atılması gerektiği düşünüldüğünde şu anda verilen mücadele oldukça zorlu şartlar altında gerçekleştiği bilinmesi gerekir. Bu çalışma, terör örgütlerine katılımda inanç, ideoloji ve etnik kökenin etkilerinin nasıl bir yol izleyerek ilerlediğini tespit etmeyi amaçlamaktadır. ; Terrorism are harmful actions that come together to act against the law and social order in a country, whose purpose is to change the order by damaging the social and political integrity of that country. It is seen in different ways in almost every country in today's societies and many management powers are in intense struggle. In terrorist acts, loss of life is experienced, and when social unrest occurs, management spends financially and spiritually in all areas to combat terrorism. These expenditures, on the other hand, are a burden on the country's economy. Fighting terrorism is perhaps the biggest reason why every country is in an intense effort and spending, because terrorism does not have a valid definition for every country. Since it cannot be united around a single definition, each country interprets terrorism differently and struggles accordingly, which often causes especially financial expenses to be wasted. While terrorist acts take place inside the country, there is also the support of other states. Especially, other states that want to harm the country feed terrorism by providing personnel and arms support. Therefore, there may be difficulties in combating terrorism. Turkey is also in the last quarter century, especially to the eastern and southern regions and the actions of the PKK terrorist organization is experienced in many lives. Although these casualties reveal the necessity of many political and economic steps, it can be said that it is too late for some steps. It should be known that the current struggle takes place under very challenging conditions, especially considering that the steps that have taken place in the last 20 years have been taken much earlier. This study aims to determine the way in which the effects of belief, ideology and ethnic origin progress in joining terrorist organizations.
Türkiyede demokrasi algısı özgür oy verme ve referandumlar üzerine yoğunlaşmıştır. Egemenliğin kullanım biçimlerinden biri olan doğrudan demokrasi geleneğinde halk istediği düşünceye özgürce oy verme hakkına sahiptir. Demokratikleşme eğilimde olan ülkeler gibi Türkiye'de demokrasi, siyasi tarihimiz için önemli bir konumda olmuştur. Demokrasinin gereği olarak yapılan seçimler ve referandumlar bu sürecin Türkiye'de nasıl yol aldığının göstergesi haline gelmiştir. İşte bu çalışmada demokrasinin önemli bir gereği olan siyasete, halkın doğrudan katılımını sağlayan referandumlar incelenmiştir. Halka doğrudan yetki veren bu kurum, demokrasi çatısı altında çoğu zaman onay kurumu olarak görülmüştür. Bu görüş doğrultusunda referandumun hukuki sınırları çizilmiş ve halk da bu sınırlar doğrultusunda karar vermişlerdir. Bu tezin amacı referandumların demokratik değerini ve Türkiye'nin demokratikleşme sürecinde bu kuruma verdiği anlam çerçevesinde yapılan oylamalardan çıkan sonuçların sosyolojik zeminde ne anlam ifade ettiğini ortaya koymaktır. 1961, 1982 yıllarında yapılan referandumların plebisite dönüştüğü ortaya çıkmıştır. 1987, 1988, 2007 ve 2010 referandumları ise kurucu referandumlar halinde, anayasal düzenlemeler için yapılmıştır. Her ne kadar demokratik kültürde yer almasına karşın Türk siyasi hayatında aktif olması düşünülen halk, pasif kalmış, zorunlu olarak onay merciinde kalmıştır. Türkiye'de referandum karşılaştığı sorunlara rağmen demokratik kültür içerisinde uygulanmasının gerekli olduğu sonucuna varılmıştır. Çalışma 3 ana bölümden oluşmuştur. İlk bölümde demokrasi tanımı ve çeşitleri üzerine teorik bir çerçeve çizilmiştir. İkinci bölümde ise demokrasinin gereği olarak referandum kavramı üzerine bilgi verilmiştir. Üçüncü bölümde ise Türkiye'de referandum uygulamaları üzerinde durulmuştur. Çalışmada genellikle literatür taraması yapılarak teorik bir analiz ortaya koyulmuş ve sayısal verilerle bu analizler desteklenmiştir. In the tradition of direct democracy, which is one way of using sovereignty, the society has the right to vote any view that they favor. Just as in the countries that tend to democratize, in Turkey, democracy has always had a crucial role in our political history. Elections and referendums, which are conducted as a prerequisite of democracy, have been indicators to illustrate the procedure in Turkey. Therefore in this study, referendums which lead a society to participate in an important requirement of democracy ?the politics? have been examined. This foundation, which gives the society authorization directly, has been regarded as consent establishment under the roof of democracy. In this respect, the boundaries of referendum are determined in the law, and so the society makes its choices. The aim of this study comes up with some ideas showing democratic value of referendums and what the results of voting right after referendums mean sociologically in the democratization process of Turkey. With this purpose, the problems that democracy has come across during the political history have been examined. Referendums, which include both positive and negative characteristics, function as approval mechanism at the end of constitution construction on the application of Turkey. Here, this function is emphasized in terms of democracy and it is also discussed that in Turkey more importance should be given to referendums and their place in the application at the end of the process. The study consisted of three main parts. In the first one, the definition and types of democracy has been given theoretically. In the second part, conception of referendum has been dealt with as a necessity of democracy. On the third part, the referendum applications in Turkey have been discussed. Generally, in this study, the literature is reviewed and a theoretic analysis has been put forward together with the supports of quantitative data. Key Words: Democracy, Referendum, Insurrection
ÖZETBasın özgürlüğü, toplumun doğru şekilde bilgilendirilmesi ile birlikte bilinçli bir kamuoyunun oluşmasında önemli bir rol üstlenir. Özellikle liberal demokrasilerin vazgeçilmez parçası olan bireylerin kendi kendisini idaresi ve fikirlerin farklılığına saygı çerçevesinde görevini yerine getirir. Bu yüzden basın özgürlüğü, demokratik bir toplumun en temel ve vazgeçilmez unsurudur.Basın özgürlüğü, ifade özgürlüğünün bir diğer şekli olarak karşımıza çıkar. İfade özgürlüğü bir insan hakkı olarak, BM İnsan Hakları Evrensel Bildirgesi, BM Medeni ve Siyasi Haklar Sözleşmesi, Avrupa İnsan Hakları Sözleşmesi gibi en temel insan hakları belgelerinde yer almıştır. Avrupa İnsan Hakları Sözleşmesi m. 10'da ifade özgürlüğü güvence altına alınmıştır. Anılan maddede ilk olarak ifade özgürlüğünün çerçevesi çizilmiş, bu özgürlüğün kanaat özgürlüğü ile kamu otoritelerinin müdahalesi ve ülke sınırları söz konusu olmaksızın haber veya fikir alma ve verme özgürlüğünü de içerdiği belirtilmiştir. 10. maddenin ikinci fıkrasında ifade özgürlüğünün kabul edilebilir sınırları belirlenmiştir. Buna göre, ifade özgürlüğü üzerine konan bir sınırlamanın kabul edilebilmesi için, sınırlama ilkin kanunen belirlenmiş olmalı, ikinci olarak bu sınırlama demokratik bir toplumda gerekli olmalıdır. üçüncü olarak ise bu sınırlama 10. maddenin ikinci fıkrasında sayılan meşru amaçlardan birini gerçekleştirmeye yönelik olmalıdır.Maalesef ülkemizde, AİHS m. 10 korumasına rağmen özellikle siyasi baskılardan ve medya sahiplik yapısından kaynaklanan nedenlerle basına müdahaleler olmakta ve Avrupa İnsan Hakları Mahkemesi tarafından ihlal kararları verilmektedir. Çalışmamızda mahkeme kararları ışığında ihlal nedenleri incelenecek ve basın özgürlüğünün meşru sınırlandırılması halleri anlatılacaktır. Ayrıca mahkeme kararları, Avrupa Birliği İlerleme Raporları ve basın meslek kuruluşlarının bildirileri ışığında Türkiye'nin basın özgürlüğü konusundaki geçmişine, şu andaki durumuna ayrıntılı şekilde yer verilecektir. This freedom fulfills mission in the context of an inherent part of liberal democraties, a form of government based on self governance, respect for a plurality of view. Freedom of expression is necessity and an essential liberty of democratic society. Freedom of press appears as a form of freedom of expression. The right to freedom of expression is protected by all major international human rights instruments such as the U.N. Universal Declaration of Human Rights, the International Covenant an Civil and Political Rights, and The European Convention on Human Rights and Fundamental Freedoms. Article 10 of the European Convention on Human Rights protects freedom of expression. First it states the scope of the right. It entitles everyone to the freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. Article 10 defines the circumstances in which limitations on free expression are permitted. Such limitations are permissible only if they satisfy three tests. Firstly, the restriction must be prescribed by law. Second, a restriction is permissible only if it is "necessary in a democratic society". And third, a restriction is valid only if it is designed to specified objectives in the article 10/2.Despite of the protection in Article 10 of European Convention of Human Rights, unfortunately in Turkey, there is illegal interference in freedom of press especially arising from political pressures and ownership structure of the media. So European Court of Human Rights finds violation of the right to freedom of press.In our thesis, causes of right violation will be analyzed in the light of the court decisions. At the same time the limitations of freedoom of press will be explained. Furthermore background, today and the plans about the freedoom of press in Turkey will be covered in detail in the light of court decisions, European Union Turkey Progress Reports and international press associations. Türkiye, planlı dönemle birlikte uygulamaya başladığı bölgesel gelişme ve bölgeler arasındaki dengesizlikleri giderici yöndeki politikalarını günümüzde yeniden gözden geçirme zorunluluğu ile karşı karşıyadır. Bu zorunluluğun esas nedeni Avrupa Birliği'ne katılım sürecinde bölgesel gelişme politikalarının entegre edilmiş olmasıdır. Bu nedenle Türkiye, yaklaşık 40 yıldır uygulamakta olduğu bölgesel gelişme model, politika ve araçlarını bir yana bırakarak yeniden bir yapılanma süreci içine girmiştir. Bu yeni yapılanmanın ana öğesini Bölgesel Kalkınma Ajansları (BKA) olarak adlandırılan birimler oluşturmaktadır. Kalkınma Ajansları, bir ülkenin belli bir coğrafi bölgesi içerisindeki özel ve kamusal tüm şirketler, yerel otoriteler ile sivil toplum kuruluşları arasında işbirliği sağlayarak, o bölgenin ekonomik açıdan gelişmesini hedefleyen ve yasal bir hükme dayanarak kurulan yapılar olarak tanımlanmaktadır. Küreselleşme süreci beraberinde getirdiği yapısal uyum politikaları ile birçok konuda özgün süreçler ve araçlar geliştirilmesini gerekli kılmıştır. Bu süreçte Türkiye'ye de AB tarafından bölge planlamanın yeni bir anlayışla ele alınması gerektiği ve bunun aracının da BKA'lar olduğu ifade edilmiş ve konu ilk kez AB'ye tam üyelik müzakereleri ile başlamıştır. Bu dönemin başlangıcı sayılacak süreç ise adaylığın ilk kez tescil edildiği 1999 Helsinki Zirvesi sonunda olmuştur. AB Komisyonu'nun hazırlamış olduğu Katılım Ortaklığı Belgesi'nde orta vadede yapılması gereken düzenlemeler arasında yer alan BKA'ları oluşturmak amacıyla yasal düzenlemeler süreci başlatılmıştır. Bu doğrultuda öncelikle Topluluk kurallarına uygun olarak kısa vadede istatistiksel bölge olarak bilinen AB (NUTS) sistemi 22 Eylül 2002 tarih ve 4720 sayılı Bakanlar Kurulu kararı ile kabul edilmiştir. Daha sonra da 2003 yılı Katılım Ortaklığı Belgesinde, katılım öncesi mali yardım programından yararlanabilmek için BKA'ların kurulması öngörülmüştür. Takip eden süreçte 32 esas ve 5 geçici maddeden oluşan, 5449 sayılı Kalkınma Ajanslarının Kuruluşu, Koordinasyonu ve Görevleri Hakkında Kanun, 25.01.2006 tarihinde TBMM Genel Kurulunda görüşülerek kabul edilmiş, 08.02.2006 tarihli ve 26074 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Ülkemizde, 5449 sayılı Kanunun birinci maddesinde ifade edildiği üzere; ?kamu kesimi, özel kesim ve sivil toplum kuruluşları arasındaki işbirliğini geliştirmek, kaynakların yerinde ve etkin kullanımını sağlamak ve yerel potansiyeli harekete geçirmek suretiyle, ulusal kalkınma plânı ve programlarda öngörülen ilke ve politikalarla uyumlu olarak bölgesel gelişmeyi hızlandırmak, sürdürülebilirliğini sağlamak, bölgeler arası ve bölge içi gelişmişlik farklarını azaltmak amacıyla? BKA'lar kurulmaktadır. 6 Temmuz 2006 tarih ve 26220 sayılı Resmi Gazete'de yayımlanan ?Bazı Düzey 2 Bölgelerinde Kalkınma Ajansları Kurulmasına Dair Bakanlar Kurulu Kararı? ile ilk olarak 06.01.2007 tarihinde Adana ve Mersin illerini kapsayan Çukurova Kalınma Ajansı ve 13.01.2007 tarihinde de İzmir ilini ve çevresini kapsayan İzmir Kalkınma Ajansları kurulmuştur. The main reason of this necessity is that regional development policies weren't integrated in the process of participation of European Union. Therefore, Turkey went into a reconstruction process by abandoning the regional development model, policy and tools that it had been has been using for 40 years. The units called Regional Development Agencies (RDA) constitute the main element of this construct. Development Agencies, all private and public enterprises within a certain geographical region of a country, are defined as structures that aim the economic development of that region by providing cooperation between local authorities and civil society organizations, and that are founded on the basis of a legal provision. As is known, globalization process entails the development of authentic processes and tools in many cases regarding structural adaptation policies that it brought along. In this process, it was explained to Turkey by EU that regional planning should be approached with a new understanding and RDA?s are the means for this and this first started with the negotiations of full membership to EU. The process that can be counted as the beginning of this period is the end of Helsinki Summit of 1999 when the candidateship was first enrolled. The legal regulations process was initiated so as to constitute RDA?s that are among regulations which should be implemented in medium term in Accession Partnership that European Commission arranged. Accordingly, EU (NUTS) system that is known as short term statistical region was initially approved by Cabinet decree no 4720 in September 22 of 2002 in accordance with the rules of congregation. Later in the Accession Partnership of 2003, it was anticipated that RDA's be constituted in order to be able to utilize the pre-accession financial support programmes. In the following process, the law number 5449 regarding the Establishment, Coordination and Missions of Development Agencies that consists of 32 major and 5 temporary articles was debated and approved in General Assembly of Grand National Assembly of Turkey and went in effect after being published in Official Journal of number 26074 and date 02.08.2006. In our country, as stated in the first article of law number 5449, RDA?s are constituted ?in order to accelerate the regional development, to insure its maintainability, reduce the differences of interregional and regional development, compatible with the principles and policies anticipated in national development plans and programmes by developing the cooperation among public sector, private sector and civil society organizations, ensuring the effective usage of resources and activating the local potency?. By ?the Cabinet Decree Regarding the Establishment of Development Agencies in Certain Level 2 Regions? that was published in Official Journal number 26220 of July, 6, 2006, Development Agencies were constituted in Cukurova regions that include Adana and Mersin and Izmir regions including Izmir, and Cukurova Development Agency officially opened in 01.06.2006 and Izmir Development Agency in 01.13.2007. Development agencies; ? Will ensure the promotion of effectiveness and success of our region plans with our regional development applications; increasing of regions' contributions to the general growth, development, welfare and stability of our country; reinforcement of social adaptation and justice and, acceleration of adaptation to changing conditions of global competition, ? Will encourage the participation of all local actors in development attemps, especially administrative, financial and technical supports that it provides to corporations, establishments and persons with its highly qualified crew, flexible resource and employment structure, ? Will improve the culture and ability to produce and manage associate projects that are based on co-financing of person, corporation and establishment in project and activity supports; reinforce the sense of ownage and cooperation; active the entrepreneurship potency of the region and keep improving it, ? Will activate the local potency, dynamics, individualities by revealing the resources and possibilities, and turn into an economic, social and cultural values in international market; Consequently, will contribute to the improvement of economic and social indicators, especially employment and income in both national and regional- local level; reduction of differences of interregional and regional development and thus increasing of general prosperity of the country and solidifying of stability.
ÖZETAVRUPA BİRLİĞİ'NE GİRİŞ SÜRECİNDE ULUSAL ELEKTRİK ENERJİ POLİTİKASININ BELİRLENMESİ VE AVRUPA BİRLİĞİ ÜLKELERİ İLE KARŞILAŞTIRILMASIHem sanayi üretim faktörleri içerisinde yer alan hem de toplumun ihtiyaçlarının karşılanmasında rolü olan elektrik enerjisi, elektrik sektörünün işlem gören ürünüdür. Teknolojik gelişmelerle beraber ilerleyen zaman içerisinde dünyada oluşan farklı siyasal ve ekonomik hareketlenmeler elektrik sektörünü de etkilemiş ve sektörde reform hareketleri oluşturmuştur. 1990'lı yılların başından itibaren daha da hızlı bir ivme kazanan bu hareketler, sektörde yapısal değişimler ortaya çıkarmış ve sektörün yeniden yapılanmasını gerektirmiştir. Bu çalışmanın amacı, AB'ne girmek isteyen aday ülke Türkiye için AB enerji politikalarına ve elektrik direktifine uygun bir ulusal elektrik enerjisi politikası belirlenmesidir. Bunu yaparken, AB ülkeleri ve elektrik sektörü yeniden yapılanan diğer dünya ülkelerinden alınan tecrübelerden yararlanılmaktadır. Ayrıca bu tezin diğer bir amacı da AB ülkeleri elektrik sektörlerinin yapılarını karşılaştırmaktır.Bu çalışma kapsamında, sektördeki yapısal modeller ele alınarak, elektrik sektöründe yeniden yapılanmanın işleyişinden, düzenlenmesi ile faaliyetlerin birbirinden ayrılmasından bahsedilmiştir. Buna bağlı olarak sektörde yeniden yapılanmanın ilk kez başladığı ülkeler olan; Şili, İngiltere, Amerika Birleşik Devletleri ve Avustralya ile farklı nedenlerle Brezilya ve Arjantin'deki yeniden yapılanma hareketleri ve Çin Halk Cumhuriyeti'nin reform hareketleri üzerinde durulmuştur. Çalışmada, AB'nin temel enerji politikası ve elektrik direktifi kapsamında elektrik sektöründeki düzenlemeler ortaya konularak, AB üye ülkelerinin elektrik sektörlerinin yapıları; üretim kaynakları, arz talep dengesi, yeniden yapılanma gereksinimleri, öncesindeki yapıları, yasal süreç ve sektördeki yeni organizasyonları oluşturan kısımlarla birlikte aynı başlıklar altında ele alınmıştır. Ayrıca ülkelerin elektrik sektöründeki yapısal durumunun incelenmesi; düzenleme kurumu, sektöre katılan oyuncuların dikey ve yatay birleşmeleri ile üçüncü şahısların sisteme girişleri tablolarda belirtilmiştir. Aynı zamanda ülkelerde oluşturulmak istenen rekabetçi piyasa yapısına, oyuncuların ne derece katıldığı ifade edilmiştir. Bununla beraber yeniden yapılanma sürecinde ülkelerdeki temel elektrik göstergelerinin değişimi grafiksel olarak gösterilmiştir. Çalışmanın Türkiye bölümünde ise, elektrik sektöründeki yeniden yapılanma hareketi 4628 sayılı Elektrik Piyasası Kanununa ve diğer ülkeler için verilen kriterlere göre açıklanmıştır. Burada ülkenin elektrik enerjisi üretim kaynaklarının gelişimi, kaynak çeşitliliği ve farklı kurumlar açısından belirtilirken, üretim-tüketim dengesindeki durumda sunulmuştur. Ayrıca, SPSS paket program aracılığı ile çoklu regresyon ve korelasyon analizi yapılarak Türkiye için elektrik talebinde bulunulmuştur. Bu talep tahmini ile bazı kurumların yaptığı talep tahminleri de karşılaştırılmıştır. Aynı zamanda Türkiye elektrik sektörünün AB elektrik enerjisi politikalarına uyumunun ne derece gerçekleştiği incelenmiştir. Çalışmanın sonunda da Türkiye için farklı bir yapı önerisinde bulunulmuş, yeni bir organizasyon şeması oluşturulmuş ve sistemin işleyişi için bazı öneriler de sunulmuştur.Mart 2004 Bülent ORALABSTRACTTHE DETERMINATION OF NATIONAL ELECTRICAL ENERGY POLICY IN THE EUROPEAN UNION PARTICIPATION AND COMPARISON WITH THE EUROPEAN UNION COUNTRIESElectrical energy is a processed product of electricity sector which is used both in industrial producing fields and supplying the requirement of a society.During the technological development, electricity sector has been effected by different political and economical activities and improvements, thus many reforms have occurred in the sector itself. Since the beginning of the 90's, these reforms have had a rapid velocity and many structural differences have appeared. So the sector has inevitably needed a radical restructurion.The main purpose of this dissertation is to determine a national electrical energy policy accepted by EU and electricity directive for the countries to join the EU such as Turkey. In this process, it is being benefited from the experiences of the EU and other countries, whose electricity sectors have already been restructured. The other purpose of the dissertation is holding a comparison for the electricity sector among the EU countries.In this concept, by taking the structural models in the sector into the consideration, it has been mentioned the unbundling of the process of the restructured electricity sector and its activities. It has been studied the restructurion of Chile, The UK, The USA and Australia in which the restructurion took place first; the restructurion of Brazil and Argentina which have different purposes; and the reformist approaches of the Republic of China.In this study, the regulating of electricity sectors has been explained about the concept of the main energy policy of the EU and the electricity directive. The structure of electricity of the EU countries have been respectively examined under the following topics: the generation sources, the supply and demand, the necessity of restructurion, the previous structuring studies, law actions, and the activities which formed the organization of the restructuring. The study of the countries' structure in the electricity sector has also been made clear in the following tables: the regulation institution the actors who took part vertically and horizontally in the integration to the sector and the access of the third party to the system. It has also been expressed how much the actors take part in the structure of the competitive market, which has been tried to be established in the above mentioned countries. At the same time, the changes of the main electricity figures have been shown in graphics for those countries, which are in the process of restructure.In the chapter of Turkey, the restructurion movement in electricity sector has been explained according to the act of 4628, the Electricity Market Law and to the other criterions for those countries. The development of Turkey's electricity energy has been put forward the balance between the generation and the consumption. A certain amount of Turkey's electricity claim has also been demanded by doing a regression and correlation analysis with the means of SPSS package program. The estimation of this claim and the other estimations which are held by the some institutions have also been compared. In addition to this it has been examined how much the Turkish electricity sector has been adopted to the electricity policy of EU. ÖZETAvrupa Topluluğu'nun sosyal yönü, Avrupa entegrasyon sürecinin başlangıcından beri vardır. Ancak, Avrupa Topluluğu'nun temel amacı, Topluluk üyeleri arasında etkin bir ortak pazar oluşturarak ekonomik bütünleşmeyi sağlamak olduğundan sosyal politikanın genel Topluluk politikaları içindeki rolü küçüktü. Üye ülkeler arasında Topluluk'un sosyal alandaki rolü konusunda hiçbir zaman bir konsensüs oluşmadı. Ancak, zaman içinde, Topluluk üyeleri ekonomik bütünleşmesinin başarısı için etkin sosyal politikaların gerekliliğini kavradılar. Dolayısıyla, Toplululuk'un sosyal yönüne dikkat çekildi ve 1980'lerin sonlarında bu yönde adımlar atılmaya başlandı. Topluluk seviyesinde etkin bir sosyal politika 1980'lerin sonunda siyasi destek kazandı ve Avrupa entegrasyon süreci boyunca, birbiri ardına gelen Antlaşma revizyonlarıyla devam etti. AB sosyal politikasının bu tarihsel gelişme sürecine paralel olarak, Tek Avrupa Senedi (TAS) ile başlayarak, sosyal politikanın yasal ve yönetişim yönlerinde bir dönüşüm gerçekleşmiştir. AB'de sosyal politika alanı hala üye devletlerin yetkisinde olmasına rağmen, özellikle 1990'lardan itibaren, AB sosyal politikasının yönetişiminde hiyerarşik yapıdan hiyerarşik olmayan yapıya doğru bir gelişim olmuştur. Bu yönetişim yaklaşımında, AB'de değişik katmanlardan çok sayıda aktör, sosyal politika yapım sürecine dahil edilmiştir. AB sosyal politikasının geçirdiği bu gelişim süreci, Avrupa sosyal ortaklarının sosyal politika yapım sürecine katılmalarıyla sosyal diyaloğun yolunu açmıştır. Bu açıdan, Avrupa sosyal diyaloğu, 1985'te o günkü Komisyon Başkanı Delors'un başlattığı 'Val Duchesse' görüşmelerinden bu yana AB'nin gündeminde yer almaktadır. Avrupa sosyal diyaloğunun Maastricht ve Amsterdam Antlaşmaları'yla kurumsallaşmasıyla sosyal diyaloğun etkisi, bağlayıcı olmayan ortak görüşlerden, Komisyon tarafından denetlenen ve Konsey kararıyla uygulanan çerçeve anlaşmalara kadar ulaştı. Avrupa sosyal diyaloğunun bu aşamalı gelişiminde, sürecin temel aktörlerinden olan sosyal ortakların rolü ön plana çıkmıştır, çünkü bunların Avrupa seviyesinde temsili, sosyal diyaloğun Avrupa seviyesinde kurumsallaşması açısından önemlidir. ABSTRACTThe social dimension of the Community exists since the inception of the European integration process. However, as the primary rationale of the Community was economic integration among the member states in order to create an effective internal market within the Community in the initial phases, the role of social policy in overall Community policy was minor. There has never been consensus among the member states as to the role of the Community in the social field. However, in time, the member states of the Community perceived the necessity of effective social polices for the accomplishment of economic integration. Thus, increased attention was paid to the social dimension of the Community, with a clear commitment to its development from the late 1980s. This idea for an active social policy, which began to gain political support in the late 1980s, continued its progress with the successive Treaty revisions throughout the European integration process. In parallel to this progressive historical development of European Union (EU) social policy, there has been a transformation in the legal and governance aspects of social policy, starting with the Single European Act (SEA). Although the social policy field is still within the domain of the member states, especially in the 1990s, there has been a transformation in the governance of EU social policy from a hierarchical mode of governance to a non-hierarchical mode of governance, producing soft law rather than the regulatory mode of hard law. According to the governance approach, multiple actors at multiple levels of the EU are involved in the social policy-making process with deliberation and problem-solving efforts. This development of EU social policy paves the way towards the European social dialogue through the active involvement of the European social partners in the social policy-making procedure. In that regard, the European social dialogue has been on the EU's agenda since 1985, when it was initiated with the 'Val Duchesse' talks under the presidency of Delors. With the institutionalization of the European social dialogue process through the Maastricht and Amsterdam Treaties, the influence of the European social dialogue has increased from merely issuing non-binding joint opinions to the point where it now makes framework agreements implemented by Council decision and monitored by the Commission. In this incremental development of the European social dialogue, the role of the social partners as the core actors of the process has come to the fore, since their representation at European level is important for the institutionalization of the social dialogue at European level. Thus, since the Maastricht Treaty, the European social partners, which represent trade union and employer organizations, has enjoyed an institutional role in the policy-making process and can negotiate legally binding agreements on labour market issues. Moreover, the power of the social partners has been enhanced with the Laeken European Council, when they were granted greater independence in the preparation and implementation of 'autonomous agreements'. In this context, the study explores the extent of the influence of the European social dialogue and the role of the social partners in EU social policy-making procedure with reference to governance in the EU. It is notable that, despite the limited outcomes of the European social dialogue process regarding binding legislation, the limited scope of the European social dialogue, the limited influence of the EU institutional framework on the social dialogue, and the deficiencies in the representative structures of the social partners, the European social dialogue is a significant part of EU social policy in terms of its contribution to its legitimacy. In that regard, the European social dialogue has emerged not only as one of the vital parts of the European social model, which comprises the concepts of compromise, consensus, and cooperation, but also as an important mechanism in the general framework of European governance and democratization of the EU. Bulgaria can't use the money too much on surroundings cause of economical lacks.Too many people are migrated to Turkey reason of economical lacks after communism regime. Population is decreased year by year, but unemployment.2. BULGARIA BEFORE 1989Ottoman empire had governorship on the Bulgaria more 500 years till 1908. Then, Bulgarian Kingdom is founded in 1908. Stamboliyski is in powered from Farmer Party in 1920. A new fascism supporter government is founded but communists and farmers were outside of government.Bulgaria is allied with Germany in 1941. Although a new government was found in 1944, the republican regime with referendum is founded in 1946. The new constution is validated in 1947. Cercenkov is in powered in 1950, relations with U.S.A. were out of order and membership of United Nations was validity in 1955.The new constitution is validated in 1971. Bulgarian economy has begun to transition period with some negative ness like other East European countries causes of political incompetence and dissociating end of 1980s.Bulgaria which had more than 60 percent of export to associate but it had couldn't find the new markets cause of inadequate ship of quality standards and had an old technology. Foreign currency reserves are high level. It has too many debts, political incompetent ship in the land. There are not important minerals in Bulgaria.In the following period of 2nd world war, metallurgy and chemical production had an importance. Industry sector had old technology. Its competition is losted the power with disunited of the Comecon.Productivity rates on industry are grown with economical reforms that started in 1979. Economical growing is dynamically continued in spite of reducing the productivity on agriculture sector, building sector and investments in Bulgaria. Especially, price volatility on agriculture sector is a reason of suspicion about real value of growth in 1988 according to 1987.Productions on agriculture and industry of Bulgaria are reduced according to statistics. Main problem on agriculture sector is delivery prices of goods.A stagnation indicator on Bulgarian economy is weakness of building and construction sector. Manufacturing products such as cement and weawing is in necessity. Manufacturing level is inadequate on that area and also unqualificationed organisations have been affected.2.3 - FOREIGN TRADEThere are no definite results on foreign trade reason of inadequate of numerical data's.However, export is increased up to the rate of 4 percent in 1988 and import is reduced to the rate of 1.8 percent. Bulgaria finance deficit is 600 million dollars result of trade with west countries in 1998. Tourism revenues are positive. Trade connections with Turkey are weak according to another East European countries.2.4 – PERESTROICA POLITICSThe new age on economy with state council's decision is started in January 9,1989. Activities to get the indepences of firms are velocitied. At the same time, this decision is more benefit to foreign investors too.3. 1989 – 1997 TRANSITION PERIOD3.1 – ECONOMICAL REFORM ACTIVITIESAlteration is started in east block countries after 1989 and together with this alteration. Comecon is losted the activity. So, idle capacities are commenced and Bulgaria is losted the production markets.The reforms are making started by new government in February 1991. External trade regime is liberalisation in one direction; this is one of the import nest factors of the reforms. With a decision is accepted in 1989, basic of economical reforms are occurred. Firms had equal rights to execution of economical activities. The laws related to foreign investment are validated in 1992.Commercial banks have gone to consolidation. Prices had freed except 11 basic consumption. Economical activities, government status on economy, foreign trade and foreign exchange regime, price regulations, privatization, tax systems are reorganized about foreign investors.3.2. SECTORAL CONSTITUTIONIndustrial sector had the over 50 percent of share on economy until 1990s. 11 private sector's share with service and trade sector approached to 60 percent between 1992 and 1997.SECTORSProductivity with old technologies on industrial sector is at low level. Engineering sector is developed. Products of textile sector are manufactured at high quality.CHEMICALSChemical products that have an important mark on export of Bulgaria. They were 1,096 milliard dollars with 22,3 percent in 1997 and 983 million dollars with 19.4 percent of total export in 1998.AGRICULTURE, FOOD AND TOBACCORate of plan tablelands are 34 percent in Bulgaria. Totally 304 firms are active on food, drink and tobacco sector.METALLURGY AND MINERSHIPIron product is 6.2 percent and other than iron is 6.8 percent on all of industry in 1998. In 1997, metallurgy sector is grown up to 117.2 percent with 529 million dollars in total amount of export in Bulgaria.MACHINEShare of machine sector is 13.8 percent in all of industry. Principal are; Machine parts, tractor, bus, ship, building and auto spare parts.CONSTRUCTIONPrivate firms in the sector have share with 13 percent in 1991. That share is grown to 62 percent in 1995 but then; it is reduced reason of financial inadequate ships.TOURISMTourism revenues are approximately 280 million dollars in 1995.4.5 million of transits and totally 8 million tourists are visited the Bulgaria in 1996.3.3. TRADE AFTER ECONOMICAL REFORMSExport of Bulgaria is totally 4.9 milliard dollars in 1997. The import nest export products are fuel oil, other fuels, cooper and its products and nuclear reactors. Import is 4.5 milliard dollars in 1997 and included the product such as mineral fuels, nuclear reactor heaters and spare parts, electric machines, mineral substances, cotton, synthetic fibres, cereals, auto and tractors.3.4. EXTERNAL DEBTSRate of the external debts to export revenues were 249.9 Percent in 1993 but then, back to 188.2 percent in 1994.Official external debts were 10.363 dollars in the end of 1997.3.5. FOREIGN INVESTORS EXTERNAL CAPITALMost investments with 636.2 million dollars by foreigners are made in 1997. This amount is 526 million dollars in 1998. Principal foreign investors are European countries and U.S.A. A new foreigner investment law is prepared in Oct 1997. Main sectors to investment are industry, trade, finance and tourism.3.6. COMMERCIAL BANKINGState banks are privatization by associate. Regulations relate to control of banking are valitidied by government. In the middle of 1997, a new law on banking are validated after economical crisis in 1996, Central Bank Law are rebuilt. High levels of capital and capital qualifications are obligationed.3.7. PRIVATIZATIONPrivatization is started with foundation transformation and privatization belongs to state and municipalities in April 1992. Privatization Agency is built-up. Privatization is realization with totally 836 million dollars between Jan 1,1993 and Dec 30,1998. Its part of 421.4 million dollars is in 1997 and part of 116 million dollars is realization in 1998.Foundations like ports, telecommunication and, etc.are out of privatization by laws. 95 percent of state firms transformed to form of private limited or nationalization. The debts to foreign countries are decreased to 9.8 milliard dollars with precautions in 1994 and end of 1996.Financial balance are obtained again in the first months of 1995, reduced the inflation and also rate of interests to 72 percent.Rate of exchange (Leva/$) was 503 percent between Jan 1 and Feb 12,1997. Especially, that increasing was 20-percent/each day in Feb 1997.Rate of interest was 300 percent in Sep.1996. 14 Banks are bankrupted in that period. Meşrutiyet döneminin önemli isimlerinden biri olmuştur. Kökü 16. yüzyıla uzanan, Süleymaniye şehrinin kurucusu ünlü Kürt aşireti Baban ailesine mensuptur. İslamcılık düşüncesinin güçlü temsilcilerinden Babanzâde Ahmed Naim'in kardeşidir. Hukuk Mektebi'ni bitirdikten sonra Mülkiye ve Mühendis Mektepleri'nde hocalık; İkdam, Tanin, Şura-yı Ümmet gibi gazetelerde köşe yazarlığı yapmıştır. Hukukla ilgili eserlerinin yanı sıra Bismarc biyografisi ve Dreyfus Meselesini anlattığı kitapları da bulunmaktadır.Meclis-i Mebusan'da Bağdat (1908) ve Divaniye (1912) mebusu olarak yer almış, İbrahim Hakkı Paşa Kabinesi'nde Maarif Vekilliği (1911) siyasi kariyerinin en üst noktası olmuştur. 26 Aralık 1913'te, henüz 37 yaşında iken ders verdiği sırada vefat etmiştir.Meşrutiyet düşüncesini resmetmeye çalıştığım bu tezde onu tanımlayabilecek temel kavramlar; itidal, tedrici tekâmül, meşruiyet,parlamenter sisteme bağlılık, teamül , uzlaşma kültürüdür.Babanzâde, Meşrutiyet'i demokrasi ile eşanlamlı bir yönetim olarak gördüğü için yazılarını, demokrasiyi oluşturan temel unsurları (çoğunluk, çoğulculuk, yasama, yürütme, yargı, güçler ayrılığı, basın özgürlüğü, hukukun üstünlüğü vb.) esas alarak sınıflandırdım.Nitekim 1909 Ağustos'unda yayınlanan Şeyhülislamlık Beyannamesi'ni değerlendirdiği yazılarında; hâkimiyet-i milliye, iktidarın denetlenmesi, güçler ayrılığı, müsavat kavramlarını vurguladığı görülmektedir.Yaşanan olaylara sosyolojik izahlar getirmesi, akademik kimliğinin yazılarına akseden önemli bir parçasıdır. Ancak sistem içerisinde padişaha biçtiği rol de oldukça sınırlıdır: Milletin birliğini ve ülkenin bütünlüğünü temsil eden, siyasi yetkileri azaltılmış sembolik bir makam.Ona göre; halk Meşrutiyet yönetimiyle beraber iktidara ortak olmuştur. Ancak sınırsız bir özgürlük elde etmemiştir. Hakkını kurallar içerisinde aramalıdır. Rüşvet, tembellik, düzensizlik gibi toplumsal hastalıkların tedavisi için siyasi ve medeni terbiyenin yükselmesi gereklidir.Çoğulculuk kavramına çok erken sayılabilecek bir dönemde vurgu yapması onun demokrasi çıtasının yüksekliğini göstermektedir. Ona göre azınlıkta kalan siyasi hareketler ancak sağlam ve tutarlı fikirlerle hayatta kalabilirler.Karmaşık seçim sisteminde en iyi sonucu alabilmek için İttihad ve Terakki'nin hem seçmenlerine hem adaylarına hem de parti yöneticilerine tavsiyelerde bulunur. Bu tavsiyeler günümüzde dahi yerleşmemiş olan parti içi demokrasi anlayışı açısından oldukça önemlidir.Dini inançların seçim malzemesi yapılmasına karşı çıkar. Siyasi cinayetlere şiddetle karşıdır. Partisinin seçim başarısını açıklarken güçlü bir analizci olduğu görülmektedir.Basının halkın sesi olduğuna dair iyimserliği siyasi rekabetin labirentlerinde kaybolur. Bu alandaki düzensizliğin önlenmesi için bir Matbuat Cemiyeti kurulmasını ve bir Matbuat Nizamnamesi hazırlanmasını önemsemiştir. Yabancı basının iç politikada taraf olmasına karşı çıkar.Osmanlı Devleti'nin azınlıkları Türkleştirmeye çalıştığı ithamını bir iftira olarak görür. Ancak herkesi ortak vatan ve ortak vatandaşlık çatısı altında bir araya getirecek Osmanlıcılık politikasının da gerekli olduğunu savunur. Eşitlik talep eden azınlıkların eski ayrıcalıklarının devam etmesini istemelerini ise bir çelişki olarak görür. Kültürel amaçla kurulan Kürt Teavün ve Terakki Cemiyeti'ne (1908) üye olması ve bu Cemiyet'in gazetesinde yazı yazması, azınlıkları Türkleştirmenin yanlış olacağını savunması kendisinin Türkleşmiş Kürt olduğu iddiasını çürütür; Osmanlıcılık idealine samimiyetle bağlı Kürt kökenli bir aydın olduğunu gösterir.Arnavutluk'un Osmanlı Devleti'nden ayrılış süreci tam bir travma etkisi doğurur. Çünkü bu ayrılış "ümmet" anlayışına vurulan ilk darbedir. Arap siyasi hareketlerine, bu süreçte yaşananları bir ibret olarak hatırlatır.Devleti oluşturan unsurlardan başta yasamayı (Meclis) öne çıkarırken daha sonra yürütmeyi ilk sıraya geçirmiştir. Bir hükümet kurulurken padişah-sadrazam-Meclis arasında güvenoyu alınmasını sağlayacak bir işbirliğini gerekli görür. Bugünkü tabirle teknokrat bir koalisyon hükümeti kurulmasına, yürütmeyi zayıflatacağı için karşı çıkar.Örfi İdarenin hatalarının üstünü örtme çabası ve muhalefetin sesini daha gür duyurabileceği açık alan mitinglerine karşı çıkması onun demokrasi anlayışında tespit edebildiğimiz nadir kırılmalardır. Halaskarân Zabitan tehdidi karşısındaki dik duruşu ise takdire şayandır.Ona göre, yasama organının diğer parçası olan Ayan Meclisi'nin varlığı -aristokratik bir geçmişe dayanmadığı için- sadece bir sebeple anlamlıdır: Kanunların hazırlanması sürecinde ihtiyaç duyulan teenniyi sağlaması. Buna rağmen zaten Meclis'in feshinde onay hakkına sahip olan Ayan Meclisi'nin bir de hükümeti düşürebilecek istizah (gensoru), kendi üyelerini seçme gibi haklara sahip olursa sistemdeki tek güç olacağı uyarısını yapar. Meclis müzakerelerinin uzamaması için yaptığı teklifler tam bir uzman görüşüdür. Muhalefet milletvekillerinin iktidarın istediği kanunları engellemek için başvurduğu obstrüksiyon (engelleme) yöntemlerini demokrasi dışı uygulamalar olarak tanımlar.Ocak 1912'de Meclis'in ilk feshinin ardından aynı yıl Ahmet Muhtar Paşa Kabinesi döneminde yeniden feshedilmesi çabasına şiddetle karşı çıkar. Bu amaçla dile getirilen Meclis'in ömrüne dair fikirleri ustaca çürütür.Güçler dengesi bağlamında Meclis'in istizah hakkına karşılık hükümetin cevabın ertelenmesi hakkının hangi dengede olması gerektiğini izah eder. İstizah, güven oylaması ile sonuçlanan bir yöntem olarak kullanıldığı için iktidarın denetlenmesinde daha hafif bir yöntem olarak sual yöntemini teklif eder. Meclis'in adem-i itimad oyuna karşılık Hükümet'in Meclis'i feshetme hakkını düzenleyen 35. maddenin değiştirilmesi meselesi, güçler dengesi başlığının en önemli konusudur. Anayasa'da yapılan 1909 tadilatıyla bu denge İttihad ve Terakki tarafından Meclis lehine bozulmuştur. 1912'de dengenin yeniden kurulması için yapılan teklifin de İttihadçılardan gelmesi muhalifler tarafından şiddetle eleştirilmiştir.Babanzâde, yargı alanında reform ihtiyacını kabul etmektedir. Ancak bunun da tedrici bir şekilde olması gerektiğini savunur. Mahkemelerin tekliği esas olmasına rağmen bir süre daha memurların yargılanması için idari mahkemelerin varlığını sürdürmesi gereklidir. Gezici sulh mahkemelerinin kurulması adi suçların çözümünü hızlandıracaktır. Hâkimlerin ilmi yeterliliklerini artırmak için hukuk mekteplerinin sayısı artırılmalı, gayret eksikliğini gidermek için görevde yükselme şartlarını belirleyen objektif kriterler getirilmelidir.Ordu ve adliye mensubu memurların politikadan uzak durması şarttır. Ancak bu sayede saygınlıklarını koruyabilirler. Küçük düzeydeki memurların halkı bilgilendirmek amacıyla politikayla ilgilenmesi yanlış olmaz, aksi takdirde siyasi güç kısa zamanda yerel zorbaların eline geçer. Constitutionalizm as an effective intellectual, politician, journalist and an auther.He is a member of Baban Family which is a famous Kurdish tribe in 16. Cc. The founder of Suleymaniye city. He is the brother of Babanzâde Ahmet Naim who is the most powerful represantative of Pan-İslam. After graduation from law school,he worked at Mülkiye and Engineering Schools and wrote articles to İkdam, Tanin, Şura-yı Ümmet newspapers. In addition to his Works about law, he wrote Bismarc biography and the book which he told about Dreyfus matter.He worked as a representative of Bağdat and Divaniye in Grand National Assembly (Mebusan Meclisi). He worked as an Education Minister with İbrahim Hakkı's Goverment. This position was his top career. While he was teaching ,26 th December 1913 at 37 years old he died.When I want to describe his constitutionalism with this thesis, I can say these terms: moderate, improving step by step, legitimacy, devotion on the system of parliament, customs, culture of reconcile.As Babanzâde has seen constitutinalism and democracy the same, I classified his writings as the basic items: majority, pluralism, legislation, propulsion, judgement the diversity of powers, the freedom of press and dominiant of law.In his writings which criticized Şeyhülislam Declaration in 1909 August, it is seen that he focused on soverignity, inspecting the power goverment, the diversity of power and equality.His sociological way of describing the events is important part of his career. Effect and cause, inevitable change, the relation of part and whole, evolutionist approach, the thing that some problems can only be solved by the maturity of the society and the necessity that the innovation must started by the concrete need are some of them.When İttihad and Terakki Party was powerful, his defensing the rivals seat untouchable position of its and the rights of being retired shows his dependancy on democracy.In Sultan Reşat's ascending the throne anniversary writings his supporting increasing the subsidy of sons in law on the behalf of protecting their honour in the assembly refutes the idea of opposition against the throne. But the role of the Sultan is very limited in his system it is a symbolic stage which represents the unity of the nation and the unity of whole country.According to him the people participated in the political power with constitutinaolism. However,they couldn't get endless freedom. They have to look for their right according to the rules and law. The social disorders like bribery, laziness, untidiness can be solved by increasing the level of political and civilized understanding of society.His focusing the concept of pluralism at early period shows his improving the idea of democracy for him weak political movements can only stay alive by strong and coherent ideas.He has some suggestions both to the candidates and voters of İttihad and Terakki in order to be succesful on the complicated voting system. These suggestions are very important for the today's changeable party and democracy understanding.He is opposed to misusing of religious beliefs. He is strongly object to political murders. While he is describing his party's voting success, he is seen to be a strong analisist.The optimism of the press about being the voice of the nation disappears in the labyrinth of political competition. He gave importance to the foundation of press and to the event of preparing a press declaration in order to prevent the disorders in this field. He opposes to foreign press's side in inside policy.The minorities of Ottoman Empire sees the accusation of making them Turkish as a slander. On the other hand,he thinks that the Ottoman policy which will make all the natives and non-natives United is a most that the minorities who demands equality and also demanding their old privilages is seen as a contradiction by him. The event of being a member of the Kurdish Teavün and Terakki Association founded with the aim of culture (1908) and writing many articles in this association's newspaper and defending that it would be wrong to make Kurdish people Turkish refutes that he is a Kurdish. It shows that he is a Kurdish-rooted, intellectual person who is strongly devoted himself to Ottoman idealism.The period in which Albania seperated from Ottoman Empaire reveals a real travma. Because this parting is a real blow for the Muslim Community. He sees it as a sample for the Arabic political movements.He gives importance to legislation but then he finds carrying a law more important than legislation. He thinks a cooperation providing with winning a vote of confidence among Sultan-Grand Vizier and Assembly is necessary. He objects to today's technocrat coalition goverment, because of its dangerous effects on carrying out the law.His effors to conceal the faults of cencorship and his objections to opposition party's demonstrations are his defects of his democracy understanding. However,his standing upwright against the threat of Halaskarân is worth to appreciating.In his opinion, existing Ayan Assembly another part of legislation is only meaningful -because of not depending on the aristocratic past- while laws being pirepared the needed calmness is because provided. Neverthless he warns that if Ayan Assembly has the right to select its own members and to give interpellation in Parliment, it will be the unique power.His suggestions not to last the parliment discussions are totally expert ideas. He identifies the methods which the opposition party's members applied for preventing the power's laws are out of democracy.He is strongly against to the efforts of repealing during Ahmet Muhtar Paşa Kabinet period again after the first repealing of parliment in January 1912. He eliminates the ideas of the life-span of the Assembly.He explains the necessary balance between assembly's interpellation right and goverments delaying right to answer. As interpellation is a method used for voting for trust he proposes as a light method "questioning method" to inspect the goverment.The problem which is about the changing of the 35. Matter the right of repealing the goverment is the most important subject of the power balance. The change in 1909 constitution ,this balance was ruined against the Parliment by İttihad and Terakki. In 1912 the proposal by İttihad and Terakki to rebuild this balance was strongly criticized by the opponents.Babanzâde accepts the need for a change in judgement. But he defends that is should be step by step. Although the courts are the only way to judge, managerial courts must exist to judge the officers for a while. Founding portable peace courts will make the solution the vulgar crimes faster. The number of law schools should be more in order to develop the judge's careers and there should be some objective criteria to improve on their careers and to prevent the effort deficiency.It is a condition for army and judge staff to be away from the policy. Providing that they can protect their esteem. Low-level officers' dealing with the policy is not wrong, otherwise political-power can be subsituted with local tyrants. The officer's union rights have disappeared today.
