La tesi si propone come obiettivo di dimostrare nel quadro di un'indagine comparatistica l'importanza della tematica del finanziamento della politica, del rapporto tra denaro e politica, nelle democrazie contemporanee. In questo senso ci si propone di sviluppare i nessi esistenti nell'ambito del tema del finanziamento fra disciplina dei partiti, disciplina delle campagne elettorali e, più in generale, disciplina del sistema elettorale in senso stretto e della forma di governo; di descrivere il complesso quadro giuridico in materia di diritto della finanza politica, oggetto di frequenti aggiornamenti e in continua evoluzione, in alcuni casi anche in via giurisprudenziale, quale risulta emergere dallo studio di ciascun ordinamento considerato; e di definire in conclusione i precisi contorni dei due distinti modelli di «finanziamento della politica» ricostruiti dalla ricerca politologica come modello statalista o pubblico, da una parte, e modello liberale o volontario, dall'altra, pur nelle specificità di ogni contesto istituzionale ; The research discusses political financing in a comparative perspective and aims to show the importance of the relationship between money and politics in contemporary democracies. We discuss the connections between party funding and campaign finance on one hand, and party regulation and regulations governing electoral campaigns on the other hand; we describe the complexities of the legal framework of political finance laws and their always evolving and ever-changing rules; we finally evaluates two different models of political financing, as evidenced by the study of each country surveyed (Germany, France, Spain, United Kingdom, Italy, and the United States).

In quello che Paolo Grossi chiama il medioevo sapienziale i giuristi si impegnano a definire una serie di regole tese alla composizione delle controversie di confine: non ci sono infatti testi normativi precostituiti che le definiscano. Il Corpus Iuris si occupa, quasi esclusivamente, della conflittualità confinaria tra privati. Quando il richiamo ai testi del diritto romano viene effettuato serve solo per conferire 'autorevolezza' a soluzioni che assai spesso si fondano su pratiche di composizione legate alla prassi. Le regole elaborate dai giuristi medievali trovano così la loro formalizzazione sul piano del diritto, ma rinviano a un modo di vivere i confini tra comunità legato agli spostamenti, alle abitudini, alle comuni necessità esistenziali. The norms elaborated by Middle Ages jurists are thus given a formal legal shape; yet, they are linked to a perception of the boundaries between communities that was affected by the displacements, the customs, the common needs of everyday life. On the other side the existence of actual neat demarcations was linked to the exertion of certain rights and privileges rather than to an exclusive and absolute political claim.

La tesi riguarda lo studio del grado di autonomia degli enti sub-statali alla luce del principio di integrazione europea, nel contesto sia nazionale sia soprattutto comunitario. ; The thesis concerns the degree of autonomy of the local government levels in the light of European integration, in both the national and, above all, the European contexts.

In the last decades, much work have been done to deconstruct the mechanisms of government in Early Medieval Europe. In that task, the interpretation of the settlement of disputes and royal/imperial diplomas as the basis of the central government strategies in local spheres has been underlined by recent historiography. Following this methodology, the aim of this article is, thus, to analyze the mechanisms of governance in the March of Tuscany in a time characterized by political fluidity, focusing in the role played by the kings and lay and ecclesiastical aristocracies in the construction of complex political systems.

Projects of the two new railway transalpine tunnel of Frejus and Gothard have similar technical characteristics: an identical length (57 km), a similar cost (10 billion Euros) and the existence of a highway along the same Alpine corridor. But, whilst the new Gothard is now under construction and should become operational in 2017, the new Frejus is at standstill at preliminary phases and has faced a very strong local opposition on the Italian side of the Alps. This difference can be explained by analysing the political and institutional framework of the two projects. The new Swiss tunnel is integrated into a national scheme of transport policy which is based on: the development of a new system of railway infrastructures, which features two new transalpine tunnels (the new Gothard and the Loetschberg); the implementation of a distance-related heavy vehicle fee, which is levied on the basis of total weight, emission level and the kilometres driven; the provision of financial resources to stimulate the transfer of transalpine freight from road to railway. The approval of such a scheme started twenty years ago: it was based on a constitutional decree, implemented through several Federal acts and supported by three confirmatory referenda. The new French-Italian infrastructure is not integrated in any transport policy scheme. The new tunnel is only partially consistent with the overall goals of the European transport policy and the Transport Protocol of the Alpine Convention (which has not yet been ratified by the Italian Parliament): actually no action for modal shift is envisaged. Moreover, the new tunnel was initially supported by a structured consultative and participative procedure – based on the 'débat public' technique – only in France. In Italy this megaproject was not backed by an effective deliberation process, neither at the local nor the national level; on the contrary: it was considered among the strategic projects of the so-called 'Legge obiettivo' and therefore it could bypass the ordinary administrative procedures (and the otherwise mandatory environmental impact assessment). The late creation of a consultative committee (the so-called 'Commissione Virano') and the implementation of participative procedures have not been always consistent and has not proved valid to stop the fierce opposition to the project. ; Le nuove gallerie ferroviarie del Frejus e del Gottardo hanno caratteristiche tecnico-economiche simili. Ma, mentre il nuovo San Gottardo è in costruzione e dovrebbe entrare in esercizio nel 2017, il progetto del nuovo Frejus è fermo alle fasi preliminari.Le ragioni di questa differenza sono da attribuire al diverso schema istituzionale e politico in cui le due grandi opere si inseriscono.Il tunnel svizzero è parte di un vasto disegno di politica dei trasporti, finalizzato al potenziamento del trasporto ferroviario e allo spostamento del traffico dalla strada alla ferrovia, anche grazie all'introduzione di una nuova tassa sul traffico stradale di merci. Tale disegno è stato sostenuto da ben tre referendum confermativi.Il tunnel italiano non è integrato in nessuna politica nazionale dei trasporti e si inquadra solo parzialmente nella politica europea dei trasporti e nel Protocollo sui trasporti della Convenzione delle Alpi: esso infatti non è affiancato da misure per lo spostamento del traffico dalla strada alla rotaia.
