The article aims to determine the influence of administrative courts' jurisprudence on planning practice in the field of spatial order protection. This impact was verified from the perspective of two key, practical (used by courts, local government units, participants in the space game), and legal information systems: LEX and Legalis. The jurisprudence theses contained in the systems mentioned above constitute the basis for the judgments and formulation of arguments expressed in subsequent cases. Two key provisions were selected, important from the perspective of the protection of spatial order and the scope of property rights in the spatial management system: Art. 2, point 1, and Art. 6. The results show that in the examined systems, neutral judgments dominate. Nevertheless, the representation of decisions enabling the expansion of development possibilities is forceful. In this context, the key decisions seem to be more precise, defining the spatial order and directly indicating the superiority of the spatial order over the ownership right. Despite the lack of a clear legal basis, administrative courts should pay particular attention to this direction.

The analysis presented in this article concerns the impact of Court of Justice of the European Union (CJEU) jurisprudence on the legal situation of Supreme Court and Supreme Administrative Court judges in Poland. The main assumption of the presented considerations is that the CJEU, in providing answers to preliminary questions submitted to it by Polish courts adjudicating cases related to judicial appointments and retirements, strengthens the independence of the courts and the independence of the judiciary, assuming that these are systemic elements of a functioning judiciary subject to EU law. For this reason, the CJEU considers itself competent to shape these systemic values under Polish law. At the same time, this body does not notice the problem of jurisdiction of Polish courts posing legal questions, which becomes an important theoretical and practical issue, because it may affect the legality and effectiveness of judgements passed on the basis of answers given by the CJEU. Detailed considerations focus on two types of judgements of the CJEU, which were made in connection with the retirement of judges, as a result of questions submitted to the Court by the Supreme Court and Supreme Administrative Court. The subject of the questions related to the compatibility with EU law of the scope of legal protection granted in Polish law to a judge against resolutions adopted in such cases by the National Council of the Judiciary. The considerations presented conclude that in the case of a CJEU judgement issued as a result of a question posed by the Supreme Court, the jurisdiction of the authority posing the question was infringed, and this should have consequences for the scope of binding the court adjudicating on the answer provided by the CJEU. ; Przedstawiona analiza odnosi się do wpływu orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE) na kształtowanie w Polsce sytuacji prawnej sędziów Sądu Najwyższego (SN) i Naczelnego Sądu Administracyjnego (NSA). Głównym założeniem przedstawionych rozważań jest stwierdzenie, że TSUE w ramach udzielanych odpowiedzi na pytania prejudycjalne, kierowane do niego przez polskie sądy, rozpoznające sprawy związane z powołaniami na stanowisko sędziowskie oraz z przejściem w stan spoczynku, wzmacnia niezależność sądów i niezawisłość sędziowską, przyjmując, że są to elementy ustrojowe funkcjonującego wymiaru sprawiedliwości podlegające prawu Unii Europejskiej. Z tego powodu TSUE uznaje się za właściwy do kształtowania tych wartości ustrojowych na gruncie prawa polskiego. Jednocześnie organ ten nie zauważa problemu właściwości polskich sądów występujących z pytaniami prawnymi, co staje się ważnym zagadnieniem teoretycznym i praktycznym, gdyż może rzutować na legalność i skuteczność orzeczeń zapadających na podstawie udzielonych przez TSUE odpowiedzi. Szczegółowe rozważania koncentrują się na dwóch rodzajach orzeczeń TSUE, które zapadły w związku z sędziowskim stanem spoczynku, na skutek wystąpienia do TSUE z pytaniami przez SN i NSA. Przedmiot pytań odnosił się do zgodności z prawem unijnym zakresu ochrony prawnej przyznanej w prawie polskim sędziemu od uchwał podejmowanych w tych sprawach przez Krajową Radę Sądownictwa. Konkluzją przedstawionych rozważań jest stwierdzenie, że w przypadku wyroku TSUE wydanego na skutek pytania SN doszło do naruszenia właściwości organu występującego z pytaniem, a to powinno mieć konsekwencje dla zakresu związania sądu orzekającego odpowiedzią udzieloną przez TSUE.

Utworzenie sądów polskich w 1917 r., jeszcze przed powstaniem niepodległego państwa, było wyrazem dążenia prawników polskich do budowy własnej państwowości. Z tego też powodu warto mówić o imponderabiliach związanych z niezależnością sędziów i sądownictwa, w szczególności dzisiaj, w aktualnej sytuacji politycznej, albowiem w tę rocznicę mamy do czynienia z atakiem władzy wykonawczej i ustawodawczej na wymiar sprawiedliwości oraz wprowadzenie założeń nowego "ładu" w wymiarze sprawiedliwości, które w swych założeniach mają doprowadzić do ograniczenia lub nawet zaniku trójpodziału władzy przez znaczące uzależnienie sądów od ministra sprawiedliwości i przez to w dalszej perspektywie do ograniczenia obywatelskiego prawa do rozstrzygnięcia sprawy przez niezależny sąd. ; The establishment of Polish courts in 1917, which took place even before Poland regained independence, was a manifestation of the will and intent of Polish lawyers to create their own statehood. This is the reason why it is worth talking about the imponderabilities related to the independence of the judges and the judiciary especially today, in the current political situation, on the first anniversary of the attack of the executive and legislative power on the judiciary, and the introduction of the 'new order' in the judiciary system, the aim of which is to limit, if not eliminate, the division of powers, hence implementing a significant dependence of the judiciary on the Minister of Justice, and consequently, in a long run, to implement a restriction of the civic right to have matters settled by an independent court.

Z opodatkowaniem wiążą się nie tylko złożone problemy prawne, lecz także etyczne. Uwidaczniają się one w procesie stosowania przepisów prawa. Zdarza się, że prawo podatkowe przeradza się w swoje przeciwieństwo, gdy rygoryzm w wykonywaniu litery prawa przestaje się liczyć z kontekstem społecznym. Właśnie wtedy, z uwagi na złośliwe tłumaczenie prawa (Cyceron), szczególna rola przypada sędziom sądu administracyjnego.Ochrona przed bezprawnym działaniem organów podatkowych wynika z wysokiej wiedzy interpretacyjnej sędziów, sędziowskiej dociekliwości i wnikliwości, moralnej wrażliwości sędziów na prawo, solidności kontroli instancyjnej.Pojawia się też problem relacji norm etycznych wywodzących się z wartości aksjologicznych do norm prawnych. Te relacje są następujące: normy prawne powinny posiadać legitymację aksjologiczną, natomiast normy etyczne legitymacji jurydycznej nie potrzebują. A to oznacza, że niesporne wartości aksjologiczne (dobro, godność, sprawiedliwość, równość, wolność) obowiązują niezależnie od umownie przyjętych w danym czasie konwencji stanowienia prawa. Zawsze więc stają się częścią systemu prawa w państwie. Prawo pozytywne jest wynikiem kompromisu sił politycznych i sił społecznych, które w życiu publicznym odgrywają istotną, ważną rolę. Dlatego też prawo pozytywne nie może być pełnym odbiciem uniwersalnych wartości aksjologicznych. I stąd właśnie pochodzą różnice zakresów pomiędzy obowiązującym systemem prawa a systemem norm etycznych wynikających z uniwersalnych wartości aksjologicznych. ; Taxation is not only associated with complex legal problems but also with ethical ones which become apparent in the process of applying legal regulations. When the rigorous application of the letter of the law ignores the social context taxation law degenerates into its opposite. In such situations, owing to malicious legal explanations (Cicero), a vital role is played by the judges of the administrative courts.Protection against the unlawful actions of tax institutions derives from the great interpretative knowledge of the judges, their inquisitiveness and insight, their moral sensitivity to legal issues as well as the soundness of the control processes of the courts.The problem arises here of the relationship between ethical norms which derive from axiological values and legal norms. This relationship can be defined as follows: legal norms ought to have axiological legitimacy but ethical norms do not require judicial legitimacy. This means that undisputedaxiological values (such as good, dignity, justice, equality, freedom) are valid independently of the legal conventions of law making applying at a given time. They are always incorporated into the legal system of a state. Positive law is a consequence of a compromise between the political and social forces which play an important and vital role in public life. This is why positive law cannot be a full reflection of universal axiological values. This explains why there are differences of scope between the legal system in force and the system of ethical norms which derive from universal axiological values.

Climate law is a fast-developing branch of law. It is regulated in a multi-centric way, since as a global issue, it needs systemic solutions that would be broader than national ones. Climate protection can also be achieved through the implementation of human rights, including the right to court. Thus, the multi-level regulation as a lex generalis is accompanied with a lex specialis regulation governing the right to court from a collective perspective and linked strictly with climate law under Article 9 of the Aarhus Convention. The theoretical and indirect aim of the article is to emphasise the relationship of environmental law in general and climate law in particular with human rights, using the example of the right to court. The direct and practical aim is to demonstrate in a horizontal manner the role of the Convention in the case law of the Polish Supreme Administrative Court. The essence of the problem is the finding of the lack of direct effect of the Convention, which weakens this protection. The article is of a scientific and research nature and the analysis of the previous case law may have cognitive value for practice. The first part provides a theoretical and legal outline of introductory issues, showing the links between human rights and climate law and the scope of application of the Aarhus Convention. The second part, concerning research materials and methods, contains an analysis of the provisions of Article 9 of the Convention made using the logical-linguistic method and teleological interpretation. The third part shows the results of the interpretation search carried out by the Supreme Administrative Court, some of them being widely accepted and some controversial. Polish administrative courts, when deciding on environmental matters under Polish administrative law, co-apply together with Polish national law the normative acts of European law, including the Aarhus Convention. However, the wording of its provisions precludes, according to the established case law, the possibility of their direct application, thus pointing to the importance of legislative actions, and administrative courts cannot substitute the legislature in this activity. It was noted in the conclusion that the implementation of the Convention is "generally correct", which does not mean, however, that it implements the Aarhus-type principles in full and comprehensive. ; Prawo klimatu stanowi bardzo dynamiczną gałąź prawa. Jest regulowane multicentrycznie, gdyż jako problem globalny potrzebuje szerszych niż państwowe rozwiązań systemowych. Ochrona klimatu może się odbywać również poprzez realizację praw człowieka, w tym prawa do sądu. Do wielopoziomowej regulacji jako lex generalis dochodzi więc regulacja lex specialis, w myśl której prawo do sądu uregulowano w ujęciu kolektywnym i powiązano stricte z prawem klimatu w art. 9 Konwencji z Aarhus. Celem teoretycznym i pośrednim artykułu jest zaakcentowanie związku prawa ochrony środowiska w ogólności, a prawa klimatu w szczególności, z prawami człowieka na przykładzie prawa do sądu. Celem bezpośrednim i praktycznym jest ukazanie w sposób przekrojowy roli Konwencji z w orzecznictwie Naczelnego Sądu Administracyjnego (NSA). Istotę problemu stanowi uznanie braku bezpośredniej skuteczności Konwencji, co osłabia wspomnianą ochronę. Artykuł ma charakter naukowo-badawczy, a analiza dotychczasowego orzecznictwa może mieć wartość poznawczą dla praktyki. Pierwsza część zawiera rys teoretycznoprawny i dotyczy zagadnień wprowadzających, ukazując połączenia praw człowieka z prawem klimatu oraz zakres obowiązywania Konwencji z Aarhus. Druga część dotyczy materiałów i metod badawczych oraz zawiera analizę przepisów art. 9 Konwencji dokonaną przy użyciu metody logiczno-językowej i celowościowej wykładni. W części trzeciej ukazano – niekiedy niebudzące kontrowersji, niekiedy dyskusyjne – rezultaty poszukiwań interpretacyjnych dokonywanych przez NSA. Orzekając w sprawach środowiskowych wynikających z polskiego prawa administracyjnego, NSA współstosuje z prawem krajowym akty normatywne należące do prawa europejskiego, w tym także Konwencję. Jednak sposób sformułowania jej przepisów wyklucza, w myśl linii orzeczniczej, możliwość ich bezpośredniego zastosowania, podnosząc tym samym ważkość działań legislacyjnych, a sądy administracyjne nie mogą zastąpić w tym zakresie ustawodawcy. W ramach konkluzji podkreślono, że implementacja Konwencji jest "zasadniczo prawidłowa", co nie oznacza jednak implementacji w pełni realizującej Aarhus-type principles.

The author commences by discussing the functions of the grounds taking as a basis the Constitution of the Republic of Poland and the jurisprudence of the Constitutional Tribunal. What's more, he indicates the applicable standards in this regard. As the next step, the linguistic role of explicative conjunctions in the Polish language, as well as their practical application in the grounds of court decisions are presented. The author specifies the considerations in this regard on the example of a set of editorial recommendations published by the French Council of State addressed to French administrative courts. The theoretical considerations are then compared with the statistical data collected by the author on the use of explicative conjunctions in a group of 100 selected judgments of the Supreme Administrative Court issued in 2015-2019. The last stage of the analysis is the identification and discussions of two observed problems related to the use of these conjunctions in the collected research corpus. The curator of the estate may be established by a common court not only from office but also at the request of an administrative court. The rules determining the award of remuneration for actions taken before an administrative court in such a case come from procedural and material law provisions. However, they do not provide in an exhaustive way all the cases of granting remuneration to the curator of the estate in respect of the performed function. As a result, there is a need to solve such problems involving rules that are not explicitly expressed in the applicable regulations. This leaves the possibility to propose solutions for this kind of situation in practice. Due to the demand for consistency of the legal system, it is necessary to attempt to identify the entities responsible for covering receivables on the basis of the applicable regulations. Depending on the actions taken by the curator of the estate, this may be a court of inheritance or a governmental or local government administration body. Due to the postulate of legal certainty, it is necessary to postulate taking into account the legal opinions functioning in the literature in order to introduce regulations that will be considered exhaustive, from the point of view of entities applying the law. ; Kurator spadku może zostać ustanowiony przez sąd powszechny nie tylko z urzędu, lecz także na wniosek sądu administracyjnego. Reguły określające przyznanie wynagrodzenia za czynności podejmowane przed sądem administracyjnym w takim przypadku pozostają zawarte w przepisach prawa procesowego oraz prawa materialnego prywatnego. Nie przewidują one jednak w sposób wyczerpujący wszystkich przypadków przyznania wynagrodzenia kuratorowi spadku z tytułu sprawowanej funkcji. W efekcie pojawia się potrzeba rozwiązania takich problemów za pośrednictwem reguł, które nie zostały wprost wyrażone w obowiązujących przepisach. Stwarza to zatem możliwość zaproponowania rozwiązań tego rodzaju sytuacji w praktyce. Z uwagi na postulat zachowania spójności systemu prawa należy podejmować próby określenia podmiotów odpowiedzialnych za pokrycie omawianych należności na podstawie obowiązujących regulacji. W zależności od czynności podejmowanych przez kuratora spadku może to być sąd spadku bądź organ administracji publicznej lub samorządowej. Z uwagi na postulat pewności prawa należy postulować uwzględnienie funkcjonujących w literaturze poglądów prawnych w celu wprowadzenia regulacji, które będą uznawane za wyczerpujące z punktu widzenia podmiotów stosujących prawo.

The article concerns the good of the child clause. Once the sense of the clause was specified, the focus of the article was shifted onto the issue that is closely related to the practice of judicial decisions undertaken by courts, namely to the criteria under which the courts apply this clause. To illustrate the issue, it was necessary to make references to the achievements of the theory of law concerning the linguistic interpretation and functional interpretation and, in particular, the relationship between them. The background and inspiration for the considerations is the decision of the Supreme Court issued a few years ago, in which the obvious thesis was propounded that if the linguistic interpretation leads to absurd conclusions, contradicting the assumption of the rationality of the legislator's actions and contradicting the axiology of the legal system, then the conclusions should be abandoned and the decisions should be made on the basis of the good of the child clause. The author however claims that the Supreme Court has erroneously interpreted Article 42 of the Act of family support and foster care. He supports his claim saying that in the discussed case there were no grounds for rejecting the norm interpreted with the use of linguistic interpretation methods. Moreover, the author asserts that the Supreme Court has improperly applied that functional interpretation since, referring to the constitutional value of the good of the child, it did not in fact protect it, and by its decision the court made the person who did not meet the legal and moral criteria obtain the status of a foster family. ; Artykuł dotyczy klauzuli dobra dziecka. Po omówienia jej sensu uwagę skoncentrowano na zagadnieniu mającym ścisły związek z praktyką orzeczniczą sądów, a mianowicie na kryteriach stosowania przez nie tej zasady. Wymagało to nawiązania do dorobku teorii prawa dotyczącego wykładni językowej i wykładni funkcjonalnej, a zwłaszcza relacji między nimi. Tłem i inspiracją dla rozważań jest wydane kilka lat temu postanowienie Sądu Najwyższego, w którym wypowiedziano oczywistą tezę, że jeżeli wykładnia językowa prowadzi do wniosków absurdalnych, sprzecznych z założeniem o racjonalności działań prawodawcy i przeczących aksjologii systemu prawa, wówczas należy od nich odstąpić, formułując orzeczenie na podstawie klauzuli dobra dziecka. Autor zarzuca Sądowi Najwyższemu błędy w interpretacji kluczowego art. 42 ustawy o wspieraniu rodziny i systemie pieczy zastępczej oraz twierdzi, że w omawianej sprawie brak było podstaw do odrzucenia normy wyinterpretowanej metodami wykładni językowej. Ponadto zarzuca Sądowi Najwyższemu niewłaściwe zastosowanie wykładni funkcjonalnej, skoro powołując się na wartość konstytucyjną, jaką jest dobro dziecka, w istocie dobra tego nie chronił, a wyrokiem spowodował uzyskanie statusu rodziny zastępczej przez osobę, która nie spełniała prawnych i moralnych po temu kryteriów.

The work of the administration should serve the interests of the parties involved and of the public. That very need for proportionate and reasonable actions of the administration has led to establishing one of the basic principles in the process of issuing administrative acts, the participation of the interested parties in the procedure before the administrative authority. This is achieved by the requirement that, before issuing the act, the authority is to gather the opinions and statements of the members of the public who will be affected by it and to reflect them in the final act. The guarantee that members of the public will be allowed to participate in the procedure and influence the final content of the act is the judicial review of the administrative act.

Niezależność sądów i niezawisłość sędziów stanowią jedną z podstaw państwa prawnego, należącego do podstawowych wartości Unii Europejskiej. Do zasad państwa prawnego należy zasada trójpodziału władz, stanowiąca równocześnie istotną gwarancję niezależności władzy sądowniczej. Zasada podziału władz oznacza, że do wyłącznej kompetencji władzy sądowniczej należy sprawowanie wymiaru sprawiedliwości i organy innych władz nie mogą ingerować w wykonywanie funkcji orzeczniczych przez sądy. W państwach demokratycznych istnieje potrzeba gwarancji niezależności władzy sądowniczej na poziomie norm konstytucyjnych. Podstawową funkcją niezależności sądów i niezawisłości sędziów jest zapewnienie obywatelom prawa do sądu w rozumieniu art. 6 Konwencji o ochronie praw człowieka i podstawowych wolności oraz art. 45 Konstytucji RP. Z punktu widzenia prawa do sądu ważne jest istnienie związku między niezależnością sądów i niezawisłością sędziów a gwarancją bezstronności sądu oraz gwarancją do sprawiedliwego rozpoznania sprawy przez sąd. Niezależność sądów i niezawisłość sędziów są ściśle powiązane z zasadą odpowiedzialności władzy sądowniczej. ; The independence of the courts and the judiciary constitutes one of the foundations of the rule of law and is one of the basic values of the European Union. Judicial independence is also guaranteed by the principle of the separation of powers. According to this principle courts are the only competent body to execute judiciary powers and no other organs may be permitted to interfere in judicial decisions or their making. Democratic states must have the independence of the courts ensured in their constitutions. The basic function of judicial independence is ensuring citizens the right to a fair trial as provided in Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Article 45 of the Constitution of the Republic of Poland. From the point of view of the right to a fair trial the relationship between the independence of the courts and judicial independence on the one hand and the guarantee of the impartiality of the courts and of a fair trial on the other, is important. The independence of the courts and the judiciary is closely related to the principle of the responsibility of judicial authority.

The monography provides a comparative analysis of the constitutional review bodies' activities, their status and efficiency in different Post-Soviet States. It deals with the complex description of the constitutional provisions' compliance, the problems of legal mechanisms and stability, evolution of the local legislation. In this book the authors provide a detailed report of the constitutional review institutions' problems in the process of ensuring its legislative position. In this context we find in the research a description of the legal, political risks of the constitutional control in Post-Soviet States, its social perception and the predictability of its legal systems' development. This work integrates the unique structure of presentation and research materials. By the reflection of this type the authors lay the base for continuing further researches of constitutional review development dynamics in the countries of the region.

The article was prepared as part of the research project Court Books of the Grand Duchy of Lithuania (GDL): A Digital Database, undertaken by the Vilnius University Library in 2011–2014 (VUL, Nr. LIT-5-19). The paper deals with the hitherto unstudied Trakai Castle Court Acts of 1660–1661 (F7-MDGs, 1660–1661) from the VUL collection, and presents Part II of the critical catalogue of manuscripts written in Polish and Ruthenian languages, as well as their descriptions (leaves 210–466). These documents are important for the study of Lithuanian, Polish and Belarusian history, as their contents reflect a broad political, social and cultural panorama of the multilingual GDL society. This feature of the manuscripts enables us to consider them as unique reference books that represent the changing sociolinguistic situation in the GDL.
