L'articolo analizza la sentenza n. 242/2019 della Corte costituzionale, che ha riscritto l'art. 580 c.p., con una sentenza manipolativa e additiva molto dettagliata. L'aiuto al suicidio resta reato, ma non è più punibile colui che agevola l'esecuzione del proposito suicida nei casi in cui l'aspirante suicida si trova in alcune condizioni, verificate da strutture pubbliche del sistema sanitario nazionale e dai comitati etici territorialmente competenti. La sentenza, di carattere normativo derogatorio, viene criticata dall'Autrice in quanto apre una fessura nelle garanzie poste a tutela della vita, nonostante la stessa Corte lo definisca primo dei diritti inviolabili e presupposto per l'esercizio di tutti gli altri diritti; la sentenza si basa poi sul discutibile presupposto che rifiutare trattamenti sanitari equivalga al procurare intenzionalmente la morte, oltre che sull'idea che l'aiuto al suicidio possa qualificarsi trattamento sanitario, in disaccordo con l'opinione delle società mediche scientifiche. Tuttavia l'A. considera apprezzabile che la Corte abbia chiarito che dal diritto alla vita discende il dovere dello Stato di tutelare la vita e non quello di riconoscere un aiuto a morire; e che, di conseguenza, non sussiste alcun dovere dei medici di esaudire tali richieste. Altrettanto apprezzabili sono ritenute le affermazioni sulla priorità delle cure palliative, un pre-requisito di altre scelte, un aspetto del diritto fondamentale alla salute e un diritto umano riconosciuto universalmente, ben diverso da percorsi di "non punibilità". Positiva viene ritenuta anche la mancata accentuazione del concetto di dignità intesa in senso soggettivo, che aveva caratterizzato invece la precedente ordinanza della Corte cost. n. 207/2018. L'A. si interroga infine sui rischi legati ad una legge in materia, ritenuta non strettamente obbligatoria, per il fatto stesso che la Corte, dopo aver lasciato un anno al Parlamento per disciplinare il suicidio medicalmente assistito, abbia ritenuto di pronunciare questa sentenza per rimuovere il vulnus costituzionale. ; The paper analyzes judgment no. 242/2019 of the Constitutional Court, which rewrote art. 580 of the Italian Criminal Code, by a very detailed manipulative and additive ruling. Aid to suicide remains a crime, but the person who facilitates the execution of the suicidal purpose is no longer punishable in cases where the suicidal aspirant is in certain conditions, verified by public structures of the national health system and by the territorially competent ethical committees. The sentence, which is a "legislative" and derogating rule, is criticized by the Author as it opens a gap in the guarantees placed to protect right to life, despite the fact that the Court defines it the most inviolable right and premise for the exercise of all other rights; the judgment is then based on the questionable assumption that refusing health treatments is the same as intentionally procuring death, as well as on the idea that suicide aid could be qualified as health treatment, in disagreement with the opinion of scientific medical societies. However, the Author considers appreciable that the Court has clarified that from the right to life derives the State's duty to protect life and not to recognize aid to die; and that, consequently, there is no duty of the doctors to grant these requests. Equally appreciable are the statements on the priority of palliative care, a pre-requisite for other choices, an aspect of the fundamental right to health, as well as a universally recognized human right, very different from "non-punishable" paths. The failure to accentuate the concept of dignity understood in a subjective sense, which had instead characterized the previous order n. 207/2018 of the Constitutional Court, is also considered positive. Finally, the Author wonders about the risks associated with a law on the matter, considered not strictly mandatory, for the very fact that the Court, after leaving a year to the Parliament to adopt a law on assisted medical suicide, decided to pronounce this judgment to remove the constitutional weak point (vulnus).

Lo scritto, rielaborazione dell'audizione svolta presso le Commissioni Giustizia e Affari Sociali della Camera dei Deputati, in merito ad alcune proposte di legge sull'eutanasia, considera innanzitutto come dall'ordinanza 207, con cui la Corte costituzionale ha chiesto al Parlamento di disciplinare condizioni e procedure per legalizzare «un farmaco atto a provocare rapidamente la morte», non possa scaturire, per l'organo legislativo, alcun dovere costituzionale di legiferare nel senso indicato. Contraddittoria, da parte della Corte costituzionale, è anche la richiesta di inserire questa eventuale disciplina nella legge 219/2017, che afferma di tutelare la vita ex art. 2 Cost., in quanto la stessa ordinanza 207 esclude che questa norma possa essere intesa come il diritto a rinunciare a vivere o come la possibilità di ottenere dallo Stato o da terzi un aiuto a morire. Un'ulteriore difficoltà a legiferare nel senso indicato è dovuta poi alle contraddittorie affermazioni concernenti l'art. 580 c.p., ora qualificato «funzionale alla protezione di interessi meritevoli di tutela da parte dell'ordinamento», ora ritenuto censurabile e «produttivo di effetti costituzionalmente incompatibili». Fra l'altro la Federazione Nazionale degli Ordini dei Medici ha escluso, in base alla propria deontologia, di poter porre in essere comportamenti finalizzati alla morte del paziente, mentre ha rimarcato la distinzione fra l'assistenza prestata ai pazienti che rifiutano i trattamenti, attraverso l'opportuna assistenza palliativa, e comportamenti che implicano invece l'uccisione intenzionale del soggetto, sia pure consenziente. La distinzione è riconosciuta da tutte le società mediche scientifiche nazionali e internazionali ma l'ordinanza 207 non ne tiene conto. Nello scritto si osserva poi come il prerequisito della scelta di suicidarsi, rappresentato da un percorso di cure palliative, non può essere al momento soddisfatto, stante l'inattuazione della legge 38 del 2010. Si ritiene infine doveroso considerare responsabilmente l'esperienza dei Paesi del Benelux, dove l'eutanasia, legalizzata per casi specifici, è divenuta routine e viene praticata a neonati, bambini, disabili e a persone psichicamente disturbate, mentre le cure palliative non corrispondono più al loro statuto originario, fissato dall'OMS. ; The paper, reworking of the parliamentary hearing of the author carried out in the Justice and Social Affairs Commissions of the Chamber of Deputies, regarding some proposals on euthanasia, considers first of all as, from order 207, with which the Constitutional Court asked the Parliament to discipline conditions and procedures to legalize "a drug capable of rapidly causing death", does not arise a constitutional duty to legislate in the sense indicated. On the part of the Constitutional Court, it is also self-contradictory the request to include this eventual regulation in the law 219/2017, which claims to protect life according to art. 2 of the Constitution, since the same order 207 excludes that this norm can be understood as the right to commit suicide or as the possibility of obtaining aid to die from the State or from third parties. A further difficulty in legislating in the sense indicated are the contradictory statements concerning the art. 580 of Criminal Code, now qualified «functional to the protection of interests worthy of protection by the legal system», now considered censurable and «producing constitutionally incompatible effects». Among other things, the Federazione Nazionale degli Ordini dei Medici, based on its ethical code, has excluded medical behaviors directed to the death of the patient, while underlining the distinction between the care given to patient who refuse treatment, through appropriate palliative care, and behaviors that instead involve the intentional killing of the patient, even if consenting. The distinction between right to refuse and right to receive assistance in suicide is recognized by all national and international scientific medical societies but the order 207 does not take it into account. The author also observes that the prerequisite for the decision to commit suicide, represented by a path of palliative care, cannot be satisfied at the moment, since the law 38 of 2010 is not implemented. Finally, it is the duty of the Italian Parliament to responsibly consider the experience of the Benelux, where euthanasia, legalized for specific cases, has become routine and is practiced to newborns, children, disabled and psychically disturbed people, while palliative care no longer corresponds to its original status, established by the WHO.

Lo scritto sottolinea l'importanza della distinzione fra il rifiuto dei trattamenti, che per il medico implica un accompagnamento di tipo palliativo, e l'intenzione di uccidersi e di aiutare a tal fine, che non è un atto terapeutico, secondo i codici deontologici di tutto il mondo e le società mediche scientifiche internazionali, inclusa la World Medical Association (Declaration on euthanasia). L'ordinanza 207/2018 della Corte costituzionale trascura però questa distinzione, allorché ritiene che in entrambi i casi il soggetto sarebbe intenzionato a «porre fine alla propria esistenza». Se il discrimen è nell'intenzione di uccidere, ne discende che l'art. 580 c.p. può interpretarsi nel senso che è incriminabile colui che, con il proprio comportamento, intenzionalmente contribuisce a determinare o a rafforzare il proposito o ad agevolare in qualunque modo l'esecuzione del suicidio altrui. Ragionevole è dunque l'ipotesi di una sentenza interpretativa di rigetto, quale epilogo della questione di costituzionalità concernente l'art. 580 c.p. Desta preoccupazione, poi, che una Corte possa privare un Parlamento dell'ampio margine di apprezzamento di cui godono, in riferimento all'art. 2 CEDU e al fine vita, tutti gli Stati aderenti, nel valutare se e come introdurre una disciplina sul suicidio medicalmente assistito. Radicalmente in contrasto con i fondamenti costituzionali appaiono poi il presunto dovere di uccidere (posto il carattere pretensivo del diritto di morire), il concetto di dignità umana intesa in senso individualistico, e le derive cui invariabilmente conduce la legalizzazione, come mostra l'esperienza del Benelux, dove l'eutanasia, in principio ammessa in casi estremi, è divenuta routine e, sganciata dallo stesso principio di autodeterminazione, è praticata a bambini, neonati e malatici psichici. ; The paper underlines the importance of the distinction between the right to refuse treatment, which for the doctor implies palliative care (and not help to kill), and the intention to commit suicide and to receive assistance in suicide, which is not a medical act, according to the medical codes of practice all over the world and international scientific medical societies, including the World Medical Association (Declaration on euthanasia). However, the Order 207/2018 of the Constitutional Court neglects this distinction, when it believes that both practices involve the intention to "put an end to the existence". If the focus is on the intent to kill, it follows that art. 580 Italian Penal Code can be interpreted in the sense that it is guilty (only) the person who, with his or her own behavior, intentionally contributes to advise or to reinforce the purpose or to aid in any way another to commit suicide. Reasonable is therefore the hypothesis of an interpretative judgment of dismissal, as an epilogue of the question of unconstitutionality concerning art. 580 c.p. It is also problematic that a Court may deprive a Parliament of the wide margin of appreciation that, with reference to Article 2 of the ECHR and end of life issues, Contracting Parties enjoy, in assessing whether and how to introduce physician-assisted suicide. Radically in contrast with the constitutional principles appear the individualistic concept of human dignity, the presumed duty to kill (given the pretensive nature of the right to die) and the tendencies invariably led by legalization, as shown by the experience of the Benelux, where euthanasia, initially admitted in extreme cases, has become routine and, detached from the same principle of self-determination, is practiced to children, newborns and mental ills.
