Метою дослідження, результати якого наведено у статті, стало здійснення аналізу сучасного стану нормативно-правового регулювання паліативної допомоги в Україні.У роботі використано методи наукового аналізу, зокрема, системно-аналітичний, контент-аналіз, прийоми узагальнення та групування.Результати дослідження. Аналіз сучасних нормативних документів ВООЗ, який здійснено у роботі, дозволив визначити стратегічні напрями розвитку паліативної та хоспісної допомоги на національному та міжнародному рівнях. Сформульовано позитивні аспекти чинного вітчизняного законодавства з питань надання паліативної допомоги. До них належать визначення паліативної допомоги як окремого виду медичної допомоги, законодавче закріплення термінів «паліативна допомога», «паліативне лікування», «паліативний пацієнт», застосування мультидисциплінарного підходу в наданні паліативної допомоги хворим на ВІЛ-інфекцію, включення до складу восьмого випуску Державного формуляру лікарських засобів (додаток 8), лікарські препарати для надання паліативної й хоспісної допомоги.Визначено недоліки законодавчих та нормативно-правових актів, що регламентують паліативну допомогу в Україні, зокрема фрагментарність регулюючих норм, відсутність переліку нозологій для паліативної допомоги, відповідно до них затверджених протоколів лікування, методики розрахунку потреби у лікарських засобах, реєстру паліативних хворих, тощо. Запропоновано першочергові заходи з удосконалення вітчизняного законодавства в аспекті надання паліативної допомоги в Україні за організаційним, медико-фармацевтичним, соціально-фармацевтичним та освітянським напрямом.Висновки. Першочерговим завданням зі впровадження ефективної моделі паліативної допомоги в Україні є формування адекватної нормативно-правової бази з урахуванням мультидисциплінарного підходу, рекомендацій ВООЗ та досвіду провідних країн світу. The priority measures to improve the national legislation in the aspect of palliative care in Ukraine for the organizational, medical and pharmaceutical, social and pharmaceutical, as well as educational directions were offered.Conclusion. The prior purpose concerning the implementation of an effective model of palliative care in Ukraine is to form an adequate legal and regulatory framework, considering the multidisciplinary approach, WHO recommendations and the experience of the leading countries of the world. Therefore, palliative patients depend on injection drug administration. It's a fact that in foreign countries Medicinal Cannabis is used for anesthesia and the treatment of certain diseases. This substance is banned in Ukraine. Public organizations are trying to initiate a law that would legalize this drug for the use in medicine. The next actual problem is psychological support of patients. It is noted that palliative patients and their families need psychological and spiritual support. A foreign experience has been analyzed in this field. The Agency for Healthcare Research and Quality in the USA has founded a special curriculum for doctors. The aim is to improve understanding of the basic principles of palliative care. It is possible to arrange upgrading courses, read necessary lectures or print literature and appropriate brochures for healthcare professionals. It suggests an improvement in the education of palliative workers on the basis of higher education. There is a problem with the lack of staff in the hospices of Ukraine. This profession is not popular and employees of hospices have a small salary. Still, this work is responsible and nervous. The article on the basis of the analysis of normative-legal documents, publications of scientific periodicals considers actual aspects of theoretical researches of some actual questions of legal regulation of palliative medicine. Modern medicine has made significant progress in the prevention and treatment of diseases. But there are cases when even modern methods of treatment arenot able to overcome the disease. This happens for various reasons, when the disease is diagnosed too late and the painful process has gone too far, or when medicine simply does not know how and there is no way to help the patient, but in any case such patients are doomed. However, they need further medical support because they cannot be left alone with their problems, they need pain relief, they need supportive treatment, the relatives of such patients need help and this is a very difficult task. Such tasks are designed to solve the latest branch of medicine - palliative medicine. A significant amount of this issue is in the legal plane because it raises a whole layer of previously unknown problems of legal and moral-ethical plan. One of such problems is the use of euthanasia, namely the legal and moral and ethical aspects of its practical application. The World Health Organization defines palliative medicine as a set of medical, social, psychological and spiritual actions aimed at improving the quality of life of a person suffering from an incurable disease or whose life prognosis is pessimistic, as well as helping family members. Ideally, palliative care should be provided from the moment of diagnosis and in combination with any medical therapy. Such care should be adapted as the patient's disease progresses to the final phase. Some palliative care programs include legal services for a power of attorney or medical order in the field of health care and assistance in the execution of a will. Exploring current issues of palliative medicine, the author would like to focus on the problem of euthanasia, namely its legal and moral and ethical aspects of its application. And although society is divided on the issue of euthanasia, but in the event of a public demand for its legalization, the legislator will be obliged to create appropriate regulatory mechanisms. It is extremely important to resolve such issues by having a dialogue between the state and society, conducting information work, explaining important aspects of euthanasia. Such work is practically not conducted in Ukraine, except for the discussion of the problem of euthanasia in the scientific community, while public discussion is practically not conducted. ; У статті на основі аналізу нормативно-правових документів, публікації наукових періодичних видань розглядаються актуальні аспекти теоретичних досліджень деяких актуальних питань правового регулювання паліативної медицини. The article deals with the political and legal problems of palliative and hospice care for incurable patients in Ukraine. The author considered the basic concepts in this area («incurable patient», «palliative care», «hospice», «palliative policy»), analyzed the legal framework for hospice care in Ukraine. The author notes that all people hope for a good death, or rather, «a good life to the very end». Unfortunately, this doesn't happen to everyone. Many people have to be in pain and suffering at the end of their lives. The goal of the palliative care is to prevent suffering and to alleviate the condition of the patient suffering from an incurable disease – by active identification of syndromes, like pain, and by providing adequate treatment that will balance the syndromes as much as possible during day and night. Public engagement and policy interventionsto improve the quality of death through the provision of high quality palliative care have gained momentum in recent years, and some countries have made greatstridesin improving affordable accessto palliative care. Unfortunately, Ukraine is a country with a low index of «quality of death», due to lack of political will, imperfection of legislative and regulatory framework, practical lack of funding, as well as informational silence on this topic. So thousands of Ukrainian's citizens today do not receive any palliative care in the end of their lives. This situation is violates their constitutional rights to health, life, honor and dignity. Palliative care is aimed primarily at alleviating pain and painful symptoms, and includes social, psychological and moral support that enables the patient to maintain the most fulfilling and active life until her last day. In addition, it includes a support system for near patient to help them cope with the loss when it will happen. ; Стаття присвячена розгляду політико-правових проблем надання паліативної та хоспісної допомоги інкурабельним хворим в Україні. Автором були розглянуті основні поняття в цій сфері («інкурабельний хворий», «паліативна допомога», «хоспіс», «паліативна політика»), зроблений огляд нормативно-правової бази, яка регулює цю сферу в Україні. Кожна людина сподіваються на добру смерть, чи, якщо бути точнішими, на «добре життя до самого кінця». На жаль, це відбувається не з кожним. Багато людей змушені проходити в кінці свого життя через біль та страждання. Мета паліативної допомоги полягає в запобіганні стражданню та полегшені стану пацієнта, який страждає невиліковною хворобою – шляхом активного медичного втручання з метою зняття больових синдромів, та наданням адекватного лікування, яке дозволить збалансувати ці синдроми протягом доби. На жаль, Україна є країною з низьким індексом «якості смерті», через відсутність політичної волі, недосконалість законодавчої та нормативно-правової бази, практичну відсутність фінансування, а також інформаційне замовчування цієї теми. Всі ці фактори створюють ситуацію, коли тисячі громадян України щодня потерпають від страждань, не отримуючи належної паліативної допомоги, що призводить до порушення реалізації їх конституційних прав на охорону здоров'я, життя, честь і гідність, а також підриву довіри суспільства до політичної влади в країні, яка вважає таку ситуацію «нормальною». Паліативна допомога спрямована, перш за все, на ослаблення болю та болісних симптомів, а також включає в себе соціальну, психологічну і моральну підтримку, що надає можливість хворому зберегти максимально повноцінне та активне життя до останнього її дня. Крім того, вона включає в себе систему підтримки для близьких хворого, щоб також допомогти їм справитися з його втратою, коли це відбудеться. В статті наголошується, що тематика паліативної та хоспісної допомоги, як правило, ігнорується науковцями політологами та є недостатньо дослідженою ними. Також в роботі окреслені основні напрями, в яких, на нашу думку, має розвиватися паліативна політика України на сучасному етапі її розвитку.

Крім того, вона включає в себе систему підтримки для близьких хворого, щоб також допомогти їм справитися з його втратою, коли це відбудеться. В статті наголошується, що тематика паліативної та хоспісної допомоги, як правило, ігнорується науковцями політологами та є недостатньо дослідженою ними. Також в роботі окреслені основні напрями, в яких, на нашу думку, має розвиватися паліативна політика України на сучасному етапі її розвитку.

Imported production comprises from 80 to 100% in some African countries, despite the fact that the incomes of population and medical support system doesn't correspond completely with the consumption of expensive medical drugs (further MD). There is an extremely severe problem of physical and economical availability of MD in theEastern Mediterraneancountries. OBJECTIVE STATEMENT OF THE ARTICLEIn connection with the above mentioned, the purpose of the work is the analysis of economic availability of MD in theEastern Mediterraneancountries, and also the comparison of the received indexes with the indexes of European countries. In the researches it has been participated such countries as Sudan, Egypt, Lebanon, Uganda and Ethiopia. To compare the received indexes of availability and their level determination it has been made the comparison of indexes among themselves and also with the indexes of the developed country of the European continent. As a standard it has been taken Germany as a country with one of the most developed pharmaceutical markets in the world and the strongest health care system, which finances medical and pharmaceutical assurance among all the EU countries.RESEARCH METHODSIn this work it has been taken into account the pharma-economic methods of analysis and methodology of the World Health Organization (WHO) and Health Action International (HAI) «Prices determination of MD, their availability and price of components ", data obtained during this methodology examination [1, 4, 6-11]; information from regional and national sources [12]; and also the scientific publications on this topic [2,3,5]. Data concerning prices for medicines and the cost of treatment course were obtained in studying of retail prices in pharmacies of the above mentioned countries. In the total examination it has been studied the MD which are used for the treatment of chronic diseases and which are included in the international list recommended for the continuous monitoring (study) by the World Health Organization . RESULTS AND IT DELIBERATION According to WHO recommendations, it has been selected the basic MD for the treatment of 14 the most common diseases, which will allow to make the international research. Also it is allowable to include in this list of MD the most important for the treatment of specific diseases in certain countries. Yes, for the African countries such drugs are the remedies for the malaria treatment.In the study it has been participated the generic MD sold at the lowest price. Further it has been determined the economic availability of studied MD, taking into account the ratio of the treatment cost by this drug (according to the international treatment protocols) and the daily wage of unskilled low paid public officer in these countries.During the determination of economic accessibility of medicines it has been used the paying capacity adequacy ratio, which includes the lowest retail price of the drug (or the treatment course price), and the average salary for a certain period of time.The analysis shows that the availability of MD in some African countries is situated at the unsatisfactory level. Regarding the indicators of availability general perception, the lowest indicators hasSudan, the highest accessible indexes has Egypt. By comparison of the availability of MD in African countries and in Germany, for the diclofenac treatment course in Germany it is necessary to spend 0.24 of one day wages, and in Sudan - 5.3, which is higher in 22 times; for the paracetamol treatment the Sudan patients spend more in 10 times.Thus, the availability economic analysis of basic MD confirms thatEgyptandLebanonassist a relatively low cost of basic MD, which is close to the level of the European countries. Especially in Egypt, the major part of economic availability indicators of medical drugs corresponds to parameters of the country with the developed pharmaceutical market and a strong health care system and this is Germany. Thus, the indicators ofEgyptare almost identical with those ofGermanyat the prices of Diclofenac, Atenolol, Captopril, Glibenclamide, Ceftriaxone, Diazepam, and even lower - with Salbutamol, Amitriptyline, the antimalarial medical drugs.Thus, in Sudan is marked with the rather high prices and, consequently, low availability on a number of medical drugs such as Diclofenac, Paracetamol, Captopril, Simvastatin, Amitriptyline. Thus, patient inSudanneed spend in 22 times more of money to the diclofenac treatment than patients inGermany. A treatment will paracetamol will be in10 times more expensive, treatment with captopril will be in 7 times more expensive. Comparison of availability indexes in theSudanwith the African region countries is also accompanied by a situation where the indicators availability of MD are in 3 - 10 times worse than in other countries with similar health care system. The necessity of generic MD availability analyses, especially for the countries with the health care systems which are forming will help to make the fast and low priced determination of the availability level of medicines for the population, the timely reaction in case of indexes deterioration, the regulation of public policy of countries in the pricing field on MD as well as coordination of original and generic drugs use, which allow to reduce the budgetary costs of medical assistance without the quality loss.References1. ISSUES OF ECONOMIC AVAILABILITY OF MEDICAL DRUGS IN AFRICAO. Imported production comprises from 80 to 100% in some African countries, despite the fact that the incomes of population and medical support system doesn't correspond completely with the consumption of expensive medical drugs (further MD). There is an extremely severe problem of physical and economical availability of MD in theEastern Mediterraneancountries. OBJECTIVE STATEMENT OF THE ARTICLEIn connection with the above mentioned, the purpose of the work is the analysis of economic availability of MD in theEastern Mediterraneancountries, and also the comparison of the received indexes with the indexes of European countries. In the researches it has been participated such countries as Sudan, Egypt, Lebanon, Uganda and Ethiopia. To compare the received indexes of availability and their level determination it has been made the comparison of indexes among themselves and also with the indexes of the developed country of the European continent. As a standard it has been taken Germany as a country with one of the most developed pharmaceutical markets in the world and the strongest health care system, which finances medical and pharmaceutical assurance among all the EU countries.RESEARCH METHODSIn this work it has been taken into account the pharma-economic methods of analysis and methodology of the World Health Organization (WHO) and Health Action International (HAI) «Prices determination of MD, their availability and price of components ", data obtained during this methodology examination [1, 4, 6-11]; information from regional and national sources [12]; and also the scientific publications on this topic [2,3,5]. The article examines the national legal framework for administrative and legal regulation of animal euthanasia. An in-depth analysis of current legislation, offers their own conclusions, judgments and proposals on the regulation of euthanasia of animals, in particular, changes and additions to Art. 89 of the Code of Ukraine on Administrative Offenses and Guidelines for euthanasia of animals, approved by the Order of the State Committee of Veterinary Medicine from 07.09.2010 № 365. Emphasis is placed on the similarities and differences between the concepts of «animal euthanasia» and «human euthanasia», ethical issues and public opinion about the euthanasia (sleeping) of animals. It was found that the legislation prohibiting cruel treatment of animals regulates such concepts as «killing», «euthanasia», «slaughter» and others, which usually relate to a particular species of animals, Cases of legal and illegal euthanasia of animals by local authorities. The activity of the "Bureau of ritual services for animals" in terms of their euthanasia is studied. Types (social and palliative), bases and methods (physical, inhalation and non-inhaled) of euthanasia of animals are studied. It is noted that such methods of euthanasia should be used, which are humane, ie completely eliminate cruelty. Difficulties in the work of veterinarians, their compliance with relevant rules and procedures, the use of legal methods of euthanasia remain in sight. Emphasis is placed on the desired behavior of pet owners during the procedure, because they usually leave the animal alone with a veterinarian, and she, in the last minutes of his life, is experiencing great excitement, looking for the owner. Particular attention is paid to euthanasia (sleeping) of animals by illegal, in particular physical methods, or without appropriate grounds (for homeless animals that have not found owners, etc.). ; У статті досліджується національна нормативно-правова база адміністративно-правового регулювання евта-назії тварин. Проводиться глибокий аналіз чинного законодавства, пропонуються власні висновки, судження та пропозиції з питання врегулювання проведення евтаназії тварин, зокрема зміни та доповнення до ст. 89 Кодексу України про адміністративні правопорушення та Методичних рекомендацій щодо проведення евтаназії тварин, затверджених Наказом Державного комітету ветеринарної медицини від 07.09.2010 р. № 365. Акцентується увага на схожості та відмінності понять «евтаназія тварин» та «евтаназії людини», етичних проблемах та думках громадськості з приводу проведення евтаназії (присипляння) тварин. З'ясовано, що в законодавстві, яке забороняє жорстоке поводження з тваринами, регламентуються такі поняття, як «умертвіння», «евтаназія», «забій» та інші, що стосуються, як правило, певного виду тварин, Розглядаються випадки проведення законної та незаконної евтаназії тварин органами місцевої влади. Досліджується діяльність «Бюро ритуальних послуг для тварин» у частині проведення ними евтаназії. Вивчаються види (соціальна та паліативна), підстави та методи (фізичні, інгаляційні та неінгалідовані) проведення евтаназії тварин. Зауважується, що мають використовуватись такі методи проведення евтаназії, які є гуманними, тобто повністю виключають жорстокість. У полі зору залишаються труднощі в роботі лікарів ветеринарної медицини, дотримання ними відповідних правил та процедур, використання законних методів проведення евтаназії. Акцентується увага на бажаній поведінці власників тварин під час процедури, адже вони, як правило залишають тварину наодинці з ветеринарним лікарем, і та, в останні хвилини свого життя, переживає сильне хвилювання, поглядом шукає власника. Особлива увага надається проведенню евтаназії (присиплянню) тварин незаконними, зокрема фізичними методами, або ж без відповідних на те підстав (щодо безпритульних тварин, яким не знайшли власників тощо).
Introduction.The article is devoted to the topical issues in the area of ensuring the right of the older persons to health, taking into account modern realities. In particular, it focuses on the existing problematic aspects through the prism of the right to decent treatment and autonomy. The issue of abuse of the elderly, which negatively affects their physical and mental health and providing palliative care, which helps to improve the quality of life of patients with diseases that limit life expectancy have been analyzed; it focuses on the problem of dementia, which is one of the leading causes of disability and dependence among older people around the world; given the fact that older people are at high risk during COVID-19, the focus is on protecting this category of people during a pandemic. The main results of the study. An analysis of the existing legal framework for cooperation between states to overcome the negative trends in the provision of health care to the elderly, in particular: the Toronto Declaration on the Global Prevention of Elder Abuse, the Council of Europe Convention on preventing and combating violence against women and domestic violence, the European Social Charter (revised), the Inter-American Convention on Protecting the Human Rights of Older Persons, the Global action plan on the public health response to dementia 2017-2025, the "Towards a Dementia Plan" Guide , World Health Organization Guidelines for Reducing the Risk of Cognitive Function and Dementia. In addition, attention is paid to the recommendations of the main bodies of international intergovernmental organizations, in particular the Committee of Ministers of the Council of Europe, and international treaty bodies in this field - the Committee on Economic, Social and Cultural Rights, the Committee on the Elimination of Discrimination against Women (General recommendation № 24, General recommendation № 27) etc. Relevant conclusions and recommendations have been made. Conclusions.It should be noted that the existing tendency of the population to age is a reality of today and encourages society to seek new ways of life in these circumstances. Aging is no longer seen as a problem, but rather as a challenge and an opportunity for society to respond and take timely adaptation measures. The international community is making significant efforts to create a legal framework, develop standards, and develop international cooperation to ensure a decent old age for the elderly. The task for governments is to implement international norms into national legislation and to optimize national measures in this area. The field of healthcare for the older personsis the most sensitive, as it is a question of a decent standard of living, so it needs a balanced strategy, which should include: disease prevention (diagnosis, medical care, etc.); development, improvement, introduction of an affordable and inexpensive system of long-term care with the involvement of the elderly themselves in this work and training of specialists who will work in this field; training of persons who informally care for the elderly; regular independent monitoring of long-term care services, based on clear principles and rights that older people can exercise on their own; giving preference to home care; creation of appropriate services to provide advice, psychological, legal assistance to the elderly. It is also important for society to be aware of aging in order to understand the problems and not to cause repeated psychological trauma to the older persons so they don't feel like a "burden" for society, rather than full members. ; Статья посвящена актуальным вопросам в области обеспечения права на здоровье пожилых людей с учетом современных реалий. В частности, в ней акцентируется внимание на существующих проблемных аспектах сквозь призму права на достойное обращение и автономию. Кроме того, сосредоточено внимание на рекомендациях, принятых главными органами международных межправительственных организаций, в частности, Комитета министров Совета Европы, и международных договорных органов в этой сфере – Комитета по экономическим, социальным и культурным правам, Комитета по ликвидации дискриминации в отношении женщин (Общая рекомендация № 24, Общая рекомендация № 27) и др. Крім того, зосереджено увагу на рекомендаціях головних органів міжнародних міжурядових організацій, зокрема, Комітету міністрів Ради Європи, та міжнародних договірних органів у цій сфері – Комітету з економічних, соціальних і культурних прав, Комітету з ліквідації дискримінації щодо жінок (Загальна рекомендація № 24, Загальна рекомендація № 27) тощо. Зроблено відповідні висновки і рекомендації. Висновки.Слід констатувати, що існуюча тенденція населення до старіння, є реаліями сьогодення і спонукає суспільство до пошуків нових шляхів існування за цих обставин. Старіння вже не розглядається як проблема, а скоріш за все, як виклик і можливість суспільства зреагувати та прийняти своєчасні заходи по адаптації. Міжнародним співтовариством докладаються суттєві зусилля щодо створення правової основи, розробки стандартів, розвитку міжнародної співпраці задля забезпечення літнім людям гідної старості. Завдання для урядів полягає в імплементації міжнародних норму у національне законодавство та оптимізація національних заходів у цій сфері. Галузь охорони здоров'я для літніх людей є самою чутливою, оскільки мова йде про гідне існування, тому вона потребує виваженої стратегії, складовою якої повинна стати: профілактика захворювань (проведення діагностики, медичного догляду тощо); розробка, удосконалення, запровадження доступної і недорогої системи довгострокового догляду із залученням до цієї роботи самих літніх осіб і підготовка фахівців, які працюватимуть у цій сфері; здійснення навчання осіб, які неофіційно доглядають за літніми людьми; здійснення регулярного незалежного моніторингу послуг з довгострокового догляду, побудованому на чітких принципах і правах, які літні люди можуть реалізовувати самостійно; надання переваги догляду на дому; створення відповідних служб з наданням консультаційної, психологічної, правової тощо допомоги літнім людям; суттєве значення має й поінформованість суспільства про старіння з метою розуміння проблематики і незавдання повторної психологічної травми літнім людям у результаті якої вони відчуватимуть себе «тягарем» для суспільства, а не повноцінними його членами.
