This study starts from the way philosophy of education was conceived by Richard Peters, how it has been amended in succeeding discussions within the Anglo-Saxon context as well has been the object of postmodern criticisms. Due to the changes in the educational area, it then asks what follows for its programme. Focusing on the debate concerning educational research it is argued that though it cannot do without addressing conceptual and justification issues, this should not be seen as a particular method. Philosophers of education write for different audiences (colleagues working in philosophy and philosophy of education), but they should not ignore those who are involved in educational practice and policy. They should therefore engage in a particular kind of 'political' research which transgresses the usual critical approach by offering also suggestions about how things could be done otherwise thus exemplifying the relevance of philosophy of education. ; El punto de partida para este estudio es la concepción de Richard Peters de la filosofía de la educación, así como las modificaciones que ha sufrido debidas a su discusión en el contexto anglosajón y a las críticas posmodernas. A la luz de los cambios actuales en la educación, esta contribución se pregunta sobre su futuro. Se argumenta, enfocándose en el debate sobre la investigación educativa, que aunque ésta no pueda evitar abarcar asuntos conceptuales y de justificación, no debe entenderse como un método más. Y aunque los filósofos de la educación escriben para audiencias diferentes (otros filósofos y filósofos de la educación), no obstante no deberían ignorar a quienes trabajan en la práctica y la política educativas. Por tanto su investigación debería ser 'política', superando el enfoque crítico usual para sugerir cómo las cosas podrían hacerse de manera diferente. Esto ilustraría la relevancia de la filosofía de la educación. ; Le point de départ de cette étude est la manière de laquelle la philosophie de l'éducation était conçue par Richard Peters, comment elle était amendée par les discussions successives dans le contexte anglo-saxon et comment elle est devenue l'objet des critiques postmodernes. Ensuite, cette contribution interroge les conséquences des changements récents dans le domaine de l'éducation pour le programme de la philosophie de l'éducation. Le débat de la recherche scientifique pédagogique prouve qu'elle ne peut pas négliger ni les concepts ni les questions justificatoires, mais que ça ne constitue pas de méthode particulière. Les philosophes de l'éducation écrivent pour des publics différents (des collègues de la philosophie et de la philosophie de l'éducation). Tout de même ils ne pourraient pas oublier ceux qui travaillent dans la praxis et la politique de l'éducation. A conséquence, ils doivent s'engager dans une recherche 'politique' qui transgresse la critique habituelle en offrant aussi des modes d'agir alternatifs. Ainsi cette approche montre l'importance de la philosophie de l'éducation.

This paper will study hermeneutically two literary texts of the Marquis de Sade published in 1795, La philosophie dans le boudoir and Aline et Valcour ou le Roman philosophique, with the objective of showing that Sade's literary texts exceed and exacerbate the ongoing political revolution by proposing an aesthetic revolution from a deep transgression ou outrage of the principles of the classical mimetic order that emerges from a spontaneous philosophical thought given in the literary writing of the late century eighteenth century. The exposition of this aesthetic criticism that we see in Sade's literature allows us to sustain that the aesthetic revolution in the face of the classical representative Regime was already being cultivated before the literary creation of Stendhal, Balzac, Flaubert and Victor Hugo, as suggested by Auerbach and Rancière. Here we will propose that this aesthetic revolution occurs, then, with Sade and his peculiar mixture of styles that outrages the classical mimetic order, configures a hypermorality resulting from the transgression of principles and, consequently, is constituted as the openness to modern literary experience. ; Este trabajo se propone estudiar hermenéuticamente dos obras literarias del Marqués de Sade publicadas en 1795, La philosophie dans le boudoir y Aline et Valcour ou le Roman philosophique con el objetivo de mostrar que los textos literarios de Sade exceden y exacerban la Revolución política en curso proponiendo una revolución estética desde una profunda transgresión o ultraje de los principios del orden mimético clásico que emerge de un pensar filosófico espontáneo dado en la escritura literaria de fines del siglo XVIII. La exposición de esta crítica estética que vemos en la literatura de Sade nos permite sostener que la revolución estética ante el régimen representativo clásico ya se venía cultivando antes de la creación literaria de Stendhal, Balzac, Flaubert y Victor Hugo, tal como lo sugieren Auerbach y Rancière. During the first decades of the 20th century, Spanish translations of the Grundlinien der Philosophie des Rechts did not abound. In 1937, the translation by Angélica Mendoza was published by Editorial Claridad, which not only represents the first Argentine version of the Grundlinien, but also the first and only complete one offered to the Spanish-speaking world until 1975, when the translation by J. L. Vermal appeared. But this first complete edition of the work cannot omit the political-cultural context to which both the translator and the publisher belonged, nor the resources Mendoza used to carry out this task. In the following work we propose to analize criticaly the version of the Grundlinien by Angélica Mendoza, arguing that there are two determined mediations that intervene in the access to the Hegelian work: one of a political nature and the other of a textual nature. First, considering the date of publication of the translation, we intend to show the elements that imply the mediating role of Marxism for the access of the Grundlinien. Secondly, by means of a critical evaluation of the translation, we will highlight the mediating role of Messineo's Italian version both for the benefit of the Spanish translation and for the problems of comprehension that derive from this indirect mean. ; Durante las primeras décadas del siglo XX no abundan traducciones españolas de los Grundlinien der Philosophie des Rechts. En 1937, se publica en la Editorial Claridad la traducción de Angélica Mendoza, la cual no sólo representa la primera versión argentina de los Grundlinien, sino que también es la primera y única completa que se ofrece al mundo hispano-parlante hasta 1975 cuando aparezca la traducción de J. L. Vermal. Pero esta primera edición completa de la obra no puede omitir el contexto político-cultural al que pertenecieron tanto la traductora como la editorial, ni tampoco los recursos de los que se valió Mendoza para realizar esta tarea. En el siguiente trabajo nos proponemos examinar críticamente la versión realizada por Angélica Mendoza de los Grundlinien, sosteniendo que hay dos mediaciones determinadas que intervienen en el acceso de la obra hegeliana: una de carácter político y la otra de carácter textual. En primer lugar, considerando la fecha de publicación de la traducción, pretendemos mostrar los elementos que implican el rol mediador del marxismo para el acceso de los Grundlinien. En segundo lugar, mediante una valoración crítica de la traducción, destacaremos el rol mediador que cumple la versión italiana de Messineo tanto para beneficio de la traducción en español, como para los problemas de comprensión que se derivan de este recurso indirecto.

It is from the experience of not understanding that we will develop the outline of a reflection on what it is understanding. This experience reveals to us the desire to understand that is extended into the dialectic between the will to understand and the desire to be understood. Insofar talk is mainly to communicate with others, dialogue will serve here as a guide: it not only enables us to recall the conditions of possibility of understanding, but it highlight the nature of the duty to understand. In a second step, we will leave this pragmatic and ethical dimension of the act of understanding and its implications and we will show that the reflection about the intersubjective nature of understanding, finds its meaning in political reflection. Indeed, if it is true that language is essentially understood from the background knowledge shared by individuals, groups or communities of interpretation in a society, then the simple coexistence of a plurality of these interpretive communities requires the consideration of the claims of recognition of each of them claim in a politically structured space. There too the dialogue will be central to the experience of negativity that inhabits the act of understanding. ; C'est à partir de l'expérience de la non-compréhension que nous développerons les grandes lignes d'une réflexion sur ce que c'est que comprendre. Cette expérience nous découvre le désir de comprendre qui se prolonge dans la dialectique entre la volonté de comprendre et la volonté d'être compris. Dans la mesure où parler est essentiellement communiquer avec d'autres, le dialogue nous servira ici de fil conducteur : il nous permettra non seulement de rappeler les conditions de possibilité de la compréhension, mais encore de mettre en lumière la nature du devoir de comprendre. Dans un second temps, nous partirons de cette dimension pragmatique et éthique de l'acte de comprendre et de ses implications pour montrer que la ré exion sur le caractère intersubjectif de la compréhension, où l'on se laisse dire quelque chose par quelqu'un d'autre, ne trouve son sens que dans une réflexion politique. En effet, s'il est vrai que le langage ne se comprend pour l'essentiel qu'à partir de connaissances d'arrière-plan partagées par des individus, des groupes ou des communautés d'interprétation dans une société, alors la simple coexistence d'une pluralité de ces communautés d'interprétation exige que soit pensée la reconnaissance que peut revendiquer chacune d'entre elles dans un espace politiquement structuré. Là aussi le dialogue s'avèrera central dans l'expérience de la négativité qui habite l'acte de comprendre.

He belongs to a new philosophical and legal current. He tries to relate the old realism issued from the old Tomism with a humanism that proclaims a new "ius humanae societatis". Beyond the rules that should govern the war in the fairest way it is possible, presents, in the line of Suárez and Vitoria, the external and internal limits of sovereignty. These premises of a balance between the human societies and a legal and formal universality are in the foundation of the bases of the International Public Law.
