The study of electoral campaigns is nowadays one of the very topical & popular themes in the field of the scientific-research work. Electoral campaigns can be defined in several ways & from several points of view. In this paper, a campaign is understood as a set of diverse activities performed to influence the electoral result. These activities can be studied according to the political-system, time-space, organizational & instrumental dimensions of their performance. The key purpose of the paper is to analyze & typologize the features of electoral campaigns of today's urban municipality mayors in Slovenia during their standing as candidates in local elections in 2006. By using various methodological & statistical approaches & tools, it was found out in the analyzed cases that electoral campaigns were an important part of the electoral process & that, according to planning features & implementing plans, they were very specific in all the studied municipalities. Because of this, the campaigns in the studied elections were characterized as particular & highly localized. Despite these particularities, four different types of campaigns were highlighted according to the groups of similar features: a) traditional campaigns; b) charismatic candidate campaigns; c) modern local campaigns & d) an intense campaign mosaic. Cilj magistrskega dela je ugotoviti, ali je skupna zunanja in varnostna politika Evropske unije primeren okvir za izvajanje mirovnih operacij. V prvem sklopu sem preučil pogodbeni razvoj, institucionalni okvir ter glavni strateški dokument SVOP. V drugem sklopu sem se osredotočil na same vojaške operacije SVOP, v okviru katerega sem preučil zgodovino in razvoj operacij, vpliv vojaških operacij na podobo EU kot varnostnega akterja ter način planiranja in financiranja vojaških operacij. Na koncu drugega sklopa sem izpostavil tudi ključne izzive, ki se pojavljajo pri vzpostavljanju in izvajanju mirovnih operacij v sklopu SVOP. V tretjem sklopu sem se osredotočil na operacijo EUFOR Althea. V začetku sklopa na kratko opišem zgodovino samega konflikta in predstavim grožnje varnosti in stabilnosti Bosne in Hercegovine, nato pa se osredotočim na samo operacijo in opišem njen mandat, proces planiranja, obseg sil in njihovo organizacijo ter naloge, ki jih izvajajo. Tudi v tem sklopu na koncu izpostavim pomanjkljivosti in kritike, ki so se pojavile skozi obdobje izvajanja operacije. Pri analizi operacije Althea sem ugotovil, da se le-ta giblje med delno uspešno in uspešno. Pri primernosti SZVP za izvajanje mirovnih operacij sem ugotovil, da ima ta za izvajanje res širokega spektra mirovnih operacij kar nekaj pomanjkljivosti. Ker sta SZVP in z njo SVOP medvladne narave, je opaziti, da se področja, ki so v pristojnosti samih institucij EU, razvijajo hitreje od področij, na katerih imajo večjo prisotnost same države članice. Moja glavna ugotovitev je, da je SZVP primerna predvsem za izvajanje manjših in manj intenzivnih mirovnih operacij. ; The aim of the master's thesis is to determine whether the common foreign and security policy of the European Union is an appropriate framework for the launching of peacekeeping operations. The first content set analyses the contractual development, institutional framework, and the main strategic document of CSDP. In the second set, I focus on the CSDP military operations. In this context, I examine the history and development of operations, the impact of military operations on the image of the EU as a security actor, and the way in which military operations are planned and financed. At the end of the second set, I also point out the key challenges that arise in the establishment and implementation of CSDP peacekeeping operations. In the third set, I focus on the EUFOR Althea operation. At the beginning of this final set, I briefly describe the history of the conflict and the threats to security and stability of Bosnia and Herzegovina, followed by the focus on the operation itself—its mandate, planning process, force and organization as well as the tasks carried out. Furthermore, this section points out the shortcomings and criticisms that arise during the course of operation. Analysing operation Althea, I have found out that it ranges from semi-successful to successful. With regard to the suitability of CFSP for the conduct of peacekeeping operations, I have found that it has quite a few shortcomings for the conduct of a considerably wide array of peacekeeping operations. As CFSP and CSDP are intergovernmental in nature, it can be observed that the areas under the responsibility of the EU institutions are evolving faster than the areas where the majority of the responsibility lies upon the member states. My main finding is that CFSP is particularly suitable for carrying out smaller and less intensive peacekeeping operations.

Slovenija je po osamosvojitvi organizirala vojaško obrambo na način, kot je bil v nekdanji skupni državi. Razvijala je številčno veliko vojsko, v katero so bili vključeni z majhnim deležem pripadniki stalne sestave ter pripadniki rezervne sestave, ki so bili v enote SV razporejeni na podlagi zakonsko obveznega služenja v rezervni sestavi. Pripadniki moškega spola so se usposabljanja za obrambo domovine udeleževali na služenju vojaškega roka, ki je bil prav tako zakonsko obvezen za vse zdravstveno sposobne moške državljane, stare med 18 in 27 let. Ob nadaljnjem razvoju Slovenske vojske se je vse bolj kazala potreba po drugačnem organiziranju vojaške obrambe, ki bi tako zagotovila doseganje novih doktrinarnih in strateških obrambnih načel. Vse bolj se je kristalizirala potreba po prehodu na poklicni način popolnjevanja vojske. Slovenska vojska je s prehodom na poklicni način popolnjevanja, dopolnjenega s pogodbeno rezervo doživela številne spremembe tako v kadrovski kot tudi v organizacijski strukturi. Vse te spremembe pa so zahtevale spremembe tudi na drugih področjih, med njimi vojaški infrastrukturi. Po izvedeni koncentraciji sil in sredstev v perspektivne objekte, ki jih uporablja Slovenska vojska, je sledilo zagotavljanje bivalnih in delovnih zmogljivosti, kjer je nastanjena poklicna vojska. Sledeč cilju razviti majhno in dobro usposobljeno vojsko, so bili posodobljeni ali na novo zgrajeni tudi nekateri objekti, namenjeni izobraževanju, usposabljanju in urjenju. Pripadnik je najpomembnejši in ključni dejavnik v delovanju Slovenske vojske. Celostna skrb za pripadnike Slovenske vojske je postala s profesionalizacijo vojske pomembna dejavnost, ki pa do danes še ni zaživela v celoti. Prostorska urejenost za izvajanje programov celostne skrbi za pripadnike Slovenske vojske je marsikje še v obliki načrtov. ; After Slovenian independence the military defence in Slovenia was organized in the same way as it was in the former joint country. Slovenia developed armed forces, great in numbers, which were complemented by permanent forces' members in a minor part, and by reserve army, which were organized into Slovenian Armed Forces (SAF) units on the basis of a legally mandatory military service. Male citizens participated in homeland defence training in the form of military service, which was also legally mandatory for all medically fit male citizens between 18 and 27 years of age. With the further development of Slovenian Armed Forces, it has become clear that the military defence should be organized differently to ensure the achievement of new doctrinal and strategic defence principles. The need of transition to complement the armed forces with professional army has become more and more clear. With the transition to the professional army, additionally complemented by contract reserve force, the Slovenian Armed Forces have experienced numerous changes, both in staff and organizational structure. All these changes resulted also in modifications in other fields, such as military infrastructure. Following the concentration of forces and assets to perspective facilities, used by the Slovenian Armed Forces, the living and work capacities for the professional army were ensured. Some facilities intended for education, training and drills have been upgraded or rebuilt in the pursuit of developing small and well-trained armed forces. The most important and key factor in the functioning of SAF is a military member. The integral care for members of the SAF has, with the professionalization of the armed forces, become an extremely important activity, which has not yet entirely thrived. The spatial arrangement of implementation of integral care programmes for SAF members is still largely in the planning phase.

POVZETEK MEDNARODNI KAZENSKI PREGON IN ČLOVEKOVE PRAVICE TUJIH TERORISTIČNIH BORCEV Avtor: Rok Petročnik Mentorica: izr. prof. dr. Vasilka Sancin V magistrski nalogi sem raziskoval nastanek fenomena tujega terorističnega borca, njihov mednarodni kazenski pregon in kršitve njihovih temeljnih človekovih pravic v domačih kazenskih pregonih. Varnostni svet OZN je leta 2014 na podlagi VII. poglavja Ustanovne listine OZN sprejel Resolucijo 2178, ki podaja opis tujega terorističnega borca, vendar ne loči med oboroženimi spopadi in terorizmom. Resolucija 2178 opisuje tujega terorističnega borca kot posameznika, ki potuje v tujino z namenom izvedbe ali sodelovanja v terorističnem napadu, medtem ko je tuji borec posameznik, ki odpotuje v tujino z namenom pridružitve oboroženim spopadom. V raziskavi sem prišel do sklepa, da trenutno ne obstaja mednarodni kazenski pregon tujih terorističnih borcev, saj pregon izvajajo države same pred nacionalnimi sodišči. Varnostni svet OZN je pregon tujih terorističnih borcev preložil na države članice OZN, in sicer z vzpostavitvijo različnih odborov za nadzor izvajanja sankcij Varnostnega Sveta, kot so Sankcijski odbor 1267 in Skupina za analitično podporo in nadzor sankcij. V primerih Nada, Ahmed in Abdelrazik so nacionalna sodišča zaradi kršitev temeljnih človekovih pravic s sodbami razveljavila državne upravne akte, ki so vpeljevali sprejete protiteroristične resolucije Varnostnega sveta. Podobno je naredilo sodišče EU v primeru Kadi, kjer je bila razveljavljena uredba, ki je vpeljala sankcije Varnostnega sveta. Sodbe nacionalnih in sodišč v EU so bile glavni dejavnik za spremembo mednarodnopravnega okvirja terorizma OZN in za posledično večji poudarek na spoštovanju temeljnih pravic, ki jih zagotavlja Evropska konvencija o človekovih pravicah. ; ABSTRACT INTERNATIONAL PROSECUTION AND HUMAN RIGHTS OF FOREIGN TERRORIST FIGHTERS Author: Rok Petročnik Mentor: Vasilka Sancin, PhD, Professor In master's thesis i explored the emergence of the foreign terrorist fighter phenomenona, international prosecution of foreign terrorist fighters, and the violation of the fundamental rights of foreign terrorist fighters in domestic prosecutions. UN Security Council in 2014 adopted Resolution 2178 under Chapter VII of the UN Charter. However, while the Resolution outlines the description of a foreign terrorist fighter, it fails to distinguish between armed conflicts and terrorism. Resolution 2178 defines foreign terrorist fighters as individuals who travel to a state other than their states of residence or nationality for the purpose of the perpetration, planning, or preparation of, or participation in, terrorist acts or the providing or receiving of terrorist training, including in connection with armed conflict, while foreign fighter is an individual who travels abroad with intention to join armed conflict. The research led to the conclusion that there is currently no international prosecution of foreign terrorist fighters because states carry it out before national courts. UN Security Council has placed the burden of prosecuting foreign terrorist fighters on UN Member States by establishing different committees monitoring the implementation of the Security Council sanctions, such as the 1267 Committee and the Analytical Support and Sanctions Monitoring Team. In the cases of Nada, Ahmed and Abdelrazik, national courts due to violations of fundamental rights, repealed national administrative acts that introduced the adopted UN Security Council counter terrorism resolutions. The Court of Justice of the EU made a similar decision in the case of Kadi by repealing the regulation introducing the UN Security Council sanctions. Judgements of national and EU courts were the main factor in changing the UN terrorism framework in terms of international law, thus shifting the focus on the respect of fundamental rights as guaranteed by the European Convention on Human Rights.

V magistrski nalogi smo raziskali uvajanje managementa kakovosti v visokem šolstvu, analizirali smo pristope ter modele zunanjih evalvacij v državah Evropske unije in drugih razvitih državah sveta ter podali splošne podatke o evalvacijah v visokem šolstvu. Raziskali smo procese evalvacij v visokem šolstvu in stanje v Sloveniji. S primerjavo z državami članicami Evropske unije in širše, kjer izvajajo zunanje evalvacije neodvisne institucije (agencije), smo potrdili tezo, da v Sloveniji sistem kakovosti v visokem šolstvu še ni primerljiv z evropskimi modeli. Analizirali smo postopke managementa kakovosti v slovenskem visokošolskem prostoru, kjer že dobro desetletje univerze in njihove članice redno opravljajo samoevalvacije, od leta 2006 pa nacionalni evalvacijski organ izvaja tudi zunanje institucionalne evalvacije. Prikazan je izvirni model notranjih institucionalnih evalvacij na Univerzi v Mariboru. Model je potrjen z raziskavo, ki temelji na praktičnih primerih, ki so podkrepljeni z ustrezno teorijo in izkušnjami iz primerov dobre prakse. Opisani so posamezni segmenti (pričetek evalvacijskega postopka, zahtevana dokumentacija visokoškolskega zavoda, obisk evalvacijske komisije, poročilo o notranji evalvaciji …) kot prispevek k izboljšanju in razvoju managementa kakovosti na Univerzi v Mariboru. Prikazana so spoznanja in rezultati na praktičnem primeru pilotnega projekta notranje institucionalne evalvacije. Podana je utemeljetev vpeljave notranjih institucionalnih evalvacij na Univerzi v Mariboru, ki se bo izjemno pozitivno izkazala ob neodvisni zunanji institucionalni evalvaciji posameznega visokošolskega zavoda. V okviru raziskave smo opravili še anketo med ciljno skupino zaposlenih na Univerzi v Mariboru, ki so doslej že sodelovali pri zunanjih evalvacijah. Rezultati bodo pripomogli k izboljšanju nadaljnjega načrtovanja in izvajanja dejavnosti v okviru notranjih institucionalnih evalvacij na Univerzi v Mariboru. V raziskavi smo potrdili zastavljeno delovno predpostavko, da se bodo s pomočjo modela notranjih institucionalnih evalvacij izboljšali procesi managementa kakovosti članic Univerze v Mariboru. Zato izsledki magistrske naloge predstavljajo pomemben prispevek k izboljševanju stanja kakovosti na članicah Univerze v Mariboru, še posebej na posameznih področjih managementa kakovosti ter celovitega sistema managementa kakovosti. ; This master's thesis examines the introduction of quality management in higher education, analyses different external evaluation models of EU Member States and other developed countries and provides general data on evaluations in higher education. In this paper, evaluation processes in higher education and the situation in Slovenia are examined. By comparing Slovenia with other EU Member States, as well as a few other countries, where external evaluations are conducted by independent institutions (agencies), the conclusion is drawn that quality assurance in Slovene higher education is still lagging behind other European models. We analyzed quality management in Slovenia, where for over a decade universities and their members have been performing regular self-evaluations. In addition, a national evaluation body is conducting external institutional evaluations since 2006. An original model of internal institutional evaluation at the University of Maribor is introduced. It is backed up by research based on practical examples as well as relevant theory and examples of good practice. Particular elements (initiation of the evaluation process, required documentation, visit of the evaluation committee, internal evaluation report, etc.) are described in order to contribute to the improvement and development of quality management at the University of Maribor. Findings and results of a practical pilot project are presented. In addition, reasons for introducing internal institutional evaluations at the university are given, one of them being that such evaluations will prove extremely useful when conducting independent external institutional evaluations of university members. A survey was conducted among the target group consisting of university staff that has already participated in external evaluations. Survey results will contribute to the improved planning and implementation of activities in the context of internal institutional evaluations at the University of Maribor. Our assumption that quality management will improve with the help of the introduced internal evaluation model was correct. For this reason, the findings of this thesis represent a valuable contribution to quality assurance at the University of Maribor and its members, especially in certain areas of quality management and in terms of a comprehensive system of quality management.

Danes živimo zelo hiter tempo življenja pri katerem pozabljamo nase in soljudi. Pozabljamo na potencial, ki ga skriva človek. Človek je najbolj prefinjen mehanizem, ki ga poznamo, vendar upravljanja le tega se še da naučiti. Uporabe se lahko naučimo skozi jogo. Joga je zelo širok pojem, zato smo ji posvetili celotno poglavje, kjer je podrobneje razložena. Tudi človeški viri so zelo kompleksna tematika. Vsi tipi organizacij se srečujejo z vprašanjem vodenja ljudi oziroma organizacije človeških virov. Na tem mestu smo videli priložnost povezave dveh kompleksnih tematik, ki sovpadata, saj se organizacije srečujejo z mnogimi vprašanji za katere joga ponuja rešitev. V nalogi na začetku opredelimo človeške vire, kjer obravnavamo neotipljivi kapital, človeka in znanje. Na to se posvetimo razlagi upravljanja s človeškimi viri, ki zajema načrtovanje, zaposlovanje in razvoj zaposlenih. V poglavju investicija v človeške vire predstavimo človeške vire kot kapital podjetja, medosebne odnose, dobro počutje zaposlenih, trajnostni razvoj in politiko podjetja. Tretje poglavje zajema opis joge, njeno psihologijo in filozofijo. Nadaljujemo z zgodovinsko razlago joge in njenih poti ter jogo pripeljemo vse v današnji čas, kjer prestavimo različice joge danes. Joga nam med drugim nudi pet podanih načel, ki so pravilna sprostitev, pravilni telesni položaji, pravilno dihanje, pravilna prehrana, meditacija in pozitivno razmišljanje. Primere prakse joge pa najdemo tudi v organizacijah, te smo podali, zraven opisa koristi joge v organizaciji. Na koncu smo naredili kvalitativno raziskavo s pomočjo intervjuja ter opisali sodelujoče organizacije pri raziskavi, podali smo izvedbo raziskave, predstavili rezultate, preverili hipoteze in zapisali ugotovitve. Investicija v človeške vire se nam zdi danes nujna za uspešno poslovanje organizacije. Investiranje v človeške vire mnoge organizacije še vedno smatrajo kot strošek, vendar na tam mestu lahko uporabimo rek »kdor ne investira, ne profilira«. Strošek ali investicija, se lahko vprašamo pri marsikaterem izdatku. Pomembno si je postaviti prioritete in se zavedati pomembnosti ljudi znotraj organizacije. V kolikor se zavedamo pomembnosti ljudi v organizaciji, bomo izdatek za človeške vire poimenovali investicija brez premisleka. Investicije so lahko različne, vendar mi priporočamo jogo, saj je tako široka in fleksibilna vsebina, ki se jo da aplicirati v katerokoli organizacijo. ; Today we live a very fast life and at this tempo we often forget ourselves and fellow humans. We are forgetting about the potential that lies within each and every one of us. Our body is the most sophisticated mechanism we know, but it's proper management is yet to be learned. Properly using our body can be learned thru yoga. Yoga is a very broad concept, so we have devoted an entire chapter to this topic, where it is explained in more detail. Human resources are also a very complex topic. All types of organizations face the issue of managing people or organizing human resources. At this point, we have seen the opportunity of linking two complex themes that coincide, as organizations are confronted with many issues for which yoga offers a solution. In the beginning of this research we define human resources, where we deal with an intangible capital, man power and knowledge. The next part is devoted to explananing the management of human resources, which covers the planning, employment and development of employees. In the chapter on investment in human resources, we present human resources as capital of a company, interpersonal relations, employee well-being, sustainable development and company policy. The third chapter covers the description of yoga, its psychology and philosophy. We continue with the historical overview of yoga and its paths, and continue to our present time, where we present different types of yoga used today. Yoga, among other things, offers us five principles, which are proper relaxation, proper bodily positions, proper breathing, proper diet, meditation and positive thinking. Examples of yoga practice can also be found in organizations, which we have outlined, besides describing the benefits of yoga in the organization. In the end, we made a thorough research with the help of an interview and described the participating organizations in the survey. We presented the results and data from our research, examined the hypotheses, and recorded the findings. We believe that investment in human resources is necessary for running a successful organization. Investing in human resources is still considered by many organizations as an expense, but in this case we can say no risk no reward. Cost or investment, is a debate in most of expenses. It is important to set priorities and be aware of the importance of people within the organization. If we are aware of the importance of people in the organization, we will call the expenditure for human resources an investment without consideration. Investments may be different, but we recommend yoga, as it is both a wide and flexible content that can be applied to any organization.

V prvem delu magistrskega dela sem se osredotočil na zgodovino in organiziranost gasilcev v Sloveniji in Združenih državah Amerike, predstavil sem požarno preventivo in vzroke za požare. V svetu požari postajajo vedno večji problem, saj zaradi klimatskih sprememb, staranja prebivalstva, malomarnosti ljudi, nepazljivosti, novih tehnologij, različnih novih materialov in zmanjševanja vlaganj v požarno varnost lahko povzročijo vse večjo premoženjsko, materialno in človeško škodo. S tem lahko opozorimo na dejstvo, da je gasilstvo zelo pomembna družbena panoga, ki pa je v Sloveniji slabše cenjena kot v Združenih državah Amerike. K znanju in usposobljenosti gasilcev izjemno pripomorejo zgodovina, organiziranost in vlaganje denarja. Seveda ne smemo pozabiti tudi na izboljševanje zakonodaje področja požarne varnosti, ki zajema tako načrtovanje požarne varnosti in tudi samo gašenje požarov. Organiziranost gasilcev v Sloveniji in Združenih državah Amerike je različno, saj se zdi da so ameriški gasilci bolje tehnično in organizacijsko izurjeni. V zgodovini obeh držav se je zgodilo mnogo uničujočih požarov, ki so terjali veliko smrtnih žrtev in premoženja. V drugem delu magistrskega dela sem opravil statistično analizo števila požarov in škode, ki je pri tem nastala v Sloveniji in v Združenih državah Amerike v obdobju od leta 1992 do leta 2018. V Sloveniji se vsako leto zgodi od 4000 do 6000 požarov, v Združenih državah Amerike pa se v zadnjih letih zgodi od 1,3 milijona do 1,6 milijona požarov letno. Najpogostejši požari so požari v objektih, v prometu, v naravi in v komunalnih ali drugih zabojnikih. V Sloveniji se skozi leta število požarov drastično ni spremenilo, vendar pa število ves čas niha. V Združenih državah Amerike se je število požarov iz leta 1992 zmanjšalo za okoli 25 %. Število poškodovanih v požarih se v Sloveniji v zadnjih letih malce zvišuje, število smrtnih žrtev požara pa ostaja dokaj konstantno. V Združenih državah Amerike obe ti številki skozi leta padata. Izjema je le leto 2001, ko se je zgodil napad na World Trade Center. Premoženjska škoda, ki je nastala v požarih, je v Sloveniji v zadnjih letih okoli 7 milijonov evrov, v Združenih državah Amerike pa se ta številka že več kot 15 let vrti okoli 15 milijard dolarjev. Spet pa je izjema leto 2001 zaradi napada v New Yorku, ki je povzročil več kot 30 milijard denarne škode. ; In the first part of the master's degree thesis, I focused on the history and organization of firefighters in Slovenia and United States of America, I presented fire prevention and the causes of fires. In the world, fires are becoming an increasing problem, as they can cause increasing property, material and human damage due to climate change, population aging, human negligence, carelessness, new technologies, various new materials and reduced investment in fire safety. Therefore, firefighting is a very important social sector, which is less valued in Slovenia than in the United States. History, organization and investment of money contribute enormously to the knowledge and skills of firefighters. Of course, we must not forget to improve the legislation in the field of fire safety, which includes both fire safety planning and firefighting itself. The organization of firefighters in Slovenia and the United States is different, it seems that American firefighters are better technically and organizationally trained. In addition, this profession is also more valued there. There have been many devastating fires in the history of both countries, claiming many lives and property. In the second part of my master's degree thesis, I performed a statistical analysis of the number of fires and damage that occurred in Slovenia and the United States in the period from 1992 to 2018. In Slovenia, between 4,000 and 6,000 fires occur every year. In the United States, however, 1.3 million to 1.6 million fires have occurred in recent years. The most common fires are fires in buildings, in traffic, in nature, and in communal or other containers. In Slovenia, the number of fires has not changed drastically over the years, the number fluctuates all the time. In the United States, however, the number of fires in 1992 fell by about 25 percents. The number of people injured in fires in Slovenia has been rising slightly in recent years, while the number of fatalities in fires has remained fairly constant. In the United States, however, both of these numbers have been falling over the years. The only exception is 2001, when the attack on the World Trade Center took place. The property damage caused by fires in Slovenia in recent years is around 7 million euros, and in the United States this figure has been hovering around 15 billion dollars for more than 15 years. Again, the exception is 2001 due to the attack in New York, which caused more than 30 billion in monetary damage.

Meje med državami članicami Evropske unije na nek način obstajajo le še na papirju – prebivalci Evropske unije lahko delamo v drugih državah članicah, podjetja pa na primer lahko poslujejo v drugih državah članicah pod istimi pogoji kot poslujejo domača podjetja. Notranji trg Evropske unije tako ponuja številne priložnosti podjetjem, ki želijo razširiti svoje poslovanje izven meja svoje države ter s tem izboljšati svoj položaj na zelo konkurenčnem trgu. Priložnosti, ki jih prinaša notranji trg Evropske unije, pa spremljajo izzivi in ovire, za katere je potrebno znanje in viri, tako finančni kot človeški, da se premostijo. Zaradi omejenosti sredstev so mala in srednje velika podjetja bolj izpostavljena izzivom ter se težje spopadajo z ovirami kot pa velika podjetja. Dejstvo, da so skoraj vsa podjetja v Evropski uniji mala in srednje velika podjetja, nalaga ustvarjalcem poslovnega in zakonodajnega okolja veliko odgovornost – malim in srednje velikim podjetjem, še posebej pa mikropodjetjem, je potrebno zagotoviti trg, na katerem lahko enakovredno nastopajo skupaj z velikimi podjetji. Znaten delež malih in srednje velikih podjetij v Evropski uniji je mnenja, da je prav zakonodaja tista, ki predstavlja najvišjo oviro pri njihovem poslovanju. Za zagotovitev skladnosti z evropsko oziroma nacionalno zakonodajo morajo nameniti velik delež svojih virov, kar nedvomno vpliva na njihovo poslovanje in konkurenčnost. Zavedajoč se izjemnega pomena malih in srednje velikih podjetij za evropsko gospodarstvo, Evropska komisija s svojimi predlogi, akti, ukrepi ter programi zmanjšuje administrativna bremena ter na ta način poskuša zagotoviti enakovredne konkurenčne pogoje za vsa podjetja, ne glede na njihovo velikost. Na vseh korakih cikla specifičnega akta/politike se posebno pozornost namenja malim in srednje velikim podjetjem, še posebej pa mikropodjetjem, ter administrativnim bremenom. Tako se že pri prvotnem načrtovanju pobude, ko Evropska komisija objavi t.i. časovnico, naredi preliminarna ocena potencialnih vplivov pobude na mala in srednje velika podjetja. Preden pa Evropska komisija dejansko predlaga nov predlog, se naprej skozi javno posvetovanje posvetuje z relevantnimi deležniki in oceni možne posledice predloga - to naredi s tako imenovano oceno učinka, ki je obvezna za najpomembnejše pobude in pobude z daljnosežnimi posledicami. Sama ocena učinka je del »MSP testa«, v okviru katerega se, med drugim, naredi natančna analiza učinkov predlagane pobude na mala in srednje velika podjetja. V oceni učinka je posebno poglavje namenjeno tudi analizi administrativnih bremen oziroma administrativnih stroškov, ki bi nastali s sprejetjem pobude, ki se ocenjuje. Rezultati te analize in »MSP testa« omogočajo podlago za odločitev, ali bodo mala in srednje velika podjetja morala upoštevati vse obveznosti, ki izhajajo iz pobude, ali bodo morebiti iz določenih obveznosti izključena oziroma bo za njih veljal blažji režim. Med samim izvajanjem posamezne pobude oziroma po koncu njenega izvajanja Evropska komisija z vrednotenjem redno ocenjuje uspešnost, učinkovitost, ustreznost in dodano vrednost ukrepov Evropske unije. V okviru Programa ustreznosti in uspešnosti predpisov – REFIT, ki je bil uveden z namenom narediti zakonodajo Evropske unije kakovostnejšo in lažjo, se izvajajo korektivni ukrepi obstoječe zakonodaje, vrednotenja in preverjanja ustreznosti, ter razveljavitve obstoječe zakonodaje, ki ne služi svojemu namenu. Ne glede na vse napore in ukrepe Evropske komisije za zmanjšanje administrativnih bremen še vedno obstajajo zakonodajni akti, ki so za mala in srednje velika podjetja, še posebej pa za mikropodjetja, zelo obremenjujoči. Leta 2012 so mala in srednje velika podjetja v javnem posvetovanju identificirala deset zakonodajnih aktov Evropske unije, ki so za njih najbolj obremenjujoči - Evropska komisija je v zvezi z identificiranimi akti, kjer je to možno, že ukrepala. ; In a way, borders between the Member States of the European Union remain to exist only on paper – for example, citizens of the European Union can work in other Member States, while enterprises can do business in other Member States under the same conditions as domestic enterprises. Due to lack of resources, small and medium-sized enterprises are more exposed to challenges and face more difficulties with overcoming barriers, in comparison with large enterprises. The fact that almost all enterprises in the European Union are small and medium-sized enterprises imposes a great responsibility on creators of the business and regulatory environment – a market on which small and medium-sized enterprises, and especially micro-enterprises, will be able to equally compete with large enterprises must be ensured. A significant share of small and medium-sized enterprises in the European Union shares the opinion that legislation represents the highest barrier to conduct business. They have to allocate a great share of their resources in order to ensure compliance with European and/or national legislation, which undoubtedly impacts their operations and competitiveness. Being aware of the immense significance of small and medium-sized enterprises for the European economy, the European Commission is reducing administrative burden with its proposals, acts and programmes. In this way, the European Commission is trying to ensure a level playing field for all enterprises, regardless of their size. On all steps of a cycle of a specific act/policy, special attention is paid to small and medium sized enterprises, especially to micro-enterprises, and administrative burden. It starts with the planning of the initiative, when the European Commission publishes a roadmap, in which a preliminary assessment of initiative's potential impacts on small and medium-sized enterprises is done. Furthermore, before the European Commission actually proposes a new proposal, it first evaluates its possible consequences with a so-called impact assessment, which is obligatory for the most important initiatives and for initiatives with far-reaching consequences. The impact assessment is also a part of a "SME test", in the context of which a detailed analysis of initiative's impacts on small and medium-sized enterprises is conducted. Moreover, a specific chapter is dedicated to the analysis of administrative burden and administrative costs, which would be incurred with the adoption of the respective initiative. Results of the analysis and of the SME test represent a basis for a decision whether small and medium-sized enterprises will be included in all obligations, deriving from the initiative, or whether they will be excluded from certain obligations or will they be a subject to a milder regime. During the implementation of a specific initiative or at the end of its implementation, the European Commission regularly assesses the effectiveness, efficiency, relevance and added value of the European Union's measures. In the context of the Regulatory Fitness and Performance programme – REFIT, which was introduced with the intention of making the legislation of the European Union lighter and of greater quality, corrective measures of existing legislation, evaluations and fitness checks, as well as repeals of existing legislation which is not fit for its purpose, are carried out. Despite the efforts and measures of the European Commission to reduce administrative burden, legislative acts, which are very burdensome for small and medium-sized enterprises, still exist.
