학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 엄석진. ; 이 연구는 '입법에 의한 행정통제의 제도화' 과정을 입체적으로 살펴보기 위하여, 김영삼 정권 시기에 제정된 행정절차법과 정보공개법의 제정과정을 옹호연합모형(ACF)을 적용하여 비교 분석한 것이다. 이를 통하여 대통령과 행정부, 의회 등 입법과정의 주요 행위자에 초점을 두어 한국 행정절차법 제정과정을 연구한 Ginsburg(2001)의 고착 모형(Lock-in Model)과 Baum(2007)의 통제 모형(Rein-in Model)이 간과한 시민단체·학계·정당 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고자 하였다. 분석 결과, 첫째, 양 법률의 제정 과정에서 적극적 개혁연합과 보수적 개혁연합이 존재하였으며, 촉발기제 및 여론의 관심, 옹호연합의 대립과 입법 주도권 정도에 따라 입법의 지연과 법률 내용의 변화를 가져왔다. 특히 양 법률의 제정과정을 비교함으로써 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 새롭게 발견할 수 있었다. 둘째, 입법 과정에서 국회의 영향력은 미약하였으며, 대통령이 강한 리더십으로 입법을 추진하더라도 법률의 규율 대상인 관료제가 입법 과정에 참여함으로써 법률 내용에 한계가 나타났다. 이는 그동안 김영삼 정부 시기의 행정법제 개혁에 대한 상반된 평가, 즉 한편으로는 행정절차법과 정보공개법의 제정으로 법치주의를 향한 진전이 있었다고 평가되면서도, 그 내용적 측면에서는 소극적이고 수세적이며 지속적인 개선이 필요하다는 지적에 대해 제정과정 측면에서 해답을 제시하고 있다. 즉, 양 법률 공히 제정과정에서 국회가 주도적 역할을 하지 못한 가운데, 대통령의 리더십과 시민사회의 요구를 바탕으로 입법이 추진되었지만, 양 법률의 규율 대상인 관료제가 입법과정에 깊숙이 참여함으로써 내용적 측면에서 한계가 나타날 수밖에 없었음을 보여준다. 결과적으로 이 연구는 양 법률의 제정 과정을 비교함으로써 시민단체·학계 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고, 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 발견하였다. 향후 대통령과 관료제 간의 심층적인 상호작용 및 정책중개자의 실체와 역할 등을 밝히는 연구가 추가적으로 이루어진다면, 김영삼 정부 시기 행정법제 개혁의 성과와 한계를 체계적으로 밝히는데 기여할 수 있을 것이다. ; This study aims to do the comparative analysis of the enactment process of the Administrative Procedure Act(APA) and the Freedom of Information Act(FOIA) enacted in the Kim Young Sam regime by applying the Advocacy Coalition Framework(ACF) with a view to looking into the various aspects of the process of 'Institutionalization in control of administrative process by the legislative'. This study has the purpose of identifying the interactions of a large variety of agents such as civil organizations, academic profession, political parties and bureaucracy which was overlooked in the previous studies - Lock-in Model by Ginsburg(2001) and Rein-in Model by Baum(2007) - which analyzed the enactment process of Administrative Procedures Act in Korea, focusing on the official agents in the legislative process such as President, the executive branch, and Congress, etc. The results and the findings of this study can be summarized as follows. First, there were two major agents in the enactment process of the APA and FOIA, the active coalition and the conservative coalition, which resulted in the delay of the legislation and the modification of the laws depending on triggering mechanisms, the public's attention, legislative advocacy coalition, and the degree of the initiative. In particular, by comparing the enactment processes of both Acts, it was concluded that the characteristic of the interactions as above was the major cause that led to the delay of the legislation and the modification of the laws. Second, even after democratization in Korea, the influence of the National Assembly in the legislative process was weak. Even though presidential's legislative power was strong, limitations on the institutionalization of legal control has still remained because executive branch as target discipline has been involved in the legislative process. Thus, the findings of this study may partially provide answers to the question on differences between APA and FOIA legislation process. The dynamics of power was present between bureaucrats and civil organizations in the legislative process, and the contents of the bill and the time delay varied with the degree of a legislative initiative of officials who was the main opposition coalition in the enactment process. The further research in the future on in-depth interaction between the president and the bureaucracy, and on the role of the policy broker will be able to contribute to systematically elucidate in the achievements and limits of the reforms of administrative laws in the Kim Young Sam regime. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Also local governments and local assemblies should cooperate each other for establishing desirable local autonomy culture not depending on the unilateral power. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱, 강원택. ; 본 연구는 제18대 국회 전반기 2년간 본회의 표결 기록을 분석하여 개인 의원의 당론이탈투표 행위를 결정하는 유의미한 변수를 찾아내는데 그 목적이 있다. 구체적으로 본 논문은 강한 정당기율의 전통에도 불구하고 국회의원들이 표결 현장에서 당론을 이탈해 독립적으로 행동하는 현상을 목격하고, 이를 결정하는 요인을 분석하고자 한다. 이러한 목적에서 18대 국회 전반기동안 의원직을 유지한 한나라당과 민주당 의원 241명의 본회의 전자표결 기록을 분석하여 이들이 당론과 다른 표결을 하도록 결정하는 요인을 찾는다. 한국의 국회 내 표결행태에 관한 다양한 연구는 의원 행위를 결정하는 다양한 요인 중 정당의 제도적 영향력을 크게 평가한다. 이에 따르면 한국의 정당은 형성기부터 권위주의 시기를 거치면서 그 기율을 강화하였고, 의원들의 행위를 제한하고 통제하는 역할을 수행해왔다. 그러나 국회의원이 단순히 정당기율만을 따라 수동적으로 행동하는 존재가 아니라는 증거 또한 여럿 찾아볼 수 있다. 구체적으로 표결의 영역에서 의원들은 당론에 배치되는 두 가지 선택을 할 수 있다. 즉, 의원은 적극적으로 본회의에서 당론에 일치하지 않는 방향으로 투표하거나 소극적으로 기권이나 표결불참을 택할 수 있다. 비록 많은 비중을 차지하지 않더라도 국회의원들이 당론으로부터 이탈하여 독립적으로 표결하는 경우가 발견된다는 사실은 강한 정당기율만을 강조해왔던 기존의 연구 전통에서 벗어나 새로운 관점에서 의원 표결을 바라볼 필요성을 제기한다. 이러한 관점에서 본 연구는 의원을 전략적 행위자로 가정하고, 18대 국회 전반기에 의원들이 당론을 이탈하여 표결하는 데 영향을 미친 유의미한 결정요인을 찾는데 주목하였다. 이를 위하여 특정 의원의 소속 정당 다수가 투표한 선택지를 당론으로 정의하고, 개인 의원이 모든 표결에 대하여 당론을 이탈하여 투표한 비율을 종속변수로 설정하였다. 연구는 표결불참을 분석대상에 포함한 포괄적 당론이탈투표 모형과 표결불참을 제외한 단순 당론이탈투표 모형의 두 차원으로 구성된다. 의원의 당론이탈투표를 결정하는 요인을 찾기 위하여 제도적, 지역구적, 의원 개인적 요인의 세 가지로 분류된 독립변수를 설정하였고, 가중최소제곱 그룹 로지스틱 회귀분석을 통한 계량 분석을 시행하였다. 연구 결과는 다음과 같이 요약될 수 있다. 첫째, 포괄적 당론이탈투표 모형에서 국회의원들이 당론을 이탈하여 투표하는 데 영향을 미친 유의미한 결정요인은 제도적 변수로 밝혀졌다. 먼저, 국회의원들은 그들이 정당으로부터 자율성을 획득할 때 정당 다수로부터 이탈하여 표결할 가능성이 높다. 구체적으로 당내에서 경험과 연륜을 통하여 비공식적인 리더십을 획득하고 있는 선수가 높은 의원들이 상대적으로 더 자율적이므로 당론을 이탈할 가능성이 높다. 반면, 정당 지도부에 위치한 의원들은 정당 전체를 책임져야 하는 입장에 있으므로 정당으로부터 자유로운 선택을 할 수 없으며 따라서 당론을 고수할 가능성이 높다. 둘째, 단순 당론이탈투표 모형에서 그 동안 크게 주목받지 못하였던 변수 중 하나인 이념이 유의미한 변수로 확인되었다. 분석에 따르면, 진보적인 의원일수록 당론으로부터 이탈하여 표결할 가능성이 높다. 특히, 표결불참을 분석에서 제외했을 때 이념이 중요한 결정요인으로 대두되었다는 사실이 시사하는 바는 크다. 의원들이 표결을 통해 전면적으로 당론에 배치되는 입장을 표명할 수 있는 것은 정당이 줄 수 있는 제도적 인센티브를 뛰어넘는 개인의 강한 이념적 속성 때문이라는 것이다. 그러나 본 연구에서 이념 변수는 정책과 이념과의 연계성 측면에서 해석된 것이 아니라 의원이 당론을 따를 것인가 이탈할 것인가를 결정하는 일반적인 이념성향으로, 이념이 정책과의 연계 속에서 당론이탈투표에 직접적으로 미치는 영향력을 측정하지는 못하였다는 한계를 갖는다. 본 연구는 건강한 대의 민주제도를 수립하는 데 필요한 요인들에 대한 함의를 제공하였다는 점에서 의의를 갖는다. 당론이탈투표의 결정요인을 연구한 결과 당론이탈투표가 의원들의 제도적 자율성에서 비롯된 것임을 알 수 있었다. 이는 그동안 많은 학자들이 한국 국회의 갈등과 비효율성을 고질적인 문제로 지적하면서 그 원인으로 강한 정당기율과 당내 비민주성을 꼽아온 것과도 일맥상통하는 결과이다. 나아가, 이념이 당론으로부터의 이탈을 촉진하는 요소 중 하나임이 밝혀졌다는 점에서 의원들이 보다 자율성을 가질 수 있는 민주적인 원내외 정당구조가 확립된다면 의원들이 보다 이념 등에 기반하여 표결할 수 있는 정치적 환경이 확립될 것이라 예상할 수 있다. ; The purpose of this study is to identify meaningful variables effecting individual national assembly member's party defection votes by analyzing floor voting records for the first two years of the 18th National Assembly of the Republic of Korea. Specifically, the study will analyze the factors that result in party defection voting behavior by assembly members, a practice that betrays the tradition of strong party discipline. To this end, the study analyzes the roll-call voting record of 241 Grand National Party and Democratic Party assembly members having held office during the first half of the 18th National Assembly to analyze the factors that cause party defection votes. Various studies on voting behavior within the National Assembly assess that party is the major influence on assembly member's voting behavior. The logic is that Korean political parties, from their inception, and, experiencing phases of authoritarian government, strengthened party discipline in kind, giving birth to a tradition of party exercising significant control over assemblymen's behavior. However, plenty of evidence indicating that assembly members are more than just passive beings submissive to party discipline is to be found. In the act of voting, two choices in disagreement with the party line are available. The first is active party defection voting, wherein a vote is cast in a direction out of line with one's party. Second is passive defection behavior, wherein one chooses abstention or absence to avoid casting a party-line vote. Although not common, the fact that assembly members on occasion display independent voting behavior, defecting from party majority, raises the need for a new explanation other than strong party discipline, which has been identified in the existing literature as the significant determinant of voting behavior. The study assumes that assemblymen are strategic actors seeking utility through floor voting, and focuses on identifying significant determinants of assembly members' party defection votes in the first half of the 18th National Assembly. For this purpose, the party-line was identified as the voting choice of the majority of assembly members in a party, and party defection voting behavior by individual assembly member was set as the dependent variable. The study is divided into two models: In the comprehensive defection model, absences from floor voti are included in the analysis, where as in the simple defection model, they are not. To identify deciding factors of assembly members party defection votes, independent variables were categorized as institutional, representational, and individual variables. Weighted least squares group logistic regression analysis was performed. The results of the study can be summarized in three points. First, institutional variables were identified as having a significant effect on assembly members' party defection voting. Assembly members are more likely to defect from the party-line in voting when they have autonomy from their party. This is because assembly members having served multiple terms, who are not part of the official party leadership, but who, with relatively more experience, in effect are part of party leadership, can afford to be more autonomous. On the other hand, assembly members who are officially in party leadership are accountable for the entire party, and are relatively less able to vote in a direction not in agreement with the party line. They can therefore be expected to vote in line with the party. Second, in the simple defection model, ideology, a variable that had largely been dismissed in the past was confirmed as having a statistically significant influence. Analysis showed that the more progressive an assembly membern, the higher the likelihood of party defection voting behavior. The fact that the influence of ideology was only visible when absences were not included in analysis has wide implications. This indicates that assembly members' making known their personal standing on issues through floor voting, directly opposing the party-line, is only possible because the strength of individual ideology is such that it outweighs the institutional incentives offered by party. However, in the study, the ideology variable was not interpreted in connection with policy; rather, ideology was defined as a general tendency to defect or vote in line with party majority. Therefore, the direct influence of ideology on party defection in a policy context could not be measured. The study's significance lies in unearthing new implications regarding the building blocks of a healthy representative democracy. The results of the study, which analyzed the deciding factors of party defection votes, showed that party defection was the result of assembly members' institutional autonomy. Such results are in line with existing literature, which points to strong party discipline and undemocratic intra-party structure as the key causes of the Korean National Assembly's chronic inefficiency and confrontations. The study identified ideology as a factor that increases the likelihood of party defection; it can therefore be forecast that once a more democratic party system is established both on and off the floor, assemblymen will be able to exercise greater autonomy, leading to a political environment in which factors such as ideology may have a more pronounced influence on voting behavior. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. Third, the government should prepare the specific legal and institutional means for the use of participative decision making. ; Master
