Toplamda 57 ülkenin üyesi bulunduğu örgütün temel sorunu üye ülkelerin ekonomik gelişmişlikleri arasındaki farktır. Üye ülkelerin bir kısmı zengin doğal kaynaklara sahipken diğer önemli bir kısmı, yüksek işsizlik ve yetersiz üretim gibi sorunlar yaşamaktadır. Dolayısıyla bu anlamda farklı gelişmişlik düzeylerine sahip bu ülkelerin Avrupa Birliği ve benzeri yapılanmalar gibi ortak ekonomi politikaları üretmeleri kısa vadede mümkün gözükmemektedir. Keza örgüt içinde benzer gelişmişlik seviyelerine sahip ülkelerin de bu doğrultuda bir çaba içinde olmadıkları gözükmektedir. Ayrıca üye ülkeler arasındaki ticaret hacmi de potansiyelin çok altında kalmaktadır. Tüm bu durumların varlığı çalışmanın amacını ortaya koymaktadır. Çalışmanın amacı, beşeri ve doğal kaynaklar bakımından zengin olan İslam İşbirliği Teşkilatı'nın mevcut ekonomik yapısını incelemek ve taşıdığı potansiyellere rağmen istenen ölçüde başarı ortaya koyamamasının nedenlerini sorgulamaktır. ; The Organisation of Islamic Cooperation, although it its the most populated organisation in the world after the United Nations, it is very far from its counterparts in terms of cooperation between member states. The main problem of the organisation which has 57 members is the difference between the economic developments of the member states. While some of the member states have rich natural resources, others face problems such as high unemployment and insufficient production. Therefore, in the short term it is seem impossible for these countries with different levels of development to produce common economic policies such as the European Union and similar structures. However, it is also seems that member states which has similar levels of development are not making an effort to make common economic policies. Moreover, the volume of trade between the Member States remains well below the potential. The aim of this study is to examine the current economic structure of the Organisation of Islamic Cooperation, which is rich in human and natural resources, and to question the reasons its failure to achieve the desired economic success despite its potential.

Türkiye-Avrupa Birliği ilişkileri; 31 Temmuz 1959 tarihinde Türkiye'nin AET'ye katılmak için müracaatıyla başlamış ve 17 Aralık 2004 tarihinde Brüksel Zirvesinde müzakerelere başlama tarihi alınmasıyla Türkiye ? Avrupa Birliği bütünleşmesi yeni bir aşamaya gelmiştir. Müzakere sürecinin en can alıcı konusu, Türkiye'nin başını en fazla ağrıtmaya aday dosyası ise tarımdır. 2006 yılı ticaret verilerine göre, Türkiye'nin Avrupa Birliği ülkelerine ihracatındaki payı ,04 oranında, ithalatındaki payı ise ,55 oranında olduğu görülmektedir. Tarım sektöründe ise yaklaşık olarak bu oran ithalatında %1,3 oranında, ihracatında %4,2 oranındadır. Bu çalışmada ilk olarak Türkiye ve Avrupa Birliği tarım sektörünün genel özellikleri, tarım politikaları, tarımsal destekleme yapıları, Türk tarımının Avrupa Birliği karşısındaki durumu ve ortak tarım politikasına uyumu incelenerek, Türkiye ve Avrupa Birliği'nde tarımın dış ticaretteki yeri ve önemi ortaya konmaya çalışılmıştır. Çalışmanın sonucunda, Türk tarımı; ekonomideki yeri ve önemi, uygulanan politikalar, tarımın yapısı, işletmelerin büyüklüğü, organizasyonu, dağılımı, üretim deseni, üretim hacmi, verimlilik düzeyi, genel performansı v.b. itibariyle Avrupa Birliği tarımına göre çok önemli farklılıklar görülmektedir. Tarım ülkesi olarak bilinen Türkiye'nin dış ticaretindeki istatistik verileri incelendiğinde, tarımsal alanda ihracattan çok ithalat yapıldığı, tarım ihracatçısı konumundan uzaklaşıp tarım ithalatçısı bir ülke konumuna girdiği anlaşılmaktadır. Türkiye'deki çiftçilere destekleme ve teşvikler yoluyla tarımsal ürün çeşidinin değiştirilmesi sağlanarak üretilen ürünlerin sanayiye hammadde sağlayan endüstriyel tarım ürünlerine yöneltilmesi gerekmektedir. Böylelikle Türkiye tarımsal ithalatındaki en yüksek paya sahip olan ürünleri üreterek tarım ithalatçısı konumundan kurtulup, tarım ihracatçısı bir konumuna tekrar dönebilir. Çalışmanın sonuç kısmında bu sorunlara ilişkin değerlendirmeler yapılmıştır. ; The relation between Turkey and the European Union has started with the application of Turkey to the AET on 31 July 1959 and with the conclusion taken at the Brussels Top on 17 December 2004 to start with the deliberation period, the integration Turkey-European Union has come to a new level. The crucial subject of the deliberation period is agriculture which is also one of the subjects that will be a problem for Turkey. According to the trade figures of the year 2006, Turkey has a export share of 56,04 % to the European Union?s countries and an import share of 42,55%. In the agriculture sector the import share is approximate 1,3% and the export share 4,2%. In this action firstly Turkey and European Union?s agriculture sector?s general specialities, agricultural policies, agricultural subsidies structures, the Turkish agriculture position in view of the European Union?s and the common agricultural policies accordance is been investigated, to show the importance of agriculture in the foreign trade of Turkey and European Union. The result of this action is as follows the turkish agriculture; its economic position and importance, the policies that is been carried out, the agricultural structure, the enterprises: dimension, organisation, distribution, production profile, production capacity, productivity level, general performance and so on in view of the European Union?s agriculture there are very important differences. When the foreign trade figures of Turkey which is known as an agriculture country is been inspected, you can see that Turkey on agricultural level mostly imports then exports, it digresses from its agricultural exporter position and it so becomes more and more an agricultural importer. By financing and supporting the Turkish farmers to make them change the agricultural products variety, it is needed to make a change-over from the produced products to industrial agricultural products which will be the industry?s raw material. By this way Turkey will produce the products which has a great share in the agricutural import and so will be released from its agriculture importer position and will return to its agrıculture exporter position. At the end part of this action the evaluation related to this problems is been made.

Küreselleşme öncesinde yeterince önemsenmeyen doğrudan yabancı yatırımlar, kalkınmaya katkısının daha iyi anlaşılmasıyla hem gelişmiş hem de gelişmekte olan ülkeler tarafından rağbet görmeye başlamıştır. Gelişmekte olan ülkeler çoğu zaman üretmekte yetersiz kaldıkları teknolojiyi ithal etmiştir. Teknoloji transferi, patent ve lisans anlaşmalarıyla yapıldığında pahalı ama doğrudan yabancı yatırım yoluyla gerçekleştiğinde az maliyetli olmaktadır. Doğrudan yabancı yatırımlar ile bir ülkeden yatırım ülkeye sermaye aktarımıyla birlikte işletmecilik bilgisi, teknoloji de gelmektedir. Bu gelen teknolojinin gelişmiş ülkelerin teknolojik gelişmesine katkı sağlayabilmesi için devletlerin aktif rol üstlenmesi önemlidir. Güney Kore, Singapur ve Tayvan gibi ülkeler devlet kontrolünde teknolojik gelişmeyi gerçekleştirmişlerdir. Türkiye, doğrudan yabancı yatırımlar konusunda uyguladığı politikalarla hala istediği teknolojik gelişme düzeyini yakalamamıştır. Polonya ise Türkiye ile başlangıçta aynı şartlara sahip olmasına rağmen uyguladığı yatırım politikalarıyla teknolojik gelişmeyi arttırabilmiştir. Doğrudan yabancı yatırımlar ile teknolojik gelişmenin sağlanmasında otomotiv sektörünün önemi büyüktür. Bu bağlamda Türkiye ve Polonya otomotiv sektörüne yoğunlaşmıştır. Bu çalışmada önce doğrudan yatırımların tarihi gelişimi ve farklı ülkelerin teknolojik gelişme süreçleri ele alınacak, ardından Türkiye'nin teknolojik gelişme süreci değerlendirilecektir. Son bölümde ise, devletin teknolojik gelişmeyi artırmak için doğrudan yabancı yatırım konusunda nasıl bir rol üstlenmesinin uygun olduğu sorusuna, Türkiye ve Polonya'nın otomotiv sektörleri özelinde cevap aranacaktır. --- ABSTRACT Foreign direct investments, which were not taken care of before globalization, became a focus of interest by all countries with a better understanding of their contribution to development. Developing countries have often imported the technology they have been unable to produce. Technology transfer is costly when it is made through patent and license agreements, but it is less costly when it is realized through direct foreign investment. Investment in a country from a country through foreign direct investments, business knowledge and technology, as well as the transfer of capital to the country. It is important for states to take an active role in this technology to contribute to the technological development of the developed countries. Countries such as South Korea, Singapore and Taiwan have achieved technological development under state control. Turkey has still wants to capture the level of technological development policies implemented in foreign direct investment. In Poland, although initially have the same conditions with Turkey could increase its investment policy implemented by technological developments. The importance of the automotive sector is crucial for the development of direct foreign investments and technological development. In this context, Turkey and Poland are concentrated in the automotive sector. In this study which will be discussed briefly before technological development process of historical development and different countries in foreign direct investments inflows, followed by Turkey will be evaluated technological development process. In the last chapter, to improve the state of technological development directly to the question of how it is appropriate to assume a role in foreign investment in private of the automotive sector in Turkey and Poland will seek to answer.

Avrupa Birliği (AB) yarattığı 19 Trilyon Dolar'dan fazla GSYİH ile dünyadaki en büyük ve zengin ekonomik alanlardan birini oluşturmaktadır. Yarım milyardan fazla nüfusu AB'yi dünyanın en kalabalık bölgelerinden biri yapmaktadır. Bütün bu özelliklerine rağmen AB bir devlet değil ve böyle bir iddiası da yok; ancak sıradan bir uluslararası örgüt de değil. AB'nin Tek Pazar ile desteklenen dev ekonomisi elbette ilişkiden bulunan bütün siyasi yapıları etkilemektedir. Hatta pek çok çalışma AB'nin çevre ülkelere ve ticaret ortaklarına yönelik pek çok düzenleyici eylem gerçekleştirebildiğini iddia etmektedir. Böylece, AB, ekonomipolitik bakış açısı ile uluslararası sistem içinde bir güç olarak değerlendirilebilir ; The European Union (EU) produces more than $19 trillion of GDP which makes the EU the biggest and one of the wealthiest economic areas. Its population reaches more than half a billion which makes the EU one of the most crowded territories around the world. However, the EU is not a state in a traditional way and it does not have such a claim; on the other hand the EU is not a standard international organization (IO), either. The EU with its huge economic capacity supported by its single market (SM) has been obviously affecting polities which are in relation with the EU. Even, numerous studies indicate that the EU exercises regulatory actions on many neighboring countries and its other trade partners. Thus, the EU, from a political economy point of view, could be considered as a power in international system.

Dengeli beslenmede oldukça önemli yeri olan zeytinyağı ve sofralık zeytin gerek sahip olduğu özellikler ve gerekse bu sektörde ürünün yetiştirilmesi ve pazarlanması ile uğraşan nüfus itibari ile Türkiye ve Avrupa Birliği'nde önem taşıyan ürünler arasındadır. Bu araştırma ile Türkiye ve AB'nde zeytin ve zeytinyağı sektörünün önemi belirtilmiş ve bu sektör analiz edilerek karşılaştırmalar yapılmıştır. Dünya zeytinyağı üretim ortalaması 1.850 bin ton'dur. Bunun 'lik kısmını AB karşılamaktadır. Diğer üretici ülkeler Tunus, Türkiye ve Fas'tır. Üretim yıldan yıla değişiklik göstermekle beraber dünya pazarını AB etkilemektedir. 1980 öncesi 9 üyeli topluluğun başlıca üretici ülkesi İtalya idi. 1981 'de Yunanistan'ın 1986'da İspanya ve Portekiz'in girişi ile Topluluk zeytinyağı üretimi yılda 1.000.000 ton'un üzerine çıkmıştır. AB'nde Yunanistan, İspanya ve İtalya başlıca üretici ülkelerdir. Bununla birlikte İtalya, aynı zamanda önemli dış alımcı ülkedir. 100 milyona yaklaşan zeytin ağaç varlığı, 90 bin üretici aile ve 1000'den fazla yağhanesi ile Türkiye, dünya zeytin ve zeytinyağı sektörü içinde önemli bir konuma sahiptir. Ancak görünüşte bu önemi belirgin iken, ülkemizin ürünler dünya üretimi ve ticaretinde istenilen konumda olduğunu söylemek güçtür. Bunun nedenleri arasında, üretim düzensizliği son yıllarda ortaya çıkan pazarlama organizasyonundaki olumsuzluklar ile dış ticarete ilişkin politikaların eksikliği ön sıralarda gelmektedir. Karşılaştırmalar sonunda Türkiye ve Avrupa Birliği'nde zeytin ve zeytinyağı sektöründe genel yapı, dış ticaret ve destekleme politikalarında bazı benzerlikler yanında önemli farklılıkların olduğu da tesbit edilmiştir.Bunun içinde öncelikle sektörde yapısal iyileştirmelerin sağlanması gerekmektedir. Türk zeytin ve zeytinyağı sektörünün geleceği, mevcut destekleme politikalarının gözden geçirilmesinin yanı sıra üretimdeki yıllık dalgalanmaları önleyecek tedbirlerin alınması ve sektördeki teknolojinin yenilenerek uluslararası standartlara uyumlaştırılması ile Türk zeytin ve zeytinyağlarının tanıtımının sağlanmasına bağlı olacağı sonucuna varılmıştır. ; Olive oil and table olive, owing to its important place in human nutrition has a significant place in Turkey and in the European Union. In this study, olive and olive oil sector has determined to important and analysed as comparative for Turkey and for the European Union. Average world production is some 1.850.000 tonnes, of which 80% comes from the European Union. The other producers are Tunusia, Turkey and Morocco. Production varies considerably from one year to another, but the world market fluctuates as a direct result of the Community market. In the early 1980 s, when the Community had nine Member States, Italy was the main producer. With the entry Greece in 1981, followed by Spain and Portugal in 1986, olive oil production to over a million tonnes a year. Greece and Spain normally the main suppliers and Italy, although on exporting producer, remains the main purchaser. Turkey has a very important position in the world olive oil sector with almost 100 million olive trees, 90.000 families, that grow olives as their sole crop and over 1000 olive oil processing plants. This importance is clear in terms of the physical wealthy it represents. However, it is not so apparent. In terms of Turkish olive oil production and exports. At first, this was because there were significant problems in production amongst other things. More recently, inadequate marketing organisation and foreign trade policy measures were the main reasons. Under the light of the comparisons, it is concluded that there are significant differences as well as a few similarities in the general formation and the foreign trade policies, in the support policies for olive and olive oil sector in Turkey and the European Union. Therefore, primarly, certain precautions mentioned in the study should urgently be taken to better and promote sector, Future of the olive and olive oil sector depends or to be modernize and existing support policies must be scrutinized besides preventive precautions must taken for years of roughness for productions. Aim of the olive and olive oil of Turkey is to introduced as like international Standard and working for promotions must be important.

AVRUPA BİRLİĞİ'NDE VE TÜRKİYE'DE SERBEST TİCARET ANLAŞMALARIÖzetSon dönemde iletişim, ulaşım ve taşımacılık alanlarındaki teknolojik yenilikler; ülkeler, bölgeler ve kıtalar arasındaki ticareti hem yoğunlaştırmış hem de hızlandırmıştır. Bu sayede günümüzde siyasi açıdan olmasa bile iktisadi ve ticari yönden bütünsel bir dünyadan bahsedilebilir bir noktaya gelinmiştir. Diğer bir ifadeyle ekonomik vizyon bağlamında, artık mali olarak daha az görünür sınırlara sahip bir yerküre ifade edilebilmektedir. Güncel olarak pek kullanılan ''küreselleşme'' kavramı da, şekillendirilen bu tablonun bir anlamda çerçevesini oluşturmaktadır. Globalleşme olarak da ifade edilen bu yeni akım, eski düzene karşı olan, ya da geçmişe rağmen ortaya konan bir model değildir. Aksine tarihsel sürecin ortaya çıkardığı ve geniş bir arka planı olan öğretidir. Ancak denk geldiği dönemin özelliği gereği organizasyonundan kurallarına ve terimlerine kadar batı elbisesi giymiştir. Ancak 80'li yıllardan itibaren etkisi artan biçimde hissedilen küreselleşmenin bileşenleri, doktrinin menşei olan kıta üzerindeki halklar tarafından bile tam olarak özümsenememiştir. Aslında tüm dünya uluslarının, tarihsel varlık süreci bağlamında karşılaşmadıkları uygulamaları da içermemektedir. Ancak ticaret boyutuyla ele alındığı zaman, üretim sürecinden pazara sunulmasına kadarki olan tüm iktisadi faaliyetlerin farklı coğrafi alanları kapsaması, meseleye her biri değişik özelliklere sahip pek çok faktörün katılmasına sebep olmaktadır. Bu anlamda en basit işlemin dahi uluslararası bir hüviyeti olmaktadır. Sonuç olarak da hesaplanması gereken değişken sayısı artmaktadır. Fakat sistem tarafından geliştirilen çeşitli araçlar, söz konusu sorunlara çözümler üretebilmiştir. Ancak bu mekanizmaların karmaşık bir yapısının olmasının yanında, çok taraflılığa dayanan bir yönü de bulunmaktadır. Bu enstrümanlara verilebilecek en iyi örneklerden bir tanesi ise serbest ticaret anlaşmalarıdır (STA). Bu etkin kavram, gerek uluslararası, gerek uluslarüstü, gerekse de bölgesel yapılar tarafından en ideal yöntem olarak benimsenmektedir. Özellikle AB ve ABD tarafından çok sık başvurulan etkin bir araç konumundadır. Hatta kendi aralarında yapmayı düşündükleri bir STA da uzun zamandır gündemde önemli bir yer işgal etmektedir. Bu da STA konusunun gelecekte daha da geniş kapsamlı ve etki gücü yüksek bir kavram ve önemli bir ekonomik ve mali unsur olacağının işareti olarak yorumlanabilir. Aynı şekilde tercihli ya da imtiyazlı ticaret ortamı olarak tanımlanan STA düzenine odaklanılmasının gerekliliğini de buradan anlayabiliriz. Ancak çalışmanın amacı doğrultusunda AB perspektifinden ele aldığımız STA'lara dair meseleler, konunun içeriği gereği, diğer ülke ve kurumlardan tamamen arındırılarak analiz edilmesi çok net ve gerçekçi sonuçlar veremeyeceği kanısındayız. Zira AB'nin kendisi bile 28 üye devletten oluşmaktadır ve öte yandan dünyanın hemen her bölgesinde Birliğin ticari ilişkiler geliştirdiği başka aktörler de bulunmaktadır. Tüm bunlar birlikte düşünüldüğünde AB'nin STA düzeninin oluşumunda etkin olan diğer faktörlerden bağımsız olarak ele alınması güçleşmekte, hatta imkansızlaşmaktadır. Aynı şekilde AB ile Gümrük Birliği tesis eden Türkiye'nin, STA süreçlerinin de, Birlik ile kurulan bağların yok sayılarak incelenmesi mümkün değildir. Dolayısıyla AB'de ve Türkiye'de STA'lara ilişkin durum, belirtilen hususlar göz önünde tutularak ve konunun taraflarının yayımladığı resmi metinler temel alınarak ancak belirli kurallar bağlamında ele alınmış ve düzenlenebilmiştir. Makro yönden kurumlar ve kurullar tarafından denetim, güvenlik ve hesap verilebilirlik öne çıkan başlıklar olurken mikro açıdan bireyler nezdinde düşük maliyet, az ve basit prosedür işlemleri ile sürecin hızlandırılması konuları üzerinde durulan hususlardır. Dolayısıyla çalışmanın faydalı olabilmesi için gündelik yaşamla ilişkilendirilme ihtiyacı doğmuştur. Bu da tutarlı, özgün ve güncel kaynaklardan yararlanmayı gerekli kılmıştır. Bunun neticesinde de görülmüştür ki, şahıslara çok ilgisiz gibi duran başta STA sistemi olmak üzere, yeni uluslararası ve hatta uluslarüstü düzen, aslında kişilerin sosyo-ekonomik durumlarını çok derinden etkilemektedir.Anahtar Kelimeler: Serbest ticaret anlaşmaları (STA), çok taraflı ticaret düzeni, menşe kuralları ve kümülasyonu, müzakere turları.FREE TRADE AGREEMENTS IN THE EUROPEAN UNION AND IN TURKEYAbstractRecently, technological innovations in the fields of communication, transportation, and transportation have accelerated and also intensified trade between regions and continents and countries. In this way, today, we have reached a point where the world can be reported as a holistic world, even if not politically, from the economic and commercial aspects. In other words, in the context of an economic vision, the earth can be expressed as it has financially less visible boundaries now. 'Globalization' which is a frequently used up to date concept, in a sense, constitutes the framework of this embodied table. This new wave, which is expressed as globalization, is not a model against the old order or a model which is put forth despite the past. On the contrary, it is a doctrine brought out with a historical process and has a broad background. However, because of the nature of the period it occurred, it has worn a Western suit to the terms and rules of the organisation. However, the components of globalization, whose impact has been increasingly felt since the 80s, have not been fully internalized by people even on the continent, where is the origin of the doctrine. In fact, it includes applications that all the nations of the world have already encountered in the context of their historical process. However, when taken together with trade dimension, all economic activities cover different geographical areas from the production process to market introduction, and that adds many factors each have different features to this issue. In this sense, even the simplest process has an international identity. As a result, the number of variables to be calculated increase. But a variety of tools developed by the system have been able to produce solutions to the case in point. However, these mechanisms have a complex structure, in addition to this; there is one aspect that is based on multilateralism. Free trade agreements (FTA) are one of the best examples that can be given to these instruments. This effective concept is being adopted as the most ideal method by international, transnational, as well as by regional structures. It is an effective tool that is referenced by especially the EU and the USA very often. As a matter of fact, an FTA which they are thinking to do among themselves has occupied an important place on the agenda for a long time. And this can be interpreted as a sign that the issue of FTA will be an even more comprehensive and effective concept and an important economic and financial factor in the future. Similarly, we can also deduce from this the necessity of a focus on layout of FTA, which is defined as the preferential or privileged trading environment. However, the FTA issues at hand, from the perspective of the EU for the purposes of the study, we believe that analysis cleansed completely from other countries and institutions cannot give very clear and realistic results due to the content of the topic. Because the EU even itself consists of 28 Member States and on the other hand there are other actors that has developed commercial relations of the Union in almost every region of the world. When all of these are considered together, addressing EU independent of other factors that are effective in the formation of the FTA scheme is difficult, even impossible. In the same way it is also impossible to examine the FTA process of Turkey which is a country establishing a Customs Union with the EU, by ignoring the ties with the Union. Therefore, the situation with regard to the FTA in Turkey and in the EU has been taken up and edited in the context of specific rules, in consideration of the matters specified and based on texts published in the official parties of the subject. In macro level, audit, security, and accountability are featured titles by institutions and bodies while in micro level, low-cost, accelerating the process with less and simple procedure are the matters focused by individuals. Therefore, to enable the study to be useful there has been a need to associate it with everyday life. And this has made it necessary to benefit from consistent, original and contemporary sources. As a result it is seen that particularly FTA system, new international and even supranational system that seem to be unrelated, in fact, have a profound influence on the socio-economic conditions of the individuals.Key Words: Free trade agreements, (FTA), the multilateral trading scheme, rules and cumulation of origin, tours in negotiation.

Günümüzde teknolojik gelişmelere paralel olarak kişilerarası iletişim hızla artmış ve bu yoğun iletişim süreci birçok uyuşmazlığın ortaya çıkmasına neden olmuştur. Ticari ilişkilerin gelişmesi ve artan rekabet karşısında yetersiz kalan hukuk sistemleri, adalet etkinliğinin sağlıklı bir şekilde yürütülmesi ve toplumsal barışın sağlanması adına farklı arayışlara yönelerek alternatif çözümler üretmeye başlamıştır. Her toplum kendi sosyal norm ve değerleri çerçevesinde çatışmaların çözümünü adına çalışmalar yapmaktadır. Küresel ekonomilerin gelişmesi ile kişiler arasındaki soyut mesafe kalkmış, dünyanın herhangi bir yerinde yaşanan sorun tüm toplumları etkiler hale gelmiştir. Nitekim, birçok ülkenin yapmış olduğu araştırmalar sonucunda ortak bir anlayış oluşmuş ve uyuşmazlıklara alternatif olarak arabuluculuk yöntemi geliştirilmiştir. Türk hukuk sisteminde de dünyadaki gelişmeleri takiben 2013 yılında 6325 sayılı "Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu" kabul edilmiştir. Kanunun 20.maddesinin öngördüğü şarta göre, arabulucu olabilmek için hukuk fakültesi mezunu ve en az beş yıllık mesleki deneyime sahip olmak gerekmektedir. Ancak arabulucu olarak göreve başlamadan önce adaylar bir eğitime tabi tutulmaktadırlar. Eğitim sonrasında yazılı ve uygulamalı sınavlardan başarılı olabilmeleri halinde arabuluculuk görevlerini yerine getirmeleri beklenmektedir. Temelinde iletişimin kilit faktör olduğu arabuluculuk sisteminin başarılı bir şekilde yürütülmesi arabuluculuk yapacak kişilerin nitelikli eğitim almasına bağlı olarak gelişmektedir. Bu kapsamda Türkiye'de iletişim alanında arabuluculuk eğitimlerine ilişkin yüksek lisan ve doktora düzeyinde bir çalışma yapılmadığı görülmektedir. Bundan hareketle bir ilk olarak arabuluculuk eğitimlerine ilişkin çalışma yapılmıştır. Çalışmanın temel amacı, daha etkin arabuluculuk hizmeti verilmesi amacına yönelik gerçekleştirilen arabuluculuk eğitimlerinin var olan durumunun geliştirilmesi ve zenginleştirilmesinde ortaya çıkabilecek seçenekleri eğitmen tutum ve görüşlerinden yararlanarak değerlendirmektir.Çalışmanın birinci bölümünde arabuluculuk sisteminin genel çerçevesi başlığı altında, arabuluculuk sürecinin içeriği ve işlevleri, uluslararası arabuluculuk modelleri ve Türkiye'deki arabuluculuk uygulaması kanunda belirlenen esaslara göre ele alınmıştır. İkinci bölümde arabuluculuk eğitimlerinin uluslararası örnekleri ve Türkiye'deki mevcut arabuluculuk eğitim sistemi iletişim kavramı ile ilişkilendirilerek irdelenmiştir. Son bölümde ise Türkiye Barolar Birliği çatısında eğitim veren eğitmenlerin arabuluculuk eğitimleri hakkında tutum ve görüşlerine yönelik bir araştırma yapılmıştır. Bu çalışma, nitel araştırma tekniği kullanılarak gerçekleştirilmiştir. Veri toplama tekniği olarak görüşme yöntemi uygulanmıştır. Kalıtımcılarla yapılan yarı yapılandırılmış açık-uçlu görüşmeler sonucunda elde edilen veriler değerlendirilerek yorumlanmıştır. Today, interpersonal communication has increased rapidly in parallel with technological developments. This intensive process of communication has led to the emergence of many disputes. Inadequate legal systems in the face of increased competition and development of trade relations, has focused on different paths and began to produce alternative solutions in order to conduct justice in a healthy way and to establish social peace. Every society works to solve the resolutions of conflicts within the framework of their social norm and values. But the abstract distance between people has been removed with the effects of globalization, and problems that occur in any part of the world has started to affect all societies. A common understanding has evolved based on the results of research conducted by many countries and a mediation method has been developed as an alternative in dispute resolution. Following the developments in the world, "Mediation in Legal Disputes Act" Numbered 6325, was adopted in the Turkish legal system in 2013. According to the conditions stipulated by Article 20 of the Law, in order to become a mediator, one has to be a graduate from law school and must have at least five years of professional experience. But before starting to serve as a mediator, candidates are subjected to a training. If they succeed in the written and practical exam after the training, they are expected to fulfill their duty as a mediator. Successful development of the mediation system, with communication as a key factor in its basis, happens due to mediators receiving a quality education. In this context, it can be seen that there are no studies related to mediation training in the field of communications in Turkey. From this point, the first study on mediation trainings has been conducted.The main objective of the study is to evaluate the options that may arise during the improvement and enrichment of the existing situation of the performed mediation training for providing more effective mediation services, by benefiting from instructor attitudes and opinions.In the first part of the study, under the title of the general framework of the mediation system, the contents and functions of the mediation process, international mediation models and application of mediation in Turkey and functions are addressed according to the principles set out in law. In the second part, international best practices of mediation trainings and existing mediation training system in Turkey is examined with relation to the concept of communication. In the last part, a research is made about the attitudes and opinions of instructors teaching under to roof of the Bar Association of Turkey about the mediation trainings. This study was conducted using qualitative research techniques. Interviews were administered as data collection techniques. Data obtained from the semi-structured openended interviews made with participants were evaluated and interpreted.
