The paper presents the implementation phases of EU funds illustrated by the example of Rural Development Programme for 2014-2020. The author emphasizes the role of authorities and institutions, both the European Union and member states which are responsible for programming EU funds for rural development. The paper indicates the most relevant events and documents necessary to organize financial support from the European Agricultural Fund for Rural Development in Poland. Furthermore, it focuses on the programming of EAFRD assistance in the form of the RDP, which is implemented in Poland in the form of a single programme, together with the presentation of the allocation of funds and their changes between the initial and the final programme. The analysis of the implementation of the RDP 2014-2020 is complemented by a management area in which the division of competencies between institutions is diversified. The article also highlights problems and negligence in the implementation of selected RDP actions, whose total budget in the financial perspective of 2014-2020 in Poland is 13.5 billion zlotys.

Przedstawia odpowiedzialne za programowanie środków na rozwój obszarów wiejskich organy i instytucje po stronie Unii Europejskiej, jak i państwa członkowskiego. Wskazuje na najważniejsze wydarzenia i dokumenty niezbędne do uruchomienia pomocy finansowej ze środków Europejskiego Funduszu Rolnego na rzecz Rozwoju Obszarów Wiejskich. Koncentruje się na programowaniu pomocy z EFRROW w postaci PROW, który w Polsce realizowany jest jako jednolity program, wraz z przedstawieniem alokacji środków oraz jej zmian pomiędzy wstępnym a finalnym projektem programu. Analiza wdrażania PROW 2014–2020 uzupełniona jest o obszar zarządzania, w którym podział kompetencji pomiędzy instytucjami i organami państwa jest zróżnicowany. Artykuł wskazuje również na problemy i zaniedbania we wdrażaniu wybranych działań PROW, którego całkowity budżet w perspektywie finansowej 2014–2020w Polsce wynosi 13,5mld PLN.

The environment is a value and subject of constitutional protection in Poland. Ensuring environmental protection is considered as a political principle in the national doctrine, and due to the editorial location of its source in Article 5 of the Constitution of the Republic of Poland, it is considered as one of the objectives of Polish statehood. In several places, the Basic Law refers to the issue of the environment, considering it an important value and entrusting its care not only to public authorities, but also to anyone who is subject to Polish state authority. Examining whether contemporary instruments of agricultural law, in particular those developed with the participation of Polish state authorities in the application of the mechanisms of the Common Agricultural Policy of the European Union, take into account constitutional directives derived from the principle of environmental protection and whether the effects of these activities are verified in the light of the constitutional model is an interesting academic question. The subject of detailed analysis in this study is the rural development programme (RDP) referred to in Article 6 of the Regulation (EU) No. 1305/2013 of the European Parliament and of the Council of 17 December 2013 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) and repealing Council Regulation (EC) No. 1698/2005. The author demonstrates that the constitutional principle of environmental protection was respected by Polish public authorities in the process of creating an important and high-budget instrument for conducting development policy, which is the RDP for the years 2014–2020. ; Środowisko jest wartością i przedmiotem ochrony konstytucyjnej w Polsce. Zapewnienie ochrony środowiska uznaje się w krajowej doktrynie za zasadę ustrojową, a ze względu na redakcyjne usytuowanie jej źródła już w art. 5 Konstytucji RP uważane jest za jeden z celów państwowości polskiej. Ustawa zasadnicza w kilku miejscach odnosi się do kwestii środowiska, uznając je za istotną wartość, a troskę o nie powierza nie tylko władzom publicznym, lecz także każdemu, kto podlega polskiej władzy państwowej. Interesującym zagadnieniem naukowym jest zbadanie, czy współczesne instrumenty prawa rolnego, w szczególności kształtowane przy udziale polskich władz państwowych w ramach stosowania mechanizmów Wspólnej Polityki Rolnej Unii Europejskiej, uwzględniają konstytucyjne dyrektywy wywodzone z zasady ochrony środowiska oraz czy efekty tych działań poddają weryfikacji w świetle konstytucyjnego wzorca. Przedmiotem szczegółowej analizy w niniejszym opracowaniu jest program rozwoju obszarów wiejskich (PROW), o którym mowa w art. 6 rozporządzenia Parlamentu Europejskiego i Rady (UE) nr 1305/2013 z dnia 17 grudnia 2013 r. w sprawie wsparcia rozwoju obszarów wiejskich przez Europejski Fundusz Rolny na rzecz Rozwoju Obszarów Wiejskich (EFRROW) i uchylającego rozporządzenie Rady (WE) nr 1698/2005. Autor dowodzi, że konstytucyjna zasada ochrony środowiska została poszanowana przez polskie władze publiczne w procesie tworzenia ważnego i wysokobudżetowego instrumentu prowadzenia polityki rozwoju, jakim jest PROW na lata 2014–2020.

Od ponad 20 lat w Polsce obserwuje się proces transformacji gospodarczej, służący m.in. rozwojowi postaw przedsiębiorczych w społeczeństwie. Jednym z instrumentów wspierających przedsiębiorczość jest działanie 312 tworzenie i rozwój mikroprzedsiębiorstw w ramach PROW 2007-2013. Celem niniejszego artykułu jest zwrócenie uwagi na politykę rolną Unii Europejskiej, w kontekście szans i możliwości jakie stwarza polskiemu rolnictwu. Opracowanie zawiera również charakterystykę aktualnego Programu Rozwoju Obszarów Wiejskich (PROW) na lata 2014-2020, który pozwala na efektywne zarządzanie środkami unijnymi w celu wsparcia polskiego rolnictwa. Sektor rolny jest kluczowy dla polskiej gospodarki przede wszystkim w celu zagwarantowania bezpieczeństwa żywnościowego. Polskie rolnictwo zapewnia różnorodne, przystępne cenowo i bezpieczne produkty na najwyższym poziomie. Polska oraz inne kraje Unii Europejskiej jest znana na całym świecie ze swoich tradycji kulinarnych, dlatego zadaniem unijnego rolnictwa jest również kreowanie warunków, dających rolnikom różne możliwości, z których kluczową jest właśnie produkcja żywności. Bogactwo zasobów rolnych Unii Europejskiej przekłada się na bezpieczeństwo dostaw żywności dla europejskich obywateli, ale także pozwala konkurować na arenie międzynarodowej i odgrywać strategiczne miejsce. ; The aim of this article is to draw attention to the agricultural policy of the European Union, especially in the context of the opportunities and possibilities that it creates for Polish agriculture. The study also includes the characteristics of the current Rural Development Programme (RDP) for the years 2014-2020, which allows for effective management of EU funds to support Polish agriculture. For the Polish economy, the agriculture sector is crucial, mainly in order to guarantee food security. Polish agriculture provides diversified, affordable and safe products at the highest level. Poland and other European Union countries are well known throughout the world for their culinary traditions, so the task of EU agriculture is to create conditions that give farmers different options, from which food production plays the main role. The European Union's richness of agricultural resources gives security of food supply for Europe's citizens and also allows it, to compete EU agriculture with others countries on the international stage.

Poszczególne części opracowania opisują istotę i znaczenie usług doradczych, powiązanie systemu doradztwa rolniczego z zasadami wzajemnej zgodności, analizę efektywności narzędzia 114 PROW oraz charakterystykę działań wybranej instytucji akredytowanej do świadczenia usług doradczych w ramach FAS. Na podstawie zebranych danych można wysunąć wniosek, że FAS jest ważnym instrumentem WPR wspierającym rolników w spełnianiu wymogów wzajemnej zgodności oraz kreowaniu nowoczesnego i konkurencyjnego rolnictwa, jednak wymaga zmian organizacyjno – prawnych, które pozwolą lepiej wykorzystać środki publiczne przeznaczone na finansowanie usług doradczych. ; Summary: The article presents farm advisory system (FAS) in Poland established to support farmers seeking to meet the European Union cross-compliance requirements. Particular sections of the study describe the essence and importance of advisory services, the link between the farm advisory system and cross-compliance rules, financing of advisory services within 114 Rural Development Programmes 2007–2013 and the evaluation of effectiveness of this tool. The analysis of the collected data shows that FAS is an important instrument of the common agricultural policy which supports farmers in meeting cross-compliance requirements and creating modern and competitive agriculture, however, it requires organizational and legal changes which will allow better use of public funds intended to finance advisory services. ; Krzysztof Firlej

The CAP played the main role in enlarging the EU, by incorporating the twelve new states from Central and Eastern Europe by means of ensuring their smooth integration into the common market and facilitating the accelerated adaptation, modernization and restructurization of the agricultural and food sectors, as well as the non-agricultural fields of the socio-economic and cultural activation of rural populations. The EU's agricultural and rural policy continues to undergo evolutionary transformation, and its shape in the new 2014–202 financial perspective is of vital and justified interest for Poland. This article highlights the positive impact that local governments have exerted on the rural development in Poland. At first, the author presents the basic features of Polish rural areas and examines what rural development means to Polish policy makers. Furthermore, the author concludes that the main ideas which lie at the core of rural development are sustainability, multi functionality and competitiveness. One of the main foundations is also the grassroots approach which involves local community in the development process – the method that is used by many nonprofit or nongovernmental organizations to energize rural areas. Thanks to this strategy their role is still increasing. However, the author gives strong arguments to support the idea that the role of local governments is also crucial in stimulating development, and that this role should be referred to more often. In Poland after '89, thanks to the changes in the law, local governments have the real possibility to run, support or effectively engage in rural development. Moreover, their workings, as often as not, are the major impulse for positive action taken in rural areas. The author examines this on the basis of the LEADER Programme and Polish Solectwo (the basic level of the Polish local government system). This article also provides examples of the best practices (from 4 municipalities: Limanowa, Baltowa, Bodzechowa, Maslowa) focusing on the successful initiatives implemented by the local governments. The examples show that, in spite of their weakness, local governments could play an important part in rural development. They make the inhabitants aware of the fact that they are indispensable for everyday life and economic growth to the same extent as NGO's and private enterprises.
