Shakespeare's Macbeth is a problematic fiction of 11th century Scotland constructed from the viewpoint of an early modern English playwright, chiefly through his reading of a black legend that developed over 400 years of violent re-arrangement of national powers and cultural and political identities in Great Britain. Given the questionable but common expectations of "realism" that cinema often invites, films of the play purporting to be "faithful to the original" have attempted to locate — or more significantly and accurately, to re-locate — Shakespeare's fiction in "authentic" settings. A version of the "Scottish play" making such a claim was filmed by director Jeremy Freeston in Scotland in 1996. A literature review on integrative actions aimed at improving living conditions and access through education in areas such as health, employment and social and political participation among vulnerable groups is presented. Particularly, integrative actions targeted to teenage mothers, single families and Muslim women in the Scottish context. This review is part of the research results of Socio-educational action to Overcome poverty and inequalities (2012-2014) funded by Beatriu de Pinós plan for post-doctoral research of the Generalitat de Catalunya [The Governtmnet of Catalonia], co-funded in turn by the Marie Curie Actions of the 7th Framework Programme of Research of the European Union. The research project was developed at the Institute for Education, Community and Society at the University of Edinburgh. ; Se presenta una revisión de la literatura sobre actuaciones integradas dirigidas a mejorar las condiciones de vida y el acceso a través de la educación en áreas como la salud, el empleo y la participación social y política en grupos vulnerables, concretamente, en madres adolescentes, familias monoparentales y mujeres musulmanas en el contexto escocés. Esta revisión es parte de los resultados de la investigación Socioeducational action to overcome poverty and inequalities (2012-2014) financiada por el Programa Beatriu de Pinós de ayudas a la investigación post-doctoral de la Generalitat de Catalunya, co-financiado a su vez por las Marie Curie Actions del 7º Programa Marco de Investigación de la Unión Europea. A review essay on a book by Cesareo Rodriguez Aguilera de Prat, Partidos y estrategias nacionalistas en Cataluna, Escocia y Flandes ([Nationalist Strategies and Parties in Catalonia, Scotland and Flanders] (Valencia: Tirant lo Blanch, 2002).
This paper's aim is to analyze the effects the secession of territories in the Member States can have within the EU, regarding the hypothetical independence of Scotland in the case a majority of Scotish citizens would back that opinion in the referendum on September 18, 2014. Those who are promoting and independent Scotland are completely convinced that the territory will remain in the EU, as an independent Member State, and that it will reach this new status from within the EU. In their mind, that is an EU's «internal» matter, which doesn't need any special procedure, as far as it would be just little more than a formality. On the contrary, this paper analyzes the issues a proposal like this of Scotland encounter within the EU both in the fields of Law and Politics. ; Este trabajo analiza el problema de los efectos en el interior de la UE de la recesión de territorios en el seno de sus Estados miembros, en relación a la hipotética independencia de Escocia, en el supuesto de un apoyo mayoritario a la opción independentista en el referéndum que va a tener lugar el próximo 18 de septiembre de 2104. RESUMEN: El presente artículo busca examinar los fundamentos de la soberanía en el pensamiento político de Jacobo VI de Escocia y su vínculo con el surgimiento del campo de lo político en el occidente europeo. Para ello se tendrán en cuenta su posicionamiento frente al tiranicidio y su postura frente al crimen de brujería. Tomando como referencia tres de sus tratados, se examinarán sus teorizaciones sobre los orígenes del orden político-institucional. Además de demostrar la génesis teológica de su postura, se buscará desentrañar los argumentos a partir de los cuáles buscó construir su legitimidad como monarca absoluto y la vinculación de aquellos con el contexto histórico inmediato de su producción.ABSTRACT: This paper aims to examine the foundations of sovereignty in James VI of Scotland´s political thought, as well as its relation with the birth of the political in Western Europe. The study will consider his stance on tyrannicide and witchcraft. By analyzing the king´s treatises, the article will focus on his theorizations about the origins of the political and the institutional order. Besides demonstrating the theological genesis of his stance, the next pages will aim to unravel the ideas by which the Stuart attempted to build his legitimacy as an absolute sovereign, as well as the relation with their immediate historical context.

El Gobierno británico ha publicado un documento de análisis sobre las implicaciones
que conllevaría una Escocia independiente. Como anexo a dicho documento se
encuentra el estudio de dos profesores (James Crawford y Alan Boyle de la Universidad de
Edimburgo) que analizan los aspectos jurídicos del referéndum sobre la independencia de
Escocia. En ese estudio se concluye que si Escocia llega a ser independiente, se considerará
como un nuevo Estado desde el punto de vista del Derecho internacional y el resto del
actual Estado sucederá al actual Reino Unido, conservando sus instituciones, rechazándose
la idea de que aparezcan dos nuevos Estados. Por ello el resto del Reino Unido continuaría
como miembro de las organizaciones internacionales de las que es actualmente miembro,
mientras que Escocia tendría que solicitar su adhesión como un nuevo Estado. Este sería
el caso de la Unión Europea.

The British Government has published a major analysis paper on the
implications of Scottish independence: «Scotland Analysis: Devolution and the Implications
of Scottish Independence». The paper annexes an Opinion written by Professor James
Crawford along with Professor Alan Boyle of the University of Edinburgh, entitled ¿Opinion:
Referendum on the Independence of Scotland ¿ International Law Aspects¿. The Opinion
concludes that if Scotland becomes independent, it will be considered a new state as a
matter of international law and the remainder of the UK will continue the legal identity of
the UK and retain its existing institutions generally uninterrupted. It rejects the alternative
possibility that Scotland and the remainder of the UK will both be considered new states.
The Opinion also concludes that one consequence of this is that the remainder of the UK
will continue its membership of international organisations, whereas Scotland will have to
join many of them as a new state. In particular, Scotland will have to join the EU as a new
member state.
Este estudio surge de los acontecimientos producidos en 2014 y 2015 en Escocia (referéndum sobre la independencia) y en Cataluña («consulta informal» y elecciones autonómicas). En ambos casos, los movimientos secesionistas deseaban que un nuevo Estado nacido de la secesión llegara a ser (según ellos, «siguiera siendo») parte de la UE. Esta convicción les fortalece, ya que la UE es vista como un «refugio seguro », que permite la independencia sin la amenaza de quedar aislado. Los Tratados de la UE ni prevén ni prohiben la división de un Estado miembro. No obstante, para llegar a ser parte de la UE, la región secesionista debería primero ser reconocida como Estado por la comunidad internacional, y específicamente por los 28 Estados miembros de la UE (incluyendo España y el Reino Unido). Esto sería legalmente posible si el nuevo Estado naciera respetando completamente el Estado de Derecho, pero en cambio excluiría un «Estado» que hubiera declarado unilateralmente su independencia violando la Constitución nacional. Así, un nuevo Estado reconocido podría ser candidato a incorporarse a la UE. El autor muestra que debería seguirse el procedimiento del artículo 49 del Tratado de la UE y no el del artículo 48 (enmiendas a los Tratados). Tomando Escocia como ejemplo, el autor describe los pasos legales necesarios que deben darse después de la secesión. Señala que la división de un Estado de la UE ya no debería verse como un asunto estrictamente nacional; dadas sus consecuencias sobre la UE en conjunto y sobre otros Estados miembros, es un asunto que no puede ser ignorado por la UE.This study starts from the 2014-2015 events in Scotland (referendum on independence) and in Catalonia («informal consultation» and regional elections). Secessionists movements in both cases wished that a new State born from the secession would become (according to them «continues to be») part of the EU. That conviction strengthens them, as the EU is seen as a «safe haven», allowing independence without the threat of being isolated. The EU Treaties neither provide for, nor prohibit the partition of a Member State. However, in order to become part of the EU, the secessionist region should first be recognized as a State by the international community, and specifically by the 28 EU Member States (including Spain and the UK). This would be legally possible if the new State was born in full respect of the Rule of Law, but would exclude a «State» having unilaterally declared its independence in violation of the national Constitution. Then, a new State recognised could be a candidate to the EU. The author shows that the procedure of article 49 of the Treaty on EU woud have to be followed (accession of a new State) and not that of article 48 (amendments to the Treaties). Taking Scotland as an example, the author describes the necessary legal steps to be accomplished after the secession. He stresses that the partition of an EU State should not anymore being regarded as a strictly national matter. Given its consequences on the EU as a whole and on other Member States, it is a matter that cannot be ignored by the EU.

This paper analyzes the seccesion of territories under the Spanish Constitution. First, we must note that the Constitution provides the «indisoluble unity» of Spain; that means that the secession of territories without prior amendment of the Constitution has to be excluded. But the need for constituional Amendment, however, in general rule which applys to all democratic Constitutions, even them which doesn't include expressly the State's indissolubility. But does that means thatconstitutional analysis of secession should conclude with this statement? In the last decades it has been building a new constitutional paradigm about how democratic constitutional systems muss adress secesionist claims, according to the principles underlying the Constitution. Countries like Canada, regarding claims for sovereignty of Québec, and United Kingdom, regarding claims for Independence of Scotland, have gone down this path. This paper attemps to analyze how these principles apply in the Spanish constitutional system. ; Este trabajo analiza la secesión de territorios en la Constitución española. En primer lugar, hay que constatar que el texto constitucional afirma la «indisoluble unidad» de España, lo que excluye la posibilidad de secesión de territorios sin previa reforma de la Constitución. La exigencia de reforma, sin embargo, no viene motivada por la singular refacción del artículo 2 de la Constitución, sino que es consustancial a los sistemas democráticos, aunque no incluyan, de forma expresa, la indisolubilidad del Estado. Pero, el análisis constitucional de la secesión, ¿debe concluir con esta constatación? En los últimos decenios se ha ido construyendo un nuevo paradigma constitucional sobre la forma en que las Constituciones democráticas deben abordar las reclamaciones secesionistas, atendiendo a los principios que subyacen a la Constitución. Esta vía es la que han desbrozado países como Canadá, al afrontar la reclamación de independencia de Québec, o Reino Unido, al afrontar la reclamación de independencia de Escocia.
