Der Verfasser sieht das im Jahr 1964 im Senegal eingeführte neue Bodenrecht als charakterisiert durch die Abwendung vom römischen Recht und der bürgerlichen Konzeption des Bodeneigentums sowie die Hinwendung zu einer den Traditionen Schwarzafrikas entsprechenden sozialistischen Konzeption von Bodenrecht. Als Kernpunkt der Rechtsreform wird die Schaffung einer 95 v.H. des Bodens umfassenden "Domaine National" gesehen mit dem Ziel, eine optimale Nutzung des Bodens zu gewährleisten. Der Verfasser stellt die Untersuchung "Le Droit Foncier Senegalais" von Caveriviere und Debene vor, die das neue Bodenrecht von einem "ganzheitlichen Ansatz" ausgehend untersuchen. Recht wird hier verstanden als "Gesamtzusammenhang von Ideen, Normen und Tatsachen, der nur aus seinem kulturellen, sozialen und ökonomischen Umfeld und aus dessen historischer Entwicklung heraus verstanden werden kann". Abschließend erörtert der Verfasser weitere Perspektiven der Entwicklung des Bodenrechts in Senegal. (ICE)
