The challenge of Populist Radical Right Parties to Europeanization – the cases of Estonia and Latvia, 2018-2021

Over the last two decades, family law has undergone changes in Western Europe, widening the definition of marriage to include same-sex couples. In addition, some East European countries offer a legal recognition of civil unions of same-sex couples, while others do not offer any legal recognition at all. This diversity in family law has been recently challenged by developments at the European level. It is argued here that this constitutes an adaptational pressure on those European Union (EU) member states that do not offer any or offer only formal recognition of same-sex couples. We examine two cases when member states faced such an adaptational pressure, namely Estonia and Latvia, focusing on the interplay of two types of factors. First is that of formal institutions which, due to their constitutional role or their expertise in the EU law, may act as facilitators of legal changes. On the other hand, there are also political actors which have tried to constrain such an adaptation. We examine here especially the role of two political parties which have made a considerable effort to oppose the change in the two countries. It is argued here that the ideological orientation of these parties explains, at least partly, their opposition to the ongoing Europeanization of family law. The paper concludes with a discussion of the main findings and their implications.
Rola sądów administracyjnych w zapewnieniu ochrony praw dzieci par jednopłciowych (w kontekście prawa europejskiego)

The role of courts in the protection of individual and the so-called judicial lawmaking are theoretical issues of a major importance for legal practice (law application), as they concern the answer to the question of what a judge when the statutory provisions, in the opinion of the court, are outdated or insufficient in relation to the factual situation being resolved, due to ongoing alterations in social relations. The aim of the study is to point out the role of administrative courts in protecting the rights of children of same-sex couples. Contemporary phenomena operating on a European scale, such as open borders and migrations, pluralism of lifestyles, or the development in infotech and biotech (also medical technologies), are reflected in legal relationships regulated by various branches of law, including the norms regulating cases falling within the scope of cognition of administrative courts. They are also, inter alia, a source of problems in the title area related to the interpretation of such norms. Case-law can play an important role in both dynamically interpreting the law within social realities, unifying practice and rising the awareness of rights protection. The title subject is presented in the light of European law – primarily in the light of standards and principles of law, the sources of which are: traditions of European states and national law, inter- and supranational regulations and case-law of the European Court of Human Rights (ECHR) and the Court of Justice of the European Union (CJEU). It is worth noting that, as far as EU law is concerned, there has been no harmonisation or unification at the community (or Convention) level in this area due to lack of delegation the relevant competences to the European Union by the Member States. According to the principle of conferral, the Union can only act within the scope of its competence and has only as much competence as the Member States have conferred on it. Thus, all matters not explicitly indicated as EU competences remain under the autonomous regulation of the Member States. However, these title matters fall – indirectly – within the scope of the norms provided for by the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights – ECHR). The paper shows that administrative courts – which as a rule are to pass conservative and formalistic judgements – are able to refer to the value of flexibility in the law application, when it is necessary to grant protection to the rights of children of same-sex couples.
"Strajk Kobiet". Zmiany społeczno-kulturowe jako efekt protestów w Polsce

This paper is devoted to the analysis of the socio-political changes that occurred in Poland in 2016 as a result of the outbreak of the so-called black protests. The protests, which later became known as the All-Poland Women's Strike, were activated several times in the following years, as a result of subsequent events related to the provisions regulating the right to abortion in Poland. The empirical findings contained in this text result from the analysis of statistical data (CBOS reports), dedicated to the research of political party electorates, which was carried out in 2015, 2017 and 2021. Moreover, the article presents own research conducted in the period from April to July 2021 using the method of analysis of the content published on social media by entities established after 2016. The results of the research confirm that the outbreak and the subsequent periodic activation of protests, supported by the activities of entities promoting the right to abortion, initiated two significant changes in Poland. The first is the clear polarization of political party electorates regarding the right to abortion, and the second is the intensification of the discourse on the very right to abortion, introducing new arguments regarding termination of pregnancy to the agenda (as well as other topics related to the situation of women and broadly understood sex education). Both of the indicated outcomes resulted in the phenomenon of abortion being visible in the public discourse, especially in social media. The following analysis is part of the trend of social research devoted to the importance of socio-political protests in democratic countries and the role of social media as an immanent tool used in the activity of new social movements.
Stereotyp polityka. Wzorce osobowe przywódców politycznych w publicystyce "Naszego Dziennika" ; A stereotype of politician. The models of political leaders' personality in the publications of "Nasz Dziennik"
The political leadership concerns a special kind of performed assignments, arriving at a decision of a greater meaning and rank than the resolutions of other kind of leaders. It is related to power domain that is bigger in comparison with the non-political leaders, because it includes more numerous and more varied measures of authority. This problem is analysed by the authors of publications in "Nasz Dziennik". They comment on the present political and social situation in Poland to show who should be their ideal. As shown by this study, this vision is characteristic of all groups connected with the daily. Due to their association with the same group of media, consumer people who are different in respect of sex, profession and social group activities, share similar opinions. A scientific background accumulated by the author of the articles, takes also the opinion of the newspaper's readers into account. The analysis of these texts is to compose the models of political leaders. personality to answer the question - what is the 'ideal' promoted by "Nasz Dziennik". Because of the radical language used in this newspaper, the author examines the positive and negative qualities of political leaders to build a true image. The article shows that the anti.model of political leaders created by the daily contains a criticism of liberals, democrats, autocrats, tripe and figure heads and career bureaucrats. They all are the worse group of leaders due to having the greatest power and access to the media. Although we find many rationalized arguments in their negative opinions, the impression is the same - bad are those who govern. The criticism not only deals with democratic.liberal parties, but it was also leveled at AWS at the end of its regime. The situation of this last party did not live up to the expectations of "Nasz Dziennik", as such models are impossible to realize. The model is not interchangeable. In the articles, we find the opinions which refuse an ideal role of a particular person in leadership, but at the same time we can hear the voices for building programmes and visions around a strong authority.
