Günümüzde devlet, toplum ve piyasa ilişkileri, birinin diğeri üzerinde mutlak belirleyici olmasından ziyade karşılıklı bağımlılık ve tamamlayıcılık ilişkisi çerçevesinde tanımlanmaktadır. Diğer taraftan kamu sektörüyle özel sektör arasındaki sınırlar giderek geçirgen bir hale gelmektedir. Kamusal hizmetlerin sunumu ve toplumsal sorunların çözümü sürecine, kamu kurumlarının yanı sıra özel sektör ve sivil toplum kuruluşları da katılmaktadır. Yönetişim bir taraftan devlet, toplum ve piyasa ilişkileri bağlamında yönetimdeki değişim sürecini anlamlandırmaya çalışırken, diğer taraftan yeni durumda bu üçlü arasındaki ilişkilerin nasıl kurulduğuna ve nasıl kurulması gerektiğine dair tartışmaları içermektedir. Tezde bu bağlamdaki teorik tartışmalar ele alındıktan sonra, İstanbul'daki bir yönetişim uygulaması incelenmiştir. İstanbul Konseyinde merkezi yönetimi, yerel yönetimleri, mesleki kuruluşları ve STK'ları temsilen çeşitli üyeler yer almaktadır. Konsey, bir İstanbul vizyonunun çoğulculuk ortamı içinde üretilmesinden gündelik sorunların çözümüne kadar geniş bir amaçlar setine sahiptir. Konsey temelde farklı kesimlerden üyeler arasında bir etkileşim ortamının oluşturulmasını ve bu etkileşim ortamı içinde İstanbul'un sorunlarının tartışılıp çözümü konusunda çaba harcanmasını amaçlamaktadır. İstanbul Konseyinin çalışmalarına bakıldığında üyelerin yaklaşık 1/3'ünün Konsey toplantılarına yok denecek kadar az katıldığı ve yine katılanların çoğunun toplantılarda aktif bir çaba harcamadığı görülmektedir. Bunun nedenleri arasında kimi üyelerin önyargılı yaklaşımı, Valinin işleyiş sürecine yoğun müdahalesi, Konseyle Konseyin Başkanlık Divanı arasındaki güç paylaşımının dengeli olmaması ve Konseyin demokratik bir tartışma platformu haline getirilememiş olması sayılabilir. Bununla birlikte demokratik ve esnek bir tartışma ortamı içinde Konseyin temel konseptinin belirlenmesi, şeffaf bir işleyişin temini ve farklıkları uzlaştırmaya imkan veren bir etkileşim ortamının oluşturulması halinde, İstanbul Konseyinin demokratik ve etkili bir işleyişe kavuşacağı düşünülmektedir. The relations among state, society and market are defined in context of interdependency and complementary relations, instead of absolute determinater of one over the others. Furthermore, the boundaries between public and private sectors become more permeable. Both private sector institutions and NGO's take role in the process of both public services supply and solution of societal problems. Governance tries to define the change process in government in context of relations among state, society and market on the one hand; it contains the debates about how those relations founded and how they should be restructured on the other hand. This PhD thesis deals with the theoretical discussions on governance and a case in Istanbul. The Istanbul Council is composed of the members from central government, local governments, professional institutions and NGO's. The Council has a set of purposes in a wide range from the development of vision on Istanbul on a pluralist medium to the solution of routine problems of urban life. The Council aims to make an interaction medium among the member from different sectors and to spend efforts in order to discuss and to solve the problems of Istanbul on this interaction medium. When we look at the Council's works, it is seen that one-third proportion of the members rarely participated the meetings of the Council. Moreover, the members participated the meetings were not active enough. The reasons of this can be summed as follows:·Prejudiced approach of some members·The continuous interferences of the Governor·The power balance between the Council and its Chairman board is not rational·The Council could not become a democratic discussion medium. However, it can be said that in case the conditions listed below are made the Istanbul Council will have a democratic and effective operation structure: ·The basic concept of the Council should be determined on a democratic and flexible medium ·Transparent operating system·An interaction climate allowing the consensus of differences.
TEZ ÖZETİSivil toplum kavramı, "sivil toplum kuruluşları (STK)" nın kalkınmanın aktörleri olarak gündeme getirilmeye başlandığı son yıllarda üzerinde yoğun bir biçimde tartışılmaktadır. Bu tartışmalar, baskı grubu olarak toplumsal mücadelelere katılma işlevini üstlenmiş olanlar ile neoliberal yaklaşımların tümüyle içinde yeraldıkları için birer ajan olarak görülenler arasındaki ayrımın giderek belirginleşmesi ile birlikte kendini göstermektedir. Bu bağlamda STK' larının özellikle, 2.Dünya Savaşı' nı izleyen yıllarda yaşanan gelişmeler doğrultusunda farklı bir işlev üstlendiği görülmektedir. STK' larının söz konusu konjonktürdeki yer ve işlevleri, kalkınma yaklaşımlarının öngördüğü devlet müdahaleleriyle aynı doğrultuda oluşmaktadır. Uluslararası sistemin 1960' lı yıllardan itibaren krize girmesiyle birlikte STK' larının daha çok "baskı grupları" şeklinde bir işlev üstlenmeye başladıkları görülmektedir. Az Gelişmiş Ülkelerde yaşanan kriz, STK' ları devlet ile karşı karşıya getirmiş; bu kuruluşlar toplumsal mücadelelerde önemli bir işlev üstlemeye başlamışlardır. 1980' li yılların ikinci yarısından itibaren soğuk savaşın son bulması ve yeni dünya konjonktürünün oluşması ile kalkınma yaklaşımları yerini neoliberal yaklaşıma bırakmıştır. Büyüme merkezli kalkınma yaklaşımları yerine insanı merkeze alan yeni kalkınma yaklaşımları STK' larını, "kalkınmanın yeni aktörleri" olarak tanımlamışlardır. Bu tanımlama, neoliberal yaklaşımların, "minimal", devlet anlayışı ile uyum göstermektedir. Küreselleşme adı verilen bu süreçte STK' lar yeni ajanlar olarak değerlendirilmektedir. Kavram, uluslararası çevreler tarafından kalkınmacı STK' lar olarak tanımlanmaktadır. "Hükümet-dışı", "özel kar amacı gütmeyen", gibi çok çeşitli açılardan tanımlanan kavram tam bir netlik taşımamaktadır. Bu durum, STK' larının içinde bulunduğumuz dönemde, neoliberal yaklaşımın gerektirdiği düzenleme araçlarından biri olarak ajan işlevi üstlendikleri yargısını kuvvetlendirmektedir.SUMMARY OF THE THESISThe concept of civil society has been intensively discussed in the recent years when "civil society organizations (CSO)" were started to be brought into agendas as actors of development. These discussions arise with clarification of the difference between those that have assumed the function of participating in social struggles as a group of pressure and those that are considered as an agent each as they take part in neo-liberal approaches in full. In this context, it is seen that CSO's assume a different function in the direction of the developments experienced following the 2nd World War in particular. CSO's position and functions in the conjuncture in question form in the same direction as the government interventions that development approaches stipulate.Along with the international system's entering into a crisis again in the 1960's, it is seen that CSO's have started to assume a function in the form of "pressure groups" rather. The crisis experienced in Less Developed Countries, brought CSO's in opposition to the state; these establishments have started to assume an important function in social struggles. As of the second half of the 1980's, along with that the cold war ended and that the new world conjuncture formed, the development approaches left their place to the neo-liberal approach. The new human-centered development approaches unlike the growth-centered development approaches have defined their CSO's as "the new actors of development." This definition demonstrates compliance with the "minimal" state understanding of the neo-liberal approaches. In this process named globalization, CSO's are considered as the new agents. The concept is defined by the international community as development-oriented CSO's. The concept defined from a large variety of views, such as "non-governmental," "nonprofit" does not bear complete clarity. This situation strengthens the judgment that CSO's assume the function of an agent as one of the regulating instruments required by the neo-liberal approach within the period that we are in.
ÖZET1950'li yıllar, Türk toplum yapısında önemli değişiklikleri meydana getiren hareketli yıllardı. Yüzyıllar boyunca tarıma, toprağa, bağlı bir hayat sürdüren Anadolu köylüsü bu yıllarda kırdan kente yoğun bir şekilde göç etmeye başladı. Türk toplumu aradan yaklaşık on yıl geçtikten sonra sınır ötesi göçle tanıştı. 12 kişilik teknisyen grubuyla F. Almanya'ya başlayan göç B. Avrupa ülkelerinin işgücü çağrısı sonucu farklı bir boyut kazanmaya başladı.30 Ekim 1961 tarihinde F. Almanya ile yapılan "İşçi Mübadelesi Anlaşması"nı, 1964 Avusturya, Hollanda ve Belçika ile 1965'te Fransa ve 1967'de İsveç ile yapılan sözleşmeler izledi. Böylece İkinci Dünya Savaşı'ndan büyük zararla çıkan Avrupa Devletleri'nin bozulan sosyal ve iktisadi düzenlerini yeniden düzeltmek için ihtiyaç duyulan işgücü açığına karşı bulunan çözüm, hukuki bir dayanağa kavuşturulmuş oldu. Ancak ikili anlaşmaların temelinde bu sınır ötesi göçün geçici olduğu kanaati hakimdi. Türkiye'den Batı Avrupa'nın gelişmiş ülkelerine yönelen işgücü göçü, bu sınır ötesi göçün resmen durdurulduğu dünya petrol krizinin yaşandığı 1973 yılına kadar sürdü. Bu süre zarfında bir milyona yakın Türk işçisi Batı Avrupa Ülkeleri'ne yerleşmiş oldu. Avrupa göçünün ardından 30 yıldan fazla bir süre geçtikten sonra bu rakam üç milyonun üzerine çıkmış oldu. Farklı toplumların bir arada yaşaması sonucu gerek göçmenlerin bulundukları ülkelerden gerekse kendi ülkelerinin düzenlemelerinden kaynaklanan bazı problemler ortaya çıkmaktadır. Bu problemler; çifte vatandaşlıktan bedelli askerliğe, oy kullanmadan çocukların eğitimine, yabancı düşmanlığından ailevi sorunlara, dil sorunundan kültürel kimlik sorununa kadar büyük bir yelpazeyi kapsamaktadır. Ortaya çıkan bu problemlerin çözümü kuşkusuz işgücüne ihtiyacı olan ve işgücü veren ülkelerin ortak bir takım düzenlemeleri sonucu çözülecektir. ABSTARCTThe 1950's were dynamic years that brought significant changes in the structure of Turkish society due to internal and external migration. Turkish villagers whose lives for centuries depended on farming and agriculture began to migrate from rural to urban areas in massive numbers. Then, after nearly a decade or so, the Turkish society met with a new migration phenomenon, that was migration outside of national boundaries.This new migration pattern, starting first with moves to the Federal Republic of Germany, acquired a new dimension after calls for labor force coming from the Western European countries.The Labor Exchange Treaty signed between Turkey and the Federal Republic ofGermany, dating back to 31 October 1963, was followed by other agreements made with Austria (1964), Holland and Belgium (1965), and France and Sweden (1967). In this way, the solution developed for the problems regarding labor deficit that was challenging most European states' damaged social and economic order after the 2nd World War, attained a legal foundation. However, beneath these bilateral agreements the supposition that the external migration was a temporary fact was dominant.The labor migration from Turkey to the developed countries of the Western Europe lasted until it was officially abandoned when the world oil crisis emerged in 1973. By that time, approximately 1 million Turkish workers had settled in Western Europe. And after thirty years or so, of the labor moves to Europe, this number exceeded 3 millions.The coexistence of different communities and togetherness of emigrant populations brings about certain problems stemming from both the regulations of mother countries and of emigrated ones. These problems range from double citizenship to voting rights of minorities, growing enmity against foreigners, social accommodation problems in emigrant peoples, linguistic issues, and to cultural identity concerns. Resolution of all these problems becomes possible only through developing common regulations mutually agreed and shared by both those countries in need of foreign labor force and those providing this need.
Arabian society, which lived on the border of two great civilizations in the 7th century in an ignorant life away from civilization, experienced great changes and transformations when Islam emerged. The Arabs of the Age of Jahiliyya, which does not have any written document about the pre-Islamic period, built a great civilization that started with the example and practices of the Prophet and the principles and messages of the Qur'an. No doubt, the messages of the Qur'an, which guided people toward science and education in the first place, had great effects on this great transformation. The education-intensive messages of the Qur'an came to life and gained meaning with the practices of the Prophet. With his message, "I was sent as a teacher" the Prophet paved the way for the formation of a great scientific and educational tradition for the following periods with his practices and verbal messages. Unmatched in previous religions, the great incentives on the way leading to the demand for knowledge turned Muslims into great seekers of knowledge and education. The Hadith "Achieve knowledge even if it is in China" and similar messages paved the way for scientific journeys (Rihle), which have an important place in the history of Islamic education. Hatib al-Baghdadi revealed the transformation of the messages of the Prophet into "Rihle" as an educational tradition with his work under the same name. ın this way, in addition to the emphasis of the verses on science, the Prophet's pointing out science and education to his ummah as a target was the basis for the formation of a great scientific and educational tradition.

Dolayısıyla Demokrat Parti iktidarını sona erdiren ve edinilen tecrübeyi günümüzde dahi vakıf kılan 27 Mayıs ihtilali süreci; yakın geçmişe dair muğlâklığı, fiili gerçekleriyle betimleyebilmektedir. Bu yönüyle bilimsel yöntemi uygulanabilir kılan ve 27 Mayıs ihtilali sürecini meydana getiren her bir parça, ayrı bir değer taşımakta ve aydınlatılmayı hak etmektedir. Bu çalışmanın konusu 27 Mayıs ihtilali'nde önemli yeri olan Muzaffer Özdağ'ın yaşamıdır. Muzaffer Özdağ'ın yaşamı çerçevesinde çalışmanın amacı; Muzaffer Özdağ'ın gençlik ve meslek yıllarını, siyasi ve sosyal açıdan önemli ayrıntılarıyla irdelemek ve bilim dünyasına katkı sunmaktır. ; It is possible to say that there is an uncertainty for the concepts of revolution and coup and also such a case for the memory of society. Such a uncertainty could be anaylzed through the factual real of history. And the 27 May 1960 Revolution process which is known as a military coup in Turkey is to introduce the factual real that a lot of people in the Turkey stil keep in mind that's experience. Therefore, 27 May 1960 Revolution process contains various materials which can make applicable the scientific method. In that case everyone of that materials has a special value and deserves to be clarify. The main issue of this study is to scruty the Muzaffer Ozdag's life who has a important role in 27 May military coup. The purpose of the stduy is to reveal Muzaffer Ozdag's youth and the military profession in context social and political details. In this way the expectation from the study is to contribute to science.
Terörizm, toplum üzerinde korku, sindirme ve baskı yaratarak siyasal düzende belli amaçlara ulaşmak için kullanılan siyasi bir şiddet dilidir. Toplumların siyasi tarihlerinde terörizmin izlerine rastlanılsa bile esasında kendisi modern dönemin bir ürünüdür. Terörizm kavramını, tekniklerini ve politikalarını icat eden Batı dünyası, terörizm tarafından tehdit edilmektedir. Buna karşılık modern demokratik devletler, terörizmle mücadele yöntemlerini sistemli, planlı, örgütlü ve uzun erimli bir yönetim tarzı olarak belirlemişlerdir. Modern demokratik devletlerin geliştirdikleri terörizmle mücadele yöntemlerinin, toplumsal yaşamda otoriter yansımalara; siyasal ve hukuksal düzende ise istisnai bir yönetim tarzına neden olduğu hususu araştırmamızın temel konusunu oluşturmaktadır. Bu çerçevede belirlenen bazı modern demokratik devletlerin terörle mücadele süreçleri analiz edilmektedir. Bu bağlamda elde edilen bulgular, farklı kuramsal yaklaşımlar göz önünde bulundurularak değerlendirilmektedir. ; Terrorism is the language of political violence which is used inorder to achieve certain objectives in political order by creating fear, intimidation and pressure on society. Even if we encounter traces of terrorism in the political history of societies, in substance, it is a product in modern era. The Western world invented the notion, techniques and policies of terrorism in threatened by terrorism. In response to this circumstance, the modern democratic states has designed the methods of combating against terrorism with a systematic, planned, organized and long range management style. The question of authoritarian reflections on social life and particular management style in political and legal order of the methods caused by combating terrorism developed by the modern democratic states is main subject of the research. In this context, the process of combating terrorism of some identified modern democratises states identified is analyzed. The findings, in this regard, are utilized by taking into account particular institutional approaches.
Bu çalışmada, Demokrat Parti'nin iktidarda olduğu 1950–1960 yılları arasında Türkiye'nin izlediği Kıbrıs politikası incelenmektedir. Söz konusu dönemde, Kıbrıs'ta iki toplumlu devlet yapısının temelleri atılmıştır. Bu nedenle bu dönem, gerek Türkiye'nin dış politikası açısından, gerekse Kıbrıs'ta yaşayan Türk toplumunun geleceği açısından günümüzde de çok boyutlu olarak etkileri görülen önemli gelişmelere tanıklık etmiştir. Adım adım Kıbrıs Cumhuriyeti'nin doğmasını sağlayan bu süreçte, Demokrat Parti Hükümeti'nin görüşleri ve adanın milletlerarası statüsü ve ada halkının geleceği hakkında takip ettiği dış politika, üç safha halinde irdelenmiştir. Büyük ölçüde arşiv belgelerinden yararlanılan çalışma sonucunda, 1923 Lozan Barış Anlaşması ile Kıbrıs'ı İngiltere'ye bırakmak zorunda kalan Türkiye'nin, Demokrat Parti'nin izlediği dış politika ile Kıbrıs'ta tekrar hak sahibi haline geldiği görülmüştür. ; In this study, the Cyprus policy of Turkey is analysed between the years 1950-1960 when the Democratic Party was in power. In the period in question, structure of bi-communal state in Cyprus was laid. Therefore, this period, has witnessed important developments which have multi-dimensional effects nowadays as well in terms of both Turkey's foreign policy, and the future of Turkish society living in Cyprus. During the process that provides the rise of The Republic of Cyprus gradually, the Democratic Party's vision and the policy followed about the island's international status and the future of the people of the island have been analysed in three phases. As a result of the study during which the archive documents greatly benefited, it is seen that Turkey which had to leave Cyprus to the UK with the Lausanne Peace Treaty1923, became eligible in Cyprus again thanks to the Democratic Party's foreign policy.
ÖZET10 Kasım 1938 tarihinde Mustafa Kemal Atatürk'ün hayatını kaybetmesi ile bir-likte Cumhurbaşkanı olan İsmet İnönü ülke yönetiminde en yetkili kişi haline gelmiştir. İnönü'nün CHP ve ülke yönetimindeki adete tek kişilik hakimiyeti ( Milli Şef ) Celal Bayar başta olmak üzere dönemin CHP'li milletvekili ve yöneticilerinde tepkiye neden olmuştur. Bir şahsın parti ve ülke yönetimindeki hakimiyetine İkinci Dünya Savaşı'nın da etkisiyle halkın büyük çoğunluğunda oluşan ekonomik sıkıntının ve iktidarın halkın muhafazakarlığı ile çelişen eğitim ve sosyal alanlardaki uygulamaları CHP ve dışındaki siyasi çevrelerde ve halkın büyük bir bölümünde muhalif bir tutumun oluşmasına neden olmuştur. Bu süreç hükümetin birtakım radikal uygulamaları ile birlikte örgütlü bir mu-halif hareketin doğmasına neden olmuştur. Yukarıda belirtilen nedenlerden kaynaklanan ve açıktan açığa bir söylem ve ey-leme dönüşmeyen CHP milletvekillileri içindeki bireysel tavırlar ilk defa Çiftçiyi Top-raklandırma Kanunu teklifi sırasında ortaya çıkmıştır. CHP milletvekilleri Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan, 14 Mayıs 1945 tarihinde bu kanun teklifinin TBMM'de görüşülmeye başlaması ile birlikte hükümetin bu uygulamasına karşı tavırlarını yaptıkları konuşmalar ile ortaya koymuşlardır. Fakat esasen bu kanun tasarısının TBMM'ye sunulmasından önce CHP içinde muhalif bir grubun oluşması Tevfik Rüştü Aras'ın evinde yapılan perşembe toplantılarıyla başlamıştır. 1945 yılının Nisan ayından itibaren Tevfik Rüştü Aras'ın evinde bir araya gelen Emin Sazak, Adnan Menderes ve Fuat köprülü CHP'nin, İsmet İnönü'nün otoritesi altında olduğunu ifade etmişler ve bu durumu değiştirmek gerektiği üzerinde durmuşlardır. İkinci defa bir ara-ya gelen Adnan Menderes ve Fuat Köprülü demokratik bir merkez oluşturma konusun-da görüş birliğine varmışlardır. Daha sonraki toplantılara Refik Koraltan da katılmıştır. Adnan Menderes, partide ve toplum içinde etkili olan Celal Bayar'ı bu gruba katmak gerektiğini açıklamıştır. Celal Bayar ile yapılan toplantı sonunda o da gruba dahil ol-muştur. Grup üyeleri 18 Mayıs 1945 tarihinde yapılan toplantıda CHP Meclis Grubuna vermeyi düşündükleri Dörtlü Takriri hazırlamışlardır.Takrir verilmeden önce TBMM'de 1945 yılı devlet bütçesinin oylamasına katı-lan üç yüz yetmiş üç milletvekilinden İzmir Milletvekili Celal Bayar, Aydın Milletve-kili Adnan Menderes, İçel Milletvekili Refik Koraltan, Kars Milletvekili Fuat Köprülü ve Eskişehir Milletvekili Emin Sazak bütçeye karşı aleyhte oy kullanmışlardır. Cumhu-riyet Dönemi'nde ilk defa bir bütçeye karşı aleyhte oy kullanılmıştır. Böylece muhalif tavırlarını ikinci defa ortaya koymuşlardır. Grup üyeleri 7 Haziran 1945 tarihinde Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan'ın imzası ile Dörtlü Takrir'i CHP Meclis Grubu Başkanlığı-na vererek muhalif tutumlarını somutlaştırmışlardır. Takrirde CHP'nin işleyişinin de-mokratik ilkelere uygun hale getirilmesini ve TC. Anayasası'nda var olan vatandaş hak ve hürriyetlerinin tanınması talep etmişlerdir. Bu takrir 12 Haziran 1945 tarihinde CHP Meclis Grubu'nda görüşülmüş ve red-dedilmiştir. Takririn reddedilmesi ile birlikte devam eden süreçte bu kadronun CHP içinde siyaset yapma imkanı kalmadığı gibi takrirde talep edilen bir düzenin kurulma-sının CHP içinde mücadele edilerek olamayacağı ortaya çıkmıştır. Takririn, CHP Meclisi Grubuna verildiği günlerde Cumhurbaşkanı İsmet İnönü, Rauf Orbay ile görüşmüş yeni parti kurulması fikrini ona açmıştır. Bu görüşmeden, İnönü'nün yaptığı diğer konuşmalardan cesaret alan grup üyelerine karşı CHP'li yöne-tici ve milletvekillerinin olumsuz tavrı, partinin yayın organı Ulus gazetesindeki ağır sözlerle dolu yazılar grup üyelerinin CHP'den ayrılmalarına neden olmuştur. Zaten Adnan Menderes ve Fuat Köprülü Vatan gazetesinde yayınlanan yazıları nedeniyle CHP Divanı tarafından 25 Eylül 1945 tarihinde CHP'den ihraç edilmişlerdir. Diğer isimlerde istifa etmişlerdir. Partisiz kalan grup üyeleri parti kurma çalışmalarına başla-mışlar ve Demokrat Parti 7 Ocak 1946 tarihinde resmen kurulmuştur. Demokrat Parti, Dörtlü Takrir'in imzacıları: Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan tarafından kurulmuştur. Demokrat Parti'nin simgesi "DP", genel merkezi ise Antalya Milletvekili Cemal Tunca'nın Ankara Sümer Sokaktaki sekiz numaralı binası olmuştur. Demokrat Parti'nin kuruluş gerekçesinde ve programında Türkiye'de demok-ratik bir rejimin kurulacağı, TC Anayasası'nda demokrasiye aykırı kanunların kaldırı-lacağı, vatandaşların hak ve hürriyetlerinin anayasal teminat altına alınacağı dile geti-rilmiştir. Muhalefet yıllarında ise CHP ve iktidar demokratik olmayan tutum ve davra-nışlar sergilemekle itham edilmiştir. Muhalefet yıllılarında iki parti arasında demokra-siye aykırı birçok olay yaşanmıştır. Hatta 7 Ocak 1947 tarihinde gerçekleşen Demokrat Parti Birinci Genel Kongresi'nde kabul edilen Hürriyet Misakı'nda TC Anayasası'na aykırı olan kanunların kaldırılması ve demokrasiye uygun kanunların yapılması talep edilmiştir. Bu istekler yerine getirilmez ise Demokrat Parti Genel Yönetim Kurulu'na sine-i millet kararı ( TBMM'den çekilme ) hakkı verilmiştir. Demokrat Parti yönetici-leri iktidara gelmeleri halinde vatandaşlara hak ve hürriyetlerinin tanınacağı, demokra-siye aykırı kanunların kaldırılacağı ve TC Anayasası'nın demokrasiye uyumlu hale ge-tirileceği sözlerini vermişlerdir. 14 Mayıs 1950 seçim faaliyetlerinde aynı vaatler tekrarlanmıştır. Hatta 2 Nisan 1950 tarihinde Kasımpaşa'da konuşan Demokrat Parti Genel Başkanı Celal Bayar, grev hakkının demokratik hak olduğunu ve demokrasinin olduğu ülkelerdeki gibi toplumsal düzene ve ekonomiye zarar vermeyecek biçimde işçilere grev hakkının verileceğini ifa-de etmiştir. Seçimleri kazanan Demokrat Parti adına Adnan Menderes 22 Mayıs 1950 tarihinde hükümeti kurmuş ve 29 Mayıs 1950 tarihinde hükümet programı TBMM'de onaylanmıştır.Hükümet programında partinin seçim beyannamesinde olduğu gibi iktidar deği-şikliğinin ülkede maddi ve manevi hiçbir sarsıntıya yol açmasına imkan tanınmayacağı ve özellikle devri sabık yaratılmayacağı vurgulanmıştır. Programda, TC Anayasası'nda vatandaş hak ve hürriyetlerine ve millet iradesine dayanan kararlı bir devlet düzeninin gerçekleşmesini sağlayacak düzenlemelerin yapılacağı ifade edilmiştir. Ayrıca CHP hükümetlerinden ( tek parti dönemi ) kalan, demokratik olmayan kanunların, alışkan-lıkların ve anlayışların değiştirileceği vurgulanmıştır. Programda, işçilere grev hakkının sosyal ve ekonomik düzeni bozmayacak şekilde tanınacağı açıklanmıştır. Demokrat Parti İktidarı Programı'nda sadece vatandaşlara tanınacak haklar yer almamıştır. Ayrıca o tarihlerde azınlıkta olsa da bazıları tarafından hak olarak görülen faaliyetlerin yasaklanacağı da yer almıştır. Cumhuriyet'in ve inkılapların korunması için aşırı sol akımlara ( komünizm ) izin verilmeyeceği ve bunlarla etkin bir biçimde müca-dele edileceği ifade edilmiştir. Bunlara karşı kanuni tedbirlerin alınacağı çünkü bu tür düşüncelerin günün şartlarında fikir ve vicdan hürriyeti olarak görülmediği vurgulan-mıştır. Bu fikir akımların hürriyet maskesi altında yayın yapmalarına izin verilmeyeceği çünkü bu düşünce akımlarının amacının özgürlükleri ortadan kaldırmak olduğu iddia edilmiştir. Komünizm fikir akımının yanı sıra irticai hareketlere de asla müsaade edil-meyeceği vurgulanmıştır. Demokrat Parti Dönemi'nde iktidarın sivil toplum kuruluşları ile ilişkilerine özetlemeden önce sivil toplumun örgütü tanımını yapmak yerinde olacaktır. Sivil top-lum kavramı farklı biçimlerde tanımlanan bir kavramdır. Özellikle devlet ile sivil top-lum arasındaki ilişki farklı tanımlamalara neden olmaktadır. Bu tanımlardan bazılarında sivil toplum, devletten tamamen bağımsız, devleti kontrol eden ve hatta devletin alter-natifi olan örgütlü bir güç olarak tarif edilmiştir. Diğer tanımlarda ise devlet ile sivil toplum arasında bu kadar keskin bir ayrılığın olmadığı, sivil toplumun devlete top-lumsal katılımı sağlama amacının var olduğu ileri sürülmüştür. Modern anlamda sivil toplum kavramı "Non Govern Mental Organizations" ( devletten bağımsız örgütlen-meler ) olarak tanımlamasının yanı sıra "gönüllü kuruluşlar", "kar amacı gütmeyen ku-ruluşlar" gibi ifadelerle de tanımlanmaktadır. Sivil toplum tanımını yaptıktan sonra Demokrat Parti iktidarları öncesi sivil toplum örgütlenmesine devletin müdahalesinin ne zaman kaldırıldığına kısaca yer verelim. Türkiye'de 28 Haziran 1938 tarihinde yürürlüğe giren 3512 sayılı Cemiyetler Kanunu ile Osmanlı Devleti döneminden kalma 1909 tarih ve 121 sayılı Cemiyetler Kanun'u ve bu kanunda yapılan 353 ve 387 sayılı kanunlar yürürlükten kalkmıştır. Bu kanunun dokuzuncu maddesinin h bendiyle "aile, sınıf, ırk, cins" esasına dayalı der-neklerin kurulması yasaklanmıştır. Bu madde ile sendika ve birçok derneğin kurulması yasaklanmıştır. Bu kanunun kabul gerekçesinde, o dönem de bazı ülkelerde var olan ko-münist ve faşist rejimlerin ülkenin yönetimin ele geçirmesini önlemek olduğu ileri sü-rülmüştür. İsmet İnönü'nün 10-11 Mayıs 1946 tarihinde CHP Kurultayı'nda yaptığı konuşmadan sonra 5 Haziran 1946 tarihinde 4919 sayılı Kanun ile dernek kurma işle-mindeki izin alma formalitesi kaldırılmıştır. Sınıf esasına dayalı dernek kurma yasağı da kalkmıştır. Bu kanunun kabulü sırasında Demokrat Parti adına bir konuşma yapan Adnan Menderes, kanunda yapılan değişikliği demokrasiye giden yolda önemli bir aşa-ma olarak adlandırmıştır. Sivil toplum örgütlenmesinin önündeki engeller Demokrat Parti İktidarı öncesinde kaldırılmıştır. Demokrat Parti İktidarı döneminde sivil toplum kuruluşları ile ilişkiler iki bölü-mde ele alınabilir. Birinci bölüm hükümetin sivil toplum alanında yaptığı düzenleme-lerden oluşur. İkinci bölüm ise iktidarın sivil toplum kuruluşlarına yaklaşımı yani onların faaliyetlerine karşı tutumu, ülke yönetimi ile ilgili alınan kararlara ilgili sivil toplum kuruluşlarının tepkileri ve sivil toplum kuruluşlarının kendi alanları ile ilgili alınan kararlarda bu kuruluşların isteklerinin ve itirazlarının dikkate alıp almamasından oluşur.Demokrat Parti İktidarı döneminde sivil toplum alanında birçok düzenleme yapılmıştır. Hükümetin yaptığı bu düzenlemelere günümüzün demokrasi düzeyi ile yaklaşmak zamanın koşullarını ve demokrasi kültürünün oluşum sürecini dikkate almamak anlamına gelir. Hükümetin sivil toplum alanında yaptığı ilk düzenleme 5680 sayılı Basın Kanunu'dur. Kanunun kabulü demokrasi ilkeleri ile bağdaşan bir uygulama olmuştur. Bu nedenle basın ve basın-yayın örgütleri bu yasayı doğru bir adım olarak görmüşlerdir. Hükümetin sivil toplum alanında yaptığı ikinci kanuni düzenleme 5844 sayılı Komünizm İle Mücadele Kanununu çıkarmasıdır. İktidarın programında komü-nizm fikir akımına ve komünist yayınlara karşı mücadele edileceği, bu fikir akımlarının faaliyetlerinin demokratik bir fikir ve vicdan hürriyeti olarak görülmediği aksine de-mokratik rejimi ortadan kaldırmaya yönelik bir tutum ve tavır olduğu vurgulanmıştır. Muhalefetin de bu konuda iktidarla aynı düşünceye sahip olması bu kanunun çıkarıl-masını kolaylaştırmıştır. Demokrat Parti İktidarı'nın bu tür düşünce akımlarına ve onların faaliyetlerine izin vermemesini değerlendirirken zamanın koşullarını ve demok-rasi kültürünün oluşum sürecini göz önünde tutmak yerinde olacaktır. İktidarın sivil toplum alanı ile ilgili yaptığı bir başka uygulama ise 5816 sayılı Atatürk Kanunu'nun çıkarılmasıdır. Atatürk'ün kişiliğine, ilke ve inkılaplarına saldırıların sonucunda kabul edilmiş olan bu kanun günümüzde de geçerlidir. Bu kanunun çıkarılmasına Atatürk'ün kurduğu parti olan CHP'li milletvekillerinin karşı çıkmış olmaları ise üzerinde durul-ması gereken önemli bir husustur. Hükümetin sivil toplum alanında gerçekleştirdiği bir başka düzenleme ise 6761 sayılı Vicdan ve Toplanma Hürriyetini Koruma Kanunu'nun kabul edilmesidir. Kanun, irticai hareketlerin artarak rejimi tehdit eder hale gelmesinin sonucu çıkarılmıştır. İrticai hareketlere izin verilmeyeceğini, demokratik rejimi koruya-cağını programında ilan eden hükümet bunun gereğini yerine getirmiştir. Dinin siyasi veya diğer çıkarlar için kullanılması ve bu tür örgütlenmelerin kurulmasını demokratik ilkelerle bağdaştırmak mümkün değildir. Hükümetin sivil toplum alanına bir başka müdahalesi Neşir Yolu ile veya Radyo ile İşlenecek Bazı Cürümler Hakkındaki Kanun'u çıkarması ile 6732 ve 6733 sayılı basın kanunlarının bazı maddelerini değiş-tirmesi ile olmuştur. Bu kanunlarda yer alan kişilerin şikayeti olmadan savcıların ya-yınlar ile ilgili kendiliğinden harekete geçebilmesi unsuru haber alma ve verme hür-riyetini engelleyen bir koşul oluşturmuştur. Yine gazetecilerin yaptıkları haberler ve köşe yazarlarının yazdıkları yazılar nedeniyle şikayet edilmeleri halinde kendilerini müdafaa edebilmeleri için ispat hakkının onlara verilmeyişi bazı konularda ( iktidar ve mülki amirler ile ilgili yolsuzluk vb) haber yapmalarına, yazı yazmalarına engel olacak ortamı oluşturmuştur. Ayrıca, halkın haber alma özgürlüğüne, gazetecilerin özgür ve bağımsız çalışmasına engel olmuştur. İspat hakkı verilmediği gibi bu tür yazı ve haberler için cezaların arttırılması basın hürriyetini ortadan kaldırmıştır. Bu nedenle bazı basın mensupları hareket içerikli haber ve yazıları nedeniyle ceza almış olsalar da hükümetin politikalarını eleştiren onlarca basın çalışanına hapis cezalarının verilmesi vatandaşlara hak ve hürriyetlerini vereceğini ve devri sabık yaratmayacağını söyleyen Demokrat Parti İktidarı'nın bu uygulamaları onun söylemleri ve adıyla çelişmesine ne-den olmuştur. Hükümetin sivil toplum alanında yaptığı bir başka kanuni düzenleme 6771 Sayılı Toplantılar ve Gösteri Yürüyüşleri Kanunu'nu çıkarmasıdır. Kanun, siyasi partilerin seçim varmış gibi çok fazla miting yaptığı ve bu mitinglerde konuşanların hükümeti ağır bir şekilde eleştirdiği ve hatta bazı hatiplerin hükümet üyelerine ağır sözler söylediği gerekçeleriyle kabul edilmiştir. Bu kanun ile partilerin miting ve kapalı alan toplantıları seçim zamanı ile sınırlandırılmıştır. Bu nedenle bu uygulama demokrasiye aykırı bir düzenleme olmuştur. Bir parti veya dernek kanunlara aykırı hareket etmediği sürece istediği zaman izin almak koşulu ile miting yapabilmelidir. Hükümetin sivil toplum kuruluşları ile ilişkilerine baktığımızda ise olumlu ve o-lumsuz tutum ve uygulamaların varlığından söz edebiliriz. İktidarın sivil toplum kuru-luşları ile ilişkileri dernekler, sendikalar ve basın teşkilatları ile olmak üzere üç ana bö-lüm halinde ele alınabilir. Derneklerle ilişkilere baktığımızda öğrenci dernekleri ile iliş-kilerin daha yoğun olduğunu söyleyebiliriz. Özellikle TMTF ve MTTB gibi öğrenci dernek federasyonları yönetimleri ile ilişkiler öğrenci dernekleri ile ilişkilerin en önemli bölümünü oluşturur. Bu konuda partilerin bugünde devam eden derneklerin yönetimle-rini elde etme isteği Demokrat Parti İktidarı'nın da faaliyetlerinden birisini oluşmuştur. Muhalif olan yönetimleri değiştirmek için çeşitli çalışmalar yapılmıştır. Bu doğrultuda Demokrat Partili dört milletvekili tarafından öğrenci derneklerine hükümetin verdiği ö-deneği dağıtma ve gençlik sorunlarını çözmek amacıyla kurulmuş olan Gençlik Bürosu' nun TMTF ve MTTB'nin yönetim kurulları seçimlerine müdahale etmesi ve sonrası yaşanan olaylar demokrasi ilkeleri ile bağdaşmamıştır. Ayrıca Türkiye Milli Gençlik Teşkilatı adında bir gençlik derneği varken Türk Milli Birliği'nin kurulması ve böylece geçliği farklı cephelerde örgütleme isteği gençliğin birbiri ile kavgalı hale gelmesine ne-den olmuştur. Radyo Dinlemeyenler Cemiyeti'nin İstanbul Valisi Ethem Yetkiner tara-fından kanunsuz bir biçimde kapatılması, Ankara Üniversitesi Siyasal Bilgiler Fakültesi Dekanı Turhan Fevzioğlu'nun görevden alınması nedeniyle eylem yapan öğrencilerin gözaltına alınması ve mahkemeye verilmesi, İTÜTB'nin üniversitedeki yemek boykotu nedeniyle öğrencilerin gözaltına alınmaları, mahkemeye verilmeleri ve hükümet yetki-lilerinin bu konuda yaptıkları açıklamalar demokratik bir iktidar sivil toplum kuruluşu ilişki tarzına aykırı olmuştur. Tahkikat Komisyonu kararları ile örfi idarelerin kurulması ve öğrencilerin tepkilerinin engellenmesi de demokrasi açısında doğru olmayan uygula-malar olmuştur. Kiracılar Cemiyeti'nin istekleri dikkate alınarak Kira Kanunu'nun ka-bul edilmesi, tüccar, esnaf ve sanayicilerin derneklerinin talepleri dikkate alınarak Milli Korunma Kanunu'nda yapılan değişiklik ve kredi imkanlarının artırılması gibi karar-larda dernekler ile ilgili hükümetin olumlu yönde uygulamaları olmuştur. Ayrıca hükü-metin irtica ve komünizm ile mücadeleleri de dernekler tarafından olumlu karşılan-mıştır. Hükümetin sendikalar ile ilişkilerine baktığımızda ise grev hakkı tartışmalarının en önemli sorun olduğunu söyleyebiliriz. İktidarın seçim vaatlerinde ve programında olan grev hakkı ile ilgili sendikalar tarafından onlarca talep gelmiştir. 1951 yılında bir tasarı hazırlanmış olmasına ve ilgili bakanların bu hakkın verileceğini yıllarca söyleme-lerine karşın grev hakkı verilmemiştir. Çalışma bakanları grev hakkının verilmeme ne-denini, genellikle iktisadi ve sosyal düzenin bozulabileceğine dayandırmışlardır. Ayrıca, grev hakkı verildiğinde işverene lokavt hakkının da tanınması gerektiği için sendikala-rın mali gücünün bunu kaldıramayacağını ve işçilerin zor durumda kalacağını iddia et-mişlerdir. Bu nedenlerle grev hakkı için acele edilmemesini dile getirmişlerdir. İşçiye grev hakkının verilmemesinin yanında işçi mitinglerinin yasaklanması; kanunsuz grev nedeniyle bazı sendikaların kapatılması; işsizlik rakamları açıklamaları nedeniyle Çalışma Bakanlığı ile tartışmaya giren bazı sendika birliklerinin Sendikalar Kanunu'nun sekizinci maddesinde yer alan ayrı ayrı iş kolundaki sendikaların sendikal birlik olama-yacağı gerekçesiyle kapatılması; işçi seminerlerinin yasaklanması ve burada konferans verenlerin cahillikle, komünistlikle ve siyasi propaganda yapmakla ile itham edilmesi; Zonguldak Maden İşçileri Sendikası ikinci başkanının muhalif açıklamaları nedeniyle görevden alınması ve sendikanın kongresine müdahale edilmesi gibi olaylar demokratik olmayan tutumlar olmuştur. Kolektif İş Akdi tasarısının TBMM'ye getirilmesi, işçiler için ev yapılması, yıllık ücretli iznin verilmesi, tatil yapamayanlara çalıştıkları gün için yevmiye ödenmesi, sendikal faaliyet nedeniyle işten çıkarılmaların kanunla yasaklan-ması, işçi sigortalarındaki düzenlemelerde işçilerin ve sendikaların lehine olan demok-ratik uygulamalar olmuştur. Basın ve onun teşkilatları ile ilişkilerine baktığımızda Demokrat Parti, muhalefet yıllarında ve iktidarının ilk üç, dört yılında basının büyük bir bölümü tarafından destek- lenmiştir. Fakat hükümet politikalarındaki değişmeler ve ekonomideki kötü gidiş bası-nın büyük bir bölümünün hükümete muhalif olmasına neden olmuştur. Bu nedenle bası-nının muhalif partilerin eylem ve söylemlerini sayfalarına taşıması; hükümet politikala-rını eleştiren yazılar yayınlaması hükümetin yukarıda aktardığımız kanuni önlemleri al-masına neden olmuştur. Bu kanunların kabulüne bazı gazetecilerin hükümet üyeleri ile ilgili eleştirinin boyutunu aşarak hakaret içeren yazıları kaleme almaları da etkili olmuş-tur. Özellikle 1958 yılından sonra basın kuruluşları ile hükümet üyeleri arasında ilişkiler gerginleşmiştir. Basın sanki bir muhalefet partisi gibi muhalefeti hükümete karşı tek cephede birleşmeye çağırırken hükümette basını reklam ödeneklerinin azalması nede-niyle bu yönde hareket etme ve meşru hükümete karşı halkı ayaklanmaya teşvik etmek-le itham etmiştir. İsmet İnönü'nün ve CHP'lilerin yurt gezileri ile Osman Bölükbaşı'nın Kırşehir'i ziyareti ve tutuklanması sırasında bazı gazetecilerin polis tarafından tartak-lanması, fotoğraf makinelerinin ellerinden alınması, gözaltına alınmaları, yargılanma-ları, bu olayların yayının yasaklanması hükümet ile basının ilişkilerini daha da gergin-leştirmiştir. Bu olaylar nedeniyle basın örgütlerinin tebliğler yayınlamaları ve bu tebliğ-lerden birisi nedeniyle İstanbul Gazeteciler Sendikası'nın siyaset yaptığı gerekçesiyle kapatılması ve Beynelmilel Basın Enstitüsü'nün Türkiye'deki basın hürriyeti ile ilgili açıklamasının yayınının yasaklanması basınla iktidarı karşı karşıya getirmiştir. Bu olay-lar bazı gazeteci örgütlerinden istifa edenlerin Demokrat Parti'ye yakın gazeteciler ile radyo ve Anadolu Ajansı'nda çalışan gazetecilerden oluşan Matbuat Kulübü'nün kurul-ması ile sonuçlanmıştır. CHP'nin son olaylar nedeniyle halkı iktidara karşı isyana teşvik ettiği ve silahlı hücreler kurduğu gerekçesiyle Tahkikat Komisyonu'nun kurulması ve bu olay sonucunda örfi idarelerin ilan edilmesi bazı örfi idare kararlarına uymadığı ne-deniyle bazı gazetelerin kapatılmasına neden olmuştur. Tabi ki sadece hükümetin basın-la olumsuz yönde ilişkileri olmamıştır. Başbakan Adnan Menderes birçok kez bazı ga-zetecilere ziyafet vermiş, onların teşekküllerini ziyaret etmiş ve istek ve sorunlarını din-lemiştir. Özetle Demokrat Parti İktidarı Türkiye'de demokrasi kültürünün oluşmadığı ve Cumhuriyet'in ilanının üzerinden çok fazla zamanın geçmediği bir dönemde işbaşına gelen bir iktidardır. The COVID-19 pandemic has affected all segments of society. In this study, the level of anxiety, grief, anger and perceived stress related to pandemic conditions were evaluated in multiple sclerosis (MS) cases, healthcare professionals and lay public and, the stress experienced by individuals with MS was compared with health care professionals and lay public.
Study sample were composed of 63 persons with MS, 59 healthcare professionals (HCP), and 99 healthy volunteers (HV). All participants were administered UCLA-Covid-19 screening test, Posttraumatic Stress Disorder - symptom checklist, Patient Health Questionnaire-9, Generalized Anxiety Disorder-7 Scale, Impact of Events Scale, K-10 scale and Trait Anger Scale. Socio-demographic features of the groups were almost same except for female preponderance and relatively low education in MS group. Hospitalization, test-positivity and quarantine rates due to COVID-19 did nor differ among groups. Pandemic conditions have made everyone feel helpless and hopeless, however, this was remarkably much more evident in HCPs. The most significant concern related with COVID-19 was contracting the disease for persons with MS, transporting the disease to their family members for HCP, and job/income loss due to lockdown for HVs. The stress level experienced by individuals with MS and health care professionals was significantly higher than that of healthy volunteers. In a similar way, the perceived stress level was the same in MS and HCP groups, but significantly higher than in the HV group. Persons with MS were as anxious and depressed as HCPs. Nevertheless, HVs stated that they experienced more psychological distress than both HCPs and persons with MS. Our results yield that depression, anxiety and stress were high among persons with MS during the pandemic.

Music, on the other hand, is a multifaceted phenomenon and its aim to entertain shapes it. On one hand, it interprets emotions, and on the other hand it bears the social, cultural and historical codes of the society to which it belongs. For this reason, it is possible to discover specific details of historical events in the kilams/songs of dengbêjs, important exponents of the Kurdish music of orality. This study focuses on unveiling traces of historical events in the songs of the dengbêjs, in context of the relationship between history and music. Information and documents dealing with the Kozanoğlu events in kilam/songs are compared. A good example of the importance of the dengbêjs in Kurdish history is taken from when in the 19th century, the Ottoman state established a military unit called Fırka-i Islahiye as a part of its policy of asserting its full dominance in rural areas, and also to carry out compulsory resettlement policies. In order to support the operation, the Kurdish chief Sürmeli Memed Pasha set out, taking with him under his auspices Evdale Zeynikê, a dengbej singer. Understanding of the revelation based on reason and applying it to the practical life has led to the emergence of different schools of thought and sects. Abu Hanifa, the founder of the Hanafi school, developed an original decision-making method regarding the matters about which there were no clear provision in the Qur'an and Sunnah. In order to use this method, which is called "Amendment" (istihsan), there should not be a consensus decision (İcma) previously taken by the majority of Muslims. Comparison is a method of reaching a conclusion by comparing a matter which has no previous judgment on it to a matter which has a previous judgement on it. But while Comparision works according to the rules of abstract inference, it may not always be a decision that embraces the highest good in favor of people. For this reason, Amendment (istihsan) method claims to be a final decision-making process that includes the highest good by eliminating the difficulty which cannot be overcome by the Comparative method. Hence, Amendment method is an all-inclusive approach that emphasizes "humane situations" that lie beyond the rules of inference. This "all-inclusive" approach takes the conditions of time, the subjective situation of the individual, the social, political and economic situations in which the society is involved into account while deciding on a matter. This is because it is a peopleoriented approach that aims to maximize justice and equity while deciding on a matter. In this study, this special problem-solving method of Abu Hanifa will be discussed.

AB'nin STK'ların karar alma süreçlerindeki rolüne ilişkin yaklaşımı ve bu alanda ortaya koyduğu normlar, Türkiye'nin AB üyeliğine adaylığından dolayı makalede ele alınarak, Türkiye ve AB'nin siyasal katılım konusuyla ilgili STK'lara yönelik yaklaşımı ortaya konmaya çalışılmıştır. Sonuç olarak Türkiye'nin siyasal katılım sorununu gidermesinin, uzun dönemde Türk demokrasisinin daha ileri seviyeye çıkması için kaçınılmaz olduğu vurgulanmıştır. ; In this article, the issue of participation of the civil society in the political sphere in the representative democracy is examined in view of the fact that the elections, which are considered to be the most important features of representative democracy, are not sufficient to ensure political participation. Within in this context, the role of NGOs in the solution of problems arising in representative democracy is evaluated and it is identified the difficulties in the participation of NGOs in the political and bureaucratic decision-making process in Turkey. The approaches of the EU to the role of the NGOs in the decision-making process and norms put forth in this field is handled because of Turkey's candidacy for EU membership, it is tried to reveal the approaches of Turkey and EU to NGOs related to the political participation. As a result, it is emphasized that overcoming the issue of political participation of Turkey is inevitable for further development of Turkish democracy in the long term.

Yolsuzluk dünyanın hemen her yerinde, toplumları ve ülkeleri önemli derecede etkileyen ciddi bir sorundur. Bu sorun merkezi hükümetlerden yerel yönetimlere, özel sektörden sivil toplum kuruluşlarına kadar her alanda tüm çabalara karşın yaygın ve kalıcı bir hal almıştır. Genellikle az gelişmiş ve gelişmekte olan ülkelerde yaygın olan yolsuzluk, ekonomik büyümeyi olumsuz yönde etkilemekte, ekonomik büyümeye zarar vermekte ve sosyoekonomik kalkınmayı sekteye uğratmaktadır. Bu açıdan yolsuzlukla mücadele oldukça önemlidir. Bu noktada Birleşmiş Milletler tarafından geliştirilen Küresel İlkeler Sözleşmesi (Global Compact) işletmelerin uzun dönemde karşılaşacakları sorunları bütüncül bir yaklaşım benimseyerek ortadan kaldırmak, sürekli rekabet içindeki iş dünyasında ortak bir kalkınma kültürü oluşturmak üzere evrensel ilkeler geliştirmiştir. Bu çalışmada yolsuzluk kavramı Küresel İlkeler Sözleşmesi'nin yolsuzlukla mücadele başlıklı ilkesi çerçevesinde ele alınmış ve lojistik sektör incelemesi yapılmıştır. Değişen ve gelişen dünyada eğitimin önemi gün geçtikte artmakta olup, yükseköğretim kademesinde nasıl bir finansman yapısının uygulanması gerektiği üzerine modeller geliştirilmektedir. Bu çalışmada, yükseköğretimin kamusal niteliği, fayda ve maliyetleri, finansman yöntemleri ele alınarak Türkiye, Amerika Birleşik Devletleri ve seçilmiş Avrupa ülkelerindeki lisans, yüksek lisans ve doktora aşamalarının finansmanı hakkında bilgi verilmiştir. Aynı zamanda, yükseköğretimin sosyal ve özel getirilerinin birey ve toplum üzerindeki etkisi güncel verilerle açıklanmaya çalışılmıştır. Uygulanan finansman yöntemlerine ait oranların ele alınan ülkelerde değiştiği görülmüştür. Farklı üniversite türlerindeki yükseköğretim sunumlarına değinilmiştir. Türkiye için yükseköğretimin finansmanının vergilerle sağlanması yerine lisans eğitiminde harçların yeniden düzenlenerek uygulamaya konulması, lisansüstü eğitimde ise bilimin gelişmesi baz alınarak programların yeniden düzenlenmesi önerilmiştir. --- In the changing and developing world, the importance of higher education is increasing day by day and models have been developed on what kind of financing structure should be applied in the higher education spectrum. In this study, the public nature of higher education relating to benefits and costs, financing methods have been discussed on Turkey, the United States and some selected European countries in various level such as undergraduate, graduate and doctoral level. At the same time, the effect of social and private returns of higher education on individuals and society has been explained with current data. It has been observed that the financing methods applied differs in the countries discussed. Higher education services provided in different types of universities have been mentioned. The financing of higher education in Turkey could be ensured by revising the tuition fees at the undergraduate level instead of financing this process through taxes, while for the graduate program this could be achieved by restructuring this branch based on the development in science.
