Game-theoretic approach has been providing a powerful tool in qualitative understanding of macroscopic social phenomena in social sciences, e.g., in economics and political science. Recently, researchers in physics, especially in statistical physics, use these game-theoretic approaches but in more quantitative way and have been producing a variety of interesting results in the new research area called 'sociophysics' by studying human society as a complex system. This work introduces recent works that have tackled combinatorial complexities arising in game-theoretic studies with the aid of simplified assumptions and numerical computations. We first show how cooperation emerges in the prisoner's dilemma game when each player's memory capacity is enhanced and suggest that the intelligent tit-for-tat strategy plays a crucial role in the history of cooperation. And then it is numerically shown that there is a certain case of simultaneous coordination among many players where the system has a high risk of failure when everyone is willing to follow the coordination, which is actually higher than when some are not concerned about it. Lastly, we discuss mathematical treatment of an equilibrium solution for a reverse auction game, which is a variant of the minority game, and its computational approach. ; Artikel på koreanska, abstract på engelska.

학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master

학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. In conclusion, all these considerations show that Rousseau's political philosophy does not defense the alleged totalitarianism but is the philosophy of 'freedom' in the strict and consistent sense of the word. ; 본 논문의 목적은 을 중심으로 루소의 일반의지 개념의 정체를 해명하고, 이를 전체주의로 규정하는 비판들로부터 루소의 논지를 명료하게 하는 것이다. 이를 위해 나는 '자유롭도록 강제'된다는 루소의 역설적인 표현을 중심으로 일반의지 개념을 재구성하고자 하며, 이 점에 주목할 때 비로소 일반의지 개념에 대한 정확한 이해가 가능하다고 본다. 루소의 일반의지 이론에서는 크게 두 가지의 '자유롭도록 강제됨'이 나타난다. 하나는 일반의지를 거부하는 자들이 자유롭도록 강제되어야한다고 주장하는 1부 7장의 주장이며 다른 하나는 2부 3장 및 2부 7장(4부 8장)에서 일반의지의 성립 조건을 논의하는 대목에서 드러난다. 나는 이들을 각각 살펴보고 루소의 궁극적인 강조점은 강제가 아니라 자유에 있음을 보여주고자 한다. 결론적으로, 루소의 논리를 따를 때 나타나는 진정한 난점은 자유롭도록 강제하는 과정이 일반의지의 산출을 위해 필수적임에도 불구하고, 실천적으로는 이것이 실패할 수 있는 여지를 허용하는 데에 있다. 루소의 인민주권론은 국가 정당성의 토대가 신적인 것이나 자연적인 근거에 있다는 견해를 부정하고 인민의 자율적인 의지가 정치적 권위의 원천이라고 주장한다. 그런데 인민은 항상 이성적이고 사회적인 질서정연한 통일체인 것이 아니라 또한 잠재적으로 정념에 좌우되기 쉬운 개인들의 무질서한 모임으로서 다중으로 현상하기도 한다. 즉 한편으로 인민의 일반의지는 사회를 정당한 것으로 만드는 조건이지만, 다른 한편으로 인민들의 개별 심의는 우연적이며 오류를 범할 수 있는 것이다. 따라서 루소는 다중을 인민으로 만들기 위해서 입법자와 시민종교와 같은 인민 외부의 권위를 도입한다. 그러나 인민은 그들이 다중이라는 바로 그 이유로 이러한 외부적 권위에 복종하지 않을 수도 있기 때문에, 인민이 스스로를 통치하는 것에 관한 난점은 해결되지 않는다. 일견 루소의 인민주권론은 인민이 인민 자신을 통치해야 한다는 낙관적 주장으로 보이지만, 인민은 그 자체로 주어지거나 발견될 수 없으며 다만 이상적 인민으로 구성되어야 한다는 루소의 비관적 주장 역시 간과되어서는 안 된다. 결국 입법자나 시민종교의 도입은 인민주권의 원리와 상충되는 것이 아닌데, 이러한 타율적 장치의 성공 여부는 불확실하여 인민주권은 여전히 그 자율성을 지니기 때문이다. 문제는 공동이익을 지향해야 할 일반의지가 각 개인이 갖는 특수의지의 득세에 의해 한갓 전체의지로 전락할 위험, 통일적이고 유기적이어야 할 인민이 무지몽매하고 개별적인 다중으로 전락할 위험, 집단적인 심의에 있어 능동적이고 합리적이어야 할 시민이 수동적이고 정념에만 사로잡힌 신민으로 전락할 위험에 있다. 좋은 법이 좋은 인민을 만들지만 좋은 법의 출처는 또한 인민이어야 한다는 인민주권의 원리, 그리고 최초의 인민은 그러한 입법을 할 수 있는 역량을 가지지 못하는 다중이라는 상황이 루소가 사로잡힌 순환 논리의 원천이다. 그런데 사회계약 이후에도 인간이 자연 상태에서 갖던 감성적, 비합리적, 비정치적 속성은 완전히 해소되지 않으며, 이는 입법자나 시민종교 같은 장치를 통해서도 인민의 자기통치가 온전히는 달성될 수 없는 난제임을 보여준다. 이처럼 루소의 사회 상태는 항상 부분적으로나마 자연 상태가 돌발할 수도 있는 위험을 갖는다는 점에서 취약한 것이다. 주권은 인민에 속하지만 인민은 스스로를 직접 통치할 수 있는 역량을 결여한다는 것이 루소의 인민주권론이 보여주는 애매성이다. 그러므로 인민의 자기통치로서 루소의 민주주의는 항상 불완전하여 계속해서 갱신되고 수정되어야 하는 미완의 민주주의로 남는다. 루소에서 이러한 역설은 자유의 원리를 일관되게 관철시키게 됨에서 귀결된다. 즉 정치의 정당성에는 어떠한 선험적이고 궁극적인 토대도 없다는 것, 인민은 자유로운 존재로서 그들의 의지만이 정치적 정당성의 유일한 원천이라는 루소의 전제는 그들이 스스로의 자유를 거부할 자유마저도 허용한다. 다시 말해 각 개인은 일반의지의 실현을 위해서 자유롭도록 강제되어야 하지만, 이들은 '자유롭도록'(즉 시민적 자유와 도덕적 자유) 강제되지 않을 수 있는 자유(즉 자연적 자유)를 가질 수도 있다. 요컨대 인간을 시민으로 만들기 위해서는 효과적인 탈자연화가 요구되지만, 이는 보증없는 과정이다. 따라서 루소의 체계를 떠받치는 이항대립, 즉 사회와 자연, 인민과 다중, 일반의지와 전체의지는 항상 실천적으로는 혼동될 위험을 가지며 이러한 위험은 일반의지가 정치의 갈등적인 과정 속에서 단지 일시적으로만 가능한 것으로 만든다. 루소가 보여주는 정치의 근본 문제는 자연 상태로부터 사회 상태로의 이행이 필수적이지만, 동시에 이것이 매우 어렵고 온전히 달성될 수 없다는 것이다. 결론적으로 이러한 탐구는 루소의 철학이 전체주의를 대변하는 것이 아니라 여전히 '자유'의 철학이며, 그것도 매우 일관적인 의미에서 그러함을 보여준다. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(외교학전공), 2020. 8. 신범식. ; 본 논문은 테러와의 전쟁에서 많은 피해를 입은 미국과 러시아의 테러조직 리스트가 예상과 달리 왜 유사점보다 차이점을 더 많이 가지고 있는가를 밝히고자 하였다. 이를 위해 러시아와 미국이 테러조직을 지정하는 과정을 비교함으로써 양국의 테러조직 지정에 영향을 미치는 요인들을 규명하고자 하였다. 우선 미국과 러시아의 국가 안보전략 문서들을 분석함으로써 양국이 시기별로 중요하게 여긴 관심사와 이러한 관심사에 대한 위협이 무엇인지 분석하였다. 그 다음으로, 미국과 러시아의 대통령들이 1993년부터 2017년까지 발표한 테러 관련 연설문, 인터뷰, 공문서들 가운데 제목이나 본문에 'terror' 및 'террор'라는 어근이 포함된 다양한 형태의 텍스트 자료들을 대상으로 워드분석을 함으로써 양국이 테러를 어떠한 위협으로 상정하는지, 국내외의 어떤 안건들과 연결하는지를 파악하였다. 그리하여 본고는 테러에 대한 역사적 경험과 인식, 안보에 대한 이해, 국제 질서와 상황 파악 등 많은 요인들이 테러조직 지정에 영향을 미치면서 양국이 테러에 대한 기본적인 인식, 즉 초국가적인 테러조직들이 한 국가만이 아닌, 국제사회 전체에 위협이 될 수 있다는 인식 면에서는 시간이 지나면서 비슷해졌지만 양국의 안보개념, 안보와 관련된 국익의 우선 순위, 테러에 대한 인식에 영향을 미친 역사적 경험이 상이하기 때문에 테러조직의 지정에서 유사점보다는 차이점이 더 많이 나타나게 되었다는 결론에 도달하였다. 본고는 일견 미국과 러시아가 테러조직을 공동의 적으로 간주하는 것처럼 보이지만 실제로는 다양한 요인들로 인해 테러와 테러조직의 지정에서 서로 다르게 접근한다는 사실을 보여주었다는 데 그 의의가 있다. ; Russia and the United States have been on the front line of the fight against terrorism for a long time, and at first glance it may seem that they are fighting against the same enemy. However, upon careful comparison of the U.S. Department of State list of Foreign Terrorist Organizations(FTO) and corresponding list of the Russian Federation the distinctions are strikingly obvious. The organizations designated by each country outnumber the ones that were appointed by both. This study aims to examine the factors behind the differences in the approaches that Russia and the U.S. took to defining the enemy. It is argued that the designation method is mainly determined by two broad aspects – the security concept and the perception of terrorism. Through the analysis of the national security strategies from 1997 to 2015, this study investigated several crucial issues: the ways Russia and the United States had been perceiving the international order, their place and role in it, as well as changes in their national interests over time, and most importantly, what constituted the perceived threats to the national security. Supporting this with the examination of the perception of terrorism through the word frequency analysis of Russian and American presidents' speeches, the study concluded that despite the fact that both countries claim terrorism to be their main threat, the approach to defining it is not the same as each country bases it on their own historical experience and national priorities. The United States views terrorism largely as a part of the global security framework, inseparably associated with other issues (such as the threat of WMD proliferation) that are claimed to emanate from rogue states and tyrannies. Consequently, the strategy in the fight against terrorism has been derived from the desire to converse these regimes to democracy. On the other hand, Russia was found to view terrorism as a more direct threat to the country's national security. For Russia, terrorist organizations are separate entities that try to violate the country's constitutional order through separatist and extremist slogans. Unlike the United States, Russia does not view terrorist organizations as an instrument in the hands of tyrannical regimes, therefore it condemns the American unilateral approach that is structured around interference into the internal affairs of other states. These differences are reflected in the formation of the terrorist organizations lists. The list of the United States is more comprehensive and geographically global. The FTO list includes not only the organizations that directly threaten US security, but also the ones that harm the partners and allies of the United States. At the same time, Russia is focused on designating the organizations that directly threaten the security of the country and the nearest region like Central Asia. There are also organizations on the list that do not commit terrorist acts, but undermine the values of Russia's constitutional system through the conduct of propaganda on the Internet. After September 11 and the Beslan school siege in 2004, there is a convergence in the perception of the US and Russia on the rise of terrorist organizations network as a major transnational threat in the 21st century. This explains why there are the same ten organizations on both lists. The vast majority of the organizations that have been designated by both countries are affiliates of al-Qaeda, which are fighting not one specific country, but the entire modern international society. Specifically, the study will analyze the factors that result in party defection voting behavior by assembly members, a practice that betrays the tradition of strong party discipline. To this end, the study analyzes the roll-call voting record of 241 Grand National Party and Democratic Party assembly members having held office during the first half of the 18th National Assembly to analyze the factors that cause party defection votes. Various studies on voting behavior within the National Assembly assess that party is the major influence on assembly member's voting behavior. The logic is that Korean political parties, from their inception, and, experiencing phases of authoritarian government, strengthened party discipline in kind, giving birth to a tradition of party exercising significant control over assemblymen's behavior. However, plenty of evidence indicating that assembly members are more than just passive beings submissive to party discipline is to be found. In the act of voting, two choices in disagreement with the party line are available. The first is active party defection voting, wherein a vote is cast in a direction out of line with one's party. Second is passive defection behavior, wherein one chooses abstention or absence to avoid casting a party-line vote. Although not common, the fact that assembly members on occasion display independent voting behavior, defecting from party majority, raises the need for a new explanation other than strong party discipline, which has been identified in the existing literature as the significant determinant of voting behavior. The study assumes that assemblymen are strategic actors seeking utility through floor voting, and focuses on identifying significant determinants of assembly members' party defection votes in the first half of the 18th National Assembly. For this purpose, the party-line was identified as the voting choice of the majority of assembly members in a party, and party defection voting behavior by individual assembly member was set as the dependent variable. The study is divided into two models: In the comprehensive defection model, absences from floor voti are included in the analysis, where as in the simple defection model, they are not. To identify deciding factors of assembly members party defection votes, independent variables were categorized as institutional, representational, and individual variables. Weighted least squares group logistic regression analysis was performed. The results of the study can be summarized in three points. First, institutional variables were identified as having a significant effect on assembly members' party defection voting. Assembly members are more likely to defect from the party-line in voting when they have autonomy from their party. This is because assembly members having served multiple terms, who are not part of the official party leadership, but who, with relatively more experience, in effect are part of party leadership, can afford to be more autonomous. On the other hand, assembly members who are officially in party leadership are accountable for the entire party, and are relatively less able to vote in a direction not in agreement with the party line. They can therefore be expected to vote in line with the party. Second, in the simple defection model, ideology, a variable that had largely been dismissed in the past was confirmed as having a statistically significant influence. Analysis showed that the more progressive an assembly membern, the higher the likelihood of party defection voting behavior. The fact that the influence of ideology was only visible when absences were not included in analysis has wide implications. This indicates that assembly members' making known their personal standing on issues through floor voting, directly opposing the party-line, is only possible because the strength of individual ideology is such that it outweighs the institutional incentives offered by party. However, in the study, the ideology variable was not interpreted in connection with policy; rather, ideology was defined as a general tendency to defect or vote in line with party majority. Therefore, the direct influence of ideology on party defection in a policy context could not be measured. The study's significance lies in unearthing new implications regarding the building blocks of a healthy representative democracy. The results of the study, which analyzed the deciding factors of party defection votes, showed that party defection was the result of assembly members' institutional autonomy. Such results are in line with existing literature, which points to strong party discipline and undemocratic intra-party structure as the key causes of the Korean National Assembly's chronic inefficiency and confrontations. The study identified ideology as a factor that increases the likelihood of party defection; it can therefore be forecast that once a more democratic party system is established both on and off the floor, assemblymen will be able to exercise greater autonomy, leading to a political environment in which factors such as ideology may have a more pronounced influence on voting behavior. ; Master

Among the various factors that can influence foreign policy, this paper concentrates on the interaction of structure, decision maker's intention, and perception or values according to Carlsnaes' dynamic model of analysing foreign policy change. After nation building, there have been two critical structural diversions in the Communist bloc—the Twentieth Party Congress of the CPUS in February 1956 and the Sino-Soviet conflict that began in the late 1950s. In each event, Kim Il-sung attempted to increase DPRK's policy-making autonomy and exclude the political leverage of two brotherhood countries, Soviet and China, in the domestic politics. Kim's strong anti-great power chauvinism was strengthened from his past experiences, and it was reinforced by two countries' intervention in 1956. These two primary elements had influenced Kim Il-sung's foreign policy decision making during his reign. In the late 1950s, Kim and his partisans concluded the intra-party conflict with two rival groups, the Soviet Korean and Yan'an groups. These events completely monopolized power in domestic politics. As the dispute between China and Soviet aggravated in the 1960s, North Korea could secure its policy-making autonomy from these two countries. It had become more equal that North Korea extended its diplomatic relations to the Third World nations in this period. On the basis of the consecutive policies, North Korea could implement the self-reliance foreign policy in around 1965. ; Master

Specifically, this study empirically analyzes how the quantitative and qualitative levels of the resident participation system influenced the democratic performance of local governments. The involvement of residents in the policy process of local government is an essential element for decentralization and actual operation of local autonomy, which is the complementary means of representative democracy. Resident participation plays a role in improving the practical problem-solving ability by preventing local government policies from violating reality. It is also known that civic involvement in the policy process plays a positive role in improving the responsiveness and effectiveness of administration. Therefore, local governments consider various measures to promote participation of residents. There are many ways to promote participation. Among them, the institutional introduction and continuous operation of the means of involvement of the residents has a positive effect on the invigoration of the involvement of the residents, as it provides the basis for the participation of the residents and broadens the scope of participation. In addition, the resident participation system can serve as a mechanism for maintaining and supporting appropriate resident participation in the policy process. Therefore, institutionalization of participation in local government is meaningful, and this study deals with civic involvement system based on such discussion. If so, is it good to have a lot of participation systems in the policy process at the basic level of local government? In reviewing previous studies, the introduction of a new resident participation system has the effect of activating resident participation or enhancing government performance. Therefore, it emphasizes the necessity of introduction to local governments that have not yet introduced the participatory system, and suggests methods for successful operation of the participant system. Previous studies have shown that the effects after the introduction of the new resident participation system or the qualitative nature of the participation system have a positive effect on the activation of resident participation and government performance. Point out that this will be a helpful option in terms of promoting participation or improving government performance. Yet another preliminary study suggests that the essential reason for local governments to introduce participatory participation systems may not be the expansion of participatory participation or the improvement of government performance. In other words, it is a formal means to show that local government officials are at work, or as a means of demonstrating that they are not falling behind in competition with other local governments. In such cases, the introduction of the resident participation system may have a negative impact on the welfare or government performance. Why is it important to measure government performance at the level of local government, and why do we consider the resident participation system as a major influencer of local government performance in this study? In general, government performance means making policy decisions that respond to citizens' policy needs and implementing them efficiently. Participation through the participatory system as a formal channel of participation not only guarantees the continuity of policy process participation, but can also reflect democratic, transparent, and responsive policies and public services because it can reflect diverse interests and communication. Therefore, the resident participation system is a channel and a means to guarantee continuous and stable resident participation. Most of the existing studies evaluate that participatory participation system acts as a catalyst for local autonomy and is justified in terms of improving government performance. Nevertheless, some studies question the effectiveness of the resident participation system, including the fact that the policy reflection rate through the resident participation system remains low at the local government's policy process and the effectiveness of the resident participation system is low. In addition, some previous studies have cited the inability to accurately measure the effect of citizen participation through resident participation system. In other words, it was difficult to determine whether the resident participation system directly influenced the government performance improvement or whether the resident participation system affected the society and the government performance improved as a result. However, it is clear that the purpose of the resident participation system is to enhance the democratic outcomes of local governments and ultimately improve the quality of life of residents. This fact is more evident when examining the Basic Ordinances on Participation of Residents, which are established by Ordinance by some local governments, which states that the purpose of the citizen participation is to promote administrative transparency and responsiveness. In other words, the purpose of the resident participation system is to improve the democratic performance of local governments. If so, it would be necessary to take a step further from the existing studies and use variables that can measure how transparent, democratic and responsive the administration has been due to the operation of the actual participatory system. Based on the above discussion, this study measured the quantitative level of the resident participation system introduced from 2005 to 2017 when the actual operation of the resident participation system was confirmed for 226 local governments in 2019. Next, the quality of the participation system was measured by categorizing the individual participation system based on the scope and intensity of participation. Type III systems are the ones with the highest intensity of delegation with the participation of the general population among the total residents participation system. Finally, the democratic achievements of local governments were divided into transparency, responsiveness and effectiveness of each basic local government. Transparency of local governments was measured by the Comprehensive Integrity Index, and responsiveness was measured by the total number of complaints handled per government official, and by the share of grievances and other complaints. Effectiveness was measured by the ratio of social welfare budget to the total budget and the quality of life index of residents. As a method of analysis, fixed effect panel analysis was used. The summary of the analysis is as follows. First, the increase in the quantitative level of the resident participation system for the local government at the basic level has a significant negative effect on the transparency of administration, while the increase in the share of the Type III resident participation system has a positive effect on the transparency of the administration. It was also confirmed that the transparency of administration did not decrease as the total number of operation of the resident participation system increased, but that the slope converged to zero when the quantitative level of the participation system reached a certain level. On the other hand, in the local governments at the County level, it was found that when the resident participation system fell short of the average number of operations, it had a negative effect on the transparency of the administration, while exceeding the average number of operations had a positively significant effect on the transparency of the administration. Second, the increase in the quantitative level of the resident participation system has a negative effect on administrative responsiveness, and the increase in the quality level has no statistically significant effect. However, the quantitatively appropriate level of the resident participation system, which improves administrative responsiveness, was confirmed in the case of the District level of local government. Although the total number of operation of the participatory system reached a certain level, it had a negative effect on administrative responsiveness, but beyond that level, it was found to have a positive and significant effect on responsiveness. Third, the increase in the quantitative level of the resident participation system has a positive effect on the effectiveness of administration. As the total number of operation of the resident participation system increased, both the proportion of social welfare budget and the quality of life of the residents increased. However, the statistical significance of the quantitative and qualitatively appropriate levels of the resident participation system to enhance the effectiveness of administration could not be confirmed. Based on this, the implications of this study are as follows. As discussed above, most existing studies analyze the effect of each participatory system implemented by local governments or their impact on the performance of specific sectors of local governments, or the effects of implementing participatory systems on individual municipalities. In addition, existing researches are only on comparative studies between local governments operating specific participatory systems and on the possibility of revitalization of participatory systems. In other words, there is a limitation in that not only the collective effects of various participation systems used in local government policy processes but also the effects of accumulated participation systems over time are not considered. In order to overcome these limitations, this study approached the resident participation system at the collective level and focused on the direct effect of the institutional factor on the government performance. Theoretical implications of this study are as follows. First, this study expanded the spatial and temporal scope of analysis to overcome the limitations of the analytical objects of previous studies. Second, the participation system was analyzed from various angles. Various types of typology of resident participation system suggested in the previous study were summarized, and it was confirmed that the effect on government performance also appeared differently according to the kind of participatory system. Third, this study attempted to measure government performance on a democratic level. Since the ultimate goal of the resident participation system is to realize local autonomy and to promote democracy, this paper analyzes the transparency, responsiveness, and effectiveness of administration focusing on the democratic dimension of government performance. Fourth, this study tried to make the analysis accurate by conducting fixed effect panel analysis that can control individual specificity such as endogenous local government's effect and time effect which was not controllable in the cross-sectional analysis used in the existing research. In terms of policy, the implications of this study are as follows. First, this study considered the quantitative and qualitative level of the resident participation system as a major influencing factor of government performance. Increasing the quantitative and qualitative levels of the resident participation system had a significant influence on the democratic performance of local governments. In particular, it was found that in order for the resident participation system to have its original effect, it must be an institution with an interactive attribute including a means for communicating with the government and delegating authority to the residents. Second, this study diagnosed the quantitative and qualitative levels of the local participation system, which is currently operated by local governments, and suggested the basis for the selection and concentration of future participation system. Third, although the administrative implications of the research on the performance of local governments are considerable, empirical research is insufficient. This seems to be because the performance of local governments is not only objectively measurable, but also limited in obtaining usable variables. Therefore, this study limited government performance to democratic performance, and analyzed total democratic performance of local government using various variables that can be measured. The limitations of this study are as follows. First, since the quantitative and qualitative levels of the resident participation system were measured at the collective level, the individual characteristics of each resident participation system could not be reflected in depth in measuring the quality level. Next, due to the limitations of the data available to local governments at the basic level, this study could only reflect the use of subjective indicators to measure democratic government performance such as 'quality of life of residents' in Seoul Metropolitan Government. In this regard, the results and methods of this study are based, and it will be necessary to approach in various ways how and in what circumstances the participation system has a significant effect on 주민참여를 활성화하기 위한 여러 방안을 고민한다. 주민참여를 활성화하는 방안에는 여러 가지가 있다. 그중에서도 주민참여 수단의 제도적 도입과 지속적 운영은 주민참여가 발생할 수 있는 기반을 마련해주고 참여의 폭을 넓혀주는 역할을 하므로 주민참여 활성화에 긍정적 영향을 미친다. 더불어 주민참여제도는 정책과정에서 적절한 주민참여를 유지하고 지원할 수 있는 기제의 역할을 할 수 있다. 그러므로 지방정부 내 주민참여의 제도화는 의미가 있으며, 본 연구는 이러한 논의를 바탕으로 주민참여제도를 다루고 있다. 그렇다면 다양한 특성을 가진 주민참여제도들이 많이 시행되면 좋은 것일까? 선행연구를 검토해보면 새로운 주민참여제도의 도입은 주민참여를 활성화하거나 정부성과를 높이는 효과를 가져오기 때문에, 아직 도입이 안 된 지방정부에는 도입의 필요성을 강조하고, 시행 중인 지방정부에는 참여제도의 실질적 운영을 위한 방법을 제시한다. 그러므로 새로운 주민참여제도를 도입한 이후의 효과 또는 참여제도의 속성이 주민참여의 활성화 혹은 정부성과에 긍정적으로 유의미한 영향을 주었다는 기존의 연구결과들은 지방정부가 앞으로 더 많은 주민참여제도를 도입하는 것이 주민참여의 활성화나 정부성과 제고 측면에서도 도움이 되는 선택이 될 것을 말해준다. 하지만 또 다른 선행연구에 의하면, 지방정부가 주민참여제도를 도입하는 이유가 주민참여의 확대나 정부성과의 제고에 있다는 것은 부차적인 문제일 뿐이라고 주장한다. 그뿐만 아니라 지방정부의 관료가 일하고 있다는 것을 보여주기 위한 형식적 방법, 다른 지방정부와의 경쟁에서 뒤처지지 않고 있다는 것을 증명하는 하나의 수단으로 주민참여제도를 도입, 운영하기도 한다는 것이다. 이럴 때 주민참여제도의 도입은 오히려 주민 복리 또는 정부성과에 부정적 영향을 미칠 수 있다. 한편, 지방정부 수준에서 정부성과를 측정하는 것은 왜 중요하며, 본 연구에서 지방정부 성과의 주요 영향요인으로 주민참여제도를 고려하는 이유는 무엇인가? 일반적으로 정부성과는 시민의 정책적 요구에 반응하는 정책 결정을 하고, 이를 효율적으로 집행하는 것을 의미한다. 참여의 공식적 통로인 주민참여제도를 통한 주민참여는 정책과정 참여의 지속성을 보장할 뿐 아니라 다양한 이해관계와 의사소통을 반영할 수 있으므로 민주적이고 투명하며, 대응성 높은 정책과 공공서비스를 산출할 수 있도록 유도하는 역할을 할 수 있다. 다시 말해 주민참여를 지속적이고 안정적으로 보장할 수 있는 통로이자 수단이 바로 주민참여제도인 것이다. 대부분의 기존연구들은 주민참여제도가 지방자치의 촉매제 역할을 하며, 정부성과 제고 측면에서도 정당성이 높다고 평가한다. 그런데도 일부 연구들은 실제 지방정부의 정책과정에서 주민참여제도를 통한 정책반영비율은 낮은 수준에 머물러 있고, 주민의 참여제도에 대한 효능감도 떨어지는 등 주민참여제도의 효과성에 의문을 제기한다. 또한, 주민참여제도를 통한 주민참여의 효과를 정확히 측정할 수 없기도 하거니와 주민참여제도가 정부성과 제고에 직접적 영향을 미친 것인지, 주민참여제도를 통해 주민참여가 활성화됨으로써 사회에 영향을 미치고 결과적으로 정부성과가 향상된 것인지 판단하는 데 어려움이 있었다. 그러나 확실한 점은 주민참여제도의 목적이 지방정부의 민주적 성과를 제고하여 최종적으로는 주민의 삶의 질 향상에 있다는 사실이다. 이러한 사실은 일부 지방정부가 조례로 제정한 「주민참여에 관한 기본조례」를 살펴보면 더욱 확실히 나타나는데, 주민참여가 행정의 투명성과 대응성을 증진하고자 하는 목적이 있음을 명시하고 있다. 즉, 주민참여제도의 목적은 지방정부의 민주성 성과의 향상인 것이다. 그렇다면 기존연구에서 확인한 바와 같이 주민참여제도가 가지는 효과의 측정을 재정이나 예산자료를 활용하여 양적으로 측정한 연구에서 한 걸음 더 나아가 실제 주민참여제도 운영으로 인해 얼마나 행정이 투명하고 민주적이며 대응적으로 변화했는지를 측정할 수 있는 변수를 활용해야 할 필요가 있을 것이다. 이상의 논의를 바탕으로 본 연구는 2019년 기준 226개 기초단위의 지방정부를 대상으로 주민참여제도의 실제 운영이 확인되는 2005년부터 2017년까지 도입된 주민참여제도의 양적 수준을 측정하였다. 더불어 개별 주민참여제도를 참여의 범위와 강도를 기준으로 유형화하여 시행 중인 전체 주민참여제도 중 일반적 주민이 참여하면서, 권한위임의 강도가 가장 큰 참여제도들(제 Ⅲ형 제도)이 전체 시행 중인 주민참여제도에서 차지하는 비중을 주민참여의 질적 수준으로 측정하였다. 다음으로 지방정부의 민주적 성과를 각 기초 지방정부의 투명성, 대응성, 효과성으로 구분하고 종합청렴도지수, 공무원 1인당 전체 민원처리 건수, 고충 민원과 기타민원의 합이 전체 민원에서 차지하는 비중, 전체 예산대비 사회복지예산의 비중, 주민의 삶의 질 지수로 측정하였다. 분석방법은 고정효과 패널 분석을 활용하였다. 분석결과를 요약하면 다음과 같다. 첫째, 기초단위의 지방정부 전체를 대상으로 주민참여제도의 양적 수준의 증가는 평균적으로 행정의 투명성에 부정적으로 유의미한 영향을 미치지만, 제 Ⅲ형 주민참여제도 비중의 증가는 행정의 투명성에 긍정적으로 유의미한 영향을 미쳤다. 또한, 주민참여제도의 총 운영 건수가 증가할수록 행정의 투명성이 지속해서 감소하는 것이 아니라, 참여제도의 양적 수준이 일정 수준에 이르면 그 기울기가 0에 수렴함을 확인하였다. 한편, 군 단위의 지방정부에서는 주민참여제도가 평균 운영 건수에 미치지 못할 때는 행정의 투명성에 부정적 영향을 미치지만, 평균 운영 건수를 넘어서면 오히려 행정의 투명성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 둘째, 주민참여제도의 양적 수준의 증가는 행정의 대응성에 부정적으로 유의미한 영향을 미치는 것으로 나타났으며, 질적 수준의 증가는 통계적으로 유의미한 영향력을 가지지 못하는 것으로 확인되었다. 그러나 구 단위 지방정부의 경우 행정의 대응성을 제고하는 주민참여제도의 양적 적정 수준이 확인되었다. 참여제도 총 운영 건수가 일정 수준에 이르기까지는 행정의 대응성에 부정적 영향을 미치는 것으로 나타났지만, 그 수준을 넘어서면 대응성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 셋째, 주민참여제도의 양적 수준의 증가는 행정의 효과성에 긍정적으로 유의미한 영향을 미치는 것으로 나타났다. 주민참여제도의 총 운영 건수가 증가할수록 전체 대비 사회복지예산의 비중과 주민의 삶의 질 모두 증가하는 것을 확인하였다. 그러나 행정의 효과성을 제고하는 주민참여제도의 양적 및 질적 적정 수준의 통계적 유의미성은 확인할 수 없었다. 이를 바탕으로 본 연구의 함의를 제시하면 다음과 같다. 앞서 논의한 바와 같이 대부분의 기존연구들은 지방정부에서 시행하는 각각의 주민참여제도가 가지는 효과 또는 지방정부의 특정 부문의 성과에 미치는 영향력을 분석하거나, 개별 지방자치단체를 사례로 참여제도 시행의 효과 분석, 특정 참여제도를 운영 중인 지방정부 간 비교연구, 참여제도의 활성화 가능성에 관한 연구에 머무르고 있다. 다시 말해, 지방정부 정책과정에서 활용되는 다양한 주민참여제도의 집합적 효과뿐 아니라 시간이 흐름에 따라 누적된 참여제도가 미치는 효과 또한 고려하지 못했다는 한계가 있다. 본 연구는 이러한 한계를 극복하고자 집합적 수준에서 주민참여제도에 접근하였고, 주민참여제도라는 제도적 요인이 정부성과에 가지는 직접적 효과에 주목하였다. 구체적으로 본 연구의 함의를 이론적 측면에서 살펴보면 다음과 같다. 첫째, 본 연구는 선행연구가 가진 분석대상의 한계를 극복하기 위해 분석의 공간적, 시간적 범위를 확장하였다. 둘째, 주민참여제도를 다양한 각도에서 분석하였다. 먼저, 선행연구에서 제시한 주민참여제도의 다양한 유형화 방식을 종합적으로 정리하였으며, 어떤 속성을 가진 참여제도인지에 따라서 정부성과에 미치는 효과 또한 차별적으로 나타난다는 것을 확인할 수 있었다. 셋째, 정부성과를 민주적 차원에서 측정해보고자 하였다. 주민참여제도가 가지는 궁극적 목적이 바로 지방자치의 실현과 민주주의의 제고에 있으므로 정부성과의 민주적 차원에 초점을 두어 행정의 투명성, 대응성, 효과성을 분석하였다. 넷째, 본 연구는 기존연구에서 활용한 횡단면 분석에서 통제 불가능했던 개별 지방정부 고유의 효과 및 시간 효과와 같은 개별특이성을 모두 통제 가능한 고정효과 패널 분석을 시행함으로써 분석의 정확성을 꾀하고자 노력하였다. 다음으로 정책적 측면에서 본 연구의 함의는 다음과 같다. 첫째, 본 연구는 정부성과의 주요 영향요인으로서 주민참여제도의 양적, 질적 수준을 고려하였다. 주민참여제도의 양적, 질적 수준의 증가는 지방정부의 민주적 성과에 유의미한 영향력을 미치는 것을 확인할 수 있었다. 특히 주민참여제도를 설계할 때 제도가 본래의 효과를 가지기 위해서는 정부와 주민이 상호작용할 수 있고, 주민에게 권한을 위임할 수 있는 수단이 포함된 교호적 성격을 가진 제도여야 한다는 것을 알 수 있었다. 둘째, 기초 지방정부 수준에서 개별 주민참여제도가 가지는 속성이 민주적 정부성과에 영향을 줄 수 있음을 확인한 바와 같이 지방정부가 현재 시행 중인 주민참여제도 전반의 양적 및 질적 수준을 진단하여 향후 주민참여제도의 선택과 집중에 도움이 될 수 있는 근거를 제시하였다. 셋째, 지방정부 성과에 관한 연구가 가지는 행정학적 함의는 상당한데도 실증연구는 부족한 실정이다. 이것은 지방정부의 성과가 객관적으로 측정하기 어려울 뿐 아니라 활용할 수 있는 변수를 획득함에서도 한계가 있기 때문으로 보인다. 그래서 본 연구는 정부성과를 민주적 성과로 한정하였고, 이를 측정할 수 있는 다양한 변수를 활용하여 지방정부의 민주적 성과를 총체적으로 분석하였다. 한편, 본 연구의 한계는 다음과 같다. 먼저, 주민참여제도의 양적 및 질적 수준을 집합적 수준에서 측정하였기 때문에 질적 수준의 측정에 있어 각각의 주민참여제도가 가지는 개별적 속성을 심층적으로 반영하지 못했다. 다음으로 본 연구는 기초단위의 지방정부에서 활용 가능한 데이터의 한계로 인해 '주민의 삶의 질'과 같은 민주적 정부성과를 측정하는 주관적 지표 활용을 서울특별시 자치구를 대상으로밖에 반영하지 못했다. 이러한 부분에서는 본 연구의 Objectives: The purpose of this study is to figure out the current state of patient safety research in Korea and to evaluate whether the research fund support project for patient safety research is proceeding in priority order. Methods: Through the literature search, a list of research projects in the field of patient safety in Korea were collected as of January 6, 2017. Four researchers independently evaluated the subject using the priority list of patient safety research derived from the previous study. Results: As of January 2017, a total of 21 research projects were conducted in the Korea Health Industry Development Institute and 42 research studies were conducted in the National Science & Technology Information. The results of the priority evaluation showed that there were no researches that ranked first and second priority. Many of the research topics were �쁀dverse drug events/drug errors,�� �쁇ealth information technology/information systems,�� and �쁋ess relevance.�� Conclusion: Patient safety research projects are not only diverse but also quantitative in Korea. Support for research topics that need to be prioritized is needed, such as developing safety indicators and measuring patient safelty levels, improving communication, and improving patient safety incident reporting systems. ; open

학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 엄석진. ; 이 연구는 '입법에 의한 행정통제의 제도화' 과정을 입체적으로 살펴보기 위하여, 김영삼 정권 시기에 제정된 행정절차법과 정보공개법의 제정과정을 옹호연합모형(ACF)을 적용하여 비교 분석한 것이다. 이를 통하여 대통령과 행정부, 의회 등 입법과정의 주요 행위자에 초점을 두어 한국 행정절차법 제정과정을 연구한 Ginsburg(2001)의 고착 모형(Lock-in Model)과 Baum(2007)의 통제 모형(Rein-in Model)이 간과한 시민단체·학계·정당 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고자 하였다. 분석 결과, 첫째, 양 법률의 제정 과정에서 적극적 개혁연합과 보수적 개혁연합이 존재하였으며, 촉발기제 및 여론의 관심, 옹호연합의 대립과 입법 주도권 정도에 따라 입법의 지연과 법률 내용의 변화를 가져왔다. 특히 양 법률의 제정과정을 비교함으로써 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 새롭게 발견할 수 있었다. 둘째, 입법 과정에서 국회의 영향력은 미약하였으며, 대통령이 강한 리더십으로 입법을 추진하더라도 법률의 규율 대상인 관료제가 입법 과정에 참여함으로써 법률 내용에 한계가 나타났다. 이는 그동안 김영삼 정부 시기의 행정법제 개혁에 대한 상반된 평가, 즉 한편으로는 행정절차법과 정보공개법의 제정으로 법치주의를 향한 진전이 있었다고 평가되면서도, 그 내용적 측면에서는 소극적이고 수세적이며 지속적인 개선이 필요하다는 지적에 대해 제정과정 측면에서 해답을 제시하고 있다. 즉, 양 법률 공히 제정과정에서 국회가 주도적 역할을 하지 못한 가운데, 대통령의 리더십과 시민사회의 요구를 바탕으로 입법이 추진되었지만, 양 법률의 규율 대상인 관료제가 입법과정에 깊숙이 참여함으로써 내용적 측면에서 한계가 나타날 수밖에 없었음을 보여준다. 결과적으로 이 연구는 양 법률의 제정 과정을 비교함으로써 시민단체·학계 등의 활동과 관료제의 반발 등 다양한 행위자 간의 상호작용을 규명하고, 이와 같은 상호작용의 특성이 입법의 지연과 법률 내용의 변화를 가져온 주요한 원인이었음을 발견하였다. 향후 대통령과 관료제 간의 심층적인 상호작용 및 정책중개자의 실체와 역할 등을 밝히는 연구가 추가적으로 이루어진다면, 김영삼 정부 시기 행정법제 개혁의 성과와 한계를 체계적으로 밝히는데 기여할 수 있을 것이다. ; This study aims to do the comparative analysis of the enactment process of the Administrative Procedure Act(APA) and the Freedom of Information Act(FOIA) enacted in the Kim Young Sam regime by applying the Advocacy Coalition Framework(ACF) with a view to looking into the various aspects of the process of 'Institutionalization in control of administrative process by the legislative'. This study has the purpose of identifying the interactions of a large variety of agents such as civil organizations, academic profession, political parties and bureaucracy which was overlooked in the previous studies - Lock-in Model by Ginsburg(2001) and Rein-in Model by Baum(2007) - which analyzed the enactment process of Administrative Procedures Act in Korea, focusing on the official agents in the legislative process such as President, the executive branch, and Congress, etc. The results and the findings of this study can be summarized as follows. First, there were two major agents in the enactment process of the APA and FOIA, the active coalition and the conservative coalition, which resulted in the delay of the legislation and the modification of the laws depending on triggering mechanisms, the public's attention, legislative advocacy coalition, and the degree of the initiative. In particular, by comparing the enactment processes of both Acts, it was concluded that the characteristic of the interactions as above was the major cause that led to the delay of the legislation and the modification of the laws. Second, even after democratization in Korea, the influence of the National Assembly in the legislative process was weak. Even though presidential's legislative power was strong, limitations on the institutionalization of legal control has still remained because executive branch as target discipline has been involved in the legislative process. Thus, the findings of this study may partially provide answers to the question on differences between APA and FOIA legislation process. The dynamics of power was present between bureaucrats and civil organizations in the legislative process, and the contents of the bill and the time delay varied with the degree of a legislative initiative of officials who was the main opposition coalition in the enactment process. The further research in the future on in-depth interaction between the president and the bureaucracy, and on the role of the policy broker will be able to contribute to systematically elucidate in the achievements and limits of the reforms of administrative laws in the Kim Young Sam regime. ; Master

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 금현섭. ; 여성의 경제활동 참여와 맞벌이 가구가 증가하면서 육아기 자녀를 둔 부모는 근로권과 부모권의 양립이라는 과제를 안고 있다. 정부는 두 권리의 양립사이에서 발생하는 문제를 해결하고 궁극적으로 여성의 경력단절, 저출산 등의 사회적 문제를 극복하고자 다양한 일ㆍ가정양립제도를 시행하고 있다. 공직사회에서도 여성공무원과 맞벌이 공무원이 증가하면서 일하며 자녀를 양육할 수 있는 환경 조성의 필요성이 커지고 있다. 이에 정부는 그동안 시행해 온 출산휴가, 육아휴직, 유연근무제 등의 일ㆍ가정양립제도 외에 근로시간을 단축할 수 있는 육아시간제를 새로 시행하게 되었다. 육아시간제는 만 5세 이하 자녀를 둔 공무원이 최대 24개월 동안 급여의 삭감 없이 하루 최대 2시간 이내에서 단축근무를 할 수 있는 제도로, 시행된 지 채 1년이 되지 않았기에 제도 정착까지는 일정한 시간과 노력이 필요하다. 따라서 본 연구에서는 육아시간제 사용에 영향을 미치는 요인을 분석하고, 이를 바탕으로 육아시간제의 원활한 사용을 위한 정책적 대안을 제시하였다. 육아시간제 사용에 미치는 영향요인을 분석하기 위해 중앙부처 공무원을 대상으로 설문조사를 실시하였고, 수집된 자료는 STATA를 통해 분석하였다. 또한 설문을 보완하고 개인의 사례 및 제도 사용경험과 현장의 상황을 풍부히 이해하고자 인터뷰도 실시하였다. 분석결과, 업무적 요인인 업무의 상호의존성과 즉흥성은 육아시간제 사용경험에 유의한 영향을 미치지 않는 것으로 나타났다. 조직적 요인의 경우 과업지향적 문화와 비우호적 분위기의 세부지표 중 조직 내 제도 사용자가 드묾만 육아시간제 사용에 유의한 영향을 미치고, 비우호적 분위기의 세부지표 중 상사ㆍ동료의 눈치, 인사상 불이익, 동료에의 미안함은 유의하지 않았다. 제도적 요인의 경우 제도의 규정과 절차의 정비 지표 중 초과근무의 불인정만 유의한 영향을 미쳤고, 재량규정과 산정방식의 불합리함은 유의하지 않았다. 한편 질적연구에서는 각각의 요인들 모두 육아시간제 사용을 결정하는데 영향을 미치는 것으로 나타났다. 종합해보면 제도 대상자들이 육아시간제 사용에 있어 업무적, 조직적, 제도적 요인의 영향을 모두 인식하고 있으나, 제도의 사용을 결정함에 있어서는 조직적ㆍ제도적 측면의 장애를 제일 심각하게 받아들이고 있음을 알 수 있었다. 본 연구결과를 바탕으로 육아시간제 사용을 활성화하기 위한 몇 가지 방안을 제시하였다. 첫째, 육아시간제에 대한 안내와 조직 내 가정친화적 분위기를 조성해야 하고, 둘째, 육아시간제 사용자 확대를 위해 강제적 제도 사용을 위한 인사평가 등의 제도를 개선해야 하며, 셋째, 단축된 근무시간에 맞는 업무량이 주어져야 하고, 마지막으로 현실과 어긋나는 제도 규정을 개선해야 한다. 이를 통해 육아시간제가 잘 정착하여 많은 육아기 공무원의 부모권과 근로권이 조화롭게 보장받기를 바란다. ; With the participation of women in economic activities and the rise of double-income households, child-rearing parents are facing the task of the compatibility of working rights and parental rights. The government has implemented a variety of work-family compatibility systems to solve problems arising between the two rights and ultimately to overcome social problems such as female career discontinuation and low birth rates. In officialdom, the need to create an environment, where female and dual-income civil servants can work and foster children, has grown. In response, the government has introduced a new childcare time system that can shorten working hours in addition to work-family compatibility systems of maternity leave, paternity leave and flexible work system that has been implemented so far. The childcare time system is a system that has been in place for less than a year, and it requires a certain amount of time and effort to settle the system. Therefore, this paper aims to analyze the factors affecting the use of childcare time system and based on this analyze the paper also aims to propose an alternative policy for the smooth use of childcare time system. In order to analyze the factors that have influence on the usage behavior of the childcare system, the central government employees are surveyed and the collected data are analyzed through STATA. Interviews are also conducted to supply the survey and to provide a good understanding of the interviewee`s case and experience. The analysis shows that task`s interdependence and spontaneity, which are work-related factors, do not significantly affect the experience of using childcare time. In the case of organizational factors, among indicators of task-oriented culture and unfriendly atmosphere, unusual institutional users in the organization has significant influence on the use of childcare time system, and among the indicators of unfriendly mood, the look of supervisors and coworkers, personnel disadvantage, and their sorriness to coworkers are not significant. In the case of institutional factors, only the disapproval of overtime has a significant effect on the maintenance indicators of the system's regulation and procedures, and discretionary regulation and the absurdity of calculation methods was is not significant. Qualitative studies have shown that each factor has an effect on determining the behavior of childcare time system use. Overall, people are aware of the effects of work-related factors or organizational and institutional factors in the use of childcare time system, but they take organizational and institutional obstacles the most seriously in determining the use of the system. Based on the results of this study, several measures have been proposed to promote the use of childcare time system. Firstly, guidance on the childcare time system and the family-friendly atmosphere within the organization should be fostered. Secondly, the system should be improved to expand the use of the childcare system by connecting and evaluating the usage, Thirdly, the workload should be given according to the shortened working hours and finally, the system regulations that go against reality should be improved. 학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 우지숙. ; 본 논문은 브라질의 인터넷권리보호법(Marco Civil da Internet)이 어떠한 전개과정을 거쳐서 지금에 이르게 되었는지 고찰한다. 각국이 인터넷의 자유와 규제의 딜레마 속에서 접점을 찾기 위해 노력하고 있는 가운데, 라틴아메리카의 브라질에서는 1990년대 이래 인터넷 규제에 관한 정책의제가 국가 내부에 존속하다가 오랜 논의 끝에 2014년 3월 25일 인터넷 이용자 표현의 자유, 개인정보보호, 망중립성(Net Neutrality) 보장 등을 골자로 하는 세계 최초의 인터넷 권리장전의 제정으로 이어진다. 연구는 '브라질의 Marco Civil은 어떠한 계기로 다른 정책들을 우선하여 정책결정자가 주목하는 주요 의제로 채택되어 제정으로 이어졌는가?'를 질문하고, 이러한 정책변동 사례를 Sabatier의 ACF 모형과 Kingdon의 MSF 모형의 결합모형에 적용하여 체계적으로 답을 모색하였다. 연구의 결과는 다음과 같다. 먼저, Marco Civil 정책은 각각 '평등주의'와 '시장주의'라는 상충하는 신념체계를 가진 찬반 옹호연합으로 분화되어 정책결정과정에서 첨예한 대립을 펼쳤으며, 정책학습의 기회에도 자신들의 신념체계를 견고화하였다. 둘째, 이들 옹호연합은 브라질 사회의 다양한 외적 변수에 직간접적인 영향을 받아 신념체계를 형성하였다. 셋째, Marco Civil은 수차례 입법 지연을 겪다가 Snowden 사건이라는 강력한 외부적 촉발기제에 의하여 정책의 창이 열리고 정책변동으로 이어질 수 있었다. 넷째, Marco Civil 정책결정과정에서 정책중개자와 정책선도자의 역할이 두드러진 것으로 나타났다. 특히 정책선도자인 Lula 대통령과 Dilma 대통령의 적극적인 역할은 Marco Civil 제정에 있어 결정적인 영향 요인이라고 판단할 수 있다. 연구의 함의는 다음과 같다. 먼저 이론적 함의로는 첫째, 연구는 ACF 모형과 MSF 모형의 적용 사례로서 비교적 새로운 분야인 인터넷 규제정책을 연구대상으로 삼았다. 인터넷 정책은 찬반 옹호연합의 첨예한 갈등이 나타나는 정책이라는 점에서 결합모형에 따른 설명력이 높게 나타났다. 둘째, 모형이 개발된 다원주의적인 서구사회가 아닌 권위주의와 엘리트주의가 뿌리 깊게 작용하고 있는 브라질의 사례를 분석함으로써 ACF 모형과 MSF 모형의 유용성을 입증하였다. 셋째, 일반적으로 대통령의 적극적 관심을 가질 경우 빠른 정책 대안의 마련으로 합리적인 대응 방안을 찾아낸다는 합리적 모형으로는 쉽게 설명되지 않는 사례로서, 룰라 대통령의 적극적인 지원에도 불구하고 임기 내 법안 제정에 실패한 원인을 추적할 수 있다. 넷째, 정책의 흐름이 열려 정책산출에 이르는 데 정치의 흐름은 정책의 창을 여는 데 결정적인 역할을 하지는 않았다. 호세프 정부 시기 정치의 흐름은 법안 제정에 부정적인 영향으로 작용하여 Marco Civil 폐지의 위기에까지 갔으나 외부적 초점사건에 의해 제정에 이르게 된다. 정책적 함의는, 먼저 정책선도자의 리더십과 정책 방향의 중요성을 함의한다. 국민의 인권 보장을 위한 룰라 대통령의 일관된 사회정책과 리더십은 우리나라에도 시사하는 바가 많다. 둘째, Marco Civil 법은 국가가 인터넷을 어느 범위까지, 어떠한 방식으로 규율해야 하는가와 관련된 가치충돌적이고 논쟁적인 쟁점을 되짚어보고 추후 유사한 인터넷 권리법 제정 논의에 적용할 수 있는 교훈적인 사례이다. 셋째, 본 정책은 참여민주주의를 실천한 사례로서 정부에 대한 국민적 신뢰를 반영한다. 마지막으로 한국과 브라질은 공통적으로 2006년도 인터넷상 사이버범죄 규제안을 제정하였으나, 한국의 경우 해당 법이 임기만료로 폐기된 이래 의미 있는 논의가 이루어지지는 않은 반면, 브라질은 사이버범죄법 발의라는 '초점사건'이 휘발되지 않고 정책선도자의 적극적인 의지 아래 인터넷권리법의 제정으로 이어진다. 브라질의 인터넷 정책결정과정에 대해 검토하고 구체적인 법안의 추진 동기, 과정, 정책의 결정요인 등을 모색함으로써 우리나라의 인터넷 규제정책이 어떠한 위치에 놓여 있는지 비교해볼 수 있을 것으로 생각한다. ; One of the most significant policy goals in the internet arena in the last decade has been striving to seek a reasonable balance between freedom and regulation of the Internet. Brazil, as Latin America's economic giant, has also spent a long time finding the balance point between creating economic profits and protecting human rights under the pressure of mediating the conflicting values of regulating and protecting users' behaviors from circumstances of the internet. And it is one of the key policy initiatives associated with this shift to pass the world's first Internet Bills of Right which is called Marco Civil da Internet on March 25, 2014 after years of discussion, which calls for freedom of expression for the Internet users, protection of personal information and guarantee of network neutrality. This case study explores the policymaking process of the Marco Civil da Internet in Brazil. It examines specifically how Brazilian internet policy came into being applying the combination frameworks of Sabatier's Advocacy Coalition Framework and Kingdon's Multiple Streams Framework, in order to learn more about the linkages between research and policy. The study began with a relatively simple question, 'On what occasion was Brazilian Marco Civil da Internet adopted as a major agenda for policymakers, prioritizing other public policies and being eventually enacted after long debate' and systemically sought an answer applying the example of this internet policy change through these policymaking process frameworks. The results of the study are as follows: First, the stakeholders in the policymaking of this legislation were divided into the a pro-MCI coalition and an anti-MCI coalition with a conflicting belief system between 'Equalityism' and 'Marketism' and strengthened their own belief system even in the opportunities of policy learning. Second, these advocacy coalitions formed these belief systems, directly or indirectly being influenced by various external variables in Brazilian society. The Snowden event in 2013 worked as a powerful external trigger mechanism of this policymaking process, as a strong variable that opened the window of policy and lead to policy changes after going through several legislative delays. Third, it was indicated that the role of a policy broker and a policy entrepreneur in MCI policymaking process was shown to be outstanding. In particular, the active role of policy entrepreneurs, the two Brazilian Presidents, Lula da Silva and Dilma Rousseff, could be judged as a decisive factor in enacting this legislation. Next, the implications of the study are twofolds. Firstly, the theoretical implications are as follows. First, the study targeted the Internet regulatory policy which is a relatively new field as an example of the application of the ACF and the MSF. The Internet policy might be highly adequate research topic, given that it is a policy that showed a strong conflict between a pro-MCI and an anti-MCI advocacy coalitions. Second, the study proved the usefulness of the ACF and the MSF by analyzing Brazilian case where authoritarianism and elitism have been deeply rooted rather than a pluralistic western society in which these theoretical frameworks were developed. Third, the study could track the causes for failure to enact this legislation within his term, despite President Lula's active support, which is not reasonably explained with a rational model supposing if the president has a active interest, he could find a reasonable and quick policy alternative. Fourth, Political Stream in this policymaking process did not play a crucial role in opening the window of policy. The political stream during the Rousseff administration had influenced a negative effect on enacting the legislation and reached the crisis of the abolition of the MCI, but an external focus event led it to be enacted in the conclusion. Political and practical implications are as follows: first of all, this study implies the importance of leadership and policy direction of policy entrepreneurs. President Lula's consistent social policy and leadership to ensure the human rights of Brazilian people provide a lot of implications for Korean administration. Second, the MCI is an instructive example that could be applied later in the discussion of enacting an Internet Bills of Right in other countries, which reflects on the value-conflicting and contentious issues concerning how the country should regulate the Internet. Third, as an example of practicing participatory democracy, the MCI policymaking process reflects public trust about the government. Finally, although each Korea and Brazil enacted regulations of cybercrime on the Internet in 2006, no meaningful discussion had been made in Korea since the law was scrapped at the end of its term, while Brazil's 'focus event' of trying to introduce the cybercrime law eventually led to the enactment of the Internet Bills of Right under the active will of policy entrepreneurs. 학위논문 (박사) -- 서울대학교 대학원 : 사범대학 사회교육과(역사전공), 2020. 8. 유용태. ; 본 연구는 청이 불평등조약과 서양 국제법 서적을 통해 주외공관 제도를 수용하는 과정을 분석한 다음, 이것이 주한공관 설립과 한청 근대외교로 이어지는 모습을 고찰하였다. 이 과정에서 전통외교와 근대외교 각각에서 유래한 합리성과 제국성이 작용하는 양상에 유의하였다. 요컨대, 외교학의 용어와 개념은 물론 주외공관의 운영 원리에 착목하여 청의 주한공관을 체계적으로 밝힌 개척적인 연구라 할 수 있다. 청은 아편전쟁으로 체결한 불평등조약에 따라 주외공관 제도를 수용하였다. 이후 열강이 속속 설립한 주청공관은 자국인을 보호하고 외교 협상을 효과적으로 전개하는 한편, 영사재판권·포함외교 등을 통해 자국의 이익을 확보하였다. 한편 이 시기 청에 번역 소개된 󰡔만국공법󰡕 등의 서양 국제법 서적 또한 주외공관의 역할, 권리, 의무 등을 총체적으로 설명하는 한편, 非서구에 대한 영사재판권과 포함외교를 정당화하였다. 이를 통해 청에서는 합리성과 제국성으로 대표되는 주외공관 인식이 형성되었다. 본고가 불평등조약과 서양 국제법 서적에서 公使·領事 등의 번역어가 정착되는 과정을 분석한 결과는 청의 주외공관 인식이 심화되는 과정을 잘 보여준다. 이러한 상황에서 대외 위기가 고조되자, 청 정부 내에서는 상주사절 파견론이 대두하였다. 그 결과, 청은 영국을 시작으로 해외 각국에 공사관을 개설하고, 싱가포르 등 청국인이 많이 거주하는 지역에는 영사관을 설립하기 시작하였다. 청의 주외공관은 현지에서 교섭 사무, 자국민 보호, 정보 수집 등 다양한 업무를 수행하였다. 이는 청이 불평등조약에 따라 설립된 열강의 주청공관을 관찰하고, 서양 국제법 서적을 번역 이해한 결과였다. 이러한 흐름 속에서 1883년 청은 첫 번째 주한공관으로서 주조선상무서를 설립하였다. 그런데 주조선상무서는 분명 근대외교의 산물이었으나 청과 조선은 아직 전통외교를 적용하고 있었다. 따라서 주조선상무서는 전통외교와 근대외교가 착종된 과도적 형태의 주한공관이라 할 수 있다. 이것은 청이 진수당의 직함을 총판상무위원이라 하면서도 사실상 총영사의 지위를 부여한 데서도 잘 나타난다. 진수당은 주로 청 상인의 경제적 이익을 확보하는 방향으로 제국성을 표출하였고, 이를 합리성으로 분식하기 위해 전통외교와 근대외교를 선택적으로 활용하였다. 이 시기 한성·인천·부산·원산에 설립된 주조선상무서는 판리조선상무장정을 토대로 운영되면서 진수당의 활동을 뒷받침하였다. 1885년 청은 진수당을 경질하고 그 후임으로 원세개를 임명하였다. 이때 원세개에게는 총리교섭통상사의라는 직함과 총영사 겸 4등공사라는 지위가 부여되었다. 본고는 원세개가 지닌 4등공사의 지위에 주목하여, 이것을 원세개가 상국의 대표로서 조선의 외교를 주지한 법적 근거였음을 밝혔다. 그러나 원세개는 외교뿐 아니라 내정에까지 개입하였고, 이 과정에서 전통외교와 근대외교를 선택적으로 구사하여 제국성을 더욱 강렬히 표출하였는데, 이는 원세개의 독단적인 판단이 아니라 어디까지나 청 정부의 암묵적 동의에 따른 것이었다. 이 시기 원세개가 임기를 마친 후에도 두 차례나 더 유임되었고, 주조선상무서의 규모가 대폭 확장되고 용산상무서가 신설된 것은 원세개의 활동을 뒷받침하는 토대로 작용하였다. 그러던 중 청일전쟁이 일어나며 주조선상무서는 폐쇄되었다. 그러나 청은 1896년 총상동·총영사 당소의를 파견하여 주조선영사서를 개설하였다. 이때 당소의가 비공식 사절을 자처하였던 만큼, 주조선영사서 또한 비공식 기구에 머물렀다. 청이 자국민을 보호하면서도 조선의 수교 요구는 거부하기 위해 일종의 편법을 사용했던 것이다. 청은 마지못해 수교를 결정한 다음에도 4등공사 또는 흠차대신을 파견하려고 하는 등, 여전히 대한제국에 전통외교를 적용하려는 태도를 보였다. 1899년 한청수교가 이루어진 후, 청은 두 번째 주한공관인 주한공사관·영사관을 개설하였다. 이는 결국 청이 대한제국에 근대외교를 전면 적용하게 되었음을 의미하는 것이다. 주한공사 서수붕, 허태신, 증광전은 서양 국제법과 한청통상조약에 근거하여 교섭 사무를 처리해 나갔고, 이 무렵 신설된 外務部가 주외공관 제도의 개편에 나서면서 주한공사관·영사관의 합리성은 한층 보강되었다. 이 시기 청이 제국성을 표출하기 어려워진 상황과 달리 대한제국에서는 열강을 모방한 제국성이 생겨나기 시작하였다. 제1·2차 한일협약 이후에는 청의 주한공사관이 철수하고 주한영사관이 그 공백을 채웠다. 이 시기 한국총영사 마정량은 주한공사에 버금가는 권한을 지녔고, 주한영사관의 규모는 더욱 확장되었다. 본고는 이 시기 청 정부가 주외공관 제도를 개편하면서, 주한영사관의 관제가 개편되고 관원에 대한 대우가 개선된 것에 주목하였다. 이는 대한제국이 국권을 상실해 가는 상황에서도 청의 주한공관이 지닌 합리성이 증진되었음을 의미한다. 그러나 한국총영사 마정량은 각종 현안을 교섭하는 과정에서 합리성을 내세웠지만, 대한제국을 매개로 일본이 표출하는 제국성에 대응하는 과제를 안게 되었다. 그리고 한일병합으로 대한제국이 주권을 상실한 후에도 주한영사관은 주조선영사관으로 명칭을 바꾸어 존속하였으나, 한청관계가 일청관계로 대체되었기에 그 위상은 점차 낮아졌다. 본 연구에서 청말 주한공관을 한청관계의 맥락 위에 놓고 전통외교와 근대외교의 착종 과정에 주목한 것은 선행 연구의 보완과 연구 지평의 확대라는 측면에서 다음과 같은 의미를 지니고 있다. 첫째, 중국외교사의 측면에서, 청의 주한공관은 중앙 정부와 개인 차원의 외교 행위를 상호 관련성 속에서 이해할 수 있도록 하는 발판이 된다. 특히 청의 근대외교는 합리성을 갖추고 있었던 것은 물론 속국에 대해서는 명백히 제국성을 띠었던 만큼, 청의 근대외교가 지닌 후진성이나 反침략성을 강조해 온 선행 연구의 관점은 재고될 필요가 있다. 둘째, 한중관계사의 측면에서, 청의 조선 정책은 전통외교와 근대외교 양쪽 모두에서 유래한 합리성과 제국성이 길항하는 과정에서 그 양상을 달리하였음을 규명하였다. 따라서 청의 조선 정책을 전통적인 속방 체제의 강화 또는 근대적 제국주의 어느 한쪽으로 이해하는 것보다는 양측 모두가 착종한 양상에 주목하는 것이 적절하다. ; This study examined the way in which Qing dynasty had introduced the diplomatic office system through unequal treaties and the Western international law books, and figured out relevance between Qing's diplomatic offices in Korea and Sino-Korean modern diplomacy. In particular, this article paid attention to the manifestation that rationality and empireness of the diplomatic offices appeared and the aspect that the traditional diplomacy and modern diplomacy competed. In premodern times, traditional diplomacy based on tributes and installation was widely practiced in East Asia. But traditional diplomacy shook and modern diplomacy spread after the Opium War. In particular, the diplomatic offices of Western powers were symbol of modern diplomacy. Qing's understanding of the diplomatic office deepened through unequal treaties and Western international law books. The unequal treaty that Qing dynasty signed with the Western powers included clauses related to the diplomatic offices. The Western international law books introduced by Qing also included contents related to the diplomatic offices. In short course, the idea of dispatching resident envoys emerged in the Qing government. In this situation, Qing started to set up legations and consulates abroad. The diplomatic offices of Qing dynasty carried out various tasks, including negotiation affairs, protection of citizens, and gathering information. These diplomatic offices were based on the reference of the Western powers' diplomatic offices and Western international law books, therefore they contained both rationality and empireness of modern diplomacy. Paradoxically, rationality and empireness were fully expressed in the East Asian country. Qing's diplomatic offices in Korea can be explained in terms of rationality and empireness, and the change of Qing's diplomatic offices in Korea can be divided into the following two periods. The first phase is the founding period of the Qing's diplomatic offices in Korea. In this period, Qing aimed at making the Chosun her vassal state through the Commercial Affair Office. The General Commissioner of Trade Chen Shu-Tang established several Commercial Affair Office. In fact, the Commissioner of Trade was equal to the consul, and the Commercial Affair Office was equal to the consulate. But Qing avoid the term 'consul', 'consulate' to emphasize the vassal status of Chosun. Yuan Shi-Kai as a successor to Chen Shu-Tang corresponded to diplomatic minister. In this period, Qing and Chosun experimented the modern diplomacy through the diplomatic offices, but the traditional diplomacy was still valid. Qing made a use of modern diplomacy and traditional diplomacy arbitrarily. The second phase is the completing period of the Qing's diplomatic offices in Korea. In 1896, Qing established the consulate in Korea to protect the Chinese and avoid Chosun's call for diplomatic ties. After deciding to establish diplomatic ties, Qing planned to dispatch the fourth minister, and soon changed it to the minister plenipotentiary. This phenomenon symbolically shows the shift from traditional diplomacy to modern diplomacy. In 1899, Qing established a legation and consulates after concluding Sino-Korean treaty of commerce. The ministers of Korea treated the negotiation with Korea on the basis of the Western International law and Sino-Korean treaty of commerce. At that time, Qing established the Department of Foreign Affairs to reform diplomatic institutions. As a result the rationality of modern diplomacy increased, but the empireness of modern diplomacy was difficult to appear. In 1906, Qing decided to withdraw legation of Korea by request of Japan, and the consulate then dealt with task of the legation. Accordingly, consul general of Korea Ma Ting-Liang came close to minister of Korea, and the consulate grew in size. At that time, Qing government reformed the diplomatic office institutions, so consulates of Korea were reformed and diplomat treatment improved. After Japan-Korea Treaty of 1910, Sino-Korean relations ended, but the consulate of Korea still maintained changing its name to consulate of Chosun. In short, the consulate of Korea had developed in a way that enhances the rationality of modern diplomacy, but had to defend against Japanese empireness. This study has the following meanings in terms of supplementation of prior research and expansion of research horizon. First, this article revealed that Qing's empireness before Sino-Japanese War had come from both traditional diplomacy and modern diplomacy. Therefore preceding researches which have judged Qing's Chosun policy traditional or modern need to be reconsidered. Second, this article discovered the rationality from modern diplomacy in proceeding of Sino-Korean relations. Several preceding researches didn't stress on the development of Sino-Korean relations.
