Since information technology tools are widely implemented in our workplace, transport and social networking, the use of data has become a major stake for the XXIst century. At the crossroads of legal, sociologic and economic issues, the balance between the needs of this new form of technological innovation and the respect of the right to privacy seems to be weak. Consequently, it creates an important gap between citizen's trust for data processing and legislators' views on the efficiency of data protection. Given that the consent has become the cornerstone of the new General Data Protection Regulation, this divergence shows how the laws of privacy were wrongly implemented within technological innovation. Based on a legal and technological perspective, this thesis will study the reasons of this failure and propose new legal concepts to fill this gap and give privacy its real sense within the digital world. ; Alors que nos environnements de travail, de déplacement et nos modes de socialisation sont de plus en plus façonnés par les outils numériques, l'exploitation des données est devenue un enjeu majeur du XXIème siècle. Situé au carrefour des problématiques juridiques, sociologiques et économiques, l'équilibre entre les besoins de cette nouvelle forme d'innovation technologique et le droit au respect de la vie privée est devenu précaire. This study examines the effect of company good governance good on the level of innovation of innovating companies. Under the prism of the literature on innovation and business theories (resource and skills theory, transaction cost theory, agency theory and stakeholder theory), we made the hypotheses to empirically test. The data used consists of 1404 observations of 156 European listed companies who carried out expenditures of R & D at least once during the 2007-2015 period. The data is from the ASSET4-ESG database. After analysing the data using a random effects panel data regression technique (GLS), we find a negative and significant relationship between the aggregate index of company governance and the level of innovation. However, a deeper analysis by breaking up the aggregate index of governance into sub-indices reveals that the sub-indices related to the engagement of the management, the respect of the rights of shareholders, and the transparency of financial information have an important effect on the propensity to invest in innovating projects in the long run. Also, the same sub-indices related to the characteristics of the Board of directors and the independence of the audit committee do not affect the propensity of a company to invest in innovating activities. These results reflect the consequences of the legal framework of the European Union and those of the countries of origin of companies of the sample after the Sarbanes-Oxley law in the United States. ; L'objet de cette étude est d'examiner l'effet des bonnes pratiques de gouvernance d'entreprise sur l'intensité d'innovation technologique dans les entreprises. Sous le prisme de la littérature sur l'innovation et des théories de l'entreprise (théorie des ressources et des compétences, théorie des coûts de transaction, théorie de l'agence et la théorie des parties prenantes), nous avons émis les hypothèses à tester empiriquement. L'échantillon est constitué de 1404 observations sur 156 entreprises européennes cotées sur la période 2007-2015 et ayant effectué des dépenses de R&D au moins une fois pendant la période de l'étude. Les données utilisées proviennent de la base de données d'ASSET4-ESG de Thomson Reuters. Après analyse de données par la technique de la régression en panel avec effets aléatoires (GLS), il ressort une relation négative et significative entre l'indice global de la gouvernance d'entreprise et l'intensité d'innovation technologique. Toutefois, une analyse approfondie en décomposant l'indice global de la gouvernance en sous-indices fait constater que les sous-indices liés à l'engagement de la direction, au respect des droits des actionnaires et à la transparence de l'information financière jouent à long terme un rôle important sur la propension à investir dans des projets innovants. En même temps, les sous-indices liés aux caractéristiques du Conseil d'administration et à l'indépendance du comité d'audit n'affectent pas la propension d'une entreprise à investir dans les activités innovantes. Ces résultats reflètent les conséquences des dispositions légales de l'Union européenne et celles des différents pays d'origine des entreprises de l'échantillon suite à la loi Sarbanes-Oxley aux États-Unis. This is shown by the analysis of the debates around the "net neutrality", whose issues intertwine both technical, economic and political dimensions. A deconstruction of the genesis and evolution of the field of struggle that is the neutrality of the Internet, shows how this formula fits into the history of utopias linked to the remote communications and information technology, and how it is appears as a matter both legitimate and central. The implementations of it's generic definition is an issue of struggle between the stakeholders, developing a "techno-political controversy" between access providers, service / content providers, organizations representing civil society and the regulatory authorities of the Internet, including the States. By observing in detail the power relations around this issue, we can observe the contemporary construction of states and markets process. ; L'internet peut-être analysé à la fois comme une infrastructure technique et sociale. This thesis on the analysis of information practices among the young population in France aims to show how their habits in research and information consumption (Journalistic) have evolved, have been transformed and modified with digital means. This is also a comparative study of the uses of means of access to information, establishing a contrast between so-called traditional media (television, radio and the printed press) and Internet. In this sense, much of our thinking is to try to know and understand how young people take ownership of the web as a communicative tool in a global comparison with other media. Does Digital information has caused a change in the information practices in everyday life? Our research has identified some changes in youth information practices: most of the information consumption is through Internet; they tend to neglect reading the newspapers in favour of online media because the information is there massively Free; Research and consumption of alternative news sites remain an extremely minority practice; The information practices of young people tend to mix entertainment and humorous topical information.
