Negli ultimi anni il dibattito circa i metodi della filosofia politica è stato caratterizzato dal moltiplicarsi di opzioni diverse in merito al rapporto tra teoria normativa e metaetica. In particolare ha avuto successo l'idea che le teorie normative siano autonome rispetto alle questioni filosofiche di secondo ordine. In questo articolo è presentato e discusso il dibattito sul quietismo, sia nella sua versione ridotta per cui la metaetica è di per sé normativa, sia in quella ampia, per cui considerazioni metaetiche sono inutili e controproducenti alla teoria normativa. Sullo sfondo di questo dibattito è presentata e discussa la posizione metodologica di Rawls. L'obiettivo è quello di capire se la proposta rawlsiana dell'indipendenza della teoria morale e del method of avoidance sia soddisfacente. Infine, un nuovo punto di vista sui benefici della metaetica per la teoria normativa viene presentato e difeso. ; In recent years the philosophical debate about the methods of political philosophy has been characterized by an increasing number of different options concerning the relation between normative theory and metaethics. In particular, the idea that normative theories are autonomous from second-order issues has gained great attention. In this article, the debate about quietism is presented and analysed, both in its restricted version, according to which metaetichs simply is part of normative theory, and in its broad one, according to which metaethical considerations are counterproductive for normative theories. Drawing from this debate, Rawls's methodological position is presented. The aim is to understand whether the rawlsian project about the independence of moral theory and the method of avoidance is satisfactory. In conclusion, a new point of view on the benefits metaethics can offer to normative theory is defended.

Il presente elaborato concerne le problematiche giuridiche connesse alla regolamentazione del settore dell'autotrasporto di cose per conto di terzi in Italia, con particolare attenzione alla disciplina dei profili tariffari ed alle dinamiche consolidatesi nella prassi in relazione alle pratiche di dumping sociale, outsourcing e delocalizzazione. Nella prima parte, dopo una premessa finalizzata a descrivere le caratteristiche strutturali dei fornitori di servizi di autotrasporto in ambito nazionale e comunitario nonchè le principali peculiarità del mercato di riferimento, viene descritta ed analizzata l'evoluzione normativa e giurisprudenziale verificatasi con riguardo ai profili tariffari dell'autotrasporto, esaminando in particolare le caratteristiche ed i profili di criticità propri delle discipline in materia di "tariffe a forcella" di cui alla L. n. 298/1974 e di "costi minimi di sicurezza" di cui all'art. 83-bis del D.L. n. 112/2008, fino a giungere all'analisi degli scenari conseguenti alla recente riforma del settore apportata dalla Legge di Stabilità 2015 (L. 23/12/2014, n. 190). Nella seconda parte, vengono esaminate alcune tematiche problematiche che interessano il settore, sia a livello nazionale che comunitario, e che risultano strettamente connesse ai sopra menzionati profili tariffari. In particolare, si fa riferimento alle fattispecie del cabotaggio stradale, del distacco transazionale di lavoratori e dell'abuso della libertà di stabilimento in ambito comunitario concretantesi nella fattispecie della esterovestizione. Tali problematiche sono state analizzate dapprima attraverso la ricostruzione del quadro normativo nazionale e comunitario di riferimento; in secondo luogo, attraverso l'esame dei profili critici emersi alla luce delle dinamiche di mercato invalse nel settore e, infine, in relazione all'analisi dello scenario futuro desumibile dalle iniziative legislative ed amministrative in atto, nonché dagli indirizzi interpretativi affermatisi in ambito giurisprudenziale. ; The research is focused on the analysis of the regulation of road haulage in Italy, with particular regard to issues related to tariffs and to the practices of social dumping, outsourcing and business relocation. In the first part, further to the description of the main characteristics of Italian and EU suppliers of road haulage services, it is described and analyzed the evolution of regulation and jurisprudence regarding road haulage tariffs aspects, with particular regard to the provisions set forth in Law no. 298 of 1974, Law Decree no. 112 of 2008 and Law no. 190 of 2014. The second part is focused on the analysis of some problematical issues regarding road haulage both at national and EU level, and in particular road cabotage, posting of workers and abuse of freedom of establishment within EU in the road haulage sector

Monetary instruments to regulate parking are often used in central areas of cities to discourage long term parking of vehicles. The availability of parking facilities, and its cost, in fact represents an important element in the decision to operate private vehicles in urban areas. The availability of instruments and tools to check the outcome of modification in parking regulations, in terms of modification of car use, successfully support planners in the determination of the best policies to decrease congestion, and regulate the use of transportation in cities. Integrated land use transportation models may successfully contribute to the assessment of such policy packages. This contribution discusses the use of the model MARS-Bari (Metropolitan Activity Relocation Simulator) for the analysis of future scenarios of development of land use and transportation. MARS-Bari is a fast integrated land use transportation model, which is designed for applications in strategic planning of urban and metropolitan areas. The model was developed as a decision support tool, to help planners in the definition of sets of policies on land use and transportation, and promote equilibrated growth of the urban system (smart growth). MARS-Bari shares the basic assumptions of the Metropolitan Activity Relocation Simulator (MARS) modeling system, so far successfully applied to many cities of both Europe and Asia. The structure of MARS-Bari is highly flexible on purpose, allowing multiple hypothesis tests of future scenarios and policies. MARS-Bari works at a high level of spatial aggregation, and its simulations are developed on a long-term time horizon (30-years in the current version). Two main sub-models run in MARS-Bari: they respectively simulate the development of land use, and the transportation system. Four different classes of users are distinguished in the transportation model, depending on the possible access to one or more of the five transportation modes: car, motorcycle, bus, train, and slow mode (walk and bike). Car and motorcycle ownership and availability functions contribute to the definition of travel patterns and activity participation of users, in dependence of the chosen residential location and of the location of the economic activities. The model was implemented and tested on the metropolitan area of Bari, Italy. MARS-Bari allows the evaluation of different scenarios of future development of the area, predicting the expected outcomes of policies and interventions on land use development, transportation infrastructures, modifications in the local economy, financial regulations and fares (e.g. fuel price, road pricing, congestion charge, parking fares, etc.). The estimation of indicators for environmental quality and pollutant emissions from transportation permits the direct comparison of the outcomes of different scenarios, thus supporting the definition of sets of "second-best" choices for policies in both land use and transportation planning. ; Le politiche per la regolamentazione della sosta sono uno degli strumenti a disposizione del planner per la governance della mobilità urbana. La corretta ubicazione e dimensionamento delle aree di sosta concorre infatti a determinare un utilizzo efficiente del sistema della mobilità (o può ostacolarlo, se tali infrastrutture non sono opportunamente inserite nel sistema dei trasporti). In questo framework, la pianificazione delle aree di sosta assume nuove priorità associate all'integrazione del sistema dei trasporti, ed al governo del territorio finalizzato al contenimento dell'impatto ambientale. Nel quadro delle politiche per una mobilità sostenibile, un ruolo strategico è associato quindi alla pianificazione e gestione delle aree di parcheggio, la cui realizzazione deve rispondere ad un'oculata allocazione delle risorse disponibili, ed alla limitata disponibilità di suoli nelle aree urbanizzate. In questo contributo, lo sviluppo di politiche per la gestione della sosta è discusso in relazione alla realizzazione di alcuni recenti interventi nella città di Bari. L'attenzione è spostata dagli effetti di breve/medio termine, di interesse per la pianificazione tattica e l'ingegneria del traffico, agli effetti di lungo corso nella pianificazione strategica. La disponibilità di strumenti per la modellazione integrata dei trasporti e del territorio espande le possibilità di analisi degli impatti di tali politiche, in termini di effetti nella formazione di comportamenti di mobilità e dell'utilizzo dei veicoli privati, e dell'evoluzione futura del sistema urbano.

This handbook is the result of three years of teaching European Union Transport Law to the law students of the University of Roma Tre.The course falls within the "Studying Law at Roma Tre" programme, which includes 14 classes entirely taught in English.Following these lines the handbook is divided into three modules, reflecting areas where the intervention of EU law has been most significant: air transport, rail transport, and passengers' rights. To each module we have annexed the most relevant judgments and decisions by the EU Courts and Commission which we found particularly useful to illustrate, from a practical point of view, the policies underlying EU transport law and the conflicting interests of the various stakeholders.Obviously there are other aspects which are touched by EU law, especially in the field of movement of goods, port infrastructures, and road safety, but we have preferred to focus, at least in this first edition, on the three aforementioned aspects.We hope that this primer – which is made available by Roma TrE-press to the whole European academic community on a freely accessible basis – will contribute to the development of the subject as a course offered to students who are and increasingly will be the main beneficiaries of the growing transport networks in the EU.

Since the "Good School" became a legislative decree containing the Government'sproposal for a reform of the education system, the world of educationalresearch has reacted intensely to it. This paper examines theprocesses of change with reference to the life cycle of scholastic institutionsand their chance for an evolutionary revamping. The underlying beliefis that there is no Good School without good schools, and that real schoolsshould not remain entrapped by a rigid paradigm. Firstly, I will examine thedynamics that have characterized the change schools have gone through inthe past decades; then I will pay attention to the processes of "derelictionof change" or "change-driven attrition"; finally, I will examine how it will bepossible to reverse such processes. ; Da quando la Buona Scuola è diventata un Decreto legislativo contenente ilpiano offerto dal Governo come proposta di riforma della scuola, il mondodella ricerca educativa ha espresso un confronto serrato. Il contributoesamina i processi di cambiamento con riferimento al ciclo di vita delle istituzioniscolastiche e alle possibilità di rilancio evolutivo, nella convinzioneche non ci sia Buona Scuola senza buone scuole, ma che una scuola realenon possa restare prigioniera di un paradigma. This handbook is the result of four years of teaching European Union Transport Law to the law students of the University of Roma Tre.The handbook is divided into four modules, reflecting areas where the intervention of EU law has been most significant: air transport, rail transport, port services and passengers' rights.With the evolution of transport regulation in the EU in these last years and thanks to the success of the first edition (over 2000 downloads in 18 months), we have considered it useful to expand the topics presented in this primer. In particular we have added in this second edition a specific module on the painstaking process of opening port services to competition. Furthermore a paragraph has been added on the Single European Sky (SES) programme. The second part of the handbook includes the most relevant judgments and decisions by the EU Courts and Commission which we found particularly useful to illustrate, from a practical point of view, the policies underlying EU transport law and the conflicting interests of the various stakeholders.

Il presente lavoro, senza alcuna pretesa di esaustività, ha inteso ricostruire il quadro normativo relativo alla disciplina dell'autotrasporto merci su strada. In primis, ci si è soffermata sugli aspetti generali del settore, approfondendo, in seguito, la normativa europea e nazionale. Tale excursus, ha permesso di riscontrare i molteplici interventi legislativi susseguitisi in ambito di regolamentazione dell'autotrasporto merci su strada, evidenziando i passaggi più significativi in tema di riordino della disciplina. Si è pertanto proceduto all'analisi del primo importante intervento legislativo del settore, intercorso ad opera della Legge n. 298/1974, disciplinante gli aspetti di natura pubblicistica del settore. Tale provvedimento, ha un apposito Albo Nazionale per gli autotrasportatori di merci per conto terzi, identificando i requisiti necessari per l'accesso al mercato e l'esercizio della professione di autotrasportatore di cose in conto terzi. Importati novità vengono introdotte con il D.lgs. 286/2005, provvedimento che ha portato al raggiungimento del processo di liberalizzazione del mercato. Successivamente si è proceduto a riscontrare l'intensa produzione normativa, posta a regolamentazione del settore, che nella ricerca di un equilibrio tra esigenze di mercato e corretto esercizio dell'attività di autotrasporto, si propone di addivenire al raggiungimento degli obiettivi comunitari di armonizzazione della disciplina e qualificazione del settore dell'autotrasporto. Significativi, in tal senso, i recenti interventi di riforma posti in essere con il "Pacchetto comunitario del 21 ottobre 2009" ( Regolamento (CE) 1071/2009 e Regolamento (CE) 1072/2009. Da ultimo, al fine di verificare le eventuali debolezze del sistema normativo vigente, in relazione al raggiungimento degli obiettivi comunitari suesposti, si è ritenuto di indirizzare la ricerca verso un'attenta valutazione dell'efficienza dei modelli di trasporto merci su strada, verificandone l'impatto in termini di maggior incidenza sui costi esterni derivanti dal trasporto. A tal proposito, particolare attenzione è stata rivolta anche alla disciplina del trasporto in conto proprio. ; This paper aims to reconstruct the normative framework concerning road freight transport and it verifies the evolution of the normative aspects in this specific sector. In particular the research analyses the suitability of the internal regulations system to promote a sustainable transport system as stated by the European objectives. First of all the study deals with the general aspects of the legislative provisions and subsequently it examines in depth the current regulations. The paper identifies the measures to regulate road freight transport and specifically the public aspects of the legislation. The most important regulatory intervention came about by means of the Italian Law n. 298/1974, finalised to establish a National Register and subsequent actions for road freight transport and to identify the requirements needed to carry out haulage activities. Another important measure is the Italian Legislative Decree (D.lgs) n. 286/2005 and the following actions oriented to the full liberalization of the transport market. Finally the research examines the Regulation (EC) No 1071/2009 and the Regulation (EC) No 1072/2009 of the European Parliament (Council of 21 October 2009) on common rules for access to the international road haulage market and their effects on the Italian internal regulation system. Under these new dispositions the prescriptive structure of road freight transport has been modified. The main guideline of the new regulations concerns the qualification of the transport system by new requirement needed to exercise the road haulage and common laws to access to the market of road freight transport. To assess the potential weaknesses of the Italian regulatory system, related to the achievement of the European objectives above mentioned, the research evaluated the efficiency of road freight transport models with particular reference to the incidence of the external costs originated from transport. Specific attention was also given to on own account transport regulation.
