The article compares the American copyright system (from its inception, borrowing the basics of the English system to the establishment of the principle of "fair use") and the Ukrainian system, which provides a specific list of cases allowed as a restriction of copyright (enumerated system) by establishing in national legal acts of the three-stage test provided by the Berne Convention. The article examines not only the legislation of Ukraine and the United States in this area, such as: the Federal Copyright Act of 1790, the second Federal Copyright Act of 1909, the Copyright Act of 1976, the Civil Code of Ukraine, the Law of Ukraine "On Copyright law and related rights" but also the case law of the United States, which is a key element in regulating disputes in the area under discussion. The author analyzes a number of cases through the prism of changing approaches in the US system of property rights restrictions, namely Philpot v. Media Research Center Inc. No. 1: 17-cv-822 dated January 8, 2018; Peteski Productions, Inc. v. Leah Rothman No. 5: 17-CV-00122 dated August 30, 2017; Rosen v. eBay, Inc., No. 2: 13-cv-06801-MWF-E of 16 January 2015 and Corbello v. DeVito No. 2: 08-cv-00867-RCJ-PAL June 14, 2017. As a result of the research, the author determines that the national legislation establishes an exhaustive list of works that are its objects, at the same time, the ways of using the work depend on the type of particular work. Therefore, an exhaustive list of all possible ways to use the works is not provided. U.S. law provides for an exhaustive list of copyrighted works and an exhaustive list of ways to use such works. And the doctrine of "fair use" in the United States provides that in determining whether the use of work in any particular case is fair, there are at least 4 factors to consider. Our report is to help combat the effects of combat trauma a of those, who have recently stood up for Ukraine. Work must be done to create a safe and comfortable, wellness space that encourages one's creativity. This space gives a new strength and in the former, warrior can feels the taste of life and then return to society with healthy psychological condition.The aim of the study is to study the innovations in the rehabilitation of ATO/OOS participants based on the work of a psychotherapist in a military hospital.Materials and methods. The statistical reports of the rehabilitation department of the Kremenchug Regional Hospital for War Veterans of the Poltava Regional Council were analyzed, as well as reports on the work of a psychologist and psychotherapist.Results. Most of the interviewed servicemen 73.8% – in 2016, 75.6% – in 2017, 62% – in 2018 did not have any symptoms of anxiety and depression, but there is a tendency for a gradual decrease in specific gravity every year from 73, 8% in 2016 to 62% in 2018. On the other hand, signs of subclinical anxiety and depression in this contingent have been increasing every year, namely, in 2016, among participants of ATO/OOS, there were signs of subclinical anxiety (almost 9.2% of respondents), in second place signs of subclinical depression (7.0% in accordance). On the other hand, in 2017, 31 persons (8.5%) were the most alarmed servicemen, with 25 people in second place (6.7%) with subclinical anxiety. And in 2018 among respondents, the highest percentage with subclinical anxiety was 102 people (16.2%) and subclinical depression – 76 people (12.1%).Conclusions. Therefore, the presence of ATO/OOS military personnel with a steady upward trend in the number of patients with signs of subclinical anxiety and depression requires the earliest possible start of psychological rehabilitation, as long as there is a high rehabilitation potential and a positive outlook for rehabilitation.

У статті розкривається зміст децентралізації органів місцевого самоврядування, необхідність передачі місцевим громадам функцій, які не можуть вирішуватися центральними органами влади.Розглянуто одну з наймасштабніших реформ – реформу децентралізації, яка триває в Україні з 2014 року. В результаті її реалізації було створено понад 800 об'єднаних територіальних громад (ОТГ), які охопили третину території України. Новостворені громади отримали більше фінансових ресурсів, прямі відносини з Державним бюджетом, та, одночасно, ширші повноваження та обов'язки. Визначено, що актуальним завданням залишається питання формування ефективного місцевого самоврядування та територіальної організації влади для задоволення інтересів громадян на відповідній території в усіх сферах життєдіяльності, узгодження інтересів держави та ОТГ. Зазначається, що критеріями здійснення успішної децентралізації є збільшення надходжень у бюджети місцевих громад.Визначено, що в Україні сьогодні реалізована континентальна громадівська модель місцевого самоврядування, основні принципи якої закріплені в Конституції та законах України, а реформу бюджетної децентралізації проводять за прикладом польської моделі. Авторами проаналізовано на скільки підсилено податкову базу в об'єднаних територіальних громадах. According to the authors, local communities have a certain degree of responsibility for inventory of taxpayers, united territorial communities are primarily interested in who and how it uses its scarce resource, pays local taxes, because local government owns the situation of who pays taxpayers taxes, developing its infrastructure. Problems encountered in the process of local self-government reform were identified, namely: slowing down the process of unification at the level of districts, which are effectively losing their power, low financial capacity of a large number of united communities, since together with financial resources from the central budget to the local new powers, slowing down of processes in relation to the land market, misunderstanding of content and indifference of a part of locals to this process, distrust of citizens and disregard of cooperation with it are also transferred.

The notary is one of the fundamental institutions of control over the authorization of legal facts in the legal system. Performing the functions of authentication and authorization of these facts, the subjects of this activity - notaries - must meet certain professional and qualification requirements. That is why any state needs to create special bodies to control the quality of professional training of notaries and their compliance with both the requirements of current legislation and professional ethics. Innovation component is the basis of modern business development, regardless of which field this business belongs in, who owns it and which structure its capital has. The challenges of modern society force to step up efforts of the developing countries in the direction of development of innovation infrastructure, which would allow taking a quantum leap in the development of industry and economy. These challenges predetermined the relevance of the chosen research. Formation and development of innovation policy in the economies of the developing countries is the actual task of recent studies of many authors. Identification of general trends in the development of leading countries will make it possible to work out a common strategy for the developing countries, in their further development of innovation policy. The purpose of writing this article was to perform the analysis of formation of innovation policy in the leading countries of the world, such as the United States of America and Japan to identify the peculiarities of these countries, common features and differences. During the research we applied methods of comparison, generalization, abstraction, analysis, elements of system analysis, algorithms and simulation. As a result of the survey we revealed peculiarities of formation and development of innovation policy of the United States and Japan with the following conclusions made: 1. The development of innovation policy of a state grows when coordination and key financing is provided by the state and by local governments, too. 2. The largest effect in the development of innovation activity for the countries with transition economies can be observed by choosing "selective" directions of development. 3. Creation of regional technological parks takes place with regard to historically established regional opportunities and directions. 4. Approval of the legislative base in the country, which must fully support (at all levels) innovation entrepreneurship. 5. Formation of a system of private (venture capital) funds, regulated by state programs in priority areas. At the present stage of development of the world economy, only innovation policy creates a vector of the development of a state. This is confirmed by the experience of such leading countries as the United States of America and Japan. As the result of generalization of the experience of formation of the innovation policy of these countries, we identified the main trends of development that can be applied in other developing countries, taking into account their national characteristics. All of the identified factors positively affect the increase of progressive indicators of the economy, well–being of society and the activity of integration at the international level. The novelty of the work lies in the fact that for the first time we analyzed formation of innovation policy in the USA and Japan to identify common peculiarities and differences in the development of innovation policy, as well as we attempted to obtain the scheme of creation of the basic structure that allows developing and implementing innovation. The obtained results can be applied to further systematization of information on the development of innovation policy for the formulation of a universal model.

The aim of the work is to clarify the nature of foreign policy and the peculiarities of US diplomacy in Latin America. The object is US policy in Latin America in the nineteenth and early twentieth centuries. The subject of the study is the relationship between US governments and countries in the Latin American region, the formation of pan-Americanism. The first chapter covers the expansion of the United States into Latin America in the early nineteenth century. The second section describes the formation of the inter-American system of relations in the mid-nineteenth century. The third section analyzes the US position on Latin America in the early twentieth century.

The paper provides a comprehensive study of the problem of combating racial discrimination in the United States. The main factors influencing the intensification of protest movements have been identified. The main phases and their specifics of the political process of combating racial discrimination are highlighted. A model of the process of combating racial discrimination in the United States has been formed. Special attention is paid to the study of the structure and levels of racial discrimination in American society, which has helped to provide a better structuring and understanding of this issue. An analysis of the dynamics of the main indicators of the object, identified general trends in the development of anti-discrimination movements in the United States. The events and processes that acted as attractors in the process of intensification of protest waves are identified. ; У роботі досліджена проблема боротьби з проявами расової дискримінації в США. Визначено основні фактори, що впливають на активізацію протестних рухів. Виокремлено основні фази та їх специфіку політичного процесу боротьби з расовою дискримінацією. Сформовано модель процесу боротьби з расовою дискримінацією в США. Окрема увага приділена вивченню структури та рівнів расової дискримінації в американському суспільстві, що допомогло забезпечити змістовну структуризацію та розуміння даного питання. Здійснено аналіз динаміки основних показників об'єкта, виявлені загальні тенденцій розвитку антидискримінаційних рухів в США. Визначено події та процеси, що виступали аттракторами у процесі активізації протестних хвиль.

In September 2011, Ukraine began the process of joining the partnership by joining the International Initiative Open Government Partnership, which aims to increase the level of openness and transparency of public bodies, the introduction of high standards of professional integrity in public administration. The OpenGovernment initiative raises and raises the issue of improving the efficiency of democratic institutions in Ukraine. The purpose of the article is to review the experience of the United States and European countries. The article provides a comparative analysis of the foreign experience of reforming state power, on the basis of which it was concluded that the process of reforming the state power had a very important political motivation in connection with the crisis of confidence in democratic countries at the end of the twentieth century to the traditional political institutes of representative democracy, which ensured its legitimacy throughout the century - parties, elections, parliaments, the state as a whole. The format of the initiative "Open Government" is considered, within the framework of which the state assumes clear commitments on the specified priorities. The official goal of this initiative is to ensure an unprecedented level of government openness, to create a system of transparency, participation and cooperation of government agencies with citizens and interest groups of the public, private and non-profit sectors in the formation and implementation of policy decisions. It is concluded that the use of experience of foreign countries with effective systems of informational openness of the authorities can bring significant benefits in the process of improving the activities of state authorities of Ukraine. However, it should be borne in mind that each country has its own specifics and blind borrowing of "foreign" samples is unlikely to bring the expected results. Therefore, Ukraine needs its own model of the system of information openness of power, which will take into account national specifics, features of historical development, political, socio-economic, cultural, socio-psychological and other factors. ; У вересні 2011 року Україна почала процедуру вступу в партнерство та приєдналася до Міжнародної ініціативи «Партнерство «Відкритий Уряд»», яка спрямована на підвищення рівня відкритості та прозорості діяльності державних органів, упровадження високих стандартів професійної чесності в державному управлінні. Ініціатива «Відкритий Уряд» актуалізує і ставить на порядок денний питання про підвищення ефективності демократичних інститутів в Україні. Метою статті є розгляд досвіду Сполучених Штатів Америки і європейських країн. У статті проведено порівняльний аналіз закордонного досвіду реформування державної влади, на основі якого зроблено висновок про те, що процес реформування державної влади мав дуже важливу політичну мотивацію у зв'язку із кризою довіри в демократичних країнах наприкінці ХХ століття до традиційних політичних інститутів представницької демократії, які забезпечували її легітимність протягом усього століття, - партій, виборів, парламентів, держави загалом. Розглядається формат ініціативи «Відкритий Уряд», у рамках якої держава бере на себе чіткі зобов'язання за вказаними пріоритетами. Офіційна мета даної ініціативи - забезпечення безпрецедентного рівня відкритості уряду, створення системи прозорості, участі та співпраці урядових агентств із громадянами і групами інтересів публічного, приватного та некомерційного секторів у формуванні та реалізації політичних рішень. Зроблено висновок про те, що застосування досвіду закордонних країн, що мають ефективні системи інформаційної відкритості органів влади, може принести помітну користь у процесі вдосконалення діяльності органів державної влади України. Проте варто враховувати, що кожна країна має свою специфіку, сліпе запозичення «чужих» зразків навряд чи принесе очікувані результати. Тому Україні необхідна власна модель системи інформаційної відкритості влади, що враховуватиме національну специфіку, особливості історичного розвитку, політичні, соціально-економічні, культурні, соціально-психологічні й інші чинники.

The article focuses on the «Intellectual Dark Web», an informal group of scholars, publicists, and activists who openly opposed the identity politics, political correctness, and the dominance of leftist ideas in American intellectual life. The author examines the reasons for the emergence of this group, names the main representatives and finds that the existence of «dark intellectuals» is the evidence of important problems in US public discourse.The term «Intellectual Dark Web» was coined by businessman Eric Weinstein to describe those who openly opposed restrictions on freedom of speech by the state or certain groups on the grounds of avoiding discrimination and hate speech. Extensive discussion of the phenomenon of «dark intellectuals» began after the publication of Barry Weiss's article «Meet the renegades from the «Intellectual Dark Web» in The New York Times in 2018. The author writes of «dark intellectuals» as an informal group of «rebellious thinkers, academic apostates, and media personalities» who felt isolated from traditional channels of communication and therefore built their own alternative platforms to discuss awkward topics that were often taboo in the mainstream media. One of the most prominent members of this group, Canadian clinical psychologist Jordan Peterson, publicly opposed the C-16 Act in September 2016, which the Canadian government aimed to implement initiatives that would prevent discrimination against transgender people. Peterson called it a direct interference with the right to freedom of speech and the introduction of state censorship. Other members of the group had a similar experience that their views were not accepted in the scientific or media sphere.
