John Stuart Mill (1806 - 1873) war einer der bedeutendsten politischen Philosophen und der vielleicht bedeutendste angelsächsische Philosoph des 19. Jahrhunderts. Als Hauptvertreter des Utilitarismus widmete er sich in seinem Werk vor allem Fragen der politischen Freiheit, des Allgemeinwohls und den Grenzen des Staates. Er verfasste darüber hinaus eine Frühschrift des Feminismus sowie eine Erörterung der Grundfragen der politischen Ökonomie. Er war vertrat seine liberale Position auch politisch aktiv und war Parlamentsmitglied für die Whigs.
Článek se zabývá tím, zda je koncept lidských práv slučitelný s utilitaristickou etikou. Nejprve stručně charakterizuje utilitarismus a upozorňuje na některá zkreslení a dezinterpretace tohoto směru. Následně se věnuje i rozlišení různých způsobů, jak můžeme chápat lidská práva (zejména jejich pojetí coby legálních a morálních práv). V souvislosti s jejich utilitaristickým ospravedlněním si pak klade dvě stěžejní otázky: 1) Podle některých autorů je s tímto etickým směrem slučitelná pouze idea legálních práv. Dává v jeho kontextu vůbec smysl hovořit o lidských právech coby určitém specifickém druhu morálních práv? 2) Jak máme postupovat, když k maximalizaci užitku přispívá porušení nějakého lidského práva? Nenutí nás taková situace zvolit si mezi utilitarismem a lidskými právy? Tento text ukazuje, že pokud chápeme utilitarismus správným, a nikoliv zkresleným způsobem, poskytuje nám na obě otázky uspokojivé odpovědi. Lidská práva coby určitá morální práva lze v jeho kontextu chápat jako součást pozitivní morálky, která by nejvíce přispívala k maximalizaci užitku. Pokud do našich úvah zahrneme všechny relevantní faktory, nemusíme se nakonec ani obávat toho, že by nás utilitaristická etika ve skutečném světě nutila k přijetí problematických závěrů stran dodržování uvedených práv.
Zusammenfassung Die Pandemie hat Knappheit sichtbar gemacht und einige Länder zur Rationierung des Zugangs zu Intensivbehandlungen gezwungen. Die Vorhaltung von Betten und Personal auf Intensivstationen müssen vor dem Ausbruch einer Pandemie geplant werden. Die Allokationsregeln für den Aufbau und die Nutzung der Intensivmedizin sollten utilitaristischen Normen folgen. Wir illustrieren dies für die Planung und Nutzung von stationären Vorhalteleistungen. Zudem beschäftigen wir uns mit den Gründen, welche die regulierenden Eingriffe eines Staates rechtfertigen und kritisieren dessen inkonsistentes Handeln bei den massiven Einschränkungen während der Lockdowns im Vergleich zum zögerlichen Vorgehen beim Impfen. Abstract: Utilitarianism Before and During the Pandemic The pandemic reveals shortages and forces some countries to ration access to intensive care. The supply of ICU beds and personal needs to be determined before the pandemic hits. The rules for planning and use of capacities can be the same and follow utilitarian norms. We illustrate this for the hold-back capacities in acute hospital care. In addition, we deal with the reasons that justify the regulatory measures and criticize the inconsistent attitude of governments with regard to the massive containment measures in the lockdowns as compared to the absence of any compulsion within vaccination programs.
Abstract The following comment on Peter Singer's One World is divided into four parts. It starts with some objections agairrst Singer's utilitarian approach (1). Then it argues for an 'Ethics of Globalization' which at the same time has universal validity and maintains context sensitivity (2). In part three it is shown that these two conditions are better fulfilled by an ethics based on Human Rights than by an utilitarian ethics. In this context John Rawls' Law of Peoples is defended against Singer's criticism (3). In the final part the role of Non Governmental Organizations (NGOs), which are not mentioned by Singer, is analyzed. It is argued that in a world in which the states are overcharged, the United Nations weakened and the Transnational Companies' power is increasing, the NGOs get growing responsibility up to the point that many of them turn out to become Human Right's advocates and Human Right's guardians (4).
