The fact that various myths influence the shape of law and the mythologization of some of its aspects is indisputable. In most cases, this process of "mythologization" is perceived pejoratively, leading to the establishment of groundless, irrational ideas and at the same time the rejection of "science" in favor of "fiction". This article aims to propose a different approach to both the concept of myth and the mythologization of law, by referring to the classical, ancient understanding of the concept of mythos as a fable, story. Ancient Greek myth performed a function similar to the law, establishing some basic rules in society. Stressing its "narrative" side indicates that what matters is not so much a description of reality, but a process that emphasizes the relational nature of the community. Thus, relating the myth, just like reading the norm of law, is an interpretation of the event in the light of applicable principles and systems of values, while being also a continuous process of shaping social awareness. Interpreting the law as a story means that those who create and use it lose the luxury of simply remaining the "mouth that pronounces the words of the law" as Montesquieu stated, since they are supposed to care not only for its implementation, but also for the quality and conviction of citizens as to its validity. The proposed form of reading the law as a myth-fable, political myth therefore is a search for a plot, understood as a possibility to act, to respond to the needs and problems of the changing world as well as the development of "the political" politics and education of citizens. ; Fakt wpływu rozmaitych mitów na kształt prawa oraz mitologizacja pewnych jego założeń są niepodważalne. W większości wypadków ten proces "mitologizacji" postrzegany jest pejoratywnie – jako prowadzący do ugruntowania bezpodstawnych, irracjonalnych wyobrażeń i zarazem do odrzucenia "nauki" na rzecz "fikcji". Celem niniejszego artykułu jest zaproponowanie odmiennego podejścia zarówno do samego pojęcia mitu, jak i do mitologizacji prawa poprzez odwołanie się do klasycznego, antycznego rozumienia pojęcia mythos jako fabuły, opowieści. Starogrecki mit pełnił funkcję zbliżoną do prawa, ustanawiał bowiem pewne podstawowe reguły obowiązujące w społeczeństwie. Zaakcentowanie jego strony "fabularnej" wskazuje zaś, że istotny jest nie tyle opis rzeczywistości, ile proces podkreślający relacyjny charakter wspólnoty. Tym samym opowiadanie mitu, podobnie jak odczytywanie normy prawa, stanowi interpretację zdarzenia w świetle obowiązujących zasad i systemów wartości, jest również ciągłym procesem kształtowania społecznej świadomości. Ujęcie prawa jako opowieści powoduje, że ci, którzy je tworzą i stosują, tracą luksus prostego pozostania monteskiuszowskimi "ustami ustawy", ponieważ mają się troszczyć nie tylko o jego wykonywanie, lecz także o jakość oraz przekonanie obywateli co do jego słuszności. Proponowana forma odczytania prawa jako mitu-opowieści, mitu politycznego polega zatem na poszukiwaniu fabuły, czyli możliwości działania umożliwiającego reagowanie na potrzeby i problemy zmieniającego się świata oraz na rozwój polityczności i edukację obywateli.
Termin "miasta bliźniacze" został wypracowany w toku doświadczeń gmin na arenie międzynarodowej. Prekursorami ruchu bliźniaczego są gminy niemieckie i francuskie, które po II wojnie światowej podjęły się zadania zbliżenia zwaśnionych narodów. Ruch bliźniaczy początkowo opierał się przede wszystkim na wymianie młodzieży. Współcześnie współpraca miast skupia się na współpracy gospodarczej, ekologicznej, na partnerskiej edukacji oraz konsolidacji działań na rzecz rozwoju. Współpraca międzynarodowa gmin, choć stanowi istotny czynnik rozwoju lokalnej polityki, nie jest w sposób wyczerpujący uregulowana prawnie. Obowiązujące ustawodawstwo krajowe i prawodawstwo unijne nie operują pojęciem "miasta partnerskie". Ustawy zasadnicze, akty wykonawcze, deklaracje oraz traktaty uściślają istotę i prawo samorządu lokalnego, nie precyzując zasad tworzenia lokalnej polityki zagranicznej. Aspekt ten pozostawiają w dużej mierze samym gminom, co podkreśla zasadę samorządności. Unijne dyrektywy także nie określają sztywnych ram międzynarodowej współpracy gmin, podkreślając jedynie ich rolę w kształtowaniu polityki. Znaczenie gmin w rozwiązywaniu współczesnych problemów cywilizacji wyraźnie uwypuklają deklaracje końcowe z kongresów miast partnerskich. Brak ram prawnych nie ogranicza gmin w rozwijaniu lokalnej polityki zagranicznej, otwierając przed nimi możliwości współpracy z dowolnymi gminami w dowolnym obszarze. ; The term 'town twinning' and 'twin cities' was coined when municipalities (gminy) became active in the international arena. The precursors of the twinning movement were German and French communes which after World War II embarked on the task of bringing the two nations together. The twinning movement in its original form was primarily based on the exchange of the youths of both countries. Today, contacts between cities focus on economic and environmental cooperation, collaboration in the sphere of education and consolidation of activities fostering further development of partnership. International cooperation of municipalities, while an important factor in the development of local politics, is not satisfactorily regulated. Neither the national nor the EU legislation contains the term 'twin cities' in its legal vocabulary. Constitutions, executive acts, declarations and treaties set out the essence of local government and law, but fail to specify the rules of a local foreign policy. This aspect is largely left to the decision of municipalities, which clearly emphasises the principle of self-government. EU directives do not define any rigid framework of international cooperation of communes either, merely emphasising their role in the shaping of that policy. Consequently, the role of municipalities in the solving of contemporary civilisation problems has been highlighted in final declarations adopted at twin cities congresses held in recent years. The absence of a legal framework at a higher level does not only mean that local municipalities are not restricted from developing their local foreign policies, but it also opens up for them numerous possibilities of cooperation in any area of their choice.
W artykule przyglądam się temu, jaką edukację polityczną warto rozwijać we współczesnej polskiej szkole i wszędzie tam, gdzie buduje się w ludziach zdolność do wspólnej i niewyalienowanej pracy. Kierunek rozważań wyznaczyła konieczność ustosunkowania się myśli pedagogicznej – i równoległego dostosowania praktyk wychowawczych – do zmian w sposobie koordynacji społeczeństwa, które dokonują się w atmosferze groźby wybuchu wojny. Rozważania te buduję na dotychczasowych badaniach własnych z obszaru uczenia się w ruchach społecznych, analizując trzy porządki zapewniające koordynację społeczeństw (neoliberalizm, nacjonalizm, militaryzm) w kontekście wykluczanych przez nie wartości: dobra wspólnego, samorządu i pokoju. Rezultatem pracy jest matryca przyporządkowująca te kontrwartości różnym typom współpracy (koordynacji, kooperacji i kolaboracji). Matryca pozwala identyfikować specyfikę konkretnych przykładów mobilizacji społecznej, jak i rozpoznawać luki w kształceniu kolektywnych umiejętności współdziałania. Rezultaty analizy pozwalają zoperacjonalizować praktyki oporu pod kątem celów wychowania i stawiają w nowym świetle problemy powiązań i nawarstwiania się wrogich szkole ideologii neoliberalizmu, nacjonalizmu i militaryzmu. ; The paper analyses types of political education worth developing in contemporary Polish schools and in other places dedicated to building human capacity to work together in a non-alienated way. The analysis is based on my own research from the area of learning in social movements. I analyze three orders ensuring social coordination (neoliberalism, nationalism, and militarism) in the context of the values they exclude: the common good, self-government and peace. The result of the work is a matrix assigning these counter-values, accordingly, to coordination, cooperation and collaboration. The matrix allows for identification of the specificity of some examples of social mobilization, as well as identification of gaps in teaching collective interaction skills. The results of the analysis can be used to operationalize the practices of resistance in terms of educational goals. Zmiana instytucjonalna jest nieodłącznym procesem wpisującym się w rozwój społeczeństwa i gospodarki. Najistotniejszym procesem w ramach transformacji instytucji wydaje się dopasowywanie (się) instytucji formalnych i nieformalnych. Jest to niezbędne, aby system instytucjonalny działał sprawnie, aby generował odpowiednie bodźce na rzecz aktywności gospodarczej (niski koszt transakcyjny, przewidywalność, zaufanie). Efektem takich dostosowań jest ład instytucjonalny, który jest warunkiem trwałości rozwoju gospodarczego. Cechą instytucji jest długookresowe trwanie, choć jednocześnie odbywa się ich nieprzerwana ewolucja. Powstaje pytanie, w jaki sposób kształtuje się ład instytucjonalny, jaką rolę odgrywają w nim instytucje nieformalne. Za cel artykułu przyjęto określenie roli instytucji nieformalnych w kreowaniu ładu instytucjonalnego. Można wysunąć przypuszczenie, że instytucje nieformalne wraz z upływem czasu stają się trwałą podstawą ładu instytucjonalnego. W artykule wskazano również przejawy niesprawności systemu instytucji w Polsce, w tym instytucji nieformalnych. ; Institutional change is an integral process in the development of the society and economy. The seemingly most significant process in the transformation of institutions is the adjustment (also, mutual adjustment) of formal and informal institutions. This is critical to the proper functioning of the institutional system, so that it generates sufficient stimuli for economic activity (low transaction costs, predictability, trust). The result of such adjustments is institutional order which is a prerequisite of sustainable economic growth. One of the features of imitations is their longevity, even though they are constantly evolving. The question arises about how institutional order is formed and what the role of informal institution in this process is. The aim of the article is to determine the role of informal institutions in the formation of institutional order. It is possible that, given time, informal institutions become a solid foundation of institutional order. In the 21st century, subversion understood as a foreign disruptive activity, has become an element of security policy and power politics in an environment where the direct use of force may be too risky. Though this term is well-known in humanities in Poland, it hasn't yet been translated and literally applied by Polish political scholars. However, states' repertoire includes measures that are a continuation or even a substitute of "war", and their very objectives are consistent with the logic of subversive strategies known in arts. As opposed to direct violence, such operations aim at maintaining conditions between political weakness and failure by targeting fragile areas. In this vein, subversion appears to become the first strategic choice of many states, including world powers. The author introduces the term to the taxonomy of security studies as he starts from a semantic theoretical reasoning (subversion as a covert and indirect strategy) and later answers how subversive strategies are implemented in Eastern Europe. In a specific geopolitical context, i.e. in the intersection of transatlantic/European security complex and post-Soviet area, subversion is part and parcel of the Kremlin policy towards Georgia and Ukraine, and recently the Republic of Belarus towards Poland. Therefore, subversive, "short of war" measures are intended to force competitors to make political concessions, which defines the Russian (in)security policy in its "near (and a bit further) abroad". ; W XXI wieku "subwersja" (subversion), tłumaczona jako zagraniczna działalność wywrotowa, staje się ważnym elementem polityki bezpieczeństwa i budowania stref wpływów w środowisku, w którym otwarte użycie siły może okazać się zbyt kosztowne. Choć pojęcie to jest dobrze znane na gruncie nauk artystycznych, w polskiej literaturze politologicznej nie pojawiało się dotąd w sposób dosłowny. Tymczasem w repertuarze państw pojawiają się środki, które są przedłużeniem, a nawet substytutem, "wojny", a których cel wiąże się z logiką strategii subwersywnych stosowanych w sztuce. W przeciwieństwie do otwartej przemocy takie operacje polegają na utrzymywaniu stanów pomiędzy słabością a upadkiem w drodze wykorzystywania newralgicznych punktów. Subwersja staje się dziś pierwszym wyborem strategicznym wielu państw, w tym mocarstw. Autor wprowadza pojęcie subwersji do terminologii nauki o bezpieczeństwie, wychodząc od rozważań natury teoretycznej (subwersja jako strategia pośrednia i niejawna), aby nieco później przyjrzeć się sposobom operacjonalizacji tych działań w regionie Europy Wschodniej. W konkretnych warunkach geopolitycznych, tj. na styku transatlantyckiego/europejskiego systemu bezpieczeństwa oraz obszaru poradzieckiego, subwersja przejawia się w polityce Kremla wobec Gruzji czy Ukrainy, a ostatnio także Republiki Białoruś względem Polski. Subwersywne działania "poniżej progu wojny" mają prowadzić przeciwnika do politycznych ustępstw, definiując politykę (nie)bezpieczeństwa Federacji Rosyjskiej w jej "bliskiej (i nieco dalszej) zagranicy". ; В XXI веке «субверсия» (subversion), переводимая как иностранная подрывная деятельность, становится важным элементом политики безопасности и построения сфер влияния в среде, где открытое применение силы может оказаться слишком дорогостоящим. Хотя эта концепция хорошо известна в области искусства, до сих пор она не появлялась буквально в польской политологической литературе. Между тем в репертуар государств входят меры, являющиеся продолжением или даже заменой «войны», цель которой связана с логикой подрывных стратегий, используемых в искусстве. В отличие от открытого насилия, такие операции заключаются в удержании состояний между слабостью и неудачей, используя горячие точки. Сегодня подрывная деятельность становится первым стратегическим выбором многих стран, в том числе великих держав. Автор вводит понятие субверсии в терминологию науки о безопасности, начиная с теоретических соображений (подрывная деятельность как косвенная и неявная стратегия), чтобы немного позже взглянуть на методы реализации этой деятельности в регионе Восточной Европы. В определенных геополитических условиях, то есть на стыке трансатлантической / европейской системы безопасности и постсоветского пространства, подрывная деятельность проявляется в политике Кремля в отношении Грузии или Украины, а в последнее время также в Республике Беларусь в отношении Польши. Подрывные действия «ниже порога войны» призваны привести противника к политическим уступкам, определяя политику (не) безопасности Российской Федерации в ее «ближнем (и несколько дальнем) зарубежье».
The book contains a thorough analysis of the European Union institutional system as a specific, sui generis international organisation, in the context of its legitimization (its validity and legitimacy). The book is mainly theoretical. Primarily, the author aims at presenting a reliable depiction of the EU institutional system legitimization through the prism of the theoretical output concerning legitimization of the political power, including and accentuating the indicated specificity of the EU as a distinct international organisation. Secondly, he took into consideration the changes introduced into the legal foundations of the EU functioning, pursuant to the Lisbon Treaty – the latest treaty reforming the structures of the Union. In the context of the main theme of the present study, these changes are important not only in terms of the EU institutions themselves, i.e. their competences and reciprocal relations, but also with regard to the fundamental change of the legal character of the EU, and the alterations introduced into the individual Union politics. Thirdly, the author attempts to present the problem of the EU institutional system legitimization in the special circumstances, i.e. in the situation of the most profound economic crisis that the EU members have faced since the beginning of the integration process. The EU is regarded as a specific structure, being neither a state nor a typical international organisation. Such an approach was the starting point for the main premise of the present book – the idea that the thesis about the deficiency of democracy in the EU, formulated in the literature on the subject and in the public debate, is a certain simplification, and the characteristic features of the EU and its institutions, which provoked the formulation of such a thesis, should be considered in a broader context, such as the problem of the EU institutional system legitimization and, alternatively, the deficiency of that legitimization. For the direct democratic legitimization is only one of many sources of legitimacy of the EU institutional system and of the Union as a specific international organisation in general – an extremely important source, perhaps the most important, yet not the only one. Thus, the legitimization of the EU and its institutions should be analysed in a broader perspective, which also includes other sources of legitimization – as it is done in case of every political power which, striving for its legitimization to be as strong as possible, attempts to derive it from the largest number of sources. According to the author of the book, to base the EU institutional system legitimization only on the grounds of the direct democratic legitimization characteristic of a democratic state, would be tantamount to a certain disruption of the right order. It would rather be a symptom of too advanced an integration on the "institutional" level in comparison to the extent of the "material" integration. Until the EU is a structure sui generis, in which case it is a combination of features characteristic of an intergovernmental, international organisation, a supranational organisation or a state, the nature of legitimization of this structure should also be specific. The most important role should be played by the democratic legitimization, which should be completed with other sources, owing to which the functioning of the EU institutional system, and the whole EU, could be recognised as legally valid. Apart from the main thesis also other theses and hypotheses are posed in the book. The first chapter is a certain theoretical introduction and a basis to the deliberations presented in the further parts of this study. In the first subsection, with reference to the literature on the subject, the problem of legitimization (legitimacy) of the political power, i.e. the concept, classifications and sources of legitimization (legitimacy) of the political power, have been synthetically depicted. In another part of chapter one, the author attempts to relate the problem of legitimization to the EU as a specific international organisation and to formulate his own definition of legitimization deficiency with regard to EU institutional system. Bearing in mind that the problem of legitimization deficiency in the EU (EC) has not been discussed on a larger scale until certain stage of development of integration process was reached, in 1.3. subsection, the author raises some questions concerning: the sufficiency of legitimization of the integration process during the first few decades after the Second World War, the grounds for that legitimization and the reasons why, at a certain stage of the EU (EC) development the legitimization of the Union's institutional system started to be considered insufficient, which was manifested in the opinions acknowledging the democracy and legitimization deficiency. The first chapter ends with a passage devoted to the importance of the EU institutional system legitimization, whereas the significance of legitimization to the political power and political institutions in general, consitutes its reference point. The second chapter (subsections 2.3.–2.8.) presents a synthesis of the evolution of the EU (EC) institutional system in the context of its legitimization, from the moment of the EC founding treaties ratification, till the time the changes pursuant to the Lisbon Treaty were introduced. The author focused here mainly on the competences of the particular EC (EU) institutions and their reciprocal relations, which should make it possible to observe two main tendencies in the dynamics of changes taking place in this field, and present its specificity and distinctiveness in comparison to the systems of democratic states. At the beginning of this chapter, a thesis has been formulated (simultaneously, becoming an extension of the attempt to determine why, at a certain stage of the integration process, the issue of democracy/legitimization deficiency started to be discussed – a question that was raised in the first chapter), which states that the legitimization of the EU institutional system will be sufficient, if the law regulations and political practice of their functioning are convergent with the level of advancement of the integration process in various spheres of social life; in other words, the "institutional" integration should correspond with the "material" integration (that is the Union politics). To that end, the author made an attempt to present, in a synthetized form, the development of the "material" integration (subsection 2.1.), which he completed with an analogical endeavour to illustrate the evolution of the EU (EC) institutional system in the context of its legitimization (subsection 2.9). For in accordance with the increasingly common approach, the EU institutions are treated as a system, the concept and principles of which have been presented in 2.2. subsection. In the third chapter, the author presents the EU institutional system in its current form, that is with the changes introduced under the Lisbon Treaty. Here, the selected aspects regarding competences and functioning of the particular EU institutions have been depicted, as well as the relations between them in the context of legitimization. Additionally, three selected problems regarding the EU institutional system have been raised, which are especially important in the context of its legitimization (the relation between the EU institutional system and the institutions of the EU member states, the question of transparency in the functioning of the EU institutions, as well as the Union budgets in the consecutive years). In the last subsection (3.9.) the specific features of the EU institutional system, significant in the context of its legitimization, have been identified. The fourth chapter is devoted to the functioning of the EU institutional system in the perspective of four basic sources of its legitimization, i.e. indirect and technocratic, direct and democratic, utilitarian, and one consisting of "values". The chapter ends with a conclusion outlining the specificity of the EU and its institutional system with regard to the sources of its legitimization, which is especially important in the context of the book's main thesis. The fifth chapter concerns the problem of legitimization of the EU institutions in the context of the economic crisis, which the EU member states struggle with since around the year 2008. The sixth chapter, in turn, regards the so called subjective (empirical, social) dimension of the EU institutions' legitimization, that is, the way this problem is perceived by the citizens of the EU member states. It has been based on the results of opinion polls conducted for the use of Eurobarometer, from among which these questions and answers were selected, which could be applied to illustrate the way the EU citizens perceive the Union institutions in the context of their legitimization. The closing remarks include the most important conclusions drawn from the conducted analyses and the potential reforms and modifications of the EU institutional system, which may allow for the reinforcement of its legitimization, primarily in its democratic aspect. In 2015 we celebrate the twenty-fifth anniversary of the first free local elections to self-governing bodies. Those elections activated local citizens initiatives and greatly contributed to the transformation in our social awareness, leading to real change in Poland's political regime. The underlying rationale of free local elections, however, was the package of laws adopted on 8 March 1990 which created real self-government, enabled the elections to commune and municipality councils of 27 May 1990 and introduced a new dynamic to the process of the decentralisation of the state.Changes are always the result of dreams and our ability to realise them. It is possible to make them if there exist organisational structures and institutions which allow such changes to be made. The need for political transformation had long been felt and deliberated on by those involved in spatial development or and for whom the state monopoly status quo was unacceptable. To quote the late and much missed Professor Jerzy Regulski, the implementation of self-governance was departure from the monopoly of central government, which in turn meant an actual change in the political regime. The reform of 1990 broke up five monopolies of an authoritarian state which had existed in Poland since the end of the World War II: the political monopoly of one party, of centralised power, of uniform state ownership, of public finances and the state budget, and of the uniform public administration of the state.However, it must always be remembered that the possibility of realising dreams of a change in the nature of the state was shaped in the first triumphant stage of the Solidarity period in 1989, and later became a stable basis for the future in the resolution of the First National Congress of Solidarity Delegates and in the 'Samorządna Rzeczpospolita' (A Self-governing Republic) document. The success of the real change of 1990 was rooted in the long term determination and persistence of those whose personal experiences were involved in the quest for rationality in land management. Both Professor Jerzy Regulski and Professor Michał Kulesza drew their inspiration to change the political regime from the need to ensure that society worked in a way that would allow the local needs and initiatives be articulated, and inhabitants having the ability to take concrete decisions about the surrounding environment. In this way, the existing possibility of active involvement in local initiatives, incapable of being realised in the former political system, would become a reality and the citizens would be able to make collective decisions about their local area. This would also give a chance to oppose formally the investment logic resulting from the central planning of those times.The analytic work aimed at the transformation of the political regime that Professor Regulski started in the 1970s during his employment at the University of Lodz were subsequently continued at the Economic Institute of the Polish Academy of Sciences and led to the formation of a group of individuals for whom self-governance became a core value of the new regime and a way of looking at the modern state. The change that took place in 1990 was the beginning of the building of a de-centralised, modern state, the status of which was subsequently confirmed when Poland adopted the Council of Europe Framework Convention for the European Charter of Local Self-Government. Self-government is never an institution whose constitution is ever finished. This was shown during the reform carried out by Prime Minister Jerzy Buzek's government, which continued the break-up of the monopoly of power and implemented subsidiarity principles at the regional level enabling them to exercise powers locally, in newly created districts (powiat), as well as in the later legislative changes pertaining to the regulations governing the election of mayors (wójt or burmistrz) or the work of the Komisja Wspólna Rządu i Samorządu (Joint Committee of the Government and Self-Government). Today, after 25 years of our experience with self-government, we are much more aware of the changes needed in the self-governing system. They include the strengthening of actual independence of self-government achieved through the ensured free choice of the manner in which self-government bodies will carry out their tasks, guaranteed revenues and the possibility given to commune and municipality authorities of exercising real influence on their size, improved cooperation between communes and municipalities (gmina) and districts (powiat), and, fore and foremost, by ensuring all citizens a chance of co-decision on matters which directly affect them. Changes in the regime of self-governance are a consequence of its assessment by external, independent experts but are also motivated by the natural dynamics of the changes resulting from the very essence of self-governance and its institutions, communes and municipalities (gmina), districts (powiat) and regions (voivodships).In 2010 associations of self-governing units realised the need for change and amendments to the law on self-governance. Thus, they formulated a number of proposals which were included in a document called 'Requests to the President of the Republic of Poland to commence work on the white book of territorial self-government in the year of the 20th anniversary.' This document initiated work on a draft law which in 2013 became the subject of a legislative initiative put forward by President Bronisław Komorowski. The purpose of the new law on the collaboration of self-governing bodies in local and regional development is to strengthen the role of the citizen as well as the community in the work of self-government in Poland. The effort that Professors Jerzy Regulski and Michał Kulesza in their capacity as Advisors to President Komorowski put into the legislative work remains invaluable. It is believed that the involvement of individual citizens constitutes the strength of self-government and is a guarantee of its role at the service and in the interest of communities, individual inhabitants and businesses. Hence the need for enhanced collaboration and the partnership of different bodies of self-government and the increased involvement of citizens. There is draft law that contains regulations supporting these activities.Under the draft law, a local referendum is seen as an important tool to ensure the participation of citizens in decision-making processes, including those concerning local development plans. Local referenda should constitute a mechanism used to solve local issues of material importance to residents. Their result should be binding regardless of the turnout.Self-governance helps to create and strengthen the natural inclination of individuals to act together in areas where because of their social, business or cultural ties, a local community spirit develops. In today's world of global challenges and competition, we are looking for a space for the individual which provides a feeling of security. Another important value of self-governance is the possibility of creating affiliations with a community as well as individual entrepreneurship, social activity and a regard for the collective memory of the symbols of a place. The ability to participate in community life is inseparable from the functioning of democracy at a local level, with the consultation process, election of public officers, or participation in referenda.Self-governance is a special value which gives each of us a chance to exercise a real influence on local matters. It therefore occupies a very special place where politics has a personal dimension. The variety of self-governance means at the same time a variety of development policies since there are different communities, with different emotions, different experiences or ability to participate in democratic management. This variety is a special asset in the process of the stabilisation of the state as a whole. The diversity of opinions and experiences, appointments to public office of citizens not affiliated to or necessarily recommended by any party creates the solid foundations of a democratic state. This feeling of freedom within self-governing communities must be continued and promoted.The authors of many of the texts published in this issue of Ruch Prawniczy, Ekonomiczny i Socjologiczny devoted to self-governance are, at the same time, authors of the transformation of Polish law and Poland's administration in the last 25 years. Contributions submitted by, among others, Prof. dr hab. Irena Lipowicz, Prof. Jerzy Stępień, Prof. dr hab. Jerzy Buzek, Prof. dr hab. Leon Kieres or Prof. dr hab. Hanna Gronkiewicz-Waltz are the best proof of the capital importance that self-governance plays in a democratic state. I thank Professor Teresa Rabska and the editorial staff of Ruch Prawniczy, Ekonomiczny i Socjologiczny for their active involvement in questions of self-government from the very beginning. This issue is entirely devoted to a range of legal, economic and sociological aspects of new challenges facing self-government and its regime. Once again I thank them for such active involvement and participation in the jubilee celebrations of Self-Government and this special issue of the journal.We need self-governance not only to feel that we can influence decisions being made about local issues but also to be continually able to renew our confidence in institutions at a local level, and through their collaboration at the national level.
In the dissertation entitled "Communication determinants of organizational changes in Polish political parties at the turn of the century" the author has made a detailed analysis of the relationship between the political communication and the internal organization of Polish political parties. The dynamic technological development made a progress in manners and forms of communication. Making new perspectives and opportunities in making interactions, including through inventing and popularization of the Internet, have been reflected in the world of politics. Using the knowledge of Polish and foreign scientists it is important to emphasize that, on the one hand, a decrease of identification with political parties and, on the other hand, an increase of professionalization of political activities run by the management of political parties have occurred in the reality at the turn of the century. The main purpose of modern political parties is their organizational survival and development. The essence of the political activity is to establish interactions with voters in order to identify their opinions, adjust them to their own election program and shape their previous preferences. Combining together theses two conclusions, it should be noted that political communication allows constructing tools and methods by means of which political parties can be well managed, which ensures their survival and development. The dissertation consists of fiver chapters. In the first chapter the author has analysed the functioning of the democratic system, in which all considerations collected in the dissertation have been embedded. The considerations have been, however, adapted to the overall context of the dissertation. In the second chapter the author has considered the issues concerning the evolutionary character of political parties. It is also important to emphasize that the considerations are focused only on political parties at the turn of the century. The third chapter discusses the issues presented in the second chapter, but in a detailed way. It contains the key management conceptions for political parties which according to the author are important to be implemented in parties whose main purpose is long-term survival and development. The fourth chapter includes the issues associated with the political communication. In the last chapter the author has collected the whole empirical knowledge gained during the interviews with the main politicians from Polish political parties. The interviews gain an insight into managerial processes in seven Polish parties: 1. Platforma Obywatelska RP; 2. Prawo i Sprawiedliwość; 3. Polskie Stronnictwo Ludowe; 4. Ruch Kukiz'15; 5. Sojusz Lewicy Demokratycznej; 6. Twój Ruch; 7. Nowoczesna Ryszarda Petru. The last chapter contains fifteen individual interviews. There were two criteria regarding the process of selecting the respondents. The first factor was their knowledge about managerial and communication processes in political parties they are associated with. The second fact was their experience gained during their political activity. The main purpose of these two criteria was to come to the representative conclusions for political parties as a whole organization, not only for their regional branches. Every interview had a detailed scenario which influenced on a scope and quantity of gathered information. The average interview lasted two and a half hours. During this time the author of the dissertation gained from ten to thirty one pages of the detailed information. To achieve the dissertation's purposes mentioned in previous paragraphs, the author has presented a series of hypotheses: 1. The most effective shaping of the development of countries and societies as well as skilful managing of public resources is achieved if political parties are well managed, in particular by conducting an effective human resources policy, which means the ability to recruit qualified supporters and members who are able to construct an election program ensuring long-term survival and development, skilful fundraising for statutory purposes and creating a strategy of development for a political party perceived as an organization which exists in the changing and rivalry environment; 2. Political parties whose main purpose is to perform public functions must construct an election program that is the most suited to the needs and expectations of potential voters. The election program needs also to be presented in the most preferred form for potential voters. The election program must be more convincing than the offers presented by other political parties; 3. In the political rivalry at the turn of the century political parties need to pick up the potential and skills indispensable in the process of shaping electoral preferences. The possibility of influencing on the decision making process in the country is associated with the proper selection of the communication tools and methods; 4. The good management of political parties is associated with an organizational structure which allows establishing interactions between politicians and voters, which makes it possible to create political programmes suited to the most preferred, from a political party's point of view, segments of the electorate, influence on electoral attitudes as well as construct a political offer more persuasive for a voter than the counterpart created by political rivals; 5. The main purpose of every political party, perceived as gaining influence on the decision making process, can be achieved only by creation effective communication methods and tools, which are the most important in political parties and can also have an influence on political party's organizational structure; 6. The level of the citizen's knowledge in the countries which adopted a representative democratic system is directly proportional to the level of the social and economic development in these countries. The progress of the representative democratic system is possible in most cases due to creation of effective communication methods and tools; 7. The political evolution of modern societies, among which is should be mentioned, the decreasing level of the permanent identification with political parties determines an evolution of organizational structures of political parties and ways of creating political processes. Nowadays the political communication is a factor which allows interpreting electoral preferences and adjusting all political activities to them; 8. The evolution of the modern societies leads to the evolution of ways of creating political processes, especially by their assimilation to the activity based on methods and forms known from the commercial market.
The article discusses the problem of procedures and specific features of functioning of a modern democratic state, as well as threats resulting from weaknesses of democracy despite existence of mechanisms protecting it from abuse. This problem is analysed on the example of the ongoing political conflict about the Constitutional Tribunal: an institution of constitutionally guaranteed independence. This conflict reveals that in Poland a need for discussion and perhaps for verification of the current philosophy and practice of democracy, has arisen. Furthermore, it demonstrates that law and the rule of law are neither sufficient guarantors of a democratic system's stability, nor guardians of civil rights and freedoms. A weakness of the democratic system lies in the fact that in the name of correctly understood democratic principles it is possible to distort the system through enacting wrong laws. Even though the acts of democracy participants, mainly decision-makers, are lege artis, they lead to impairment of democracy. Without doubt, a democratically organized society is an autonomous community and polyarchy which has adopted a democratic system of government as a form of its organization. On the other hand, democracies are highly conflict-prone systems, for example, due to the fact that they are based on the principle that all views and all participants of democracy are equal. As a consequence, such logic leads directly to emergence of disagreements, conflicts and even fights among democracy participants. This feature of democracy has enforced the establishment of appropriate procedures of conflict solving so that to ensure a possibly optimal resolution of crisis situations which could ultimately cause even a collapse of the democratic system. Thus, a simple mathematical rule has been adopted, albeit secondary in relation to any other methods of conflict solving, that is the majority principle. This is a standard of the democratic conduct without which the rule of majority would not be possible. The Constitutional Tribunal has recently become the object of popular interest – one of the many institutions of a democratic state which has not aroused so much factual and political dispute ever before. The conflict over the Tribunal has basically the formal and legal character, this is a technical dispute whose solution should be dictated by binding regulations and developed by experts in law. However, this is not the case. This conflict has turned into an argument of a political character, so it has become a genuine clash of interests, additionally aggravated by values. Moreover, it has stirred up the society and the environment of lawyers. When a political conflict, as one of the conflict types, is analysed, it is defined as a disagreement over power, whose participants are these individuals, groups, institutions and organizations which have a direct impact on politics or influence it through political channels. The practice of democratic states of the Western world does not prescribe a way at the beginning of which there is a sign "the winner takes it all". This practice is corroborated by philosophy and theory of democracy, as well as by several hundred years of achievements including such principles as Montesquieu's tripartite system of the separation of powers or the contemporary definition of democracy which describes it as a rule of majority that guarantees rights to minorities. ; Artykuł porusza problem procedur i specyfiki funkcjonowania nowoczesnego państwa demokratycznego oraz zagrożeń wynikających ze słabości demokracji mimo istnienia mechanizmów zabezpieczających ją przed nadużyciami. Problem ten jest rozpatrywany na przykładzie toczącego się konfliktu politycznego o Trybunał Konstytucyjny, instytucję o gwarantowanej konstytucyjnie niezależności. Konflikt ten pokazał, że w Polsce pojawiła się konieczność dyskusji i być może weryfikacji dotychczasowej filozofii i praktyki demokratycznej. Również to, że prawo i rządy prawa nie są wystarczającymi gwarantami stabilności ustroju demokratycznego, tym bardziej strażnikami praw i wolności obywatelskich. Ułomność systemu demokratycznego polega na tym, iż w imię właściwie pojętych zasad demokratycznych możliwe jest wypaczanie systemu przez tworzenie złego prawa. Działania uczestników demokracji, głównie decydentów, są lege artis, ale prowadzą do jej osłabiania. Demokratycznie urządzone społeczeństwo jest bez wątpienia autonomiczną wspólnotą i poliarchią, a przyjęło jako formę swojej organizacji demokratyczny system rządów. Demokracje są natomiast systemami wybitnie konfliktogennymi, choćby z tego powodu iż opierają się na zasadzie równości wszystkich poglądów i wszystkich podmiotów biorących udział w demokracji. Taka logika prowadzi w prostej konsekwencji do pojawienia się niezgodności i konfliktów, a nawet walk pomiędzy uczestnikami demokracji. Ta właściwość demokracji wymusiła stworzenie odpowiednich procedur rozstrzygania konfliktów, by zagwarantować w miarę optymalne wychodzenie z sytuacji kryzysowych, mogących w ostateczności doprowadzić nawet do upadku systemu demokratycznego. Przyjęto zatem prostą zasadę matematyczną, co prawda wtórną wobec wszystkich innych sposobów rozwiązywania konfliktów – zasadę większości. Jest ona regułą demokratycznej gry, bez której nie mogłyby istnieć rządy większości. Przedmiotem społecznego zainteresowania stał się ostatnio Trybunał Konstytucyjny, jedna z wielu instytucji demokratycznego państwa, która dotychczas nie wywoływała aż takich sporów merytorycznych i politycznych. Konflikt o Trybunał ma przede wszystkim charakter formalno-prawny, jest to techniczny spór, którego rozwiązanie powinno być podyktowane przez obwiązujące prawo, a jego rozstrzyganiem powinni się zająć eksperci z dziedziny prawa. Tak jednak nie jest. Konflikt ten przerodził się w konflikt o charakterze politycznym, stał się więc rzeczywistym konfliktem interesów, uzupełnionym dodatkowo o wartości. Zaktywizował ponadto społeczeństwo oraz środowisko prawnicze. Gdy rozważa się jeden z typów konfliktów, mianowicie polityczny, definiuje się go jako taki, którego przedmiotem jest władza, a podmiotami biorącymi w nim udział są te jednostki, grupy, instytucje, organizacje, które bezpośrednio mają wpływ na politykę lub oddziałują na nią za pośrednictwem kanałów politycznych. Praktyka demokratycznych państw świata zachodniego nie wskazuje drogi, na początku której stoi znak "zwycięzca bierze wszystko". Praktykę tę wyznacza filozofia i teoria demokracji oraz kilkusetletni dorobek z takimi dogmatami, jak choćby monteskiuszowski trójpodział władz czy współczesna definicja demokracji, według której są to rządy większości gwarantujące prawa mniejszościom.
Po upadku komunizmu i zakończeniu zimnej wojny wydawało się, że świat na trwałe wchodzi w okres stabilizacji, pokoju i współpracy. Szybko jednak okazało się, że świat narastającej globalizacji ma różne oblicza, także negatywne, co rzutuje na prawie każdą sferę życia, także na bezpieczeństwo. Spadło co prawda zagrożenie nuklearne, ale pojawiły się nowe zagrożenia oraz nasiliły te, które przedtem przesłonięte były rywalizacją Wschód – Zachód. Chodzi głównie o konfl ikty etniczno- -religijne, kulturowe i cywilizacyjne, w tym rozlewające się konfl ikty wewnętrzne w państwach słabych i upadłych, proliferację broni masowego rażenia, niebezpieczne ambicje państw dyktatorskich. Ogromny wpływ na ład międzynarodowy i bezpieczeństwo miały zamachy 11 września 2001. Zmieniły one percepcję zagrożeń dla bezpieczeństwa. Terroryzm uznany został za największe zagrożenie dla bezpieczeństwa, a ogłoszona przez prezydenta Busha walka z terroryzmem doprowadziła Stany Zjednoczone i prawie cały Zachód do zaangażowania w dwie wojny: w Iraku i w Afganistanie. O ile interwencję w Afganistanie i obalenie reżimu Talibów można uznać za swoiste prawo do samoobrony Stanów Zjednoczonych (a właściwie po uruchomieniu art. 5 traktatu waszyngtońskiego za sprawę całego NATO), bo Al-Kaida, która była organizatorem zamachów 11 września, za przyzwoleniem tego reżimu była na stałe zainstalowana w tym kraju, to już interwencja w Iraku miała wątpliwe podstawy prawne, a właściwie była ona jednostronną decyzją USA, podjętą mimo protestów połowy sojuszników NATO. To co nastąpiło potem, w ramach wojny z terroryzmem, przekształciło się w totalny chaos, przypominający wojnę domową, w Iraku obecnie wygasającą, w Afganistanie zaś, już w warunkach obecności tam Międzynarodowych Sił Wsparcia Bezpieczeństwa (ISAF), coraz bardziej nasilającą się. W ostatnich dwóch latach warunki bezpieczeństwa w Afganistanie, za które w praktyce, w ramach ISAF, odpowiedzialne jest NATO, gwałtownie się pogorszyły. Gwałtownie wzrosła liczba zamachów terrorystycznych, a talibowie odzyskują pozycje, kontrolując już prawie 40% obszaru Afganistanu. Sytuacja w Afganistanie i odpowiedzialność NATO za bezpieczeństwo tego kraju budzi ogromne zaniepokojenie przywódców państw natowskich oraz kierownictwa sojuszu. Staje się to również jednym z centralnych problemów nowej administracji waszyngtońskiej. Trwające już siedem lat i rosnące zaangażowanie NATO i sił koalicyjnych w Afganistanie, pionierskie w ramach misji out of area, mimo zaangażowania ok. 64 tysięcy żołnierzy, sprzętu i idących w miliardy dolarów kosztów operacji nie przynosi jak dotąd, oczekiwanych rezultatów. Dlatego też przygotowana i realizowana jest nowa strategia obecności USA i NATO w Afganistanie. Zaangażowanie NATO w Afganistanie często interpretowane jest jako swoisty test dla Sojuszu, jako wyraz rosnącej odpowiedzialności za bezpieczeństwo globalne, w tym za zwalczanie nowych zagrożeń, takich jak terroryzm, których eskalacja jest także ubocznym skutkiem globalizacji. Autor nie w pełni podziela te opinie, choć niewątpliwie obecność NATO w Afganistanie jest ważną i trudną próbą dla Sojuszu, w tym także dla Polski ze względu na rosnące zaangażowanie sił zbrojnych naszego kraju w tę operację. Sprawa udziału NATO jednak rzutuje na stan bezpieczeństwa międzynarodowego, eskaluje napięcia i budzi negatywne emocje cywilizacyjno-kulturowe, utrudnia walkę z terroryzmem, kładzie się cieniem na i tak niejasny obraz sytuacji na Bliskim i Środkowym Wschodzie. Na wiele spraw z zakresu bezpieczeństwa globalnego i regionalnego, w tym narodowego poszczególnych krajów (choćby USA), patrzy się przez pryzmat Afganistanu. ; When the cold war ended, after the collapse of communism and when fi nally the Soviet Union disintegrated, there was a widespread feeling through the world that at long last universal peace had descended on earth. The fear of war in which weapons of mass destruction would be used had vanished. Today's world is a vastly different place. It is a world of globalization, which has both good and bad sides. This inexorable process has extended the opportunities of worldwide interchange. But this same globalization process and associated technology have also brought major new threats and intensifi ed existing ones. The threats we face are seamless, running across the boundaries of defence, foreign affairs, domestic and social life. It has left nations and peoples ever more vulnerable to phenomena ranging from international crime and terrorism through to cyber-attacks, health pandemics, energy politics, resource shortages and fi nancial crisis. We are facing the problem of failed states, WMD proliferations, rough countries challenges. We all have to agree that it was a great impact of 9/11 terrorist hijackers and attacks on security. The perception of international security threats has changed. Terrorism has been recognized as the biggest threat for security. The war on terrorism, declared by George W. Bush, has engaged United States and almost the whole West in two wars: in Iraq and in Afghanistan. As far as Afghanistan case is concerned, one has to recognize the legitimacy of American intervention (as did the UN Security Council), as U.S. had the right to self-defence after Al-Qaeda attacks, operating from Afghan territory. In the case of intervention in Iraq there are far going doubts about its legitimacy. The result was not only the overthrow of both regimes, of Saddam Hussein in Iraq and Taliban in Afghanistan, but a real mess – if not a civil war – in Iraq. Today, after seven years, the security situation in Iraq has much improved, but in Afghanistan there is ongoing process of violence escalation. In the last years the conditions of security in Afghanistan, for keeping which responsible is ISAF (and practically NATO, being a core of ISAF), has dramatically deteriorated. The number of terrorist attacks has enormously increased and Taliban have regained the control over 40% of Afghan territory. The security situation in Afghanistan and NATO's responsibility for that is the reason of deep concern for both the leaders of NATO member states and Alliance itself. The new American administration has made the confl ict a policy priority. President Obama announced a new strategy for Afghanistan, including the decision to commit an additional 30 000 U.S. military forces to address the confl ict. NATO's engagement in Afghanistan is treated as a kind of test for Alliance and a confi rmation of NATO's rising responsibility for global security, opening new out of area alliance missions. It is also important for Poland, taking in consideration the rising number of Polish troops in Afghanistan. Many questions of global and regional [Middle East] security are treated in the framework of Afghanistan case. ; Многие считали, что после падения коммунизма и окончания холодной войны, мир входит в период стабилизации, мира и сотрудничества. Однако вскоре ока- залось, что в эпоху глобализации мир имеет разные обличия, в том числе нега- тивные, что отражается почти на каждой сфере жизни, в том числе и на безопас- ности. Хотя и уменьшилась ядерная угроза, но появились новые угрозы, а также усилились те, которые ранее, в связи с соперничеством Востока и Запада, на- ходились на втором плане. Главным образом здесь необходимо иметь ввиду эт- ническо-религиозные, культурные и цивилизационные конфликты, в том числе, внутренние конфликты в слабых и распавшихся государствах, распространение оружия массового уничтожения, опасные шаги диктаторских государств. Огромное влияние на международный порядок и безопасность оказали террористические акты 11 сентября 2001 года. Они полностью изменили вос- приятие угроз безопасности. Терроризм был признан самой большой угрозой безопасности, а провозглашенная президентом Бушем война с терроризмом вовлекла Соединённые Штаты и почти весь Запад в ведение двух войн: в Ира- ке и в Афганистане. Если интервенцию в Афганистане и свержение режима та- либов еще можно признать своеобразным правом на самозащиту Соединённых Штатов (а имея ввиду 5 статью Вашингтонского договора делом всего НАТО), поскольку Аль-Каида, ответственная за организацию терактов 11 сентября, с согласия режима талибов имела постоянные базы в этой стране, то интер- венция в Ираке имела очень слабые юридические основания и в действитель- ности она была односторонним решением США, принятым вопреки протестам половины союзников НАТО. То, что произошло в рамках войны с терроризмом, позже превратилось в тотальный хаос, приведший к ослабевающей гражданс- кой войне в Ираке, и усиливающейся войне в Афганистане, происходящей в ус- ловиях присутствия там Международных сил содействия безопасности (ISAF). В последние два года безопасность в Афганистане, за которую в действитель- ности в рамках ISAF, несет ответственность НАТО, сильно ухудшилась. Возрос- ло количество террористических актов, а талибы контролируют уже почти 40% территории Афганистана. Ситуация в Афганистане и ответственность НАТО за безопасность этой стра- ны, вызывает огромное беспокойство глав государств членов НАТО, руководс- тва союза, а также становиться одной из главных проблем новой вашингтон- ской администрации. Продолжающееся уже семь лет и растущее присутствие НАТО и коалиционных сил в Афганистане, не взирая на контингент численностью около 64 тысяч солдат, современную технику и исчисляющуюся в миллиар- дах долларов стоимость операции, пока не принесло ожидаемых результатов. В связи с чем, подготавливается и реализуется новая стратегия присутствия США и НАТО в Афганистане. Действия НАТО в Афганистане часто интерпретированы как своеобразный тест для союза, как проявление растущей ответственности за глобальную бе- зопасность, в том числе за борьбу с новыми угрозами, такими как терроризм, эскалация которого в какой-то степени является побочным следствием глоба- лизации. Автор не полностью разделяет такое мнение, хотя, несомненно, при- сутствие НАТО в Афганистане – это важное и тяжелое испытание для союза, в том числе также для Польши, ввиду возрастающего присутствия вооружён- ных сил Польши в этой операции. Вопрос участия в операции НАТО, хотим мы этого или нет, отражается на состоянии международной безопасности, вызыва- ет напряжения и отрицательные цивилизационно-культурные эмоции, затруд- няет борьбу с терроризмом, оказывает влияние на и так непростую ситуацию на Ближнем и Среднем Востоке. На многие вопросы в сфере глобальной и ре- гиональной безопасности, в том числе и национальной, отдельных стран (даже США), нужно смотреть сквозь призму Афганистана.
The text is an attempt to analyze the international political situation in the security sector in the context of the crisis which has arisen as a result of the aggressive actions of the Russian Federation in relation to Ukraine: in particular the forcible annexation of the sovereign territory of Ukraine in violation of all the principles and norms of international law and the inspiration of the armed conflict in the eastern regions of Ukraine. For the first time after the end of the World War II aggression has become a fact of reality in European politics. Pan-European and transatlantic security institution – the Organization for Security and Cooperation in Europe – was not sufficiently effective mechanism for crisis management. In two years, the conflict in eastern Ukraine killed about 10 thousand men. The conflict in Eastern Ukraine has radically changed the perception of security in Europe. The problem is that Ukraine, like most of the "new democracies" of Eastern Europe as a result of the transformation processes of the early 90th appeared in a "gray zone" of security. Most of the Eastern European countries overcame the security gap by joining NATO/EU. At the same time, Ukraine remained in the buffer zone and became an object of intense economic, political, informational and military pressure from the Russian Federation. As a result, Ukraine is forced to rely primarily on their own capabilities and the military-industrial potential (not being part of the European collective defense/security), on the other – the international political, economic, informational support from the international community plays a key role in the possibility of Ukraine resist aggression. However, the crisis has led to a certain re-evaluation of existing regional security system: 1) The failure of attempts to build a pan-European security system became obvious; 2) The OSCE in Ukrainian crisis has created a platform for the negotiations and the peace process, but did not provide, at least until now, the mechanism of a real resolution to the crisis; 3) The question of inefficiency, lack of prospects and obsolescence of NATO as a collective security organization may be withdrawn from the agenda; 4) There is an activization of existing and search for new formats of cooperation between European countries in the development and improvement of the international security system in Europe. ; W artykule podjęto próbę analizy bezpieczeństwa w wymiarze polityczno-międzynarodowym w kontekście kryzysu wywołanego agresywnymi działaniami Federacji Rosyjskiej wobec Ukrainy – w szczególności aneksji części terytorium Ukrainy przy użyciu siły z pogwałceniem wszelkich norm prawa międzynarodowego oraz "instalacji" konfliktu zbrojnego we wschodnich obwodach państwa ukraińskiego. Po raz pierwszy od zakończenia II wojny światowej agresja stała się rzeczywistością polityki europejskiej. Ponadto ogólnoeuropejskie i transatlantyckie struktury bezpieczeństwa – Organizacja Bezpieczeństwa i Współpracy w Europie – nie jest zbyt efektywnym mechanizmem zarządzania kryzysowego. W ciągu dwóch lat konfliktu zginęło ok. 10 tys. osób. Konflikt na wschodzie Ukrainy radykalnie zmienił postrzeganie bezpieczeństwa na kontynencie europejskim. Problemem jest to, że Ukraina jak większość "nowych demokracji" Europy Wschodniej w wyniku procesów transformacyjnych znalazła się w szarej strefie bezpieczeństwa. Większość wschodnioeuropejskich państw rozwiązało problem security gap, wstępując do NATO i UE, podczas gdy Ukraina pozostała w szarej strefie, stając się celem ekonomicznych, politycznych, informacyjnych i wojskowych nacisków ze strony Federacji Rosyjskiej. Po pierwsze, w wyniku rozwoju kryzysu Ukraina jest zmuszona w pierwszej kolejności liczyć na własne możliwości i potencjał wojskowo-przemysłowy (nie będąc częścią europejskiego systemu bezpieczeństwa kolektywnego/obronnego). Po drugie, wsparcie polityczne, ekonomiczne i informacyjne ze strony społeczności międzynarodowej odgrywa kluczowe znaczenie w kontekście przeciwstawienia się Ukrainy rosyjskiej agresji. Razem z tym kryzys doprowadził do przewartościowań w zakresie istniejących w regionie systemów bezpieczeństwa: 1) możemy konstatować nieudane próby wybudowania ogólnoeuropejskich mechanizmów zagwarantowania bezpieczeństwa; 2) OBWE stworzyło platformę rozmów w ramach pokojowego rozwiązania konfliktu, ale nie wybudowała do tej pory realnego mechanizmu rozwiązania konfliktu; 3) NATO jako system bezpieczeństwa kolektywnego nie powinno być traktowane w kategoriach nieefektywności, archaiczności i braku perspektyw; 4) pojawiły się formy aktywizacji istniejących i poszukiwanie nowych form współpracy pomiędzy państwami europejskimi w celu rozwoju i doskonalenia systemów bezpieczeństwa międzynarodowego w Europie. ; Текст является попыткой анализа международно-политической ситуации в секторе безопасности в контексте кризиса, возникшего в результате агрессивных действий Российской Федерации по отношению к Украине: в частности насильственная аннексия части суверенной территории Украины в нарушение всех принципов и норм международного права и инспирирования вооруженного конфликта в восточных областях украинского государства. Впервые после завершения Второй мировой войны агрессия стала фактом действительности европейской политики. При этом общеевропейская и трансатлантическая структура безопасности – Организация по безопасности и сотрудничеству в Европе – оказалась не достаточно эффективным механизмом кризисного урегулирования. За два года конфликта погибло около 10 тыс. человек. Конфликт на востоке Украины радикально изменил восприятие безопасности на европейском континенте. Проблемой стало то, что Украина, как и большинство «новых демократий» Восточной Европы в результате трансформационных процессов начала 90-х гг. оказались в «серой зоне» безопасности». Большинство восточно-европейских государств решило проблему security gap путем присоединения к НАТО/ЕС. В то же время Украина остались в этой «зоне» и стала объектом интенсивного экономического, политического, информационного и военного давления со стороны Российской Федерации. В результате развития кризиса с одной стороны Украина вынуждена полагаться в первую очередь на свои собственные возможности и военно-промышленный потенциал (не будучи частью европейской системы коллективной обороны/безопасности), с другой – международно-политическая, экономическая, информационная поддержка со стороны международного сообщества играет ключевую роль в возможности Украины противостоять агрессии. Вместе с тем, кризис привел к определенной переоценке существующих в регионе систем безопасности: 1) Можно засвидетельствовать провал попыток выстроить общеевропейские механиз- мы обеспечения безопасности; 2) ОБСЕ создала платформу для переговоров и мирного процесса, но не обеспечила, по крайней мере, до сих пор, механизма реального урегулирования кризиса; 3) Вопрос о неэффективности, бесперспективности и устарелости НАТО как организации коллективной безопасности может быть снят с повестки дня; 4) Происходить активизация существующих и поиск новых форматов сотрудничества между европейскими государствами в целях развития и усовершенствования системы международной безопасности в Европе.
