Agents and Patients: The Principal-Agent Perspective

Antropólogos y Agentes institucionales ; Anthropologists and institutional agents ; Antropólogos e agentes institucionais
En este trabajo, una antropóloga que gestionó una política social en los 90´del siglo XX y un antropólogo que implementó una política educativa entre los años 2009 y 2018 nos proponemos una mirada disciplinaria de la constitución de la estatalidad, desde la doble perspectiva del actor/a y agente institucional. Entendemos que en el Programa Materno Infantil y Nutrición y en el Programa Nacional de Educación Sexual Integral se expresan al mismo tiempo, las condiciones estructurales socio-económicas y político-culturales en los cuáles ellos se implementaron y también ciertas especificidades de la gestión estatal, que muestran algunas continuidades. Esas especificidades estarían presentes en las trayectorias, y relaciones que aquellas y aquellos agentes institucionales establecieron entre sí, con funcionarios de mayor jerarquía y también con los destinatarios; se pone así de manifiesto el caracter heterogeneo y disputado dentro de las instituciones estatales permitiendo una aproximación más afinada de la gestión estatal. ; In this essay, as a female anthropologist who managed a social policy in the 90's of the twentieth century and a male anthropologist who implemented an educational policy between 2009 and 2018, we propose a disciplinary view of the constitution of statehood, from the double perspective of the social actor and the institutional agent. We understand that the Maternal and Child Nutrition Program and the National Program of Integral Sexual Education express at the same time the socio-economic and political-cultural structural conditions in which they were implemented, as well as certain specificities of state management, that display some continuities. Those specificities would be present in the trajectories, and relationships that those institutional agents established with each other, with senior officials and also with the recipients; the heterogeneous and disputed character within the state institutions is thus revealed, allowing a more precise approximation of state management. ; Neste trabalho, uma antropóloga que participou da gestão de uma política social durantes os anos 90 do século XX junto com um antropólogo que participou da implementação de uma política educacional entre 2009 e 2018, propomos uma visão desde a nossa disciplina sobre a conformação estatal, a partir de uma dupla perspectiva: ator/a e agente institucional. Entendemos que no Programa Materno Infantil y Nutrición e no Programa Nacional de Educación Sexual Integral manifestam-se simultaneamente as condições estruturais socioeconômicas e político-culturais nas quais foram implementados, assim como certas especificidades da gestão estatal; indicando algumas continuidades. Essas especificidades estariam presentes nas trajetórias e nas relações que os/as agentes institucionais estabeleceram entre si, com os altos funcionários e também com os destinatários dos programas. ADMISSIBILITY OF AN AGENT PROVOCATEUR AND AN ADVOCATE ACTING AS AN AGENT
The issue of an agent in criminal proceeding has been the topic of scientific discussion for several years in European countries as well as in the Slovak Republic. In particular, the topic of agent provocateur is constantly interesting and controversial in a view of its problematic practical implementation in relation to the national legal regulation of that institution, existing jurisprudence, including the practice of the European Court of Human Rights. This issue is worthy another discussion because there are many opinions that it intervenes into the fundamental rights of individuals and many lawyers point out that is not in compliance with the basic principles of the democratic state respecting rule of law. Theoretical aspects of the topic have caused its complicated way of application in the relation to respect towards the basic principles of the democratic state respecting rule of law By analyzing and comparing the domestic regulation, case law of domestic courts and the European Court of Human Rights the authors have ambition to suggest different views on problematic aspects of this institution, especially its form as agent provocateur. Special attention is dedicated to the question whether a lawyer, concretely advocate can act as an agent. The nature and purpose of all these institutions, including the question of legal entrapment, raising polemics dividing the society. The article does not aim to offer one satisfactory solution. The reason is, as the reader will have a chance maybe to come to the same idea, there are many different state approaches worldwide and especially in the States of the Council of Europe, which affected different ways of understanding of the Agent Provocateur, its role and purpose in the democratic state with rule of law. The authors´ intention is to seek arguments acceptable for both parties to the dispute.
