This paper is a revised version and an expanded version of the paper entitled 'Shares Divestment Scheme in Indonesian Mining Law'. Several cases of ICSID are cases of shares divestment, one of them is the Freeport case that offers divestment by giving the assumption of investment if the Government extends the Freeport Operational License until 2041. It violates determination of divestment share price as the value should be based on fair market price without calculating the amount of minerals. Shares divestment execution is often hampered by the determination of divestment shares' price. The purpose of the divestment arrangement was not achieved because of the price fixing issue which causes divestment failure or causes divestment delay, and the shares that were previously for the government eventually fell on private shareholders which might be owned by foreign parties. This paper is a legal research. It is intended to formulate a shares divestment scheme in the mining sector in Indonesia based on rational choice theory and public choice theory, which is expected to give a valuable contribution to the Government of the Republic of Indonesia as well as stakeholders and can be the ontological basis for laws and policies related to the investment and mining laws in Indonesia. The approaches which are used are the conceptual, statute, case and comparative approach. The primary legal materials that are used are legislation, international conventions and court decisions, while the secondary legal materials are in the form of literature and related materials.Key words: Investment law, mining law, national interest, rational choice theory, shares divestment.
The aims of this study are to examine and analyze the effect of implementation of good governance, performance based budgeting, and quality of human resources to regional work unit's (SKPD) budget qualities. Goal setting theory and agency theory are used to explain the phenomenon of budget qualities. The population of the present study are SKPD's in Sumbawa Regency. The number of respondents in this study were 94 respondents that selected using purposive sampling method. Data was collected using the questionnaire technique. This research uses analytical techniques Partial Least Square (smartPLS) 3.0. The results of quantitative analysis in this study showed thatimplementation of good governance, performance based budgeting, and quality of human resources had influence on SKPD's budget qualities. This means better and ideal implementation of good governance, performance based budgeting, and quality of human resources owned by the SKPD, SKPD's budget will be more qualified.The implications of this study can be useful for SKPDs on local governments to implement the principles of good governance and performance-based budgeting in the budget process to be able to provide better services to the public Keywords: Budgeting, Budget Qualities, Good Governance, Performance Based Budgeting, Quality of Human Resources.
This article aims to test competing explanations about the US foreign aid policy, namely interest-driven theory, humanitarian theory, and domestic political theory. Using longitudinal data on the amount of Official Development Assistance provided by the US to 155 recipient countries from 1960 to 2008, analyzed using random coefficient models, the research found that humanitarian and domestic political theories can account for the US foreign aid policy to the recipient countries for almost five decades better than the interest-driven theory. Generally, the US were more likely to send aid to poorer countries and/or countries where the US-based NGOs were actively involved. The econometric models also show that there are some cross-sectional and temporal variations in the aid. On average, countries receiving high amount of aid in the 1960s tend to have lower annual growth rate in the money they received from the US.
Regional Technical Implementation Units (UPTD) Work Training Centers (BLK) and Regional Revenue Bodies (Bapenda) Disnakertrans Tulungagung Regency is a newly established public organization. As a new public sector, an institution should have maturity in the fields of management and organization that are reflected in measurable work plans, regulations, clear governance, standard operation procedures, and guarantees of quality quality of institutions and graduates who must always be evaluated with appropriate instruments. This program takes one of the above BCS perspectives, namely the internal business perspective; from the perspective of a strategy based on Human Resources (HR). The making of the BSC will be based on the details of the governance that has been determined by the laws and regulations related to the two UPTDs which are then determined by the indicators of the implementation of the work program based on the capacity of the HR they have. The making of the work program indicator is based on the key performance indicator (KPI) theory. The aim of the program and the benefits of this program is to become one of the proofs of good cooperation between the institutions of STKIP PGRI Tulungagung and the Regency Government of Tulungagung Regency especially at the UPTD BLK and Bapenda Disnakertrans; to donate lecturers' knowledge to the public; and to improve the quality of management of government / public sector management in the Tulungagung Regency area. The results of previour research Wahyu (2001-2009), found the reinforce and complement the theory of Cognitive Development (Scheme) student (Extended Level Triad++) in the learning of mathematics. The purposes of the study are: 1) to generate a new theory about the Extended Level Triad++ ie levels of development schemes student to Graph Theory finer (from five levels to seven levels); 2) to determine the characteristics of the new levels of the triad (the Triad Level Extended++). In the qualitative research, data were collected from a task-based interview, then performed the data reduction, and presentation of data, as well as the next steps as set out in the flowchart prosesur collection and analysis of data, the data analysis will apply genetic decomposition analysis. Then to get a characterization of each level of the development carried out by the method-comparison analysis-fixed, by applying the theory of Glaser & Strauss, a theorizing process through four stages. The results of this study obtained in the form of advanced theory Extended Level Triad++. The theory is then summarized in a network schema development consisting of seven levels, ie the level of pre-intra, intra, semi-inter-level, international level, the level of semi-trans, trans level, and the level of extended- trans. The COVID-19 pandemic has greatly impacted all people in various walks of life and sectors of life, especially in the food and beverage service business industry such as at PT. So the main step from the government, especially in the city of Medan, is to issue Medan Mayor Regulation No. The method used in this study is a qualitative descriptive method which was conducted by means of open and in-depth interviews. The theory used in this study is the theory of G. Shabbir Cheema and Dennis A. Rondinelli models to determine the success of the implementation of several variables used, namely: environmental conditions, resources, organizational relationships, and characteristics of the implementor. The results of this study based on the presentation and analysis of data by the author, it can be concluded that the implementation of the adaptation of new habits in the conditions of the covid-19 pandemic at the determining paradise dynasty outlet was successfully implemented based on indicators of environmental conditions, resources, organizational relations, and characteristics of the implementor. . However, from the successful implementation of the adaptation, the obstacle encountered was the lack of awareness of visitors to comply with health protocols
DPR-RI oversight in TNI (military) Business have very important role in forming of professional and reliable TNI, despitefully DPR-RI oversight also useful to link citizen priority and views in rule of policy and law in defence area. The purpose of this research is to analyze the oversight mechanism conducted by DPR-RI in the case of military business. Theory used by researcher in conducting this research is theory of parliamentary oversight, which is conducting through various mechanism which available in parliament, that is: passing debate mechanism; passing existence of commission; and through raised questions when in meeting. This research used qualitative method,and data research was obtained from primary and secondary data. Primary data was gained through observation and interview. Based on the research, the oversight mechanism have been run by first commission of DPR-RI was still weaken, on the other side the parliament (DPR) also lack in creating an effective oversight, where this matter because of some factors, such as: the lack of political willingness of parliamentary member, lack of positive supervision practices and the limited information had by DPR.

This study uses the theory Waynes Parson in Palumbo and the size of the policy evaluation is based on the theory that the evaluation process, the evaluation of formative and summative evaluation. policy resources, communication among organizations, characteristic of the implementing agencies, economic, social and political conditions and the tendencies of implementation. This research uses descriptive method with qualitative approach. Data collection techniques are interviews, document analysis and observation. The data obtained were processed with qualitative data analysis. Informants in this study were 1) the Regent of Halmahera, 2) Regional Secretary, 3) Assistant for Public Administration, Law and Authority, 4) Head of Governance Regional Secretariat of Central Halmahera, 5) Head of Integrated Licensing Service Agency, 6) Head Weda South 7) The community served Based on the research results we concluded that the implementation of the PATEN in the district of South Central Halmahera Weda considered not running optimally. This study is a survey on Credit Union (CU) Cikal Mas Purwokerto and BaitutTamwil Muhammadiyah (BTM) Dana Mentari Patikraja members in Banyumas. Theaims of this study are to determine: (1) The differences of financial literacy levels between CU Cikal Mas Purwokerto and BTM Dana Mentari Patikraja members at thethree aspects i.e. behaviors, knowledge and attitudes, (2) The level of sharia aspectsknowledge of BTM Dana Mentari Patikraja members, (3) The implementation of interest system of CU Cikal Mas Purwokerto, and (4) The implementation of profit sharingsystem of BTM Dana Mentari Patikraja.The population in this study are individuals in Banyumas who grouped into twogroups, i.e. the members of Credit Union Cikal Mas Purwokerto and the members ofBaitut TamwilMuhammadiyah Dana Mentari Patikraja. There were 60 respondentstaken in this study which consisted of 30 respondents for each group. Based on the research and analysis of data using different test Mann Whitney U showed that: (1)Thereare differences between the financial literacy levels of CU Cikal Mas Purwokertomembers and BTM Dana Mentari Patikraja members viewed from three aspects: behaviors, knowledge and attitudes,(2) The level of sharia aspects knowledge of BTMDana Mentari Patikraja members are relatively low, (3) The implementation of interest system in CU Cikal Mas Purwokerto as according to the theory that the loan interest relatively smaller than the saving interest, it known based on interview with managers of CU Cikal Mas Purwokerto, and (4) The implementation of profit sharing system in BTM Dana Mentari Patikrajaas according to the theory used by Islamic financial institutions that profit sharing agreement to both parties when the contract is underway.
This study aims to understand e-government implementation in ATM Samsat services at Samsat Office of East Surabaya as well as the factors that obstruct the e-government based services implementation. The main idea of this study is the use of ATM Samsat smartcard service has not yet reached the target realization. E-Government project failure factors theory from Anthopoulos et.al.(2015) were used in this study with the instrument such as ICT and system development process. This study uses qualitative descriptive methods. The results indicates that the e-government implementation in ATM Samsat services were found in a form of phase simplification from motor vehicle tax payments by using smartcard. Furthermore, ICT and system development process were the factors that obstruct the e-government based services implementation. whereas ICT and system development process obstructs because ATM Samsat system were more complex than the manual system. Less socialization over the society also take effect because it was only done once which is when its launching.
As a part of the culture, folklore is important to be documented and studied. The folklore of south coast Pacitan, is still prevalent nowadays. Although it is not all documented, an effort of the research has to be conducted. Beside as an effort of conserving it, the research is also very important to reveal another side of the story. Based on the reason, the study is conducted to reveal the mindset as well as the culture system of the past society reflected in folklore. This study uses the theory of narrative structure of Levi 's Strauss . The method used is a qualitative method approach using anthropology. The data used comes from the 14 folklores taken from the South Coast of Pacitan region. Based on the result of the analysis, it can be concluded that the mindset of the past society can be separated into (1) the social status way, (2) migration way, and (3) the way of techno-economy. While, the life views of the past society in the south coast of Pacitan region are (1) complying the rule, (2) nature as the source of life, and (3 ) Peace of life is very desirable dream.
This study examines the performance of the regional council in serving of channeling aspirations of the people in West Java, Indonesia. This is possible because West Java province is an autonomous regional authority to regulate and manage the interests of the community and Government Affairs at its own initiative based on the aspirations of the people. The study uses a qualitative approach in order to get the natural settings in which there were many behaviors and events occurred. This study also uses an institutional theory (institutionalism), because the theory could lead the researchers on the structure, regulation and institutional procedures which could have a significant impact on a public policy and it should not be ignored in policy analysis. This study finds that in order to carry out their functions as elected representatives, the members of the provincial representative council always make themselves available for the community. To that end, the members of the provincial parliament, among others, absorb and collect the aspirations of the constituents through regular working visits; accommodate and follow up the aspirations and complaints; and give morally and politically accountable to the constituencies. In addition to receiving complaints that come to the Parliament's office, public aspiration was performed on working visits on a regular basis by members of Regional Representative Council for each electoral district at the time of recess. In terms of transparency, all the services were conducted in a transparent manner. Even so, some people still doubt the veracity of such transparency.

Tourism is a large sector that includes many things in it. Facilities and infrastructure that can support the life of the tourism sector are not only owned by one party, but involve various stakeholders so that collaboration between these stakeholders is needed to collaborate, but collaborative governance in the development of the Tanjung Lesung Special Economic Zone is still not optimal. The purpose of this study was to determine and analyze collaborative governance in the development of the Tanjung Lesung SEZ. This research is based on the Collaborative Governance Theory from Ansell and Gash. This theory is to examine the collaboration process which includes dimensions including the collaboration process, initial conditions, institutional design, and facilitative leadership. The research method used is a qualitative method with a descriptive approach. Because the main purpose of this study is to describe and provide an explanation of collaborative governance in the development of the Tanjung Lesung SEZ. Informants were determined by purposive sampling and snowball techniques. The data collection technique used is by conducting observations, interviews, literature studies and documentation. The result of this research is that Collaborative Governance in the development of the Tanjung Lesung SEZ has not been implemented optimally. Suggestions from this research are that the community increases its resources so that they can collaborate, the government provides ongoing training to help the community actively collaborate and the government forms a special forum as a forum to communicate and discuss the vision and mission to be achieved together. ; The development of tourism is not only conducted by one stakeholder, but it involves various stakeholders and therefore needs the collaboration among them. The purpose of this research is to describe the collaborative governance in developing the special economic zone of Tanjung Lesung. The description of collaborative governance is based on collaborative governance model that emphasizes four dimensions, namely starting condition, institutional design, facilitative leadership, and collaboration process. Method of this research is descriptive-qualitative method. This research needs primary and secondary data. Primary data of this research are collected by in-depth interview and observation, and secondary data of this research are collected by documentation. The collected data, both primary and secondary, are qualitatively described. Results of this research indicate that the collaborative governance based on the dimensions of starting condition, institutional design, facilitative leadership, and collaboration process in developing the special economic zone of Tanjung Lesung is not optimally implemented yet. This research recommends that the community increases its resources in order to involve in collaboration; the government provides the sustained training to help the community in order to actively collaborate and forms a special forum to communicate and discuss the vision and mission to be commonly achieved in developing the special economic zone of Tanjung Lesung.
