Die Forschungsprojekte des Future-Megacities-Programms liefern wertvolle Ergebnisse zu Energieeffizienz-Standards und energieeffizienten Stadtstrukturen. Sie zeigen, wie Ressourcen eingespart und Emissionen verringert werden können. Um diese ehrgeizigen Ziele zu erreichen, ist es aber unabdingbar, die Bevölkerung zu beteiligen und zu befähigen, eine aktive Rolle in der nachhaltigen Entwicklung ihrer Lebensumwelt zu übernehmen. Dafür sind Bildungs- und Qualifizierungsanstrengungen auf vielen Ebenen nötig, für unterschiedliche Zielgruppen und mit spezifischen Inhalten und Themen. Dieser Band zeigt erprobte und evaluierte Ansätze, nach denen fachgerechte Arbeitsausführung und ressourcenschonendes Verhalten im Arbeits- und Lebensalltag sowie individuelles und institutionelles Wissen entwickelt und gefördert werden können. The concept of diminished capacity allows a defendant in a criminal case to prove, usually by presenting psychiatrists who testify that he suffered from an abnormal mental condition, that he was unable to entertain the particular mens rea required for conviction.' Although courts historically have been reluctant to admit such testimony, in recent years a growing number of jurisdictions have recognized the concept of diminished capacity. Recent decisions in Pennsylvania, the District of Columbia, and North Carolina, as well as recently adopted statutes in ten other jurisdictions,illustrate the evidentiary, social, and constitutional issues raised by the concept of diminished capacity. Evidentiary problems arise as the courts evaluate the relevance and probative value of psychiatric testimony presented to negate mens rea. Social problems must be considered as the courts determine the future disposition of defendants acquitted because their mental defect prevented them from entertaining a required mens rea. Constitutional problems of due process arise in those states that require a defendant to bear the burden of proving his insanity, but refuse to allow him to demonstrate his inability to entertain a mens rea that is held to be an essential element of a crime. The purpose of this Recent Development is to analyze these decisions and statutes and to propose an approach to the concept of diminished capacity through which courts and legislatures may consider carefully all three types of issues raised by the concept and thus properly assess the benefits and detriments of admitting psychiatric testimony on the issue of mens rea.

This paper develops a simple and transparent methodology that takes the main aspects related to rail infrastructure capacity into consideration to give an approximated value of the maximum capacity charge (initial mark-up). The method can be used (as a basic calculation tool) to develop a uniform (and thus, interoperable) charging system. According to the hypothesis formulated, the result of the method's application to typical railway services was from higher to lower initial mark-up: suburban trains, intercity trains, regional trains, express freight trains, conventional freight trains. After this preliminary valuation is reached, the railway under- takings' willingness to pay and the socioeconomic aspects of transport come into play for setting the definitive mark-ups, thereby establishing the final charging level. ; TRYSE Research Group, Department of Civil Engineering, University of Granada, Spain

AbstractFollowing a brief review of recent criticism of technical cooperation as an instrument for capacity building in sub‐Saharan Africa, this article examines current strategies for addressing the professional staff retention problem within African governments, and for making the market for technical cooperation more effective by allowing greater substitution of national experts for expatriate experts in project design and implementation. In order to strengthen and effectively use scarce local expertise, while avoiding its diversion to donor‐financed projects, the article proposes capacity‐building strategies aimed at the development of national or regional markets for development analysis and management expertise in sub‐Saharan Africa.
The successful completion of any task depends upon, amongst other factors, the matching of capacity to demand. If capacity exceeds demand, completion is possible; if capacity is less than demand, total completion is impossible.
