Conflicts may arise within countries as well as between different countries. Conflict is an integral component of human existence. Conflicts occur in the economic, political, social, ideological, military, managerial and other spheres of public life. Accordingly, the methods and ways of their settlement vary significantly. It is dangerous that both internal (intrastate) and external (interstate) conflicts reduce the country's ability to defend its own interests in the world. Under certain circumstances, such conflicts can be used by external and internal players as an instrument of pressure on the state leadership and encourage it to adopt decisions and agreements that are unfavorable for the country. The solution to any conflicts requires a deep understanding of both the nature of their occurrence and the dynamics of the flow. Today the most dangerous for Ukraine is the armed conflict in the Donbass. This conflict was provoked by the Russian Federation, which sees our country as a "buffer zone" against international military threats. The level of conflict in the zone of armed confrontation is very high. Negotiations at the international level and the efforts to resolve the conflict in Donbass did not bring the desired success. The citizens of Ukraine have no confidence in the successful completion of this conflict. It provokes a social apathy and aggression in Ukrainian society. The cessation of the armed conflict in Donbass is extremely important both for Ukraine and the entire world community. Now Ukraine is forced to develop a strategy of national self-preservation in the difficult and uncertain conditions of international security. Finding optimal answers to hybrid threats is a necessary precondition for maintaining the sovereignty and territorial integrity of our state.
У статті досліджений етимологічний зміст понять «воєнний» та «військовий». Проаналізований зміст таких понять як «воєнний конфлікт», «збройний конфлікт» та «війна». Також автором визначені відмінні та спільні ознаки цих понять. Встановлений зв'язок між поняттями «воєнний конфлікт», «збройний конфлікт» та «війна» за допомогою категорій загального, особливого та одиничного. ; The article examines the etymological content of the concepts of «military» (voyennyy) and «military» (viys'kovyy). It is established that the concept of «military» (viys'kovyy) refers to the army or relates to a ser- viceman. The concept of «military» (voyennyy) refers to the war, associated with it. Consequently, the author established that in relation to the conflict, the use of the concept of «military conflict» (voyennyy) is appropriate.In the Military Doctrine of Ukraine military conflict is defined as «the form of resolving interstate or national conflicts with the bilateral application of military force; the main types of military conflicts are war and armed conflict».In the Military Doctrine of Ukraine armed conflict is defined as «armed collision between states (inter- national armed conflict, armed conflict at the state border) or between the warring parties in the territory of one state, usually with support from the outside (internal armed conflict)». Consequently, armed conflict is a conflict of any level, the main feature of which is the use of weapons.The war means a socio-political phenomenon associated with the radical change in the nature of relations between states, folks, nations, classes and social groups opposing sides and the transition from the use of non-violent forms and methods of struggle to the direct use of weapons and other violent means to solve certain social political, economic, ideological, as well as national, religious, territorial and other contradictions.Thus, the author singled out common and distinctive features of the concepts of «military conflict», «armed conflict» and «war». Consequently, the common in these concepts are the subjects of interaction, namely, the states or conflicting parties in the middle of one state and the presence of the use of weapons. Demarcation of these concepts may be carried out according to the criterion of the motives of occurrence. That is, political motives that are necessary for the emergence of a military conflict and war are not neces- sary for the emergence of an armed conflict. Such a criterion is central to the demarcation of the «military conflict» and «war» from the «armed conflict».The distinctive features of «war» from «armed conflict» and «military conflict» is the formal act of its announcement; the rupture of diplomatic relations and the cancellation of bilateral agreements between thewarring parties; the introduction of a special legal regime; qualitative change in the state of society.The author suggests the connection between these concepts with general, special and individual categories. Where is the notion of «military conflict», which is generic in relation to «war» and «armed conflict». In turn, the «armed conflict» is special, and the concept of «war» is individual category.

At the same time, in order to damage the territorial integrity and sovereignty of Ukraine, the Black Sea Fleet was used as the main lever of influence. It should be noted that the impact on the population of the Crimean peninsula, through the prism of events around the Black Sea Fleet, was carried out in many spheres, primarily, military, political, informational, linguistic, etc. In our opinion, in 1997 the resolution of the issue of the Black Sea Fleet division marked the fact that by this time the majority of the population of the territory of the Crimea had formed a negative attitude towards the Ukrainian authorities and, as a result, towards the Armed Forces of Ukraine. Therefore, the rapid occupation of the Crimean peninsula in 2014 and the events in Donbass were a natural consequence of the unfriendly policy of the Russian political leadership towards Ukraine, which the leadership has been pursuing since 1991. It has been shown that in recent years in Ukraine the pressure of religious organizations on the legislative and executive authorities has increased and information campaigns and projects of anti-gender and anti-Ukrainian trends have been implemented. The author analyzed how in the regions staying under Russian informational pressure the religious fundamentalism shows the potential of development develop into religious extremism. It has been demonstrated that in Ukraine the gender aspects of security are not well-developed and are heavily influenced by religion. It has been shown that the lack of high-quality gender analytics significantly complicates the forecasting of social processes. The article deals with the question how religious fundamentalism manipulates women's security issues in favor of religious interests. It is noted that the pressure of pro-religious anti-gender movements on the authorities in Ukraine can lead to negative consequences, and that the establishment of a state policy based on religious perceptions of the world can threaten the country's internal security. It was concluded that in times of conflict, religious extremism does not recognize the rule of human rights and proclaims the primacy of religious customs over women's human rights. It is proved that, considering direct conflict with Russia, the spread of religious fundamentalism in Ukraine and the spread of structural gender violence will be relevant and require the immediate development of gender and biopolitical aspects of security. It was concluded that for the progressive democratic development of Ukraine, as well as safe living conditions and the well-being of its citizens, the security services should turn to gender analytics. It has been proven that, in order to protect their interests, religious leaders can initiate a departure from state-guaranteed compliance with international agreements on gender equality in all spheres of life. In this regard, Ukraine's implementation of United Nations Security Council Resolution No. 1325 on Women, Peace, Security and the similar resolutions as well as Recommendations of the UN Committee on the Status of Women for Countries that have ratified the Convention on the Elimination of All Forms of Discrimination against Women, other UN instruments is important for Ukraine. Also important are the country's European commitments in the field of gender equality. In particular, the Council of Europe Convention on the Prevention and Combating of Violence against Women and Domestic Violence (Istanbul Convention) needs to be ratified.
The analysis of the crisis of a social nature, which indicated that the most severe, widespread and dangerous social crisis are those generated by low living standards and unsolved social problems; they are the basis of serious social conflicts that arise between citizens and authorities, therefore the most appropriate and relevant is the study of the crisis is socio-economic nature and development of mechanisms of state regulation of these phenomena. Calculations to determine the socio-economic situation in the regions of Ukraine during 2011–2013 and calculation of threats socioeconomic second – fourth quarter of 2014 and first quarter of 2015 according to the first quarter of 2014 revealed the preconditions for social conflict escalation economic grounds. Determined that the reasons for ethnic proximity eastern region of Ukraine with the «aggressor country», information-psychological influence was dominant in this region of the state, which was the reason for maintaining the separatist movement at the beginning of the armed conflict. It is noted that at present time the public international law and most national constitutions define that in terms of armed conflict public authorities may restrict some liberties in order to restore order and greater use of the most fundamental human rights by introducing emergency legal and administrative regimes. The introduction of emergency powers is governed by three major international and regional human rights treaties, the requirement to comply are clearly spelled out in the constitutions of most countries. Noted that Ukraine must adhere to the International Covenant on Civil and Political Rights and the European Convention on Human Rights. Armed conflicts have a negative impact on the family functioning in general, and especially on the provision of the basic needs of the child, his development and psychological state.According to the UN Children's Fund (UNICEF), as of January 2019, more than 34 million children worldwide living in conditions of conflict or emergencies do not receive the necessary protection. Their largest number is in Yemen (6.6 million people), Syria (5.5 million people), the Democratic Republic of the Congo (4 million people). In the conflict zone in eastern Ukraine, about 500 thousand children need immediate protection and humanitarian assistance.The article further substantiates the need to fundamentally change the anthological paradigm in the study of security concepts (social, human): to move from monism in explaining the relation between the material and the spiritual, as components of the universe, to pluralism. It allows to represent any phenomenon as an organic unification and a dialectical combination of material and ideal, when under certain conditions there is a priority development of one of them, and to substantiate the necessity of forming a new concept of comprehensive "broad" security, in which the environment of the subject, will allow him to make and implement decisions according to his goals, aimed at progressive development.The author of the article also identifies and analyzes the risks for children, possible violations of children's rights during and after an armed conflict. Analysis of the provisions of the Geneva Conventions (1949) and the Additional Protocols thereto (1977), the Convention on the Rights of the Child (1989), the Optional Protocol to the Convention on the Rights of the Child on the Involvement of Children in Armed Conflict (2000), other international acts on the establishment of the protection of the rights of the child in armed conflicts for the purpose of their coherence between themselves and with the norms of international humanitarian law in general is carried out. Measures aimed at improving the mechanism for ensuring the right to child safety and strengthening the protection of children from involvement in armed conflicts are proposed. ; На сьогодні основним змістом безпеки стає захист людини і суспільства, основною стає проблема соціальної безпеки у широкому розумінні, проблема безпеки особи, окремих груп населення, суспільства загалом. Діти – особливо вразлива категорія населення, вони виступають основними суб'єктами та об'єктами системної дискримінації, яка особливо посилюється в умовах збройних конфліктів. Збройні конфлікти негативно впливають на функціонування сім'ї загалом, та особливо на забезпечення основних потреб дитини, її розвиток та психологічний стан.За оцінками Дитячого фонду ООН (ЮНІСЕФ), загалом у світі станом на січень 2019 року не отримують необхідного захисту понад 34 млн. дітей, які живуть в умовах конфліктів або надзвичайних ситуацій. Найбільша їх кількість у Йємені (6,6 млн. осіб), Сирії (5,5 млн. осіб), Демократичній Республіці Конго (4 млн. осіб), у зоні конфлікту на сході України приблизно 500 тисяч дітей потребують невідкладного захисту та гуманітарної допомоги.В статті додатково обґрунтовано, що при вивченні концепцій безпеки (соціальної, людської) необхідно принципово змінити антологічну парадигму – перейти від монізму в поясненні співвідношення матеріального і духовного, як складових універсуму, до плюралізму, що дозволяє представляти будь-яке явище як органічне поєднання і діалектичне сполучення матеріального і ідеального, коли за певних умов має місце пріоритетний розвиток одного з них, та обґрунтувати необхідність формування нової концепції всеосяжної «широкої» безпеки, при якій середовище, в якому знаходиться суб'єкт, дозволить йому приймати і реалізовувати рішення згідно зі своїми цілями, спрямованим на прогресивний розвиток.Автором статті також виокремлюються та аналізуються ризики для дітей, можливі порушення прав дітей під час та після збройного конфлікту. Проводиться аналіз положень Женевських конвенцій 1949 року, Додаткових протоколів до них 1977 року, Конвенції про права дитини 1989 року, Факультативного протоколу до Конвенції про права дитини щодо участі дітей у збройних конфліктах 2000 року, інших міжнародних актів щодо становлення захисту прав дитини у збройних конфліктах на предмет їх узгодженості між собою та з нормами міжнародного гуманітарного права в цілому та пропонуються заходи, спрямовані на вдосконалення механізму забезпечення права на безпеку дитини та посилення захисту дітей від участі у збройних конфліктах.

Проводиться аналіз положень Женевських конвенцій 1949 року, Додаткових протоколів до них 1977 року, Конвенції про права дитини 1989 року, Факультативного протоколу до Конвенції про права дитини щодо участі дітей у збройних конфліктах 2000 року, інших міжнародних актів щодо становлення захисту прав дитини у збройних конфліктах на предмет їх узгодженості між собою та з нормами міжнародного гуманітарного права в цілому та пропонуються заходи, спрямовані на вдосконалення механізму забезпечення права на безпеку дитини та посилення захисту дітей від участі у збройних конфліктах.
Проведено аналіз міжнародно-правових актів сфери захисту культурних цінностей під часзбройних конфліктів. Акцентовано увагу на необхідності вдосконалювання українськогозаконодавства стосовно захисту культурних цінностей відповідно до міжнародних конвенцій. ; The analysis of international laws in the sphere of cultural property protection in time of armed conflicts is conducted. The article is devoted to the analysis of the current legislation in Ukraine concerning journalistic activity. The problem studied concerns legal protection for media workers and their responsibility for violating the law.Action area – is a territory where the lives of journalists, military and civilians are at risk. The military correspondent must be not only erudite and have highly intelligent, but also use his practical and theoretical skills. He must have knowledge that he can protect himself physically and legally.The media with its prevalence informative function performing tasks the information function, is a means of transmittings the news especially from the combat zone to the area of peaceful life. Вesides, they are a social instrument controlling public opinion above the government and state.Сonsequently it is extremely important, that all the information provided should be true not only from moral and ethical considerations, but also from the point of view of the law.All current stage the research of the topic of legal protection of journalists belongs to the actively studied topics. However, there is a demand to consider not only legal protection, but also the journalist's legal responsibility, this topic has not received much attention.For instance, there have been as cases when legal ignorance of some correspondents led to them being charged with such offences as treason and in interference military matters.The Constitution of Ukraine, the nation's fundamental laws, clearly defines the rights and freedoms of each individual. But at the same time the Constitution clearly states that this right may be limited to protect the territorial integrity of the Ukrainian state or national security.Work of the journalist in the zone of active military operations is extremely dangerous. During the Russian-Ukrainian armed conflict a lot of journalists have been captured, killed or subjected to violence. It was clearly an unauthorized limitation of their freedom of movement by the Russian mercenaries and militants of pro-Russian groups. Despite the fact that Russia acts contrary to all international norms and laws it does not reduce legal liability of Russian military forces for the committed crimes.So, it is of paramount importance for every journalist to know the laws and regulations which can defend him/her and which are not to be violated under any circumstance.Key words: armed conflict, military correspondent, legal protection, laws. ; Статтю присвячено аналізу діючого законодавства України, яке стосується журналістської діяльності. The problem of protection of personal rights and human freedoms during armed conflicts is raised. Particular attention is paid to ensuring Protocol I to the Geneva Convention, which states that the parties to any armed conflict must distinguish between civilians and the military and direct their actions only against military objectives. Civilians should be provided with living conditions, as far as possible, and should be protected from murder, violence, stress, repression, destruction of their property and hostage-taking. Their personal rights, honor, dignity and personal integrity must be respected and guaranteed. The aggressor state does not comply with international law, and the Ukrainian security system, in turn, has identified gaps in the organization of rapid evacuation of civilians. As a result, a significant number of citizens remained on the territory of hostilities and were forced to provide themselves with at least a minimum of personal security. Accordingly, it is necessary to study the experience of other countries of the world that have suffered armed aggression in their territories in the context of positive practices of protection of the population, forced to find themselves in the territory of hostilities. The article draws conclusions about the formation of a new security policy and the development of preventive measures to protect the personal rights and freedoms of citizens during armed conflicts
The article is devoted to the study of anti-Soviet resistance in Belarus in the 1920s and 1930s. For the last twenty years this topic has been silenced in the official scientific publications of the Republic of Belarus. Most documents on armed anti-Soviet resistance are kept in the KGB archives, to which a researcher in the Republic of Belarus has limited access. The author analyzes the participation of the Belarusian population in anti-Soviet local armed conflicts. The vast majority of actions of the Bolshevik government brutally violated the traditional way of life, which caused outrage among the Belarusian population, which grew into armed forms of protection of property and dignity. On the basis of archival materials the activity of insurgent detachments is revealed. In the period 1919–1923, 1925–26, 1930–1931. the actions of armed peasants and intellectuals in Soviet Belarus had a clear political context. For the purposes of the insurgent detachments, anti-Soviet units, which fought for the elimination of Soviet power, and Belarusian national units, which sought to create an independent Belarusian state, are nominated - these are the organizations "Biloruske bratstvo", "Za Batkivshchynu", "Zelenyy Dub". They had a military structure, interacted with each other, enjoyed the broad support of the population. They were attended not only by Belarusians but also by Ukrainians, both of local origin and those who found themselves in Belarus. The article shows the fighting destiny of the insurgent leaders Mefodiy Karatkevich, Vasil Shevchenko, Mikhail Bakun, Fyodor Shatsko. On the part of the Soviet authorities, the main method of combating the insurgent movement was to use force. The author concludes that a fairly large part of the population of Belarus did not perceive the Soviet state as their own and interpreted the Bolshevik government as aggressive and not legitimate. The massive anti-Soviet armed resistance ended both under the influence of the transition to a new economic policy and the forced destruction of the most conscious and hardworking part of the Belarusian population.
Кризовий стан України після революції гідності та військова агресія на Сході державизумовлюють нестабільність економіки регіонів, що приймають на себе виклики вимушеноїміграції населення. До демографічного тиску приєднуються таких викликів приєднуєтьсяекономічний спад, слабкість системи публічного управління, недовіра до органів влади танаростання випадків порушення прав людини. Саме таким проблемам присвячена стаття. Авторами здійснюється дослідження крихкості Української держави та її окремих регіонів,зумовленої чинниками збройного конфлікту. З цією метою обґрунтовано методологіюобчислення індексу крихкості регіонів, проведено розрахунки його величини для десяти крихкихобластей України та побудовано рейтинг їх слабкості за період 2013-2017 роки. Аналітичнівисновки авторів узгоджуються з практичними рекомендаціями щодо заходів вирішенняконфлікту та забезпечення стійкості регіонів України у середньостроковій перспективі. ; Ukraine's crisis after the dignity revolution as well as the military aggression in the East of thecountry predetermine the economic instability of the regions, which suffer from the challenges offorced population migration. Demographic pressure is accompanied by such challenges as theeconomic downturn, the weakness of the public administration systems, distrust to the authorities andhuman rights violation. But the most painful losses caused by the armed conflict in the East of Ukraineare the social deprivations, such as: reduction real incomes, growing poverty, rising unemploymentand informal employment, lack of social budget, sharp increasing of forced internal and externalmigration, growth of utility fees. Such issues are investigated in the article. The authors study thefragility of the Ukrainian state and its regions, caused by factors of armed conflict. In order to assessthe impact of the armed conflict in the East of Ukraine on the socio-economic development of some ofits regions, the authors conducted a study on the adaptation of the methodology of the internationalfragility rating of the Fragile States Index countries and evaluated their sustainability based on thecalculation of the integral index of fragility of Ukrainian regions. Its indicators are grouped into fourcategories: cohesion, economic, political, and social. The comparative analysis of the degree offragility of the regions of Ukraine shows that the most critical positions are taken by Donetsk,Luhansk, Lviv and Zakarpattia regions. Transformation of socio-political and economic conditionsaffected their development most of all. Kyiv, Dnipropetrovsk and Kharkiv regions, which havepowerful economic positions and favorable prospects for development, were the most stable to theimpact of the armed conflict in Ukraine. Taking into account the scale of the conflict, mostinternational experts point out that the situation in Ukraine is unique and has no direct analogues inworld practice; therefore, over these years of conflict, Ukraine developed its own problem-solvingmechanism and can share its experience. However our country continues to seek new forms and toolsof social and economic recovery of the affected regions and the socialization of internal migrants. Tothis end, the methodology for calculating the regional fragility index has been elaborated. The indexhas been calculated for ten fragile regions of Ukraine, the rating of their weakness for the period2013-2017 has been constructed. Analytical findings of the authors are in line with practicalrecommendations on measures to resolve the conflict and ensure the stability of the regions of Ukrainein the medium term.
