PORTUGUÊS: O presente artigo trata do problema da relação entre justiça e política nas cidades italianas do final da Idade Média. Trata-se, especificamente, de determinar a maneira como as práticas judiciárias citadinas e a reflexão de determinados juristas, em particular no que tange a questões penais, se encontraram no centro da legitimação de novos atores políticos e de novas configurações institucionais em um momento de grandes transformações políticas das cidades italianas no final da Idade Média / ENGLISH: The present article deals with the problem of the relationship between justice and politics in Italian cities in the end of the Middle Ages. It is specifically about determining the way the judicial practices of the city and the reflection of particular jurists, especially in the ambit of penal issues, found themselves in the center of the legalization of new political actors and of new institutional order in a moment of great political changes of the Italian cities in the end of the Middle Ages.

In questo intervento l'autore si concentra sulle città italiane di tradizione comunale in un arco cronologico che, grosso modo, va dalla seconda metà del secolo XIII alla prima del successivo. Fu, questo, un periodo caratterizzato da un mutamento profondo dei gruppi dirigenti e dei regimi politici urbani. Al centro di questa trasformazione furono posti i sistemi giudiziari e la dimensione giuridica, che costituirono le risorse fondamentali della lotta politica di quegli anni. L'assunto può apparire generico. Il rapporto tra giustizia e politica è da sempre, infatti, uno dei nessi delle relazioni di potere, e determina le pratiche sociali e politiche di ogni società storica. Per restare al secolo XIII basterà ricordare la centralità che esso assunse nella definizione della sovranità imperiale di Federico II. Ma nelle città comunali, nella fase di affermazione sul piano politico dei gruppi sociali appartenenti al mondo degli affari, della mercatura e delle corporazioni, che cominciò ad attuarsi in molte città nella seconda metà del Duecento, questo nesso, mai come prima fu assunto sistematicamente, fu al centro della competizione per il potere, fu elaborato ideologicamente. La giustizia - e, in particolare, la giustizia cresciuta intorno al penale - e la riflessione dottrinaria servirono infatti il processo di affermazione politica di nuovi gruppi sociali e familiari e di legittimazione dei nuovi assetti di potere - delle nuove configurazioni istituzionali, vale a dire, assunte dai regimi politici urbani italiani, indifferentemente in ciò, se svolgimenti a 'popolo' o soluzioni signorili. Da qui queste riflessioni odierne, che si inquadrano in una ricerca sui sistemi giudiziari e sui regimi politici nelle città comunali italiane tra XIII e XIV secolo. La relazione è articolata in due parti: la prima (paragrafi 2-4) - che si potrebbe titolare "l'officina della prassi" - sarà dedicata a un'analisi delle pratiche giudiziarie cittadine; la seconda (paragrafo 5) - che si riferisce invece al "laboratorio sapienziale" - si concentrerà sul ruolo che un paio di generazioni di giuristi, sia pratici sia dottori, si trovarono a svolgere in quegli anni nel vivo delle trasformazioni sociali e politiche.

Criminalité et justice à Florence à la fin du Moyen Age ont été l'objet ces dernières années d'une attention renouvelée. On peut percevoir, pendant la période qui va de l'apogée communal de la fin du XIIIesiècle au début de l'affirmation des régimes oligarchiques vers la fin du XIVesiècle, la limitation progressive de l'action judiciaire exercée par la communauté — telle qu'elle s'exprimait à propos des litiges en son sein par le compromis arbitral desboni et savi homines; inversement se dessine à la fois une pénalisation des comportements et un renforcement de l'autorité judiciaire publique.

Particularly reffering to the digital work named Atlante della documentazione comunale, the research centered on the series of council decisions books, the only ones (among those produced before 1343) that survived until nowadays in a continuous form, and was focused upon legislation regarding Florentine magnates. This matter turned out to be an excellent perspective allowing to reconstruct the communal normative system, that in Florence got a crucial qualitative leap in the development of all its political and cultural potentialities at the time when new "popolo" government took the power, in 1280's.

The European Union (EU) Water Framework Directive (WFD, 2000/60/EC), which came into force in Italy under Decree Law no. 152 of 3rd April 2006, has as its objectives the protection and improvement of aquatic ecosystem status, promoting the sustainable use of water resources and mitigating the effects of floods and droughts. According to this Directive, the ecological classification of a watercourse should be considered in addition to physical-chemical and biological aspects of its hydromorphological condition, in order to define the deviation of the present condition from a pre-defined reference state. The Italian National Institute for Environmental Protection and Research has promoted a methodology called IDRAIM for the hydromorphological analysis of streams. This is an integrated approach aimed at implementing both WFD and EU Flood Directives (2007/60/EC). In this paper, we describe the application of the morphological quality index (MQI) protocol, which is part of the IDRAIM, used for evaluating the morphological quality of the Cordevole River, Province of Belluno, northeastern Italy. General settings and segmentation of the water network through the use of semi-automatic GIS techniques were presented. The MQI data derived from the application of 28 indicators in 42 reaches were then analysed. Most (48%) of the analysed reaches have a good quality status; 38% have a moderate quality status and poor morphological conditions (14%) are due to the presence of artificial elements and to the limited connectivity between hill-slopes and the river corridor.

This book is a collection of contributions by the Italian scholarship fellows at the Deutsches Historisches Institut of Rome over the last decade. It is intended as a tribute to one of the leading mediaevalists at international level, a scrupulous and sensitive scholar of Italian history. Over and above all this, it is a sign of gratitude from the young academics who have been able to consolidate their research thanks to such scholarships. Consequently the 14 contributions that make up the book do not share the academic orientation of any particular school, but range over various research sectors and different chronological periods. - Il volume, che raccoglie i contributi di ex borsisti italiani dell'ultimo decennio del Deutsches Historisches Institut di Roma, vuole essere un omaggio a uno dei medievisti più noti a livello internazionale e all'attento e sensibile studioso della storia italiana, ma soprattutto un segno di gratitudine di giovani studiosi che con tale borsa hanno potuto consolidare i loro percorsi di ricerca. I 14 contributi che lo compongono non sono quindi accomunati da un comune orientamento formativo di scuola, ma spaziano fra diversi settori di ricerca e differenti ambiti cronologici.
