Ponencia presentada al IX Simposio de Derecho histórico y autonómico de los territorios de Vasconia, dedicado a «Vasconia en el primer constitucionalismo español (1808-1814)». ; La ponencia describe en una primera parte los antecedentes políticos e institucionales que condicionaron la actuación de los representantes vascos en la asamblea de Bayona, tanto la evolución del sistema foral en el siglo XVIII, como la conmoción que produjo la Guerra de la Convención entre la Monarquía española y la República francesa, con las secuelas de la nueva política hostil de Godoy respecto de los Fueros vasco-navarros. Examina los contrapuestos planteamientos ideológicos respecto del régimen foral, personificados en Larramendi, exponente del modo de pensar de las provincias, y Llorente, portavoz del despotismo absolutista ilustrado. This includes the evolution of the system of 'Fueros' in the 18th century, as well as the commotion and unrest that was caused by the War of Convention between the Spanish monarchy and the French Republic, with the consequences of Godoy's political hostility towards the Basque and Navarrese 'Fueros'. It explores the opposing ideologies with regards to the 'régimen foral' (the body of institutions and code of laws of an autonomous administration) embodied by Larramendi, an exponent of the provincial way of thinking, and Llorente, the spokesperson for the absolutist despotism that has been previously alluded to. The second part of the paper deals with the political situation in each of the provinces at the time the assembly was called, and the co-operative disposition of the representatives towards Napoleon and José I at the Bayonne Assembly. They were rewarded with Article 144 of the Constitution, which preserved the 'Fueros', albeit on a provisional basis.

Ponencia presentada al X Simposio de Derecho Histórico y Autonómico de los territorios de Vasconia dedicado al "Constitucionalismo liberal y constituciones históricas propias de los territorios de Vasconia (1812-1876)". ; El 31 de agosto de 1839 se firmó en Bergara un Convenio entre loos generales Espartero y Maroto que finalizó la guerra carlista con un compromiso de reconocimiento de los Fueros Vascos. Con esa finalidad el Gobierno de Madrid presentó de inmediato en las Cortes un proyecto de Ley que confirmaba provisionalmente los Fueros pero con la obligación de presentar otro proyecto de ley ulterior de modificación para adaptarlos a la Constitución del Estado de 1837. El proyecto gubernamental, al carecer el Ejecutivo de mayoría en la Cámara, fue alterado en Comisión y posteriormente enmendado de manera más severa por un grupo de diputados. Así y todo, como consecuencia del desarrollo del debate en el pleno, el Gobierno consiguió preservar lo fundamental del proyecto inicial, si bien con el añadido de que la confirmación de los Fueros se realizaría «sin perjuicio de la unidad constitucional». En el Senado se mantuvo el texto votado en el Congreso. For this purpose immediately the Madrid Government introduced in the courts a draft law that provisionally confirmed charters but with the obligation to submit another modification further bill to adapt them to the Constitution of 1837. The Government project, in the absence of the Executive's majority in the House, was altered in Committee and subsequently amended in a more severe way by a group of Deputies. As well and all, as a result of the development of the debate in the plenary, the Government managed to preserve the essence of the initial project, albeit with the added that the confirmation of the charters would be made «without prejudice to the constitutional unit». The Law was enacted on October 25, 1839.

Ponencia presentada en el XI Symposium celebrado en Donostia-San Sebastián en el mes de noviembre de 2012, dedicado al tránsito del autogobierno foral a la autonomía constitucional entre 1876 y 1936. ; Los Fueros de Álava, Gipuzkoa y Bizkaia persistieron entre 1844 y 1876. El liberalismo español utilizó una hipotética vinculación entre las instituciones forales vascas y la insurrección carlista para extender la unidad constitucional, acometiendo una reforma drástica del servicio militar, de la fiscalidad, y la reducción de los poderes de las Juntas Generales y Diputaciones. En la reforma, el Presidente del Gobierno Cánovas pretendió atenerse al procedimiento previsto en la Ley de Fueros de 1839 convocando a los comisionados de las Provincias vascas, sin ningún resultado. El proyecto de nueva ley suscitó una fuerte división en el seno del liberalismo español, entre la minoría constitucionalista partidaria de la abolición total los Fueros, y la mayoría del partido liberal-conservador de Cánovas que pretendía mantener, tras una negociación, algunas pecualiaridades en el orden fiscal y administrativo. El proyecto del Gobierno fue retocado en el paso por el Senado. Se produjo un intenso debate en el Congreso entre los diputados vascos, los constitucionalistas y el partido del Gobierno. La Ley de 21 de julio de 1876 terminó con un ciclo multisecular de autogobierno vasco. ; Araba, Gipuzkoa eta Bizkaiko foruek 1844 eta 1876 bitartean jarraitu zuten. The Spanish Liberalism used a hypothetical link between the Basque foral institutions and the Carlist insurrection to extend constitutional unity, undertaking drastic reform of military service, taxation, and reducing the powers of the General Councils and Councils. In the reform, the Prime Minister Cánovas sought to follow the procedure laid down in the 1839 Foral law by summoning the commissioners of the Basque Provinces, without any result. The new law's draft provoked a strong division in the Spanish liberalism between constitutionalist minority which was for Jurisdictions' total abolition and the Canovas' party's liberal-conservative mayority who pursued to maintain, after a negotiation, some singularities in fiscal and administrative order. The Government's project was altered in the Senate. There was an intense debate in Congress between the Basque deputies, the Constitutionalists, and the ruling party. The Law of July 21, 1876 ended with a centuried Basque self-government.

Ponencia presentada al XII Simposio de Derecho histórico y autonómico de los territorios de Vasconia, dedicado a la evolución del autogobierno entre la Guerra Civil y la aprobación de la Constitución española de 1978. ; Tras examinar la reivindicación de los derechos históricos vascos durante la Restauración y la Segunda República, el trabajo se centra en su tratamiento en la Constitución de 1978. La propuesta inicial del PNV de un pacto con la Corona quedó convertida por los partidos del consenso (UCD, PSOE, Alianza Popular, PC y CIU) en una disposición de alcance más limitado. La actualización de tales derechos se verificaría en el Estatuto de Autonomía y aceptando el marco constitucional. El trabajo describe el azaroso proceso negociador del PNV y de la UCD en la Comisión y en el Pleno, tanto del Congreso como del Senado. En esta última cámara el Grupo de Senadores Vascos consiguió incorporar, con apoyo socialista, una enmienda distinta sobre esta materia en el dictamen constitucional, pero la UCD confirmó en el Pleno del Senado la vigencia de la propuesta del consenso, que es la que hoy rige como Disposición Adicional primera de la Constitución. ; Lanak, euskal eskubide historikoen aldarrikapena Berrezarkuntzan eta Bigarren Errepublikan aztertu ondoren, 1978ko Konstituzioan duten trataeran zentratzen da. PNV's initial proposal of a pact with the Crown was converted by consensus parties (UCD, PSOE, Alianza Popular, PC and CIU) in a more limited range provision. The update of these rights would be verified by the Statute of Autonomy by accepting the constitutional framework. The paper describes the hazardous negotiating process between PNV and UCD in the Commission and in Congress' and the Senate's Plenaries. In this last chamber Basque Group Senators incorporated, with Socialist support, a separate amendment on constitutional opinion on this matter, but the UCD confirmed in the Senate the validity of the agreement proposal, which is currently known as first Additional Provision of the Constitution.

El texto examina algunos hitos significativos del devenir de la foralidad de Derecho público de los territorios de Vasconia en los siglos XIX y XX. Con dicho examen se intenta discernir el elemento más característico de la cultura foral. En concreto, si la foralidad consiste en una suma de instituciones tradicionales susceptibles de actualización o si el la relevancia de los derechos históricos descansa en la atribución al sujeto titular de una auténtica capacidad constituyente, si bien limitada por la aceptación de la unidad política del Estado. En la perspectiva de la relación entre la Constitución del Estado y los Fueros vascos, el texto distingue cuatro fases: la época foral propiamente dicha que culmina en 1839 y 1841, el período neoforal que llega hasta 1876, y la fase de los Conciertos Económicos, suprimidos en 1936 en Bizkaia y en Gipuzkoa. Concluye con lo acontecido en el proceso constituyente que se inició con la Transición. Entonces se formuló la Disposición Adicional Primera de la actual Constitución que reconoció de manera atenuada los derechos históricos de los territorios de Vasconia y que ha sido objeto, a su vez, de una singular interpretación jurisprudencial. ; Testuak XIX. eta XX. mendeetan Baskoniako lurraldeetako zuzenbide publikoko foraltasunaren bilakaeran izandako mugarri esanguratsu batzuk aztertzen ditu. Said review attempts to discern the most characteristic element of regional law culture. More particularly, if regional law culture consists of a sum of traditional institutions subject to update, or if the relevance of historic rights rests on the attribution to their bearer of genuine constitutional capacity – although this may be limited by acceptance of the State's political unity. In terms of the relationship between the State Constitution and Basque Regional Law, the text distinguishes four phases: the 'Foral' or 'Regional Law' era itself, which culminates between 1839 and 1841, the 'Neoforal' period that goes up to 1876, and the period of Economic Agreements o 'Conciertos Económicos', removed in 1936 in Biscay and in Gipuzkoa. It concludes with the happenings of the constituent process that started with the Transition to democracy. That was when the First Additional Provision of the Current Constitution was formulated, which recognised, in a tempered way, the historical rights of the territories of the Basque Country and which has likewise been subject to a singular case law interpretation.

Ponencia presentada en el VII Symposio de Derecho histórico de los territorios de Vasconia: La fiscalidad, celebrado en Donostia/San Sebastián, 11 y 12 de diciembre de 2008. ; Tras la abolición foral producida en la última guerra carlista (1872-1876), el Presidente del Gobierno Central Cánovas del Castillo negoció un Concierto Económico con la Diputación de Bizkaia (1878), al que se adhirieron las Diputaciones de Álava y Gipuzkoa. Se preservaba así un importante residuo de la foralidad. Consistió en fijar en cada una de las provincias una cantidad alzada de ingresos para el Estado respecto de cada uno de los grandes impuestos. Al conjunto de las aportaciones a realizar al Gobierno Central se le denominaría cupo. El Concierto histórico fue renovado en 1887, 1894, 1906 y 1925. El régimen de Franco suprimió la institución en Bizkaia y Gipuzkoa (1937), pero la mantuvo en Álava, donde fue renovado en 1952 y 1976. Con la llegada de la democracia, el Concierto Económico fue recuperado en el Estatuto de Autonomía de Gernika (1979) y se desarrolló normativamente en la Ley 12/1981, de 13 de mayo. Gerora, Kontzertu Ekonomiko berria berritu egin dute, Fernando de la Huchak bere hitzaldian azalduko duen bezala. ; Following the abolition of the charters during the Carlist war (1872-1876), the President of the Central Government, Cánovas del Castillo, negotiated an Economic Accord with the Provincial Council of Vizcaya (1878), which was subsequently joined by the provincial councils of Álava and Guipúzcoa. This preserved an important residue of the region's special status and consisted of establishing a specific sum for each of the provinces raised for the state in relation to each of the major taxes. The total sum of the contributions to be paid to the central government was known as the quota. The historical Accord was renewed in 1887, 1894, 1906 and 1925. The Franco regime abolished the institution in Vizkaya and Guizpúzcoa (1937) but maintained it in Álava, where it was renewed in 1952 and 1976. With the arrival of democracy, the Economic Accord was reinstated in the Guernica Statute of Autonomy (1979) and legally articulated via Law 12/1981, of 13 May. Since then the new Economic Accord has been renewed, as shall be seen in Fernando de la Hucha's presentation.
