Die Debatte um Menschenrechte ist eng verwoben mit der Genese des sogenannten humanitären Kriegsvölkerrecht, also der Idee, dem Krieg Regeln aufzuzwingen. Das Konzept von "Crimes against Humanity", erstmals angewandt vom Internationalen Militärgerichtshof in Nürnberg 1945, spiegelt dies auf eindrucksvolle Weise wider. Weitgehend unbekannt ist, dass diese Konzepte 1945 nicht neu waren, sondern den Schlusspunkt von fast hundert Jahren Debatten darstellten. Die historische Vorgeschichte der juristischen "Erfolgsstory", insbesondere aber die Protagonisten und Vordenker, sollen in diesem Vortrag analysiert und gewürdigt werden. Vom Lieber Code des Amerikanischen Bürgerkriegs über die Haager Friedenskonferenzen, vom "Carnegie Endowment for Peace" 1910 bis zu den Juristen in Versailles und, während des Zweiten Weltkriegs, in der "United Nations War Crimes Commission" , reicht der Blick, der aus dem Blickwinkel der Historikerin der Frage nachgeht, unter welch schwierigen Vorzeichen der Durchbruch des humanitären Völkerrechts - und mit ihm der Menschenrechte - schließlich gelingen konnte.

This article addresses the normative framework of the concept of "crimes against humanity" from the perspective of intellectual history, by scrutinizing legal debates of marginalized (and exiled) academic–juridical actors within the United Nations War Crimes Commission (UNWCC). Decisive for its successful implementation were two factors: the growing scale of mass violence against civilians during the Second World War, and the strong support and advocacy of "peripheral actors," jurists forced into exile in London by the war. These jurists included representatives of smaller Allied countries from around the world, who used the commission's work to push for a codification of international law, which finally materialized during the London Conference of August 1945. This article studies the process of mediation and the emergence of legal concepts. It thereby introduces the concept of "legal flows" to highlight the different strands and older traditions of humanitarian law involved in coining new law. The experience of exile is shown to have had a significant constitutive function in the globalization of a concept (that of "crimes against humanity").

Um die Gräueltaten des Zweiten Weltkrieges zu sühnen, fanden in Europa und Asien nach 1945 mehrere Tausend Kriegsverbrecherprozesse statt. Nicht selten jedoch waren die Verfahren weniger dem Streben nach Gerechtigkeit als politischen Interessen gezollt. Das zeigt sich vor allem an ostasiatischen Kriegsverbrecherpro zessen im Kontext von Dekolonisierung und Kaltem Krieg. Heidelberger Historiker erforschen die Wechselwirkungen zwischen Asien und Europa im Rahmen der Prozesse und analysieren die weitreichenden Folgen der ambivalenten Rechtsprechungen.

In Nürnberg formulierten die Alliierten 1945 erstmals das völkerrechtliche Prinzip, dass allgemeine Menschenrechte über nationalem Recht stehen. Damit wurde es möglich, staatlich sanktionierte Verbrechen zu ahnden – in diesem Fall die deutschen Verbrechen der NS-Zeit und des Zweiten Weltkriegs. Seit den 1990er-Jahren haben diverse vergleichbare Prozesse stattgefunden, etwa zu den Ereignissen in Jugoslawien, Ruanda und Kambodscha. Dass das Führungspersonal eines Landes für Kriegsverbrechen und "Verbrechen gegen die Menschlichkeit" strafrechtlich belangt werden kann, war im 20. Jahrhundert stark umkämpft und ist bis heute nicht vollständig durchgesetzt. Der Aufsatz stellt die drei wichtigsten Etappen im Überblick dar: die Leipziger Prozesse nach dem Ersten Weltkrieg, die Prozesse von Nürnberg und Tokio nach dem Zweiten Weltkrieg sowie die Debatte um die Entstehung des Internationalen Strafgerichtshofs in Den Haag zu Beginn des 21. Jahrhunderts. Strittig war und ist vor allem, inwieweit auch Großmächte wie die USA bereit sind, universellen Menschenrechten und einer supranationalen Autorität gegenüber herkömmlichen nationalen Souveränitätsrechten einen Vorrang einzuräumen. ; In 1945 in Nuremberg, the Allies advocated the new principle that human rights take precedence over national law, according to the idea that states should be held accountable for their deeds by means of justice. In this case, Nazi Germany was to be held responsible for crimes committed during the Second World War. Since the mid-1990s, further trials based on this rule have taken place in Rwanda, Yugoslavia and Cambodia. The trial of state elites for war crimes and 'crimes against humanity' in court has been very controversial and is still not accepted in many parts of the world today. This article presents the three main stages leading to transitional justice: first, the failed trials in Leipzig after the First World War; second, the International Military Tribunals in Nuremberg and Tokyo; third, the debate about the ratification of the International Criminal Court in Den Haag and the strong opposition to it in the USA, which has continued since 2002. Criticism focuses on the degree to which states are prepared to hand over parts of their national sovereignty, especially in justice, to supranational organisations.

Zusammenfassung
Am Fall des SS-Obergruppenführers und Generals der Waffen SS, Karl Wolff, der mit Allen Dulles die deutsche Kapitulation in der Schweiz verhandelte und dafür vor Strafverfolgung geschützt wurde, lässt sich beispielhaft zeigen, wie im Zerfallsprozess der alliierten Allianz zu Kriegsende politische Erwägungen zu dominieren begannen, die dann im Kalten Krieg direkten Einfluss auf die Strafverfolgungsmechanismen ausübten. Exemplarisch wird hier eine wichtige Facette der westalliierten Kriegs- und Nachkriegsstrategie deutlich, die statt »unconditional surrender« eher auf »unconditional agreements« setzte. Die Ergebnisse im Fall Wolff zeigen, dass die Kriegsverbrecherpolitik hinter politischen Erwägungen rangierte und zur Erreichung eigener strategischer oder politischer Ziele auch Kompromisse denkbar waren, die der offiziellen politischen Linie der Westmächte widersprachen und auf der Basis ideologischer Übereinstimmungen mit den deutschen Kriegsgegnern und gegen Stalin getroffen wurden.

AbstractWhen considering the wave of forced migrations during the Second World War in Europe and Asia, and the international and institutional responses thereof, we can speak about the 1940s as witnessing the birth of a global refugee resettlement regime. Organisations including the United Nations Relief and Rehabilitation Administration (UNRRA), the International Refugee Organization (IRO), and eventually the United Nations High Commissioner for Refugees (UNHCR) placed refugee resettlement at the heart of constructing the postwar world order. This volume adopts a global optic to investigate the formation of this international resettlement regime in Europe and Asia, while also studying refugee camps and movements, agency of refugees and migrants, decision factors for resettlement, and the intellectual production of people on the move. A historicisation of the global resettlement regime of the long 1940s may well carry important political and ethical lessons for us today, if only to remind us of the connected fates of our common humanity, and the responsibilities we therefore bear towards our fellow human beings.

In recent years, there has been a deepening convergence between scholarship on global intellectual history and on legal history. To take just one example, a recent book on international law, by Arnulf Becker Lorca (2014), carries "global intellectual history" in its subtitle—a stance related to the author's emphasis on the constitutive role in the field of non-European legal actors. A sustained reflection on the convergence between legal studies and global intellectual history, however, still remains a desideratum, at least in the sense that we do not yet have even a basic platform where scholars with different space/time and (trans-) cultural specialization come together to reflect on how studying legal concepts gains from global intellectual history. This forum, which results from a conference organized at Heidelberg University in 2016, attempts a preliminary intervention here. The introductory remarks are not meant to be conclusive; they invite responses.
