This thesis investigates presumptive effects of the political participation on the economic growth through social capital accumulation. In the second section, by using an endogenous growth model, we examine the issue with a comparison of two economic systems; decentralized and centralized economy in the latter of which the representative household internalizes all externalities in social, productive and private sector, in contrast to the decentralized economy. In the third section, we approach the same point by adopting an efficient bargaining model in which we assume that average level of the political participation is a contributor to the labour union's bargaining strength. Upon this approach, we develop a comparative analysis by solving the representative household optimization problem in two different scenarios, with and without efficient wage hypothesis. We demonstrate that there exists an effect of the political participation resulting in a positive stationary growth rate in all models. Moreover, we found the average level of political participation to be correlated with the bargained wage rate and the bargained employment rate under the ef- ficient wage hypothesis.
open ; Rational-choice explanations of institutional change are generally considered the prototype of the individualistic research programme. The first aim of the paper is to demonstrate that this claim is not warranted. It is not so if the phenomena to be explained are defined from the external point of view of social efficiency: in this case, individualism is transformed into functionalism and the notions of its toolbox are turned into elements of an objective teleology. When considered from the point of view of the individuals involved in their construction, institutions can be conceived as repeated cooperation schemes devised by some of these individuals (the proposers) as the best means to tackle the mutual dependences in which they find themselves and achieve some of their goals, and adopted in mutual agreement with their counterparts (the receivers) because convenient for them too, given their own particular interests. The second aim of the paper is to develop a bargaining model based upon this idea. The proposed model shows, among other things, that when bargaining concerns the adoption of repeated cooperation schemes (i.e. of institutions, according to my definition), it is in the interest of the proposers to get to correct (or so considered) beliefs and to communicate them to the counterpart sincerely. Moreover, when bargaining consists in choosing one scheme among others, it is possible that some will agree to it despite the fact that they are not better-off with respect to the initial situation. The aim of this work is to present and investigate a model that departs from three considerations. First, fiscal policy and debt sustainability are two sides of the same coin: the former is the policy instrument that government manages in the present time to achieve its social objectives, whereas, the latter is the repercussion of the former in the long run. Second, fiscal policy has a direct impact on industries capital accumulation because it affects the available income and, therefore, their savings; such an impact can be evaluated through the intertemporal optimization of industries saving decisions. Finally, fiscal policy has to be characterized on both the revenue and the spending side: revenues are determined through a unique tax rate, while spending is represented as an industry-based subsidy with a fixed fraction, Φ, that must be re-invested in capital. The production function in each industry is assumed AK and investment is subjected to quadratic adjustment costs. The consequences of assuming a convex adjustment cost function are twofold: the model does not display growth in the long run and the invested capital due to the public incentivization program hyper-crowds out private saving, consequently the optimal Φ is 0. Another advantage, due to the simplicity of the framework, is that the notion of debt sustainability, contrary to the majority of literature on fiscal policy sustainability, is defined unambiguously therefore it is always possible to determine whether a certain public debt can be sustained. In section 4, the model is solved as a Nash bargaining problem by assuming an explicit welfare function and it is found that the optimal government size results undetermined whenever the optimal Φ is 0. However, in the conclusions, it is proposed a way to modify slightly the model in order to overcome the problem of the hyper-crowding-out and letting the designed public program of capital incentivization work effectively.
This paper estimates the extent of downward wage rigidity in Italy using a micro-econometric model and the recently released WHIP longitudinal data. The econometric approach distinguishes between downward nominal wage rigidity – i.e., the impediment to nominal wage cuts – and downward real wage rigidity – i.e., when nominal wages cannot grow by less than a minimum positive threshold. The model accounts for measurement error and flexibly specifies the counterfactual, rigidity-free wage change distribution. The period analyzed goes from the mid eighties to the end of the century, within which the 1992-1993 income agreements – with the abolition of the scala mobile – are situated. Overall, downward wage rigidity impacts on about 70% of the observations. However, in the periods following the income agreements, the impact of wage rigidity is reduced, in particular with regards to real rigidities (with a slight increase in nominal rigidities). In each sub-period, however, real rigidities prevail over nominal rigidities

Il presente lavoro analizza la legislazione statunitense in materia di contrattazione collettiva sin dall'emanazione del Wagner Act nel 1935. Al riguardo, vengono discusse le regole per il riconoscimento dei sindacati nei luoghi di lavoro e per la stipula degli accordi collettivi (principio di maggioranza e rappresentanza esclusiva, obbligo di negoziare secondo buona fede) e per la gestione del conflitto industriale (arbitrato e clausola di tregua): sulla scorta di un approccio storico-critico e dei leading case giurisprudenzialil'articolosottolineailcarattereprettamenteaziendaleeprivatisticodellerelazioniindustriali statunitensi; inoltre, si descrivono le recenti strategie sindacali alternative al modello prefigurato dal Wagner Act (ad es., l'azione dei worker center) e si analizza a titolo esemplificativo l'ultimo rinnovo contrattuale negli stabilimenti Chrysler. ; COLLECTIVE BARGAINING IN THE USA. Specifically, it analyses the rules for union recognition in the workplace and for collective bargaining (majority rule and exclusive representation, duty to bargain in good faith) and for managing industrial strike action (arbitration and peace clause): using a historical-critical approach and discussing several leading cases, the paper presents clear evidence of a decentralized bargaining pattern and a privatized system of labour justice in the U.S.A. To conclude, it examines current trade unions strategies alternative to the model designed by the Wagner Act (i.e., worker centers), describing the latest contract renewal between UAW and FCA for the Chrysler plants in the U.S.A. as an example case.
Il presente elaborato analizza il complesso fenomeno del welfare occupazionale nell'ambito della conclamata crisi del moderno Stato sociale. Dapprima, ci si soffermerà sulla genesi del fenomeno, e, nello specifico, sul mutato contesto istituzionale e sociale da cui esso trae origine: allo studio dei principali modelli di welfare state e alla loro ricostruzione storica, si affiancherà l'osservazione delle possibili concause che hanno determinato, nel tempo, l'insorgere di forme di welfare integrativo, parallele, se non anche alternative, a quelle garantite, in via principale, dallo Stato centrale. Nel prosieguo si darà conto della crescente rilevanza assunta dal welfare occupazionale nel contesto politico e aziendale europeo e nazionale, attraverso l'analisi dei più recenti studi sul tema e dei provvedimenti adottati dal Legislatore italiano e dalle parti sociali nell'ultima stagione di rinnovo contrattuale. Al termine della ricostruzione normativa, si procederà alla lettura del fenomeno secondo tre differenti indirizzi interpretativi, con lo scopo di evidenziare le opportunità e i limiti derivanti dall'adozione di un diverso modello di solidarietà sociale e le sue possibili strategie di sviluppo nei diversi ambiti di applicazione. Sulla scorta di tali considerazioni, infine, si collocherà il fenomeno oggetto di studio nel più ampio processo di "innovazione sociale" che investe, pur con marcate criticità, le società contemporanee avanzate: in tal senso, dall'analisi di esempi virtuosi di collaborazione fra diversi attori istituzionali, pubblici e privati, si giungerà ad affermare l'importanza di inquadrare il welfare occupazionale in sistemi circolari e partecipati di gestione del rischio sociale per la creazione di un benessere diffuso e duraturo, che si sviluppi oltre il perimetro aziendale e con la collaborazione di tutta la comunità. ; This study aims to describe the phenomenon of occupational welfare against the backdrop of the crisis and the transformation of the modern Western welfare state. First of all, we will focus on the genesis of the phenomenon, and, specifically, on the emergence of new social risks that have deeply transformed the institutional and social pattern since the Fordist revolution: beside the study of the main welfare state models and their historical reconstruction, we will observe the possible contributing causes that have determined, over time, the gradual retrenchment of welfare state and the rise of different forms of supplementary welfare. Then, we will zoom in on the growing importance of occupational welfare in the European and national political and business context, through the analysis of the most recent studies on the issue and the measures adopted by the Italian legislator and the social partners in the last collective bargaining season. At the end of the normative reconstruction, the phenomenon will be read according to three different interpretative outlooks, with the aim of highlight limits and opportunities deriving from the adoption of a different model of social solidarity and its possible development strategies in the various fields of application. Ultimately, on the basis of these considerations, we will look at the phenomenon under a broader perspective of "social innovation": by this expression, we define the process encompassing socially innovative policies and actions aimed at overcoming poverty and social exclusion, through a reconfiguration of social and political relations. Moving from the analysis of some virtuous examples of dialectical interplay between public and private institutional actors, the paper concludes stating the importance of embedding occupational welfare in a broader circular and participatory systems of social risk management, through which develop and maximize social well-being, even beyond company policies.
In un articolo del 1984 M. Pohjola ha introdotto nel modello di Lancaster la considerazione della contrattazione fra capitalisti e lavoratori nella analisi della relazione fra distribuzione del reddito e accumulazione del capitale in termini di un gioco differenziale. Lo scopo del nostro lavoro è quello di estendere l'analisi di Pohjola al caso in cui i lavoratori possono decidere di risparmiare e quindi di accumulare capitale per analizzarne le conseguenze sull'equilibrio non cooperativo del corrispondente gioco differenziale. In his paper of 1984 M. Pohjola generalized Lancaster's model of capitalism as a differential game by considering the bargaining process between capitalists and workers in the analysis of the relationship between income distribution and capital accumulation. Our contribution aims to extend his model by introducing the possibility of saving for the workers and its consequences on the noncooperative equilibrium of the correspondin differential game.
This article explores the possibility of applying the tools of economic analysis of law, which are traditionally used in the field of private law, to public law as well. The first part investigates constitutional law issues, addressed by prevailing approaches through the social contract framework, by applying an agreement model to a general public good such as the State. This model is typically based on games with features of the 'prisoner's dilemma.' Through the analysis of constitutional preferences that may transform such dilemma in a game with full cooperation equilibrium, two types of preferences are compared: 'utilitarian based on impartiality principle' & 'rawlsian based on difference principle'; it is shown that this second type better facilitates the constitutional agreement. With the objective of utilizing more easily economic theory tools, the article then attempts to apply the distinction between private & public good to that between private & public rights. In particular, both public goods & public rights can be assimilated as they are non-excludable & non-transferable through exchanges or contracts. Moreover, an attempt is made to define an economic counterpart to the juridical notion of 'general interest' which is the basis for those norms in the fields of public & administrative law envisaging the direct intervention of the State to remedy market failures, both at constitutional & sub-constitutional level. Hence the question of what are the most efficient legal procedures to solve such problems is addressed. Using above all the case of negative externalities related to private goods, the article discusses in particular when it is more efficient to resort to administrative interventions rather than judicial ones; or otherwise allowing such problems to be dealt with through private bargaining between injured & injurers. In this respect the latest literature of economic analysis of law often favors private bargaining in the spirit of Coase's thinking. However, it is here put forward that in terms of cost-benefit analysis economic theory reaches much less radical conclusions often supporting the higher efficiency of legal rules & administrative types of intervention. In the final part of the article, different legal systems (minimal, neoliberal, welfarist) are compared by way of analyzing their rationale & limitations from an efficiency point of view. Public employment is an interesting case study because it is one of the few sectors in which unions maintain a strong membership and are able to contrast sector reform policies. In this work, after a theoretical framework and a few words about the attempts to reform proposed by Renzi government, we are dealing with empirical evidence on the socio-demographic transformations of the public over the early 2000s, on the unionization of public sector, on the electoral support in the elections of union representatives, despite the adoption of moderate contractual strategies. The final part of the essay describes the specific italian 'supply model', observing that the confederal, pluralistic and multitasking pattern of CGIL, CISL and UIL are the main factors that explain its (relative) success. ; Il pubblico impiego rappresenta una caso di studio particolarmente interessante perché è uno dei pochi settori in cui i sindacati mantengono una forte membership e sono in grado di contrastare le politiche di riforma del settore. In questo lavoro, dopo un inquadramento teorico e qualche cenno ai tentativi di riforma del governo Renzi, si presentano una serie di evidenze empiriche sulle trasformazioni socio-demografiche del pubblico impiego negli anni duemila, sulla sindacalizzazione, sul consenso elettorale nelle elezioni dei delegati sindacali, nonostante l'adozione di strategie contrattuali di tipo moderato. Nella parte conclusiva si descrive lo specifico modello di offerta sindacale dell'Italia, osservando che l'assetto confederale, pluralistico e multitasking di Cgil, Cisl e Uil costituiscono i fattori principali che ne spiegano il (relativo) successo.
Questa ricerca analizza le implicazioni derivanti dall'introduzione della procedura di co-decisione come procedura legislativa ordinaria nel processo di riforma della politica agricola comune. La diversa distribuzione dei poteri tra le istituzioni europee modifica gli assetti istituzionali e fornisce al Parlamento il ruolo di colegislatore in materia agricola. La forma assunta dalla nuova politica agricola europea scaturisce dalla configurazione dei poteri di contrattazione che ciascun attore ha mostrato nella sede dei triloghi negoziali. La ricerca tenta di verificare la accuratezza predittiva di diversi modelli di contrattazione legislativa attraverso il confronto e la verifica degli errori di predizione sui risultati finali di alcune questioni salienti della riforma della Politica Agricola Comune e allo stesso tempo, cerca di identificare il peso del potere del Parlamento europeo in veste di co-legislatore nel processo di riforma della PAC post-2013. ; This research analyzes the implications of the introduction of the codecision procedure as the ordinary legislative procedure in the process Common Agricultural Policy reform. The different distribution of powers between the European institutions modified the institutional structure and give to the European Parliament the role of colegislator in agricultural matters. The form taken by the new European agricultural policy derives from the configuration of the bargaining power that each actor has shown in the seat of the trialogue negotiations. The research attempts to verify the predictive accuracy of different models of legislative bargaining through the comparison and verification of prediction errors on the final results of some salient issues emerged during the Common Agricultural Policy reform process, and at the same time, try to identify the weight of the power of European Parliament as colegislator in the of CAP reform process post-2013.
Después de la caída del régimen comunista, la situación cambió dramáticamente en Rumania: el sistema de "economía real", basado en la propiedad colectiva que prohibía casi cualquier forma de propiedad privada, tuvo que ser reformado, transformándose en un sistema de economía de libre mercado. La reforma del sistema económico también "revisó" la organización del trabajo y las relaciones laborales. Las relaciones laborales han perdido su "estabilidad". El modelo de contrato de trabajo está recogido en la legislación vigente. Desde un punto de vista objetivo, el Código de Trabajo de Rumania regula la totalidad de las relaciones laborales individuales y colectivas, la forma en que se controla la aplicación del derecho laboral, así como la jurisdicción del trabajo; mientras que, desde un punto de vista subjetivo, examina el desempeño laboral de cualquier persona en Rumania (ciudadanos rumanos y extranjeros, y apátridas), así como, en cierta medida, el desempeño en el extranjero de los rumanos. Los derechos previstos en el convenio colectivo nacional deben considerarse como "derechos mínimos" para la "negociación" posterior de los convenios colectivos corporativos (obligatorio para las empresas con más de 20 empleados). En los casos en que los convenios colectivos no se firmen, el contrato nacional único se utilizará como referencia. Con respecto a la legislación laboral rumana, ciertamente menos protectora que la de sus socios de la Unión que pertenecen a la zona de países de Europa Occidental, y del bajo costo laboral practicado en Rumania, no hubo acusaciones de "dumping" social, que, como es bien conocido, favorece la deslocalización. ; After the fall of the communist regime, the situation changed dramatically in Romania: the "real socialism" system of the economy had to be reformed, based on collective property that prohibited almost all forms of private property, transforming it into a free market economy system . The reform of the economic system has also "revised" the organization of work and labor relations. The employment relationship has lost its "stability". The model of the employment contract is foreseen by the legislation in force. From an objective point of view, the Romanian Labor Code regulates the totality of individual and collective labor relations, the way in which the application of labor law is controlled, as well as the jurisdiction of labor; while, from a subjective point of view, it examines the work performance of anyone in Romania (both Romanian and foreign citizens, and stateless persons), as well as, to a certain extent, that performed abroad by Romanians. The rights provided for in the national collective agreement are to be considered as "minimum rights" for the subsequent "negotiation" of corporate collective agreements (mandatory for companies with more than 20 employees). In cases where collective agreements are not signed, the single national contract will be used as a reference. With regard to the Romanian labor law, certainly less protective than that of the Union partners belonging to the area of the countries formerly of Western Europe, and of the low labor cost practiced in Romania, there were no accusations of dumping social, which, as is well known, favors delocalization. ; Dopo la caduta del regime comunista, la situazione è cambiata radicalmente in Romania: è stato superato il sistema del "socialismo reale" in economia, basato sulla proprietà collettiva, che vietava quasi tutte le forme della proprietà privata, trasformandolo in una economia di libero mercato. La riforma del sistema económico ha "ritoccato" anche l'organizzazione del lavoro e i rapporti lavorativi. Il rapporto di lavoro ha perso la sua "stabilità". Allo stato attuale il modello del contratto di lavoro è previsto dalla legislazione in vigore anche se il datore di lavoro può adattare il contratto in funzione della particolare situazione lavorativa. Dal punto di vista oggettivo, il Codice del Lavoro romeno regola la totalità dei rapporti individuali e collettivi di lavoro, il modo con cui si controlla l'applicazione della normativa sul lavoro, nonché la giurisdizione del lavoro; mentre, dal punto di vista soggettivo, prende in esame la prestazione lavorativa da chiunque svolta in Romania (sia cittadini romeni, che stranieri, che apolidi), oltre che, entro una certa misura, quella svolta all'estero da romeni. I diritti previsti nel Contratto collettivo nazionale sono da considerarsi quali "diritti minimi" per la successiva "negoziazione" dei contratti collettivi aziendali (obbligatori per le società con più di 20 dipendenti). Nell'ordinamento italiano, il tema della disciplina delle procedure e dei contenuti della contrattazione collettiva rappresenta una delle maggiori questioni giuslavoristiche, che non ha ancora trovato una stabile soluzione. Ad essa, inoltre, si lega strettamente il tema della regolamentazione, a fini negoziali, dei soggetti dell'autonomia collettiva. La finalità della presente trattazione è quella di esaminare, dapprima, lo sviluppo storico del dibattito nell'ordinamento italiano, per concentrare, in seguito, l'attenzione sulle tematiche più recenti che, anche alla luce della crisi dell'unità sindacale e della frammentazione dei tessuti produttivi generata dalla globalizzazione, evidenziano una richiesta di regolamentazione obiettiva dell'attività negoziale. In merito a tali questioni verrà infine esaminato, in una logica comparata, l'ordinamento francese che, a differenza di quello italiano, ha disciplinato per legge i presupposti, le procedure e i requisiti di accesso alla negoziazione collettiva sin dalla prima metà del XX Secolo. In particolare, il primo capitolo della tesi prende in esame, dapprima, la questione che si pone alla base dell'intero dibattito nazionale sulle modalità di regolamentazione della contrattazione collettiva: la mancata attuazione da parte del legislatore della seconda parte dell'art. 39 Cost. e la conseguente illegittimità costituzionale di quelle norme volte a generalizzare l'efficacia degli accordi collettivi aggirando quanto previsto dalla Carta fondamentale. L'analisi prosegue con la disamina dell'evoluzione storica della contrattazione anomica nel nostro ordinamento: a partire dalla negoziazione accentrata a livello nazionale nei primi anni Cinquanta, dalle istanze di decentramento e dall'effimera introduzione della contrattazione articolata con il Protocollo Intersind-Asap del 1962, fino alla bipolarità totale tra livello confederale e aziendale manifestatasi tra la fine degli anni Sessanta e la metà degli anni Settanta del Novecento, per giungere alla negoziazione collettiva della crisi, con gli accordi triangolari e la concertazione che, tra alterni risultati, hanno prodotto i loro effetti fino alla metà degli anni Duemila. In tale contesto, particolare attenzione è dedicata al sistema degli accordi del luglio-dicembre 1993 che, per quasi vent'anni, hanno costituito il fulcro di una disciplina delle relazioni industriali organizzata su due livelli, e che hanno tentato, nel contempo, con l'introduzione delle RSU, di contrastare la crisi di rappresentatività delle organizzazioni sindacali, evidenziata nella sua gravità, pochi mesi dopo, dal referendum del 1995 sull'art. 19 della l. 300/1970. La parte finale del primo capitolo si pone in ideale continuazione con l'inizio del secondo. Al centro dell'esame vi sono le questioni dei nostri giorni che hanno indotto le parti sociali, significativamente del settore industriale – a seguito della crisi del sistema del 1993, che ha avuto il proprio epicentro nella vertenza Fiat del 2009-2011, della successiva e connessa sentenza manipolativa della Corte Costituzionale del 2013 in riferimento, ancora una volta, all'art. 19 St. lav., e all'introduzione da parte del legislatore del discusso art. 8 del d.l. 138/2011 – a ritenere maturi i tempi per una nuova regolamentazione pattizia del sistema. Al riguardo, vengono analizzati nel dettaglio i tre accordi interconfederali del 28 giugno 2011, 31 maggio 2013 e 10 gennaio 2014, l'ulteriore e recentissima intesa del 28 febbraio-9 marzo 2018 e il dibattito, in una prospettiva de iure condendo, sull'opportunità di introduzione di una legge sindacale, capace, eventualmente, di dare completa attuazione all'art. 39 Cost. Il terzo capitolo, infine, si pone in parallelo con i primi due, dal punto di vista dell'ordinamento francese. Pertanto viene inizialmente presa in considerazione l'evoluzione normativa di tale contesto giuridico, a partire dalla loi del 1919 sulla contrattazione collettiva di diritto comune e dalla leggi del 1936 e 1950 sull'estensione erga omnes in via amministrativa dei contratti collettivi sottoscritti dalle organizzazioni sindacali rappresentative, fino al nuovo modello di "cittadinanza nell'impresa" proposto dalla leggi Auroux del 1982 e alla frammentazione del sistema tra gli anni Ottanta e Duemila, punteggiata di provvedimenti privi di carattere sistematico e, in alcuni casi, contraddittori. Ci si sofferma, infine, sulle riforme che, in tempi recenti, hanno svolto il ruolo di pietre angolari nella ridefinizione degli assetti dell'ordinamento francese: l'introduzione di criteri obiettivi per la selezione dei sindacati rappresentativi nel 2008, l'estensione di tale modello alle organizzazioni datoriali nel triennio 2014-2016 e, sul versante dell'assetto contrattuale, le discusse riforme introdotte con la loi Travail dell'8 agosto 2016 e dalle ordonnances promosse dal neo-presidente Macron nell'autunno del 2017, nella direzione di una forte valorizzazione del secondo livello negoziale, a discapito delle conventions de branche. Il punto d'arrivo del percorso tracciato supra porterà a cercare di dare una risposta, da un lato, all'interrogativo inerente all'opportunità di intervenire, nell'ordinamento italiano, con una legge sindacale, per fornire certezza, chiarezza e stabilità al sistema contrattuale e, in seconda istanza, anche sulla base della riflessione comparata, ad una valutazione su quali potrebbero essere gli istituti più efficienti da adottare, nei termini anzidetti, per assicurare un'estensione generalizzata della contrattazione collettiva, idonea a permettere un armonico sviluppo anche degli accordi di secondo livello. ; In the Italian legal framework, the question concerning the regulation of procedures and contents of collective bargaining represents one of the major labour law issues, which has not found a satisfying solution yet. The abovementioned topic is, in addition, strictly connected to the selection of criteria aimed to determine the actors of the bargaining process. The purpose of the present dissertation is then to examine, first of all, the historical development of the debate on the aforementioned issues in the Italian context, to focus attention, afterwards, on the most recent instances to enact a clearer regulation of the bargaining process, in reason of the crisis of trade unions' cohesion and of the fragmentation of production originated by globalisation. Finally, the last part of the dissertation will be centred on a comparative analysis with the French regulative context that, in opposition to the Italian one, disciplined by law prerequisites and procedures to accede to collective bargaining process already at the beginning of XX Century. In particular, the first chapter starts from the matter of contention at the base of the whole national discussion referred to the regulative process of arrangements executed between employers' and workers' organizations: the incapability of the Italian legislator to enact a law concerning the collective bargaining proceeding respecting, in the meantime, the criteria set forth by Article 39 of the Constitution, that has been at the base of the consequential declaration of illegitimacy of all the legislative attempts to generalize the efficacy of the considered agreements, circumventing the provision of the Fundamental Chart. The analysis continues focusing on the evolution of collective agreements regulated by civil law in the national legal framework: highly centred during the Fifties, then organized on two ordered levels in the brief period of "contrattazione articolata" – introduced initially in public industries with the Protocol Intersind-Asap of 1962 and soon extended to the private field – until the total independence between company and sectorial bargaining level in the years between the end of the Sixties and the beginning of the Seventies, and to the particular characteristics assumed by the said agreements during the oil crisis and in the following years, when the practice of the three-side covenants executed between main trade unions, employers' organizations and the government, with different outcomes, perdured until the middle of 2000's. In this context, particular attention is devoted to the collective agreements executed at national level in July-December 1993 that, during the following twenty years, have been considered the fulcrum of the two-level collective bargaining system, and which attempted, in the meantime, with the introduction of Trade unions' Unitary Representative bodies (in Italian, Rappresentanze Sindacali Unitarie, RSU) to contrast the deep crisis of representativeness of workers' organizations, whose gravitas has been highlighted, several months after, by the national referendum held in 1995 on Article 19 of law no. 300 of 1970. The last section of the first chapter founds an ideal continuation in the second one. In this field, the main topic become the most recent issues concerning the Italian bargaining system, and significantly the one which moved social actors of the industrial sector – on the base of the crisis of the system of 1993, showed by the Fiat dispute of 2009-2011, followed by the connected judgment of Constitutional Court that in 2013 modified another time the interpretation of Article 19 of law no. 300 of 1970, expanding the criteria to admit workers' organization to benefits provided by the law, and by the enactment of Article 8 of law-decree no. 138 of 2011 – to affirm that is come the time to set new rules to try to govern the bargaining system. On this point, the dissertation focuses attention on the three national collective agreements held on 28 June 2011, 31 May 2013 and 10 January 2014 and on the further arrangement of 28 February-9 March 2018 and on the respective debate centred, in a perspective of reform, on the opportunity to introduce a bill able to completely fulfil the requirements of Article 39 of the Italian Constitution. The third chapter, finally, follows the scheme of the precedent ones, from the point of view of the French legal framework. Therefore, firstly is described the evolution of the said juridical context, from the loi of 1919 concerning collective agreements regulated by civil law and the regulations of 1936 and of 1950 on the extension erga omnes, through an administrative decree, of collective agreements signed by representative trade unions, until the new model of "citizenship in the company" promoted by the laws Auroux enacted in 1982 and to the fragmentation of the labour law system occurred between the 80s and 2000s, characterised by measures without a systematic approach and, sometimes, in contrast between each other. The attention is focused, then, on the reforms that, recently, heavily redefined the structure of the French labour law framework consisting in the introduction, in 2008, of objective criteria to select representative trade unions, in the extension of this model to employers' organizations in 2014-2016 and, with reference to the bargaining structure, in the disputed reform responding to the name of loi Travail, held in 2016, and in the ordonnances promoted by the new President Macron in the late 2017, towards the direction of a relevant and decisive expansion of company collective agreement, to the detriment of sectoral level. The arrival point of the path traced above regards the attempt to reply to the issue concerning the opportunity to provide or not, in the Italian context, for a law regulating collective bargaining and the related obligations and rights of social actors, to clarify and stabilize the arrangement system. Secondly, also on the base of the comparison with the French frame of reference, the dissertation is closed by a reflection on the possible legal institutes to be introduced in the Italian juridical framework, in order to assure a general extension of collective bargaining, in the light to allow an harmonious development also of the company level.
We propose an endogenous growth model with public capital and an imperfect labor market to account for the long run regional development of the Italian economy. A stylized model of a monopolistic Union characterized by heterogeneity in its members' reservation wage creates a spatially rigid wage. We then include the above mechanism in a growth model where public investment is subject to installation costs and analyze the effects of policy changes in the period 1951-2004 on the long run growth and unemployment rate of the macro areas of Italy: Center-Northern and Southern. The calibration exercise with parameters values grounded in the economic history literature is then performed. Our results indicate that two permanent institutional innovations deeply affected the long run dynamics of the Italian regional development, both in terms of growth and unemployment: the centralization of the wage bargaining and the decentralization of the governmental functions with the birth of the ordinary regions. ; Nel presente lavoro proponiamo un modello di crescita endogena con capitale pubblico e mercato del lavoro imperfetto per spiegare lo sviluppo di lungo periodo dell'economia italiana. Un modello stilizzato di Sindacato monopolistico caratterizzato da eterogeneità nei salari di riserva dei suoi membri determina un salario rigido in senso spaziale. Inseriamo poi tale meccanismo in un modello di crescita nel quale l'investimento pubblico è soggetto a costi di installazione e analizziamo gli effetti dei cambiamenti nelle politiche nel periodo 1951-2004 sulla crescita di lungo periodo e sul tasso di disoccupazione delle due macro aree d'Italia: il Centro-Nord e il Sud. Nel lavoro effettuiamo inoltre un esercizio di calibrazione del modello con i valori dei parametri determinati sulla base della letteratura esistente sulla storia economica italiana. I nostri risultati indicano che due innovazioni istituzionali di tipo permanente hanno avuto effetti profondi sulla dinamica di lungo periodo dello sviluppo regionale italiano, sia in termini di crescita che di disoccupazione: la centralizzazione della contrattazione sul salario e la decentralizzazione delle funzioni di governo con la nascita delle regioni ordinarie.
L'Autore ripercorre l'evoluzione delle forme e degli strumenti di rappresentanza degli interessi collettivi di tutela della salute e sicurezza dei lavoratori disciplinati dalla legge e dalla contrattazione collettiva, prestando particolare attenzione alle figure dei RLS istituite dall'art. 19 del d.lgs. n. 626/1994 e rese compiutamente operative, riguardo al settore artigiano, dall'accordo interconfederale 3 novembre 1996 che si esprime chiaramente a favore del modello territoriale giudicato come il più adeguato alla realtà organizzativa delle piccole imprese. Più recentemente, il ruolo del RLS territoriale è stato rafforzato dal d.lgs. n. 81/2008 anche mediante l'attribuzione ex lege della funzione rappresentativa in tutte le aziende o unità produttive in cui non sia stato eletto o designato un RLS aziendale. L'importanza della scelta sollecita una più approfondita riflessione sull'adeguatezza degli strumenti di cui può disporre e delle procedure alle quali ricorrere. In tal senso, destano particolare interesse alcuni contenuti della più recente contrattazione collettiva destinati a legittimare forme inedite di collaborazione e di assistenza tra RLS aziendali e RLS territoriali al fine di rendere più efficiente l'esercizio delle loro prerogative. The author retraces the evolution of forms and means of representation of the collective interests of protecting the health and safety of the workers covered by the law and by the collective bargaining, paying particular attention to the role of RLS (workers' safety representative) established by art. 19, Legislative Decree no. 626/1994, and put into effect, with regard to the artisan sector, by the interconfederal agreement of November 3, 1996, which is clearly in favor of the territorial model evaluated as the most appropriate model for the organizational reality of small businesses. Il saggio indaga le attività di rappresentanza dei lavoratori in materia di salute e sicurezza nelle grandi società di capitali e nelle aggregazioni produttive complesse. Messi in evidenza i tratti che caratterizzano le specificità di tale rappresentanza, l'A. approfondisce diversi aspetti nei quali la complessità organizzativa fa emergere significative criticità che, se non adeguatamente affrontate, possono comprometterne l'azione. In particolare, dall'indagine emerge che la rappresentanza per la sicurezza non può fare a meno del supporto strategico di una contrattazione collettiva che allargando il suo tradizionale ambito di intervento, quello definito dalle misure relative alla sua costituzione e al suo funzionamento, individui nuove modalità e strumenti, di natura complementare ed integrativa rispetto al dettato normativo, che consentano alla stessa rappresentanza di gestire al meglio la tutela della salute e della sicurezza dei lavoratori nelle condizioni imposte dallo specifico modello organizzativo operante in azienda. The essay analyses the workers' representation in the field of health and safety at work in large-corporations and in complex groups of entreprises and businesses networks. The author highlights the aspects that characterise this specific safety representation and identifies some situations in which the business structure brings out critical issues that can negatively impact the activity of workers' representatives. In particular, the analysis shows that safety representation needs to be strategically supported by collective bargaining that, extending its traditional aims, finds complementary and additional tools compared to the current legislative rules. This is in order to make the workers' representation able to ensure a fair level of health and safety in the work environment, considering the conditions imposed by the organizational model adopted by the company.
