Осуществление конституционного контроля в Российской Федерации является важным элементом в системе обеспечения, охраны и защиты конституционных прав и свобод человека и гражданина, а также развития правового, демократического и социального государства. На основании принципа разделения властей органы конституционного контроля относятся к судебной ветви государственной власти. ; The article deals with the importance of judicial protection of citizens ' rights, which is one of the constitutional guarantees, including in the course of constitutional control aimed at restoring and protecting violated constitutional rights and freedoms of a person and citizen. Constitutional control is directly reflected in the rights and freedoms of man and citizen, which are the highest value in the State. The exercise of constitutional control in the Russian Federation is an important element in the system of ensuring, protecting and defending constitutional rights and liberties of man and citizen, as well as the development of a legal, democratic and social state. On the basis of the principle of separation of powers, the bodies of constitutional control belong to the judicial branch of State authority.

The October Revolution of 1917 profoundly influenced the course of the Indian freedom movement in multiple ways. It gave impetus to Indian political aspirations, widened the base of the freedom struggle by making industrial workers and peasants active participants, and endowed the movement with a progressive outlook. The revolution's principles resonated deeply among the people and leaders of the Indian freedom movement. In fact, many of the values enshrined in our Constitution, adopted post-independence, were inspired by the lofty ideals of the Russian Revolution. The most important event in Russia, influencing the course of the freedom movement in India, was the October Revolution in 1917. The revolution, its ideology, V. I. Lenin and his deep involvement with the issues confronting the people of the East, the transformation of Russia post 1917, and the overall attitude of the Soviet government and the Comintern towards India's freedom struggle deeply influenced both the people and the leaders of the Indian freedom movement. Though the multiclass national movement did not get converted completely to the cause of socialism, the fact remains that the legacies of the October Revolution influenced the course of the freedom struggle in multiple ways. Some of its legacies got imprinted in the Constitution that India adopted post-independence. The socialist component of the Constitution of India did not happen by accident. It was the outcome of the massive ideological churning that took place within and outside the Indian National Congress and that which by no small measure was triggered by the emancipatory ideals of the Russian Revolution of 1917. The Constitution of the Republic of India, adopted on 26 January 1950, was based on a set of principles and ideas that would achieve socialist reconstruction of society through democratic means. The right balance of the proper socio-economic rights with guaranteed democratic and civil liberties, based on the majority principle along with the right of minority opinions to exist and flourish in a secular state became the cornerstones of the Constitution that independent India adopted. Many of these values were clearly inspired by the lofty ideals of the Russian Revolution.
The analysis of court practice, legal view of the Constitutional Court and current legislation give reasonable grounds to believe that grounds and order of rehabilitation do not provide sufficient protection of the civil rights and liberties, restoration of human dignity and they need to be improved. ; В статье по итогам исследования судебной практики и действующего законодательства автор приходит к выводу о том, что основания и порядок реабилитации не обеспечивают надлежащей защиты прав и свобод граждан, восстановления достоинства личности и нуждаются в совершенствовании.
Проанализировано влияние Октябрьской революции 1917 г. на индийское освободительное движение. Отмечено, что она дала импульс индийским политическим устремлениям, расширила базу освободительного движения, превратив промышленных рабочих и крестьян в активных участников борьбы, и наделила движение прогрессивным мировоззрением. Принципы революции вызвали резонанс среди рядовых борцов за независимость и лидеров индийского освободительного движения. Сделан вывод о том, что многие ценности, закрепленные в Конституции Индии, принятой после обретения независимости, были вдохновлены высокими идеалами российской революции. Сама революция, ее идеология, В. И. Ленин и его глубокая озабоченность проблемами, стоящими перед народами Востока, преобразования в России после 1917 г., отношение советского правительства и Коминтерна к борьбе за независимость Индии оказали сильнейшее воздействие как на народ, так и на лидеров индийского освободительного движения. Хотя многоклассовое национальное движение не преобразовалось в социалистическое, фактом остается то, что наследие Октябрьской революции повлияло на ход освободительной борьбы. Таким образом, социалистический компонент Конституции Индии не был случайным. The paper presents the characteristic of different classes' activities (congresses, conferences and councils of political parties and non-governmental organizations) in the period of the "Democratic Counterrevolution" (June – November 1918) and the Civil War. Congresses and conferences are analyzed as one of the key elements of society formation and activity that had significant influence on the state administration bodies, reauthorization and society selforganization. On the basis of the statistical analyses, it is proved that the number of congresses, conferences and councils decreased greatly in the researched period (from March 1917) compared to the previous period. That fact signifies, on the one hand, the democratic liberties limitation by the government, and, on the other hand, decreasing the society's political activities. The following tendencies in the internal structure of the civic movement are observed in the researched period: the activity of local public authority was renewed, while the activity of the Soviet bodies was prohibited, the Socialists-Revolutionaries (SRs) and the Mensheviks became more active, at the same time, the Bolsheviks went underground, the Oblastniks, the clergy and businesspeople began to participate in the civil movement considerably. The tendency is registered to decrease the involvement of trade union movement into policy, the antagonism between professional workers and working people is observed. Being the center of Siberian legislative power, Tomsk became the center of the Siberian civil movement in the researched period. Most of Siberia-wide and regional congresses and conferences were held in Tomsk. The activity of democratic institutions (in some limited type) is proved to have continued longer than in other regions of Siberia. ; В статье представлена характеристика съездов, конференций, совещаний различных социально-классовых сил в Томской губернии на одном из этапов революции и Гражданской войны – «демократической контрреволюции» (июнь – ноябрь 1918 г.). Съезды, конференции и совещания рассматриваются как один из важных элементов формирования и жизнедеятельности гражданского общества, оказавшим существенное влияние на трансформацию органов государственного управления, на перераспределение полномочий между властью и обществом, на самоорганизацию общества. На основе статистического анализа событий сделан вывод о том, что на исследуемом этапе по сравнению с предшествующими (с марта 1917 г.) заметно снизилось количество съездов, конференций и совещаний. Это снижение было связано как с правительственным курсом на ограничение демократических свобод, так и со снижением политической активности масс. Изменилась внутренняя структура общественного движения: была возобновлена деятельность органов местного самоуправления, запрещена деятельность советов, активизировались эсеры и меньшевики, большевики ушли в подполье, заметно оживились областники, предприниматели и духовенство. Наметилась тенденция к деполитизации профессионального движения, внутри него стали нарастать противоречия между союзами служащих и рабочих. Томск, который в рассматриваемый период являлся центром сибирской законодательной власти, стал фактическим центром общественной жизни Сибири. В нем было проведено абсолютное большинство всесибирских и региональных съездов. Функционирование институтов демократии (хотя и в урезанном виде) в Томске продолжалось дольше, чем в других сибирских регионах.
The article studies the history of the notions of "patriot" and "patriotism" in the political and social life of 18th-century Britain. The methodology of research is based on the approach of the Cambridge School of the history of political thought, consisting in the analysis of certain notions in the context of the epoch. The material of the paper is pamphlets of John Wilkes, and his main opponent Samuel Johnson as well as some anonymous journalistic essays. The paper focuses on the problem of interpretation of "patriot" and "patriotism" as notions by followers of different political views. John Wilkes acted as a "patriot", supposing that it implied opposition to power until the "natural" rights and liberties of Englishmen were restored. Another understan-ding is reflected in Doctor Johnson's and his supporters' pamphlets. According to them, a patriot is "he whose public conduct is regulated by one single motive, the love of his country". The author comes to the conclusion about Samuel Johnson's victory in the discussion, because he took the notion of "patriot" beyond the limits of political space. Moreover, the discussion about "false" and "true" patriotism indicated the formation of the public sphere and civil society in England of the 1760s–1770s. ; Статья посвящена исследованию истории понятий «патриот» и «патриотизм» в общественной и политической жизни Британии 60–70-х гг. XVIII в. Методология исследования основывается на подходе Кембриджской школы истории понятий, заключающемся в анализе понятий в контексте эпохи. Источниками выступают памфлеты Джона Уилкса и его оппонента доктора Сэмюэла Джонсона, а также публицистические очерки анонимных авторов, опубликованные в 1763–1774 гг. В центре внимания статьи — проблема интерпретации понятий «патриот» и «патриотизм» представителями разных политических взглядов. В роли «патриота» выступил эсквайр Уилкс, полагавший, что патриоты должны находиться в оппозиции к власти до тех пор, пока не будут восстановлены «естественные» права и свободы англичан. Иное понимание патриотизма нашло отражение в памфлетах доктора Джонсона и его сторонников. В их понимании, патриот — это «человек, чьей руководящей страстью является любовь к своей стране». Автором делается вывод о победе в дискуссии доктора Джонсона, сумевшего вывести понятие «патриот» за пределы политического пространства. Более того, дискуссия о мнимом и подлинном патриотизме стала маркером складывания публичной сферы и гражданского общества в Британии 60–70-х гг. XVIII в.
