The scientific article is devoted to the study of land (land plot) as an object of civil rights. The article indicates that the relevance of writing an article is due to the land reform in Ukraine. Delimitation of the legal concept of "land" and "land plot" is carried out. The article analyzes the rules of law on a land plot as an object of property rights. An integrated theoretical approach to the legal regime of land and a land plot as an object of civil rights is considered. The features of a land plot as an object of civil rights have been determined. The importance of protecting the lands of Ukraine by the state has been substantiated. It was found out how the legal regime of a land plot differs from the legal regime of other real estate or other things. Land and land plot are identified with the boon as an object of civil rights. The view of the land plot is illuminated as an intangible and material boon. A critique of the scientific definition of land as an object of land relations is given. It is determined that there is a need for a compromise between private interests, the interests of the land market and environmental interests, which can simultaneously contribute to the protection of the civil law regime of land and the protection regime of a natural object. A distinction is made between the legal regime of construction real estate and the legal regime of land as real estate. It also indicates the difference between a land plot as an object of property rights and other objects of property rights. The conclusion is made about the need for comprehensive legal regulation of land relations, about the limited legal regime of the land plot. The historical trends and the state of modern legal regulation of property rights have been identified. The characteristics and features of the servitude as an object of civil rights have been investigated. The methods of ac-quiring and terminating a servitude, its scope and legal regime, the peculiarity of public easements are consid-ered. A servitud, as a kind of property rights that are the subject of rights to another's property, is a special catego-ry of property rights and a specific object of civil rights in view of the peculiarities related to its turnover. Servitude law not only gives the owner the opportunity to effective-ly use his property, but also provides for the satisfaction of the interests, including non-property, of others (for example, to exercise the right of vehicular and pedestrian traffic through another's plot of land even to place tem-porary structures). The right of a landowner to restrict-ed use of other land is necessary and satisfies the needs (or deficiencies) of the land at expense of other, usually neighboring plots. The person who has received servitude in due course has the following competences, which con-stitute the content of the servitude law.In the absence of consent to establish a servitude, the person concerned must prove in court that it is impossible to make normal economic use of the land in the absence of a servitude. When acquiring a servitude, a person should avoid abusing their rights. If there is no basis for the ac-quisition of rights, the attempt to acquire them by any means results in nullity of legal effects.There are always two parties in the servitude rela-tions: the landowner and the person (or several persons) who acquires a limited property right in the form of a servitude. Since any servitude is always a restriction on the right of others, it is thus the least burdensome for the owner of the thing. On the other hand, it should be noted that the restriction of property rights makes it necessary for the owner to refrain from certain actions that may vio-late the rights of another person. If a person has acquired a limited right, they cannot have legal relationship with the owner of the property. The author has studied the features of educational service as an object of civil rights. It has been noted that social benefits should not be understood as the object of civil rights, as some researchers insist on, the object of civil rights must be perceived as a legal behavior of the participants in legal relations. The main argument in favor of such a conclusion is the indication that the right as a regulator of public relations can affect only the volitional conduct of the participants, but not directly the benefits. The benefits are not capable of perceiving the legal requirements of legislative acts or contracts. Consequently, the educational service should be regarded as the legal behavior of the provider of this service, aimed at forming certain social qualities of the subject of educational influence. Behavior of educational services' providers is a series of interrelated and purposeful acts of conduct (operation), and when such operational actions are carried out over a long period of time, they become the nature of activity. The legal form of providing educational services is a contractual obligation. The object of such binding legal relations is the requirement of the customer of the educational service in relation to the execution of the relevant subject actions by the provider and the subsequent positive reaction of the latter to the fulfillment of his duty. The object of the considered legal relations and the object of the subjective right of the customer of the educational service, according to the author of the article, coincide in their volume. It has been emphasized that the providers of educational services cannot have civil and legal obligation to guarantee the effectiveness of training, since the achievement of such an effect depends on the intellectual capacity of the subject of training and other factors. The eligibility criteria for the performance of educational services are regulatory requirements that determine the content of a particular level of education, the volume and sequence of teaching disciplines, etc. Based on this, one of the features of educational services is the implementation of public control over the compliance of the substantive conduct of the providers of such services with the requirements of the law. ; Розглянуто особливості освітньої послуги як об'єкта цивільних прав. The article is devoted to the actual scientific problem - the protection of human rights and freedoms by the judicial authorities, their priority in this process. It provides an analysis of international legal acts, devoted to this problem. It is stressed, that the success of judicial administration in the performance of justice depends on many factors, and especially on the regularity of the procedural form of resolving disputes in court and on the universality of the nature of the "procedural order". Compliance with the procedural guarantees of the administration of justice is a prerequisite for its implementation and proper consideration of court cases. The procedural guarantees of observance of human rights in the administration of justice include: courteousness of the court, transparency, openness of court proceedings, efficiency of justice, participation of the people in its implementation, competition of the parties in court proceedings, etc. Particular attention is paid to the specifics of guarantees of observance of human rights in criminal justice and analysis of normative and legal acts that establish the basic principles and guarantees of observance of human rights and their classification on: international legal acts, constitutional acts (constitutional or basic laws), legislative acts (first of all separate laws and codes). There are two groups of guarantees of the observance of human rights in the administration of justice. These are procedural guarantees, which are almost completely equated with the principles of justice and procedural safeguards for the observance of human rights in the administration of justice. The concept of objects of civil rights is one of the complex in civil law science. The mentioned issue has not got round the provisions of the norms of legislation and scientific concepts in the context of providing housing services. This problem occurs because the Civil Code of Ukraibe does not contain certain norms regarding the specifics of the relevant type of services as an object of civil rights and the presence of dispersion regulating the procedure of their provision by housing services. The modern doctrine of civil law admits the plurality of objects of civil rights and denies the possibility of non-object civil legal relations' existence. Plurality is conceptually defined in the Section III of the Civil Code of Ukraine and means a variety of their species, due to the diversity of legal interests of civil law subjects. The object of civil rights is everything, in respect of which the subjects come into legal relations. The concept of housing services would be appropriate to interpret due to a combination of these categories (actions and benefits). Consequently, housing services – are the result of economic activities aimed at meeting the needs of an individual or legal entity to provide hot and cold water, water discharge, gas- and electric power supply, heating, as well as removal of waste in the manner prescribed by the law. The subject matter of the contract on providing housing services is a non-material service, i.e. the intangible benefit obtained by the customer in the process of committing certain actions by the executor or exercising certain activities. The feature of contractual structures on providing housing services is the quality of provided services. Our vision is confirmed by the norms of the current legislation. The results of the conducted research are the following conclusions: 1) the object of civil legal relations is the actual behavior of their subjects related to the performance of certain actions due to subjective rights and legal responsibilities; 2) a housing service as an object of civil law is a definite benefit provided by a specialized organization and is the result of the activities of the latter; 3) a housing service is a subject matter of many types of contracts, but has its own specificity depending on its type, which may be associated with the presence of various criteria of quality of provided services (water discharge, gas supply, electric power supply, etc.). ; Окреслено авторське бачення окремих проблемних питань, що існують у контексті визначення житлово-комунальних послуг як об'єктів цивільних прав. With the development of information and communication technologies, issues of providing information security are becoming more and more aggravated. These are crimes related to the use of electronic computers, systems and computer networks and telecommunication networks, the propaganda of separatism and extremism, etc.While providing information security in the digital environment, the role of technical and legal human rights guarantees, due to technical means of protection, is increasing. Relying on the developers of technical means of protection determines the difference between the aforesaid concepts and the traditional approach to ensuring the protection of human and citizen rights, in which responsibilities are put on information intermediaries, owners of confidential information.Technical guarantees of human rights are a necessary component of ensuring information security, but the effectiveness of the application is provided in conjunction with the legal guarantees of human rights, as evidenced by the tendency to recognize the principles of inviolability of privacy on the basis of design decisions in the law of the European Union as legal acts.Providing information security is a legitimate goal of establishing constraints of human rights, since it can be correlated with the norms of international law. The establishment of constraints of human rights is permissible in order to attain other objectives–ensuring state security, public order, health, rights and freedoms of the person in the information sphere. The legitimacy of this goal is determined by its compliance with the objectives envisaged by international agreements ratified in an established order.The article examines the impact of the use of technical means in the field of providing information security in the aspect of following the fundamental human and civil rights in Ukraine, taking into account the legislation of the European Union and the decision of the European Court of Justice. The comparative and legal analysis of various factors influencing the restriction of information rights of people in the digital environment is carried out. Legal guarantees from the point of view of the concept of privacy and security due to design decisions, taking into account the role and characteristics of technical primus are revealed. ; З розвитком інформаційних і комунікаційних технологій загострюються проблеми забезпечення інформаційної безпеки. Покладання на розробників технічних засобів обов'язків визначає відмінність вищевказаних концепцій від традиційного підходу до забезпечення захисту прав людини та громадянина, при якому обов'язки покладаються на інформаційних посередників, власників конфіденційної інформації.Технічні гарантії прав людини стають необхідною складовою забезпечення інформаційної безпеки, але ефективність застосування забезпечується у поєднанні з правовими гарантіями прав людини, на що вказує тенденція визнання принципів недоторканності приватного життя на основі проектних рішень у праві Європейського Союзу в якості правових актів.Забезпечення інформаційної безпеки виступає легітимною метою встановлення обмежень прав людини, оскільки це може бути співвіднесено з нормами міжнародного права. Встановлення обмежень прав людини допускається для досягнення інших цілей – забезпечення державної безпеки, публічного порядку, здоров'я, прав і свобод особи в інформаційній сфері. Легітимність цієї мети визначається її відповідністю цілям, передбачених міжнародними договорами, ратифікованими у встановленому порядку.У статті розглянуто вплив застосування технічних засобів у сфері забезпечення інформаційної безпеки в аспекті дотримання основоположних прав людини та громадянина в Україні з урахуванням законодавства Європейського Союзу та рішення Європейського суду справедливості. Здійснено порівняльно-правовий аналіз різних чинників, що впливають на обмеження інформаційних прав людини у цифровому середовищі. Розкрито правові гарантії з погляду на концепції недоторканності приватного життя та безпеки за рахунок проектних рішень, з урахуванням ролі та особливостей технічного примусу.
The author of the article has analyzed the legislation of Ukraine on combating the spread of infectious diseases, in particular, with regard to the perfection of the formulation of powers of local self-government agencies. The author emphasizes that the restrictions imposed by the authorities (regarding the ban on the operation of private catering establishments, hotels, shops, etc.) are an intrusion (interference) of the state, represented by local self-government agencies into the property right guaranteed by the Art. 1 of the First Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms. This conclusion, according to the author, follows, in particular, from the ECHR judgments, where it stated that the concept of "property", as well as "ownership", has a fairly broad interpretation and covers a range of economic interests (assets) – both tangible and intangible, such as: real estate, proceeds from property, personal property, "assets", "legitimate expectations" to act in accordance with a permit issued by public authorities, etc. The author of the article studies the process of introducing sequestration restrictions on the territory of Kyiv City; studies the status of the Plenary Committee on Technogenic and Environmental Safety and Emergency Situations of the executive agency of Kyiv City Council, which decided to introduce such restrictions. The analysis of the Ukrainian legislation has resulted to the conclusion that the Committee did not have the authority to introduce sequestration restrictions. In this article the author considers the concept of restriction of individual rights in civil law, as well as the re-lationship between the concepts of restriction and encumbrance of civil rights. First of all, the lack of a legislative definition of the concept of restriction of individual rights in civil law, as well as the ambiguity of the position of the legislator on the use of the term restriction and its place among related conceptsIn writing this work, first of all, attention was paid to the Constitution of Ukraine, which is the Basic Law, which serves as a guide that establishes the general boundaries of human and civil rights. The connection of the provisions of the Constitution with the norms of the Civil Code of Ukraine within the framework of the chosen topic was presented. Emphasis is placed on the fundamental principle according to which the national legal system is built, namely: "everything is allowed that is not expressly prohibited by law."The views of some scholars who adhere to their vision of the concepts under study are given. In addition, in this study, the relationship between the concepts of restriction and encumbrance of individual rights in civil law. In the process of writing this work, the positions of legal scholars who had relatively similar positions were given. They distinguish between the above concepts, and provide the relevant features. However, outside the scope of this study were many works of scientists who do not see a difference in these concepts.None of this was left out of the regulatory framework for the definition of the above concepts at the legislative level. In particular, it was found that in contrast to the concept of restriction of individual rights, including in civil law, the current legislation contains a definition of encumbrance. There are several acts that provide this definition. And in all cases, the definition is different.Based on the analysis of regulations, it was found that the legislator does not consistently approach the definition of encumbrance. In particular, in some cases the latter includes the encumbrancer's right to the debtor's movable property or restriction of such right, in others - prohibition or restriction of disposal and / or use of real estate, and in some cases the legislator identifies encumbrances and restrictions.According to the results of the study, the conclusions on the failure to define in national law the concept of re-strictions on the rights of persons in civil law, as well as the lack of a clear distinction between the concept of restric-tion of the right of person and encumbrance, in particular under civil law. There is a position on the need for further research on relevant topics, which will ensure clarity and clarity of the law, and promote its effective application, as well as consensus on this issue among scholars. ; У даній статті автором розглянуто поняття обмеження прав особи у цивільному праві, а також співвід-ношення понять обмеження та обтяження цивільних прав. У процесі написання вказаної роботи, було наведено позиції вчених-правників, які мали відносно схожі позиції. Вони розмежовують вищенаведені поняття, та наводять відповідні особливості. Однак, поза рамками вказаного дослідження залишились безліч робіт науковців, які не вбачають в наведених поняттях різниці. Кім цього не залишилось поза увагою нормативно-правове регулювання, щодо визначення вищевказаних понять на законодавчому рівні. Зокрема було встановлено, що на відміну від поняття обмеження прав осо-би, у тому числі в цивільному праві, норми чинного законодавства містять визначення поняття обтяження. Існують декілька актів, в яких наводиться вказана дефініція. І у всіх випадках, визначення відрізняється.На основі проведеного аналізу нормативно-правових актів, було встановлено, що законодавець не послі-довно підходить до визначення поняття обтяження. Зокрема в одних випадках в останнє закладається право обтяжувача на рухоме майно боржника або обмеження такого права , в інших – заборона або обмеження розпорядження та/або користування нерухомим майном, а в окремих випадках законодавець ототожнює обтяження та обмеження.За результатами проведеного дослідження, наведено висновки щодо не визначення в національному законодавстві поняття обмежень прав осіб у цивільному праві, а також відсутності чіткого розмежуван-ня поняття обмеження права особи, та обтяження прав, зокрема у рамках цивільного права. Наведено позицію, щодо необхідності подальшого дослідження відповідної тематики, що забезпечить ясність і чіткість закону, та сприятиме ефективному його застосуванню, а також консенсусу з даного питання серед науковців.

Наведені погляди деяких науковців, які дотримуються свого бачення з приводу понять, які досліджу-ються. Кім цього, в рамках даного дослідження було розглянуто співвідношення понять обмеження та обтя-ження прав особи, в рамках цивільного права. У процесі написання вказаної роботи, було наведено позиції вчених-правників, які мали відносно схожі позиції. Вони розмежовують вищенаведені поняття, та наводять відповідні особливості. Однак, поза рамками вказаного дослідження залишились безліч робіт науковців, які не вбачають в наведених поняттях різниці. Кім цього не залишилось поза увагою нормативно-правове регулювання, щодо визначення вищевказаних понять на законодавчому рівні. Зокрема було встановлено, що на відміну від поняття обмеження прав осо-би, у тому числі в цивільному праві, норми чинного законодавства містять визначення поняття обтяження. Існують декілька актів, в яких наводиться вказана дефініція. І у всіх випадках, визначення відрізняється.На основі проведеного аналізу нормативно-правових актів, було встановлено, що законодавець не послі-довно підходить до визначення поняття обтяження. Зокрема в одних випадках в останнє закладається право обтяжувача на рухоме майно боржника або обмеження такого права , в інших – заборона або обмеження розпорядження та/або користування нерухомим майном, а в окремих випадках законодавець ототожнює обтяження та обмеження.За результатами проведеного дослідження, наведено висновки щодо не визначення в національному законодавстві поняття обмежень прав осіб у цивільному праві, а також відсутності чіткого розмежуван-ня поняття обмеження права особи, та обтяження прав, зокрема у рамках цивільного права. Наведено позицію, щодо необхідності подальшого дослідження відповідної тематики, що забезпечить ясність і чіткість закону, та сприятиме ефективному його застосуванню, а також консенсусу з даного питання серед науковців.
На основі системного аналізу цивільно-правових норм виявлено проблему нормативно-правового встановлення послуги як об'єкта цивільних прав. Зокрема, граматичне усвідомлення змісту певних норм, які містяться в ЦК України, дало змогу дійти досить суперечливого висновку про те, що послуга є матеріальним благом, річчю, яка полягає в дії чи діяльності надавача послуги. Обґрунтовано та сформульовано пропозиції щодо вдосконалення концепту послуги як об'єкта цивільних прав у ЦК України з метою погодження такого закону з вимогами правової визначеності. ; Based on a systematic analysis of civil law norms, the problem of regulatory consolidation of a service as an object of civil rights is revealed. In particular, grammatical awareness of the content of certain norms contained in the Civil Code of Ukraine allowed us to make a rather contradictory conclusion that the service is a material good, a thing that consists in the action or activity of the service contractor. This legal paradox exists due to several shortcomings of legislative technique. The first one concerns the conjunction "including", which, according to grammar rules, refers a service (as a specific concept) as things (as a generic concept). It follows from the above that the Union "Including" should be removed in Part 1 of the Art. 177 of the Civil Code of Ukraine. The second disadvantage is due to the lack of a separate norm that would determine a clear place of the service in the system of objects of civil rights. In this regard, and taking into account the essence of the service as an object of the intangible world, it is offered to supplement Chapter 15 "intangible benefits" with a separate Article entitled "Services", which should contain a definition of the concept of this object of civil rights along with other important provisions. Moreover, the concept of a service is applied contrary to its legislative definition according to the analysis of judicial practice, namely as its result, and not as a benefit, we offer that the word "services" and the phrase "results of work" in Part 1 of the Art. 177 of the Civil Code of Ukraine should be swapped. These amendments will contribute to legal certainty and reduce the manifestations of arbitrary interference by state agencies, including the court, in the rights protected in the Constitution of Ukraine and in the Convention for the Protection of Human Rights and Fundamental Freedoms. ; На основе системного анализа гражданско-правовых норм обнаружено проблему нормативно-правового установления услуги как объекта гражданских прав. В частности, грамматическое осознание содержания определенных норм, содержащихся в ГК Украины, позволило сделать достаточно противоречивый вывод о том, что услуга – это материальное благо, вещь, которая заключается в воздействии или деятельности поставщика услуги. Обоснованы и сформулированы предложения по совершенствованию концепта услуги как объекта гражданских прав в ГК Украины с целью согласования такого закона с требованиями правовой определенности.
The article contains the results of scientific research of the efficiency as a criterion for enforcement the way of judicial protection of subjective civil rights on immovable property. It is defined that in context of current civil as well as civil procedural and commercial procedural legislative provisions of Ukraine the efficiency isconsidered as determinative criteria for enforcement appropriate way of protection in concrete juridical situation. At the same time legislative provisions of current civil law of Ukraine do not reveal clearly the nature of mentioned criterion that is the factor that actualizes the necessity of it scientific comprehension particularly in context of ways of protection of subjective civil rights on immovable property. During the research the author turns to the modern lexicographical sources that reveal the nature of the efficiency as characteristics of certain phenomenon as well as to the juridical positions of highest courts dedicated to appropriate features of the ways of protection of subjective civil rights on immovable property. It is defined that the efficiency of the way of protection of subjective civil rights on immovable property is a complex concept that covers tree main components:1) proper character of the way of protection on the whole. According to this meaning the proper character means the conformity of the protective way to the kind of rights violation. The proper way of protection of property rights on immovable property in this context is vindication, negatory lawsuit, lawsuit on recognition of right of property etc. that can be used in appropriate situation for protection of property right;2) actually the efficiency of protective way that denotes the ability of protective way to achieve the goal, particularly to prevent the violation, terminate it or to provide compensation for the caused damage in concrete practical situation;3) the ability of appropriate protective way to achieve the most complete result (effect) in concrete juridical situation. In circumstances when only one among several juridical ways or several ways at one time can be used in order to protect subjective civil rights the effective way or combination of ways is the way (combination of ways) that can provide the most complete juridical result. ; Стаття містить результати наукового дослідження ефективності як критерію застосування способу судового захисту суб'єктивних цивільних прав на нерухоме майно. Встановлюється, що в умовах дії положень чинного цивільного, а також цивільного процесуального й господарського процесуального законодавства України ефективність розглядається як визначальний критерій застосування способу захисту в конкретній правовій ситуації. Водночас положення чинного законодавства України не розкривають чітко зміст критерію, що актуалізує необхідність його наукового осмислення, в тому числі в контексті способів захисту суб'єктивних цивільних прав на нерухоме майно. У процесі дослідження автор звертається до сучасних лексикографічних джерел, які розкривають сутність ефективності як характеристики певного явища, а також до правових позицій вищих судових інстанцій із приводу відповідної властивості способу захисту суб'єктивних цивільних прав. Встановлюється, що ефективність способу захисту суб'єктивних цивільних прав на нерухоме майно є комплексним поняттям, яке охоплює три компоненти: 1) належність способу захисту в цілому. У такому розумінні належність способу захисту розглядається як його відповідність характеру порушення. Ефективними в такому сенсі способами захисту права власності на об'єкти нерухомого майна є, зокрема, вінди-каційний, негаторний позови, позов про визнання права власності й інші, які взагалі можуть бути використані для захисту права власності;2) власне ефективність способу захисту, яка позначає здатність способу захисту досягти визначеної мети, зокрема не допустити порушення, припинити порушення, відновити порушене право або забезпечити відшкодування завданої шкоди в конкретній практичній ситуації;3) здатність відповідного способу захисту досягти найкомплексні-шого результату (ефекту) в конкретній правовій ситуації. В умовах, коли для захисту суб'єктивних цивільних прав на нерухоме майно може бути використаний один із декількох способів захисту або одночасно декілька способів захисту, ефективним способом або комбінацією способів вважається той спосіб (комбінація способів), що здатен забезпечити досягнення найкомплекснішого результату.
The article is dedicated to analyze the forms of protection civil rights parties of the bank deposit contract considering the statistical data in regard to banks which allow violations of these rights and necessity to restore these rights by competent bodies. Fixing in civil legislation a number of opportunities to protect these rights with the existing economic crisis, especially in banking field, have practical importance that based on the efficiency of any form. Therewith, research the peculiarities of protection violated civil rights of the bank deposit contract in judicial, administrative and other forms. Attention is drawn on the peculiarities of some forms of protection. So, emphasizing the certain duration of judicial protection, alternatives opportunities of protection and restoration the violated rights of parties of the bank deposit contract is analyzed by the author. However, due to lack of effective mechanisms for protection the rights of parties of mentioned contract, the author proposed some ways for improving protection the violated rights of parties of the bank deposit contract. ; Статья посвящена анализу форм защиты гражданских прав сторон договора банковского вклада (депозита), учитывая статистические данные относительно банковских учреждений, допускающих нарушение указанных прав, и необходимость восстановления последних компетентными органами. Закрепление в гражданском законодательстве ряда возможностей защиты вышеуказанных прав наряду с существующим экономическим кризисом, прежде всего в банковской сфере, имеют практическую значимость исходя из эффективности той или иной формы. Исследуются особенности защиты нарушенных гражданских прав указанного договора в судебной, административной и иных формах, особенности функционирования той или иной формы защиты. Учитывая определенную продолжительность судебной защиты, автором анализируются альтернативные возможности защиты и восстановления нарушенных прав сторон договора банковского вклада (депозита). В связи с отсутствием в национальном законодательстве действенных механизмов для защиты прав сторон указанного договора, предлагаются определенные пути для усовершенствования защиты нарушенных прав сторон договора банковского вклада (депозита). ; Аналізуються форми захисту цивільних прав сторін договору банківського вкладу (депозиту) враховуючи статистичні дані щодо банківських установ, які допускають порушення вказаних прав, та необхідність відновлення останніх компетентними органами. Закріплення у цивільному законодавстві низки можливостей захисту зазначених прав поряд з існуючою економічною кризою, зокрема у банківській сфері, мають практичну значущість, виходячи з ефективності тієї чи іншої форми. Досліджуються особливості захисту порушених цивільних прав вказаного договору у судовій, адміністративній та інших формах, а також особливості функціонування різних форм захисту. Наголошуючи на певній тривалості судового захисту, автором розглядаються альтернативні можливості захисту та відновлення порушених прав сторін договору банківського вкладу (депозиту). У зв'язку з відсутністю у національному законодавстві дієвих механізмів для захисту прав сторін вказаного договору пропонуються окремі шляхи вдосконалення захисту порушених прав сторін договору банківського вкладу (депозиту).
The article is devoted to consideration the problem of exercising means of protection of subjective civil rights on immovable property by court in context of specifically-authorizing type of legal regulation of the court's activity in dispensing justice. In the analysis of the art. 16 of Civil Code of Ukraine (hereinafter - CC of Ukraine) the author is turning to the problem of numerus clausus (closed list) of means that can be used for protection of subjective civil rights in general and, particularly, for protection of subjective civil rights on immovable property. This problem is considered including amendments to the art. 5 of the Code of Civil Procedure of Ukraine and to the art. 5 of Code of Commercial Procedure of Ukraine. The author notes that specifically-authorizing type of legal regulation that is spread over the court's activity in dispensing justice let the court to exercise only legal behavior that is clearly defined by current legislative provisions of Ukraine. In this regard the court's right to define the mean of protection the subjective civil right that is not defined by contract or law expands much the borders of court's discretion. At the same time appropriate approach is justified in cases when defined by law protective means don't cover all possible forms of violations. More over the court is differ from other subjects of law-enforcement because it deals with violations of subjective civil rights that go beyond the boundaries of regulative models of social relationships. The violations have untypical character, do not match to the common models and are deviations from them. But it shouldn't be a barrier for civil rights protection. The author concludes that the amendments to the art. 16, part 1, paragraph 1 of CC of Ukraine haven't led to the retreat from numerus clausus principle of means of protection of subjective civil rights on immovable property and empowered the court on enforcement the mean of protection of subjective civil rights that is not against the law when the law or the contract doesn't define the effective protective mean. But specifically-authorizing type of legal regulation of the court's activity unlikely let the court to define protective mean that is not defined by current legislation of Ukraine at all. ; Стаття присвячена розгляду проблеми застосування судом способів захисту суб'єктивних цивільних прав на нерухоме майно в умовах спеціально-дозвільного типу правового регулювання діяльності суду зі здійснення правосуддя. Аналізуючи ст. 16 Цивільного кодексу України, автор звертається до проблеми numerus clausus (закритого списку) способів захисту суб'єктивних цивільних прав взагалі і суб'єктивних цивільних прав на нерухоме майно зокрема й осмислює її в контексті змін, внесених до ст. 5 Цивільного процесуального кодексу України та ст. 5 Господарського процесуального кодексу України. Автор зазначає, що діяльність суду зі здійснення правосуддя підпадає під спеціально-дозвільний тип правового регулювання, який дозволяє суду здійснювати лише ту юридичну поведінку, яка прямо визначена положеннями чинного цивільного законодавства України. У зв'язку з цим право суду визначати спосіб захисту цивільних прав, що не встановлений договором або законом, значно розширює межі судового розсуду. Водночас відповідний підхід виправданий в тих випадках, коли встановлені законом способи захисту не охоплюють всі можливі форми порушень суб'єктивних цивільних прав. При цьому суд відрізняється від інших суб'єктів правозастосування, зокрема, у зв'язку з тим, що має справу з випадками порушення суб'єктивних цивільних прав, що виходять за межі регулятивних моделей суспільних відносин. Порушення якраз і полягає в тому, що певною мірою воно має атиповий характер, не вкладається в запроваджену модель, є відхиленням від неї. Однак це не повинно бути перешкодою у захисті порушених прав.Висловлюється висновок, що внесення змін до абз. 1 ч. 2 ст. 16 ЦК України не спричинило абсолютного відходу від принципу numerus clausus способів захисту суб'єктивних цивільних прав на нерухоме майно, а лише надало суду можливість застосування для захисту прав спосіб захисту, який не суперечить закону, в умовах коли закон або договір взагалі не встановлюють ефективного способу захисту відповідних цивільних прав. При цьому через спеціально-дозвільний тип правового регулювання діяльності суду малоймовірним у відповідній ситуації є визначення судом способу захисту суб'єктивних цивільних прав на нерухоме майно, що взагалі не передбачений положеннями чинного цивільного законодавства України.
Метою статті є аналіз перспективи реформування організаційно-правового механізму забезпечення прав і свобод людини та громадянина в Україні з позиції системного підходу. На основі методології системного аналізу розглянуто перспективи реформування організаційно-правового механізму забезпечення прав і свобод людини та громадянина України у контексті асоціації з Європейським Союзом. Проаналізовано ключові чинники, які впливають на ефективність поданого організаційно-правового механізму. Педставлено заходи, які спрямовані на удосконалення нормативно-правого регулювання, що сприятиме забезпеченню конституційних прав і свобод в умовах реформування всіх сфер життєдіяльності суспільства. ; The purpose of the article is analyzing the prospect of reforming the organizational and legal mechanism for ensuring the rights and freedoms of individuals and citizens of Ukraine from the systemic approach. Based on the methodology of system analysis, the prospects of reforming the organizational and legal mechanism for ensuring the rights and freedoms of men and citizens of Ukraine in the context of association with the European Union are considered. The key factors that influence the effectiveness of the submitted organizational and legal mechanism are analyzed. The measures aimed at the improvement of normative-legal regulation, which shall promote the maintenance of constitutional rights and freedoms in the conditions of reforming all spheres of society's life, are presented.
The article analyzes the key historical stages of the formation of human rights. It is determined that each person has a certain spectrum of a priori rights. And today, most democratic countries in the world are striving to ensure that these rights are not only formal but also implemented in practical terms. That is why the last half of the XX century marked the emergence of international recognition of human rights. The author of the article also believes that the mechanisms of ensuring, guaranteeing or observing rights in society begin with its high moral standard, where the person does not infringe the rights of other individuals, or even in the event of such an attack, will consciously follow the punishment provided by the state. In this article, the term human rights was deliberately used, since the author considers it more justified in this context, given that it is a more general category that covers "human and civil rights and freedoms". In other cases, such phrases may be used as "human rights" or "fundamental, fundamental or fundamental rights." Both of these terms have the right to exist and each of them is found in separate European documents. Separately, the article explores the distinction between law and freedom, which is a separate argument to the emergence of a cumulative category, which may include rights and freedoms. Another argument in favor of this opinion, the author calls the possibility of the existence of not only human rights, but also non-human rights, in particular, it is about the rights of animals.
